Roger Ailes demands arbitration to halt Gretchen Carlson's sexual harassment suit, as even more women step forward to make accusations against him.

Lawyers for Fox News chairman Roger Ailes on Friday asked a judge to halt anchor Gretchen Carlson’s “shameless publicity campaign” against her former boss, and send her sexual harassment lawsuit against him to arbitration in accordance with her employment contract. 

The request came two days after Carlson sued Ailes in Superior Court in New Jersey, portraying him as a persistent harasser who demoted her and ultimately forced her from Fox News, her employer since 2005, after she rebuffed his advances. Ailes has forcefully denied Carlson’s allegations. 

Carlson’s lawyers, Nancy Erika Smith and Martin Hyman, said their client intends to pursue her right to a public jury trial. 

“Roger Ailes is trying to force this case into a secret arbitration proceeding,” the lawyers said in a statement. “Gretchen never agreed to arbitrate anything with Mr. Ailes.”

Trying to move the case behind closed doors so that the public cannot see the proceedings.

Hmm, now why does that sound to familiar?

Of course it is unlikely that this would even help Roger Ailes as more and more women are pointing an accusing finger his way.

In recent days, more than a dozen women have contacted Carlson’s New Jersey-based attorney, Nancy Erika Smith, and made detailed allegations of sexual harassment by Ailes over a 25-year period dating back to the 1960s when he was a producer on The Mike Douglas Show. “These are women who have never told these stories until now,” Smith told me. “Some are in lot of pain.” Taken together, these stories portray Ailes as a boss who spoke openly of expecting women to perform sexual favors in exchange for job opportunities. “He said that’s how all these men in media and politics work — everyone’s got their friend,” recalled Kellie Boyle, who says Ailes propositioned her in 1989, shortly after he helped George H.W. Bush become president, serving as his chief media strategist. 

Six of the women agreed to speak with New York publicly for the first time. Two spoke on the record; the others requested anonymity for reasons that include shame and fear of retribution. “I didn’t tell my husband, it was so mortifying,” said Marsha Callahan, a former model who says Ailes harassed her in the late ‘60s, shortly before he became Richard Nixon’s media adviser.

Damn, if this keeps up Ailes may soon replace Bill Cosby as the most disgusting sexual predator in America.

    Companies want you to follow internal HR processes first to alleviate situations. He claims that she did not follow protocol and therefore negates her lawsuit and she probably didn't. She took it to the public which was good.

    Corporate human resource departments are not in place to help the employee. I think we all know that by now.

    What comes out clearly from both of these disgusting men is that they didn't think they did anything wrong and it opens up the notion that they knew they weren't alone in this behavior, and it may have been/be much more rampant than anyone can imagine.

    Gretchen Carlson’s sexual harassment lawsuit against Fox News CEO Roger Ailes has played out very differently — so far.

    Carlson executed a coordinated legal and media strategy designed to catch Fox News and Ailes off guard — and it worked. Carlson filed her suit on Wednesday morning, and her P.R. firm — Ripp Media, a boutique communications shop that specializes in high-profile litigation — quickly blasted out the news to dozens of reporters and media organizations.

    Carlson had not given Fox a heads-up, or even announced publicly that she had been terminated from the network.

    “Ailes and Fox have a very heavy hand in media relations. What’s important [is] no one had known up until the suit was filed that Gretchen had been fired,” Ripp Media founder Allan Ripp told POLITICO.

    Through the following days, her representatives and lawyers aggressively courted the press, with one of her representatives even taking calls from reporters during the Euro Semi-final in football between France and Germany at the Stade Velodrome in Marseille. Carlson’s legal team has produced a steady stream of accusations against Ailes, culminating Saturday morning in the statements of six women alleging Ailes had sexually harassed them at different times throughout his long career in media and politics, orchestrated by Carlson’s representatives.

    It was a shockingly sophisticated effort from the very beginning. For hours on Wednesday, Carlson’s lawyers and P.R. people talked to the press while Ailes and Fox remained silent. It was not until Wednesday evening that the company finally responded — and it was hardly the full-throated defense of Ailes that watchers of the company have come to expect in cases like this.

    Gretchen's contract with FOX specifically states any disputes will be settled with confidential abritration. This is why Gretchen is pursuing the suit with Ailes. FOX is not named in the suit.

    So Gretchen might have played a bimbo on TV, but she is really a pretty smart cookie.

    I believe, Gretchen signed an arbiter agreement with FOX, but not with Ailes. So, she can insist on a trial and does not need to agree with arbitration.

      I doubt she is interested in any settlement. I'm sure an offer to buy her off and shut her up has already been made.

      She's out for blood; a public pillory. She wants him exposed. If she can get him fired, that's good. If she can get convicted of criminal charges, even better.

      This is why the Greeks feared women warriors. Once you push them far enough, they are the most vicious fighters in the world. They are tenacious.

      I hope Gretchen has been pushed that far.

    Well, of course he wants it in arbitration. Not only does that keep it quiet, but it also raises the odds it will be dismissed and whatever the findings ensures he doesn't do jail time. Arbitration is to shut it up and sweep it under the rug. It's weighted on the side of the employer. Includes a gag. And even if arbitration finds Ailes at fault, he'd pay some lame ass piddly fine and continue on.

    As to worse than Cosby, no. Cosby drugged women to have sex with them. Ailes is only guilty of sexual harassment for over 25 years. He's not in Cosby's league.

    What gets me is this dirty old man thought he had such power that he didn't need to change his behavior with the times. I guess he thought he was so powerful nothing could touch him.

    Arbitration was not designed to cover up criminal behavior, which this is. The judge better toss this out and strongly chastise the lawyer that presents it.
