Texas prosecutor says that it is very unlikely that father who shot daughter's boyfriend will face charges.

The District Attorney’s Office in Houston, Texas says that no charges will likely be filed against the father who shot his teenage daughter’s boyfriend dead. 

Prosecutor Warren Diepraam told FOX 26 that “[w]hat was going on in the person’s mind at the time of the shooting what they found out after the fact isn’t going to matter a whole bunch. They’re looking at what he was thinking when he made the decision to shoot.” 

The decision to shoot, according to police, was made by the 55-year-old homeowner after his 4-year-old son informed him that there was a strange man in his 16-year-old daughter’s bedroom. It was 2:20 a.m., and the homeowner immediately grabbed his gun and entered his daughter’s bedroom to find her under the covers with an unknown teen. 

He allegedly told the teen not to move, and police say his daughter initially claimed not to know who the teen was. At some point during the discussion, the father perceived the teen to be moving for what could have been a gun and shot him dead. 

The teen was unarmed, and his daughter later confessed that the dead teen was her boyfriend, and that she had snuck him into her bedroom.

When I wrote about this earlier I predicted that the father would likely not face any jail time, though I have to admit I was hoping I would be wrong about that. 

In my opinion this man had every right to threaten that young man with an ass whooping and throw him out on the street, but he did NOT have the right to take his life.

And do you know what? If he had smacked that kid around he probably would be MORE likely to face charges.

That is how screwed up this country has become.

    Since when has "trespassing" become something that warrants murder? Many years ago, in a town near where we lived a young boy was found climbing a fence between yards. The homeowner shot and killed the boy who was unarmed and ten or eleven years old. For all anyone knows, he may have been in the yard looking for a ball. Shooting first and thinking later is never acceptable behavior.

    I can understand the father's panic in this case but he should have wondered why his daughter had not screamed, why she was not screaming when he came into the room; he should have suspected that she knew the boy.

    The whole family will have to live with this forever. Too many Americans have to learn that guns are not our friends; I just hope that they don't have to learn "the hard way."

      Maybe you should go and volunteer with a sexual assault program. No all rape victims scream, sometimes they are too frightened, sometimes they have been threatened. Do not judge how any rape victim would act since that is exactly what any person would assume had been going on if they found a strange man that their daughter didn't know in their bedroom at 2-3 am.

      1:25 No one has mentioned rape except you. The teenager invited her boyfriend into her bed....that is not rape! The father found them - shot the kid who was unarmed when he could have used other methods. Years ago these matters were handled w/o force as to guns and kids were not killed.

      I am a rape survivor, thank goodness my daughters are not. If anywhere along the line my daughters would have made noise/screamed/cried out, I would have taken out anyone in their rooms. Every fucking day we see all the accidental shootings of children, pregnant wives, kids sneaking in after curfew, people who have been in accidents knocking on doors, men on their own property shot by stupid neighbors, cops shooting themselves in the leg, children shooting each other, men in movie theaters shooting popcorn throwers and drunk morons who shoot innocent kids who play loud music.

      So we know a hell of a lot of bad things happen in homes---And as far as protecting your family with a gun---its usually a dead family member shot by another family member.

      At the moment of the shooting, if all provided information is true, the father had every reason to pull the trigger... guy in daughter's bed, daughter claimed she didn't know him, told not to move, and he continued reaching for something.. You can sit here after knowing the rest of the information unavailable at the time of the shooting and pass judgement, but the only guilty person in this instance is the daughter...

  8. Our laws don't call for the death penalty for a 17 year old boy who is caught in bed with a 16 year old girl. The first reports said the dad had already called 911 when he shot the boy. Why didn't he wait for the police? IMO, he didn't wait because he had his excuse to kill a kid. The daughter was probably terrified at being caught and terrified that her dad was standing there with a gun pointed at the boy. Daddy wasn't "protecting himself or his family", the danger was over. Daddy was pissed off - with good reason - but not enough reason to take a youngster's life.

    There's a lot more going on in these phony SYG cases than people being so fearful that they have to shoot. Again, IMO, there's at least a certain number of them that are control freaks who demand that whoever they are confronting has to obey them immediately or they'll kill them. In the "popcorn shooting", it's now come out that the Reeves, the killer, was himself texting right before he killed the young father for texting - the movie hadn't even started. There were only 25 people in the theater, the old guy could have moved. But hey! Why move when you gotta gun?

He wasn't judge, jury, and executioner- he was a man woken up in the middle of the night by his 4yo that there was an intruder in his house and he reacted.     The picture above triggers so many questions for me.
    Why is the father in a stretcher? Why is his hand bandaged up? What happened? Was a fight reported as well? It's hard to make an assumption about who was justified or not when no one knows the details of what happened.

    Everyone needs to call down. At the end of the day, two families are torn apart forever because of a father's initial decision to protect his daughter based solely on his daughter's rash decision to 1) enjoy herself with the young man's company and then 2) protect herself when they got caught.

    To the victims of rape, including myself, projecting your circumstance on this young lady is not warranted, however, the scars from our ordeal does add a layer of justification on the father's actions based on what he was told by BOTH his children.

    As a former soldier and military weapons trainer, there is nothing wrong with owning a gun even though I would probably never own one myself. In my opinion, it is not fair to demonize a father for protecting his family from an intruder after being awakened by his youngest child at 2am in the morning. Sleepy, fearful, angry, determined, etc....

    Attacking people for sympathizing with the father is pointless and unnecessary. I abhor the thought of rapists justifying their actions just as much as I abhor the thought of gun enthusiasts justifying and provoking murder without just cause. But, in this case, without knowing all the details....it APPEARS that the father was reacting to a threatening situation within his own home and had just cause to protect a family member that was directly in harm's way by means that were available to him at the time.

    A terrible life lesson and consequence for all involved. My sympathies and condolences to the families and those negatively impacted by this ugly reminder of their past experiences.

      A mother of two small kids had to use her AR-15, when three young men broke into her house. Her husband was on a business trip and taught her how to use the gun. She gave a warning shot into the wall first and they ran out... One got his gun out of his pocket and went back inside, and she shot at him and he ran... The police caught all three and the gun the guy had was fake... She could have killed three unarmed young men... If they were in her children's room, she would had killed them.

      This man may not had a choice... He told the boy NOT TO MOVE... The boy reached for something under the cover. He had to make a split second decision. The daughter lied and say she didn't know him, she is responsible for the death of the young man... She never introduce this young man to her father before dating him, her baby brother didn't even know him... If this her boyfriend, why her family didn't know him? Shame on her, she need need to be punished! The same people who calling the man a murderer, would have probably reacted the same way to protect their kids...

      These are REAL people and this crime was preventable and unnecessary, but since the girl already lied, the victim is dead, the truth was buried and no one's held accountable.

    My parents raised 4 daughters. There were boyfriends hanging around our house all the time. When my sister and her boyfriend were caught in bed together, my parents did something far worse than shoot the young man, they made him endure the "walk of shame". He had to come out into the living room, sit wrapped in the sheet, and wait for his parents to arrive and explain to my dad what the boy was doing. That young man sat there for hours, shivering cold, while the parents discussed the situation in the kitchen. (I am sure they were having coffee and talking about baseball or something) My sister was on restriction for the 'rest of her natural life' as my dad put it, and only allowed to leave the house to go to school. Nobody got beaten, nobody got shot, but everyone got the message. A few years later, my sister married that young man, and a year after that, my beautiful niece was born. That was over 40 years ago. Seems to me, parents don't know how to be parents any more.
