Special counsel Robert Mueller is trying to piece together what happened inside the White House over a critical 18-day period that began when senior officials were told that National Security Adviser Michael Flynn was susceptible to blackmail by Russia, according to multiple people familiar with the matter.
The questions about what happened between Jan. 26 and Flynn's firing on Feb. 13 appear to relate to possible obstruction of justice by President Donald Trump, say two people familiar with Mueller's investigation into Russia's election meddling and potential collusion with the Trump campaign.
Multiple sources say that during interviews, Mueller's investigators have asked witnesses, including White House Counsel Don McGahn and others who have worked in the West Wing, to go through each day that Flynn remained as national security adviser and describe in detail what they knew was happening inside the White House as it related to Flynn.
Some of those interviewed by Mueller's team believe the goal is in part to determine if there was a deliberate effort by President Trump or top officials in the West Wing to cover up the information about Flynn that Sally Yates, then the acting attorney general, conveyed to McGahn on Jan. 26. In addition to Flynn, McGahn is also expected to be critical to federal investigators trying to piece together a timeline of those 18 days.
Essentially Flynn lied to the FBI. two days later Sally Yates told Don McGahn that Flynn lied, McGahn told Trump, Trump fired Yates, and then only after the press started to report on some of this did Trump finally fire Flynn.
So it would appear that there is a solid case to be made for obstruction.
However I actually think that Mueller is coming at this from several different angles.
I think that he well might make a case for obstructionism, but that he is also looking to flip Manfort and then Kushner and make the case for conspiracy as well.
I think that is why Trump is starting to lose his shit and why there is increasing talk about firing Mueller, while the Right Wing propaganda outlets prepare the base to accept that decision.

Trump is preparing to shut down Robert Mueller’s investigation of Russian intervention in the 2016 election.
The administration and its allied media organs, especially those owned by Rupert Murdoch, have spent months floating a series of rationales, of varying degrees of implausibility, for why a deeply respected Republican law-enforcement veteran is disqualified to lead the inquiry: He is friends with James Comey, who is biased because Trump fired him; Comey is biased because he pursued leads turned up in Christopher Steele’s investigation, which was financed by Democrats; Mueller has failed to investigate Hillary Clinton’s marginal-to-nonexistent role in a uranium sale.
The newest pseudo-scandal fixates on the role of Peter Strzok, an FBI official who helped tweak the language Comey employed in his statement condemning Clinton’s email carelessness and has also worked for Mueller.
His alleged crime is a series of text messages criticizing Trump. Mueller removed Strzok from his team, but that is not enough for Trump’s supporters, who are seizing on Strzok’s role as a pretext to discredit and remove Mueller, too. The notion that a law-enforcement official should be disqualified for privately expressing partisan views is a novel one, and certainly did not trouble Republicans last year, when Rudy Giuliani was boasting on television about his network of friendly agents. Yet in the conservative media, Mueller and Comey have assumed fiendish personae of almost Clintonian proportions.
As I have said before, if this happens it will blow this investigation wide open, and essentially prove the case for obstruction.
I would bet big money that Trump is itching to fire Mueller and that the only thing holding him back are his lawyers and advisers telling him that it would be political suicide.
The only question is, how long can they hold him at bay?

Okay this tidbit from the NBC report was brought to my attention, take a look at this: Mueller is trying to determine why Flynn remained in his post for 18 days after Trump learned of Yates' warning, according to two people familiar with the probe. He appears to be interested in whether Trump directed him to lie to senior officials, including Pence, or the FBI, and if so why, the sources said.
Okay well that is a whole new dimension to all of this.
That is suggesting that Mueller may have evidence that Trump not only ignored evidence that Michael Flynn lied to the FBI, but that he himself may have instructed him to do so.
If that pans out, I do not think that even the Republican majorities in the Senate and House can protect him from impeachment.

In this context, you really should use the word “obstruction” vs “obstructionism”.
ReplyDeleteObstructionism is a practice of continually obstructing, where obstruction is Either a single act or multiple acts employed to obstruct an investigation.
People can be charged with multiple counts of obstructing justice when employing the practice of obstructionism with regard to an investigation, but they will never actually be charged with “obstructionism”, as the law covers single discrete acts of obstruction.

ReplyDeleteTwo top Democrats on the House Judiciary and Oversight Committees are demanding documents from the Justice Department that they say could reveal evidence of “politically motivated misconduct” at the FBI meant to damage Hillary Clinton’s 2016 presidential campaign.
Jerry Nadler of New York and Elijah Cummings of Maryland, ranking members of the judiciary and oversight committees respectively, made the document request on Monday, in a move that turns the tables on Republicans, who have accused both the FBI and special counsel Robert Mueller’s office of being tainted by political bias against Donald Trump.
“Our committees are now engaged in an investigation of allegations of politically-motivated misconduct at the FBI,” the Democrats wrote in a letter to Attorney General Jeff Sessions and Deputy Attorney General Rod Rosenstein. “The facts point to a coordinated effort by some in the FBI to change the course of the Clinton investigation by leaking sensitive information to the public, and by threatening to leak additional information after the investigation was closed.”
The documents they are seeking include possible leaks to True Pundit, an anonymously written right-wing website, during the FBI’s investigation into Clinton’s email server. In the letter, Nadler and Cummings asked for information that could show whether True Pundit’s reporting, which cited sources within the FBI, influenced the bureau’s decision to reopen the email investigation less than two weeks before the election.
Now, Nadler and Cummings are demanding to know more about those sources, which they say could reveal an anti-Clinton bias within the FBI. Recently released emails show that True Pundit’s reporting was on the radar of senior FBI officials, including deputy director Andrew McCabe and then-Director James Comey, who discussed the potential source(s) of the leaks.

ReplyDeleteThat doesn't make any sense as it IS the House and the Senate that need 2/3 majority votes to impeach the President. No one else has the power to impeach, thus if the GOP majority in House and Senate stand behind him and do not vote to impeach, there is NO WAY he can be impeached.
So, his obstruction could have started with firing Sally Yates and continued by firing James Comey.
ReplyDeleteNow the question is what he covering or trying to protect Michael Flynn? I don’t thiink so. If anything, he was trying to protect his own ass. So with that in mind, what is it? That everything Michael Flynn did was at Trump’s direction. We all konw what a micromanager and control freak Trump is. Not only does he demand loyalty but he also demands obedience. Everything Flynn did he did at Trump’s direction. Certainly Trump’s knowledge.
As for those assholes with the FBI. They basically hijacked our election and manipulated the vote so Trump could win. Trump had nothing to do with it. They did this on their own. But the results were the same. The FBI rigged the election.
That means that Trump is NOT the legitimate president. Unfortunately our forefathers could never have foreseen this possibility and there is nothing in the Constitution to address this. It was basically a coup, not by the military but by a Federal Government department. Now, what did Comey know? He’s the one that released that damned letter that destroyed Hillary’s lead and gave the election to Trump.
It is all just so very CORRUPT.
So think about this. I always wondered why Mueller only brought one charge for Flynn to plead to. Lying to the FBI. Flynn has now pled guilty to that charge.
ReplyDeleteSo when Mueller hits Trump with obstruction of justice charges, Trump can't claim that he did nothing wrong because Flynn didn't lie.
With Flynn's one, measly plea of guilt, Trump can no longer weasel out with that excuse because he said he was guilty. Trump is in a corner that he can't get out of and therefore goes down for, among other things, obstruction of justice.
