Trump's former national security adviser Michael Flynn seeking immunity, has "a story to tell." Update!

Retired Lt. Gen. Michael Flynn, who briefly served as national security adviser to President Donald Trump, is seeking immunity from prosecution in exchange for testifying to those conducting investigations into the president’s ties to Russia, the Wall Street Journal reported Thursday. 

According to the report, Flynn made the offer to the FBI, the House intelligence committee and the Senate intelligence committee. All three entities are currently investigating whether Trump’s associates had contact with Russian officials during the 2016 presidential campaign. According to the Wall Street Journal, none of them have yet accepted Flynn’s offer. 

Flynn’s attorney, Robert Kelner, confirmed in a statement that “discussions have taken place” with both committees, but declined to provide details on what those discussions entailed. 

“General Flynn certainly has a story to tell, and he very much wants to tell it, should the circumstances permit,” Kelner wrote. “Out of respect for the Committees, we will not comment right now on the details of discussions between counsel for General Flynn and the House and Senate Intelligence Committees, other than to confirm that those discussions have taken place.”

While Flynn’s attorney didn’t explicitly confirm Flynn’s request for immunity, he argued that his client is the target of “unfounded allegations” and “outrageous claims,” and should not be blamed for seeking “assurances” prior to agreeing to testimony. 

“No reasonable person, who has the benefit of advice from counsel, would submit to questioning in such a highly politicized, witch hunt environment without assurances against unfair prosecution,” he said.

Oh now we're talking!

There have long been rumors that Flynn had cut a deal to spill his guts, and now it looks as if this is confirmation that he is looking to do exactly that.

Somehow I don't think that Donald Trump understands what this could mean to his presidency.
Yeah, right.

Update: It looks like Flynn's request for immunity was denied.
I think that means that the intelligence folks already know what he knows.

Does NOT sound good for Trump.

    Michael Flynn was like a shooting star across Donald Trump’s firmament. Short and not so sweet. Seems like just yesterday when Trump was calling him “an invaluable asset to me and my administration.”

    In fact, he has left a sour taste in everyone’s mouth, showing that you can spend 33 years in the military and still come out smelling like a jerkweed.

    Trump' switch hunt tweet is all his supporters will pay attention to. Comments and insight about ignorant and stupid people reminds me of the Great Recession because stupid people were quite vocal then too unable to comprehend indirect financial impact to them if banks, financial institutions went under that they would be subjected to a great depression even if they did not have savings or investments in the stock market.

    I am astounded how dismissive people are able to disregard the significance of a dictator of a powerful country choosing a president for our country! I am stunned that compulsive lying is also irrelevant to voters as long as their ignorant beliefs or extreme judgments are reinforced. I also hunk they are spellbound by fame and wealth even if won by cheating, lying and behind closed doors philandering and sexual assaults.

    Running Out of Rungs on the Ladder

    Mike Flynn tells the FBI he's willing to talk, but only for immunity. But you only get immunity if you deliver someone else higher up the ladder. And there's only one person higher up the ladder.

    ...Flynn's lawyer states rather grandly that his client "has a story to tell and ... very much wants to tell it." But Alex Whiting of Harvard Law School argues pretty convincingly that what we learned last night likely means either that Flynn doesn't have a story prosecutors are willing to barter for or isn't yet willing to tell it.

    So who knows what the immunity request means? Far more interesting to me is how Flynn ties in to the latest revelation in the unfolding Nunes debacle.

    Dem Intel Member On Flynn: 'Innocent People Don't Seek Immunity' (VIDEO)

    Rep. Eric Swalwell (D-CA), a member of the House Intelligence Committee, on Thursday night suggested that a report that former National Security Adviser Michael Flynn is seeking immunity from the intelligence committees shows that he is not "innocent."

    "Generally, innocent people don't seek immunity," Swalwell said on CNN following a report in the Wall Street Journal that Flynn has asked for immunity in exchange for speaking with the intelligence committees in Congress.

    Swalwell said that he would not support giving Flynn immunity.

    "I don't want to hear from him in a setting where there are conditions," he said. "I think we should hear from him in the public and that we should get to the bottom of just exactly why was he working with Russia Today, who, as a former Defense intelligence agency director, he of all people knows that that agency is connected to Russia's intelligence services."

    "And so to take money from them and then to work with Russian ambassador after sanctions were put on Russia and to lie to the vice president, that's powerful evidence that he knew what was going on," Swalwell continued. "And this was converging at the time of Russia's interference campaign."

    When asked how the committee would decide if someone is granted immunity, Swalwell said, "Ideally, we work together as far as witness testimony."

    "This is not anything that I or I believe my colleagues are familiar with. And so we want to hear from Michael Flynn. We want to hear from Paul Manafort, and Carter Page and Roger Stone," he added.

    Devin Nunes Is Just the Errand Boy in the Trump-Russia Scandal
    The manic flailing before the cameras, the ridiculous lie about a ‘whistleblower’ who turned out to be two White House officials—no, the intel chair wasn’t the brains behind this farce.

    For a week, Washington has stared slack-jawed at the antics of Rep. Devin Nunes (R-Flopsweat), the clown prince of the Trump-Russia intelligence and influence scandal.

    To the bemusement of his colleagues on both side of the aisle, the media, and the intelligence community, the House Intelligence Committee chairman desperately spent his days racing toward every TV camera in sight, like a soft-chinned Jason Bourne plunging into battle.

    Nunes’s manic flailing left a chain of confused, exhausted reporters trying to parse his daily lies, revisions, walkbacks, and pushbacks. His use of amateur intel slang was as cringeworthy as it was unconvincing. He did everything but show up in a fedora and trenchcoat. As he tried to change the subject from Russia and its influence over President Trump to the evil NSA’s boundless perfidy in “tappping” a poor, innocent, hard-working New York real-estate developer on behalf of that evil Kenyan Muslim Barack Obama, it became increasingly obvious that Nunes didn’t get this information from the intelligence community, but rather from the Trump White House.

    Over the weekend, the first cracks in Nunes’s ludicrous story emerged.

    ...Nunes is a clumsy liar and it shows. He’s an errand boy sent by grocery clerks with just enough understanding of the game and the stakes to think this is going to work out because their base is always with them.

    It’s not just the White House that’s in crisis. It’s increasingly obvious that the House of Representatives is also in trouble. Thursday’s Senate Intelligence Committee hearings were serious, probing, informative, and bipartisan; a marked contrast to the alternate reality Nunes and his allies tried to cast in their first hearings. For the House, Nunes has almost singlehandedly wrecked the credibility of its intelligence committee, raising the specter of either a Senate committee that dominates the investigation or a select committee with sweeping powers that will terrify this White House.

    Donald Trump had a four point plan to protect himself from the Russia scandal. That plan is collapsing.

    Three of Trump’s four firewalls have already collapsed, and the fourth one is weakening

    In hindsight, it’s becoming fairly clear how Donald Trump used the transition period and his earliest days in office to set things up so that he would be insulated from his Russia scandal. He put his co-conspirators in key positions so they could protect him. He groomed and recruited others who were already locked into key positions. He thought he’d walled off the inevitable investigation in at least four different ways. And yet now that’s mostly collapsing in on him.

    This month’s meltdown of Congressman Devin Nunes appeared to have come out of nowhere. But looking back, Donald Trump and his strategists had been playing Nunes like a fiddle for months. They knew that, as Chairman of the House Intelligence Committee, he’d end up being in charge of one of the two congressional investigations into Trump-Russia. So they added the bumbling Nunes to the White House transition team just to make him feel special.

    Then they recruited Michael Ellis as White House counselor, who had previously worked for Nunes (link). From that point they sat back and waited, until they needed to activate their asset. Once it became clear to Trump and his team that the Democrats on the House Intel Committee were able to make noise on Trump-Russia despite being in the minority, they used Ellis to trick Nunes into setting himself on fire so the flames would engulf the entire investigation. But because Nunes was so bumbling about it, the whole thing backfired and has made the Trump-Russia controversy bigger, not smaller.

    But Nunes is far from the only firewall which Donald Trump thought he had in place. Trump appeared to have had the same plan in mind for Senate Intel Committee Chairman Richard Burr. But after the White House conned Burr into misleading a few reporters early on, and the scandal became public, Burr then decided to being playing things straight. Moreover, Trump wasn’t counting on Republican Senator Susan Collins siding with the Democrats to give them a majority on the committee, forcing a serious investigation to proceed. Burr couldn’t sabotage it now even if he wanted to, because unlike Nunes, he’s outnumbered. So that’s two assets down.

    FBI agents descend on offshore casino run by Donald Trump business partner and campaign adviser

    ...Feds are hitting closer to home for Trump by heading offshore. FBI agents descended today on a casino on the U.S. island territory of Saipan, which just happens to be run by a longtime Trump business partner and a former Trump campaign adviser.

    According to a Bloomberg report, FBI agents entered the Saipan casino in a joint action with local authorities. A local politician characterized the action as an “investigation or raid” of the property (link). The casino is run by Mike Brown, who according to a prior Forbes article is a longtime protege of Donald Trump (link). In fact Brown is the former CEO of Trump Hotels and Casinos, which went on to file for bankruptcy three times. But Brown isn’t the only direct Trump connection to the property.

    Former CIA Director James Woolsey, who was a foreign policy adviser to Donald Trump during his campaign and part of his transition period, is on the board of directors of that same casino. That means two people with close ties to Trump, one of them financial and one of them political, just saw their casino raided by the Feds.

    I think that Trump is figuring out ways he could destroy his life even if he gets immunity. There are probably many ways. He could ruin him financially. He could expose the skeletons of one of his loved ones. The list goes on. So unfortunately I am doubtful that Flynn will be completely forthright and honest even if he gets immunity. But at least its a start.

    ...The government isn’t going to simply give immunity just to hear what he has to say. “You would have a difficult time seeing a scenario whereby they would be willing to look the other way if they think he engaged in criminal misconduct,” Bussert said. “They might say, ‘Come in and help yourself. Come in to a cooperation agreement and we’ll help you at sentencing — but we’re not going to simply let you walk away from this.’ ”

    But, he added, “What a congressional committee might feel could be completely different.” And that’s key.

    Remember: Defense attorneys generally are quick to advise clients not to talk to prosecutors at all. That Flynn’s attorney publicly demonstrated his willingness to “tell his story” under the cover of immunity gives us a hint of what the strategy might be. As Alex Whiting also noted at the blog Just Security, Flynn’s attorney may be hoping that Congress, not prosecutors, grant him immunity before he tells them anything. Congress can’t make Flynn immune from prosecution, but lawmakers can make his testimony immune from being used against him — as has famously been done in the past.

    A former top official in the CIA and Defense Department describes the Trump White House as a "runaway train," saying "criminal liability" from the 2016 presidential election could extend "all the way to the top."

    "The image I have in my head of the White House is a runaway train," Jeremy Bash, a former CIA and Defense Department chief of staff in the Obama administration, said in an interview with MSNBC anchor Brian Williams Thursday night, after former national security adviser Michael Flynn offered to testify in ongoing Russia probes in exchange for immunity.

    He added that Justice Department officials would have to weigh whether Flynn's testimony would warrant protection from prosecution.



    "For the Justice Department to agree to give somebody like him immunity it means they want him to turn and testify against someone higher up in the food chain," Bash said.

    "Who is higher up in the food chain, higher than the national security adviser? There's really only one person. And so this shows that the jeopardy of criminal liability actually extends all the way to the top."

      The stress is getting to Trump. His face has changed substantially since taking the oath. His eyes are always puffy and his face is totally bloated.

      I suspect he has high blood pressure, is probably on medication and subject to a heart attack or stroke. Neither of which would hurt my feelings.

      He's doing a horrid job and does not represent the majority of Americans! The world even detests him!

    There may be more to Flynn’s immunity request than meets the eye

    Here’s a tidbit tweeted by political pundit Jester, who tends to be quite insightful in his analysis despite his playful nickname. He dug up an older tweet from Robert Kelner, the attorney representing Mike Flynn who sent the immunity request letter to Congress and the FBI. Back in November, Kelner made what may now be a foreshadowing statement:

    'A prediction: Donald Trump will make novel and unusual use of the President's pardon power. An under-utilized tool of political power.'

    ...But why was Flynn’s lawyer making predictions about Trump pardoning people just a few days after the election, back before Flynn incriminated himself by making his phone calls to the Russian Ambassador?

    Was this an overconfident assertion by Flynn’s attorney that Trump would pardon his loyal sidekick Flynn for whatever crimes he committed during the campaign? Was it a veiled public warning shot at Trump, reminding him that Flynn has the dirt to take him down if he doesn’t end up pardoning him for his crimes?

    With the limited understanding we have right now of Mike Flynn’s true intent and motivation regarding his immunity request, it’s difficult to parse just what Flynn’s attorney was specifically alluding to in his November tweet. But as the Flynn immunity storyline develops, the above tweet may be crucial to keep in the back of your mind. Before long, I suspect it’ll make perfect sense one way or the other.

    Obama administration officials were so concerned about what would happen to key classified documents related to the Russia probe once President Trump took office that they created a list of document serial numbers to give to senior members of the Senate Intelligence Committee, a former Obama official told NBC News.

    The official said that after the list of documents related to the probe into Russian interference in the U.S. election was created in early January, he hand-carried it to the committee members. The numbers themselves were not classified, said the official.
