Justice Antonin Scalia found dead! Update!

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said. 

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa. 

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

Well holy crap!

I knew these old guys would start dying off soon, but I kind of thought it might happen in the NEXT administration.

This is going to be a quite the game changer.

Yes I realize I should probably express some sympathy here, but the guy WAS 79 years old, and he WAS Antonin Scalia, so the best I can do is give my condolences to his family.

Update: Yep this is going to go as we expected.

It took only a few minutes after news broke of Supreme Court Justice Antonin Scalia's death on Saturday for conservatives to demand that Senate Republicans block any replacement nominated by President Barack Obama. 

It took just a little while more for Republican leadership to agree with them. 

In a swift statement designed to warn Barack Obama against even nominating a replacement, Senate Majority Leader Mitch McConnell (R-Ky.) pledged to sit on his hands for the remaining 11 months of the president's term. 

"The American people should have a voice in the selection of their next Supreme Court Justice," the statement read. "Therefore, this vacancy should not be filled until we have a new President."

I have been saying for months how important it is to elect a Democrat to the White House to appoint Justices for the opening sure to come in the next eight years. 

Justice Scalia's death has now driven that point home.

No more screwing around, it's time to get serious.

      There are those who contend that it does not benefit African Americans to get them into the University of Texas, where they do not do well, as opposed to having them go to a less-advanced school, a slower-track school where they do well. One of the briefs pointed out that most of the black scientists in this country don't come from schools like the University of Texas. They come from lesser schools where they do not feel that they're being pushed ahead in classes that are too fast for them.

      The Supreme Court cannot hear cases until the position is filled.

      So, of course, Obama will appoint someone to fill it. Undoubtedly,the Senate will play politics, but whether they will actually leave the court idle for a year, until after the election, is anyone's guess. I think that they are quite capable of it, but we shall see just how craven they have become.

      If Hillary or Bernie wins, and if Obama wants the position, and if he wants it now and not before he can take a well earned rest, either of them could appoint him to fill the vacancy. But unless the dems get control of the Senate, who knows who might be confirmed or when.

      The republicans will truly reveal their colors with how they deal with this. If they kick it down the road to 2017, then they truly do not love this country and seek to do it harm.

      Just look at the ages of those on the Supreme Court - that in itself would caution President Obama to have already made a decision.

      A tie vote by the Supreme Court justices means that whatever the lower court ruling was it stands. So even if the GOP blocks the nomination until 2017, the court might just be stuck in approval mode, letting the lower courts make the calls.

      If I were Obama, I'd use that as a negotiating point to get his nominee confirmed. If they don't like it, they take a chance on it being even worse under the next Democratic president. And the next president will be a Democrat if they obstruct this nomination for an entire year. The public is tired of their partisan bullshit and come November they may find their numbers shrinking even more.

      Here's to hoping the Dems get a supermajority in the senate come November and gain seats in the House.

      I'm fine with Supreme Court Justice Obama. He should be on the phone to Hillary and Bernie right now saying if this is how they want to play, this is what we're going to do.

      The average time for confirmation of the 9 Justices prior to Sotomayor was 73.8 days.

      Even Obama's nominees, despite the obstruction by the GOP, didn't take more than 2 1/2 months. Sotomayor was nominated on May 26 and sworn in on August 6. Kagan was nominated on May 17 and sworn in on August 7.

      You can be sure that, with the advanced age and tenuous medical conditions of several of the current Justices, the Obama administration has already prepared and vetted a list of potential nominees, so the first part of the process is undoubtedly already completed.

      Once it goes over 125 days or whatever the record is, the media will start to blast this out as "news" that this is the longest congress has refused to confirm a supreme court nominee. They'll also probably add personal stuff about the nominee and there being no reason for refusal except politics, partisanship and being dicks.

      Yes. Happens all the time when justices have to recuse themselves. What it may mean is that there will be more 4-4 decisions, and 4-4 decisions leave the lower court decision in place.

      I disagree about Obama wanted to do more ala Carter and Clinton.

      I think he'd like some stability, peace and quiet and a stable life for his family. He'd still be able to do "good" on the court, but he would be more out of the spotlight than as a recent ex-president.

      He might welcome the opportunity.

      I hope he considers it and is in talks with Sanders and Clinton about the possibilities.

      In fact, if Clinton and Sanders both express their support of the idea, it might move the Republicans to confirm whoever Obama nominates just to keep him off the bench.

    This may just put the Republicans in a lose-lose situation.

    If they confirm ANY Justice that President Obama nominates, they will be vilified by their base.

    However, if they delay and obstruct this replacement the way they've obstructed legislation for the past 7 years, they prove once again that they can't legislate and will lose even more of the already tenuous votes from moderates. AND they take a chance on an even more liberal nominee being nominated by Clinton or Sanders and confirmed by a Democratic majority Senate.

    In the meantime, any decisions that are tied apparently revert to the lower court's decision, which could be a problem for any cases they lost and were hoping to have reversed by conservative majority of the current SCOTUS.

    This is the precise reason why I am pissed that Bernie Sanders is trying to get the Democratic nomination. First of all, he isn't even a democrat, second, he has no chance whatsoever of winning the general. There is no way that America will put a Socialist in the White House.     Sorry, but I can't go along with all the condolence crap. This man was extraordinarily contemptible and destructive to the nation. His death is an unalloyed blessing to the American democracy.

    BTW, the absence of even the smallest details about his deata, after an interval of at least 10 hours, make me think that it may have occurred in embarrassing circumstances. His underlings or overseers may be scrambling to concoct a plausible cover story, and to give potential witnesses an incentive to keep their lips sealed.

      It was when breakfast was served at the fancy retreat that the other guests were wondering why there was still so much food at the buffet. Scalia was known to scarf whole buffet tables in one sitting. That's when somebody went to his room and found he had died peacefully in his sleep. That's their story and they're sticking to it.

    OH. MY. GOD. This is gonna be a brawl, the likes of which we ain't seen before.

    We're in an election for the next President of the United States.

    The President of the United States is the person that puts forward a candidate for the SC. It's been done that way since forever.

    President Obama is now in a position, legally, and constitutionally, to put forward that candidate.

    If and when he put that candidate forward, all hell's gonna break loose with the howls from the right, because that would be THREE justices that Obama will have the opportunity to put on the bench. So he will be able to leave a solid legacy for the SC and they will do everything they can do to not let that happen. Sort of a final attempt to block Obama's power and legacy and influence.

    And because we're in election season, we're gonna hear a lot more about who they would choose if they were ever to become POTUS. It will give us an insight into their thinking that we might not otherwise have had.

    And McConnell is already squealing and threatening to gum up the works, but we'll see how this plays out. One thing you can be sure is that all of a sudden the election is gonna be about stopping Obama, and who will be the next Supreme Court Justice of these here 'United' States.

      Justice Anthony Kennedy was appointed by Ronald Reagan in his last year as President, on Feb. 18, 1988.

      So the precedent is there for a SCOTUS appointment in the last year of a presidents term, and McConnell is full of shit.

      Also too, Pres. Obama is not considered truly "Lame Duck" until the 2 parties have officially nominated their candidates.
