Here let Mother Jones take a crack at explaining her unbelievable stupidity. I need an aspirin.
Inexplicable? Does she not understand the difference between apples and nuclear reactors? The two instances she links have little in common. In the case of her book, she managed to get a judge to order Gawker to take down a post showing portions of her book after the website had put them up. And the judge in this case was following precedent established when The Nation magazine was successfully sued by Harper & Row in the 1970s after publishing excerpts of former President Gerald Ford's memoirs before the book was released. The Supreme Court, deciding the case in favor of the publisher, said media outlets could not, under a claim of fair use, publish a significant portion of a copyrighted book (accepting the argument that this could weaken the commercial value of the book). Palin's lawyers took advantage of this ruling, in demanding that Gawker not show the actual pages of her book.
Stopping a media leak involving government information before the fact is not the same. The grand-daddy legal decision on this front comes out of the famous Pentagon Papers case, when the Supreme Court ruled that the government could not block newspapers from publishing the secret Pentagon history of the Vietnam war leaked by Daniel Ellsberg to The New York Times and other papers. The guiding principle here: the government does not have the right to impose prior restraint on the media.

Reasonable, intelligent people would think that because they understand the complexities of the situation. Sarah is also unaware that Gawker had already gotten what they needed from the pages displayed after several days. It was no problem for them to remove them. She has to think she won and they'll let her believe that if it makes her happy or keeps her quiet for awhile.

In any other generation they would get the attention they actually deserve--none. Somebody needs to explain to her that not every event in human history actually revolves around Sarah Palin. Her petty issues are not a par with the serious problems of the day and her constant need to insert herself into every issue makes her look desperate, not engaged. Her inability to distinguish between petty and serious is but one of many reasons she is not fit for elected office.

Gryphen, you left out the equally obvious difference - the WikiLeaks materials were published abroad. The US courts cannot tell Der Spiegel or The Guardian what they may print, and even if they were to enjoin re-publication within the US, it would be a silly and futile gesture, thanks to the internet. If the person or persons who leaked the materials are discovered and are subject to the jurisdiction of US courts, they can be prosecuted, but that won't put the genie back in the bottle.

ReplyDeleteHad I tried to justify why, I would have thought, oh, it's anonymous, or it's off in another country where we don't have jurisdiction, or it has some other sort of immunity. Because of course the US Government does not want certain things made available to our enemies.
My point is, if one thinks things through, one might decide this doesn't compare to that, then I might ask for help; $owah PayMe doesn't think things through and she's beyond help.

You can also add these to the "I can't believe she said that, either" pile. It proves she does not do any research, she just reacts, over and over again! I keep reading references to her handlers and have to laugh. How can anyone believe this woman has handlers? If she did, they would have to be fired because they certainly aren't doing anything to help her. Oh, and neither are her advisors! Why aren't her advisors doing a better job is asked frequently, too. Sarah doesn't need no stinkin' help, she's edumakated better than any advisors or handlers and she's gonna do and say whatever she wants to until the courts tell her she can't. Then when she gets to be Queen, she likes that title better than President, nobody is going to be able to tell her what to do because she's changing all the rules!
