New Mexico Republican lawmaker writes bill that would make it illegal for rape victims to terminate pregnancy, calling it "destroying evidence of the crime." No, I am NOT kidding!

A Republican lawmaker in New Mexico introduced a bill on Wednesday that would legally require victims of rape to carry their pregnancies to term in order to use the fetus as evidence for a sexual assault trial. 

House Bill 206, introduced by state Rep. Cathrynn Brown (R), would charge a rape victim who ended her pregnancy with a third-degree felony for "tampering with evidence." 

“Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime," the bill says. 

Third-degree felonies in New Mexico carry a sentence of up to three years in prison. 

Pat Davis of ProgressNow New Mexico, a progressive nonprofit opposing the bill, called it "blatantly unconstitutional" on Thursday. 

“The bill turns victims of rape and incest into felons and forces them to become incubators of evidence for the state,” he said. “According to Republican philosophy, victims who are ‘legitimately raped’ will now have to carry the fetus to term in order to prove their case.“

You know I think the part of this that bothers me the most is that it is being introduced by a woman! How is that even possible?

First off this is a completely naked attempt to  an anti-abortion bill while cloaking it in the most transparent covering of an pro-law enforcement bill, and I truly doubt that too many people in New Mexico are confused about that.

However the other thing is that THIS is what Rape Kits are for. If used properly they can identify the rapist using the DNA he would leave behind and as humiliating as it is for a woman to go through that process it is infinitely better than forcing her to give birth to her rapist's child.

You know I often ask myself if the Republican party is a party completely without compassion or self awareness, ans when I read stories like this one the the answer to that question becomes all too obvious.

    I'm going to give this woman the benefit of the doubt and assume, as she claims, that the intent of the bill is to prevent the rapist from "destroying the evidence", and that it was just worded badly.

      Although I'd like to give her the benefit of the doubt, it's really hard to imagine how to improve "worded badly" into something that doesn't jail women for being raped and pregnant.

      I have to think that after the GOP fails during this last election (whenever they roamed into "rape" territory) would have given Cathrynn Brown a little clue that any legislation containing the words

      "rape"

      and

      "abortion"

      needs very careful thought, proofreading and general care to avoid "foot in mouth" spin sessions when the media just happens to say the exact words you said.

      Does Cathrynn Brown really think we're stupid enough to read the text of her proposed legislation and think there's a benefit to women in that verbiage? Of course she doesn't. She's just had a rude awakening and is now trying to squirm out of the hole she dug for herself.

    It makes sense that the GOP is now using women to talk about rape and further dehumanize women. In some ways it is even more twisted than when Akins and Donnelly--to say nothing of Paul Ryan talked about it.

    This makes me sick--as does Ms. Brown's face.

      Umm, Angela. It wasn't Donnelly who talked about rape. You're confused. It was Richard (Dick) Mourdock, Donnelly's opponent, who said that God intended for the rape to result in a child.

  5. The UPDATE to that HuffPo article provides an "explanation" by state Rep. Brown saying the goal of her bill is to punish the RAPIST.

    UPDATE: 12:25 p.m. -- Brown said in a statement Thursday that she introduced the bill with the goal of punishing the person who commits incest or rape and then procures or facilitates an abortion to destroy the evidence of the crime.

    “New Mexico needs to strengthen its laws to deter sex offenders,” said Brown. “By adding this law in New Mexico, we can help to protect women across our state.”


    How wacked-out crazy is that? This woman is a moron.

    (I'm sorry that I've been using that word so frequently lately, but honestly, what kind of person is stupider than stupid? Yeah, a moron)

      No one is forced to have an abortion. This bill, should it be approve would force a woman to carry a fetus to term. So much for freedom-loving Americans.

And there should be no place in a rational discussion of a woman's legal right to choose what is best for her body for the intrusion of the subject of rape and its consequences. Rape is a violent crime against women and we should not allow ourselves to get mired in the absurd and cruel topic of whether a woman should have the right to choose to continue a pregnancy that was begun in the midst of a violent assault. Mixing the two subjects only encourages the insane belief (held by some men and many Republicans) that the victim of rape is responsible for it. She is not. And, for the life of me, I cannot understand why a woman who is a state legislator, even a Republican, would bring forward such a bill. Utterly insane.

      I'll bet she didn't specify what the orientation was on the swastika, did she? With the exception of the current use in the theosphical movement and certain other modern movements along those lines, the only usage I can find that is turned 45 degrees from the horizontal is the NAZI swastika. All the others seem to be positioned so the "arms" are horizontal and vertical.

      So she needs to tell us HOW it is tattooed onto him, orientation-wise.

    Whenever I hear of one of these Republican lawmakers coming up with these nasty anti-abortion laws, my knee-jerk reaction is that they're less-than-human. That they're some kind of sub-human sociopath lacking part of what makes the rest of us more than just animals.

    But that's not true: they're ignorant. Or maybe just really stupid, which would be too bad, since it's nearly impossible to fix stupid.

    But ignorant CAN be fixed. Whenever one of these deluded lawmakers come up with these wicked ideas, they should
    A)have to spend one year helping out at a NICU in a major city
    and
    B)have to spend a couple of months at a rape-counseling clinic.

    If after all that they haven't changed their minds about abortion then there is something wrong with their mind - or their soul. The next steps would have to be psychiatry and college-level courses in philosophy.

    If, after all that, they still have no functioning brain, no compassion, no empathy - then they should have to go sit in the corner with Sarah Palin and the stupid people.
