In the early days of the presidency the White House counsel warned Donald Trump that Michael Flynn had probably lied to the FBI and yet Trump did not fire him until after a Washington Post article.

The White House turned over records this fall to special counsel Robert Mueller revealing that in the very first days of the Trump presidency, Don McGahn researched federal law dealing both with lying to federal investigators and with violations of the Logan Act, a centuries-old federal law that prohibits private citizens from negotiating with foreign governments, according to three people with direct knowledge of the confidential government documents. 

The records reflected concerns that McGahn, the White House counsel, had that Michael Flynn, then the president’s national security advisor, had possibly violated either one or both laws at the time, according to two of the sources. 

The disclosure that these records exist and that they are in the possession of the special counsel could bolster any potential obstruction of justice case against President Donald Trump. The records that McGahn turned over to the special counsel, portions of which were read to this reporter, indicate he researched both statutes and warned Trump about Flynn’s possible violations. 

McGahn conducted the analysis shortly after learning that Flynn, on Dec. 29, 2016 — while Barack Obama was still president — had counseled the Russian ambassador to the United States at the time, Sergey Kislyak, not to retaliate against U.S. economic sanctions imposed against Russia by the outgoing administration. 

McGahn believed that Flynn, and possibly anyone who authorized or approved of such contacts, would be in potential violation of the Logan Act, according to two of the sources, both of whom work in the administration.

I would contend that the "anyone who authorized or approved of such contacts" means Donald Trump.  Either directly or indirectly.

It is very clear that Trump, at least in the beginning of this presidency, was very hands on and was involved in essentially all of the decision making.

And that would explain this next part: 

Despite McGahn’s concerns that Flynn violated one or both of these laws, Trump allowed Flynn to continue in his job and only fired him after the Washington Post reported that Flynn had lied to Vice President Mike Pence and other senior administration officials about his contacts with Kislyak. That was 18 days after then-Acting Attorney General Sally Yates informed McGahn of her own concerns about Flynn’s covert diplomacy with Russia prior to Trump taking office.

Why would Trump suddenly fire Flynn if Flynn was simply following his own orders?

I never believed that Trump fired Flynn for lying to Mike Pence, and have always seen that as a convenient excuse.

Flynn was let go because Flynn got caught, and now that he has made a plea deal with the Special Counsel Robert Mueller know EVERYTHING.

No wonder the White House and the Republicans are trying to undermine this investigation.

      There is some palpable fear out there that President Trump, fanned by the irresponsible voices in his right wing media echochamber, supported by his enablers in Congress and seduced by his own ego might fire Mueller or otherwise hamper the investigation during the Christmas holidays. I share this concern. This is a time when he might figure the nation is preoccupied and Congress is out of session. To be fair, President Trump has said repeatedly he will not fire Mueller. But we have seen before how short the half life is on the veracity of his words.
      So we wait, and wonder whether we will find ourselves plunged into a Constitutional Crisis. I do believe that if the President does fire Mueller, it will be a gross miscalculation. He may hold on to his GOP allies (When did the party of law and order become the party of attacking law enforcement?) But I sense a deep stirring across this nation among people who will not let this pass without their fury being heard - in the streets and at the ballot box."

    2. Since when does Trump care about abuse or violations. He does whatever he damned pleases. He gets away with it which is why he continues to do it. It’s worked for 70s years. No reason for him to stop now.

    Listen, it's known that Trump had mob ties in New York so Trump's not dumb as far as knowing how NOT to get caught. My opinion is that Trump gave an order(s) to Kushner, who then gave any further orders to underlings like Flynn.

    Kushner has already proven to be a liar (just like Trump and Kushner's jail-bird father). Kushner and Trump are arrogant and they believe they won't get caught or indicted.

    My hope is with Mueller, the FBI and foreign agents. We'll see soon, I hope.

    We all know it’s not the crime, it’s the cover up AFTER the crime.

    Here’s hopeing Mueller times his report just right so that the Republicans that refuse to impeach Trump will all lose in 2018. Then again in 2020.

    If we don’t turn the House and Senate in 2018 we have to in 2020. That’s when the census and redistricting happens. We need as many Democrats in office from the local on up to the Federal level by 2020. Otherwise the Republicans will continue to screw over the citizens of this country.

    Doesn't WH counselor have some legal obligation to inform the FBI or DOJ that the security advisor is working for the enemy?
    This isn't trump's private attorney. I imagine Mueller has gotten out of Flynn exactly how much top secret info he gave the russians.

  13. Mueller better be taking precautions. Checking his car for bombs, bodyguards, snipers. I’d go so far as a food taster. But if Putin wants him dead there’s really no protection that can save him. A small pellet injected, Ricin or some Thalium.

    Of course, there’s also the convenient balcony. Those that are a threat have “fallen” before.

    It’s just a matter of if Putin wants to protect Trump or not. Personally, I think it’s in Putin’s best interests to stay out and let Trump do as much damage on his own as possible. Putin may have gotten him into office but at this point probably has no interest in keeping him there. Trump can do more damage all by himself.
