Russ Feingold, the only Senator to truly probe Alito's responses, forced Alito to admit that his failure to recuse himself from the Vanguard case was not due to a computer glitch. CNN, which has been doing its best, as are all the nation's media, to ensure Alito is shown in the best possible light, almost immediately left the hearing for a commercial break.
"In the 1990 questionnaire [federal appeals court Senate hearing], Alito was asked how he would resolve potential conflicts of interest. He responded: 'I do not believe that conflicts of interest relating to my financial interests are likely to arise. I would, however, disqualify myself from any cases involving the Vanguard companies.
'"In April 2002, Alito, writing for a three-judge panel, ruled in Vanguard's favor.
"Alito later claimed the oversight was due to a computer glitch, which prevented him from knowing the case involved Vanguard. Alito has a six-figure investment in the company.
This is a small thing really, but it makes you wonder what else this guy might be lying about.
I am actually sort of curious about the CAP (Concerned Alumni of Princeton) issue. It seems weird that he would right this down on an application to demonstrate his conservative bonafides and then when questioned about it today acts as if he does not remember why he joined, or why he used his association with them to show how conservative he was. He uses some lame excuse about trying to get ROTC reinstated at Princeton as the reason he joined this controversial group. Something just does not smell right.
I don't think that either of these things are going to be a "smoking gun", so Alito will most likely be confirmed. I do like seeing the Democrats flexing their muscles though.
