The president’s personal attorney Michael Cohen interceded in 2011 to prevent porn star Stormy Daniels from airing her story about an alleged affair with Donald Trump, telling the agent who arranged for its publication that he could harm her career, according to a person involved in the discussions.
Randy Spears, the ex-husband of agent Gina Rodriguez, told The Washington Post he answered the phone when Cohen called Rodriguez after she arranged for Daniels to earn $15,000 by telling her story to a celebrity publication.
“You tell Gina that if she ever wants to work in this town again, she’ll call me immediately,” Spears said Cohen told him. He said Rodriguez, who declined to take Cohen’s call, contacted her lawyer instead.
Spears’s account offers the first look at the original effort by Trump’s lawyer to silence Daniels, who resurfaced again in 2016 as Trump ran for president. Cohen has acknowledged arranging a $130,000 payment in October 2016, using money from his own home equity line of credit, to ensure her silence. Cohen did not respond to questions from The Post.
According to Spears, Stormy Daniels, who was a friend and fellow adult film actor, told him about her affair with Trump right after it happened, and he even took a lie detector test about that in 2011.
The agency that Rodriguez worked for was also threatened with a lawsuit, and this story was essentially killed.
Unfortunately for Donald Trump, and his attack dog lawyers, that story did eventually come out within the pages of In Touch Magazine this last January.
However this is yet more proof that Trump has been trying to keep this story quiet for years, and it provides even more credibility for Stormy Daniels.
Not that she needs it at this point.
Michael Cohen’s Attorney Just Made It Easier for Stormy Daniels to Win
ReplyDeletehttps://lawandcrime.com/legal-analysis/michael-cohens-attorney-just-made-it-easier-for-stormy-daniels-to-win/
"In the Stormy Daniels case, the $1 million liquidated damages clause arguably looked, walked, and quacked like a penalty clause, and a court is almost certainly going to hone in on that when examining the agreement for unconscionability. However, now that Michael Cohen’s attorney more or less admitted that Michael Cohen wanted — or wants — to penalize Daniels, a court doesn’t have to apply much guesswork as to what the multiple $1 million payments are really supposed to do. A court, therefore, might not fret as much about invalidating that part of the agreement. Thus unencumbered, who knows what Stormy might say." <E. Penny

Trump’s adversaries steal the spotlight after wild 24 hours
ReplyDeleteStormy Daniels and Andrew McCabe have a bigger platform than ever before.
Donald Trump’s supporters want to see porn actress Stormy Daniels and former FBI Deputy Director Andrew McCabe silenced and sidelined. But after an explosive 24 hours that featured an unprecedented legal threat from a sitting president against Daniels and the public firing of McCabe on Friday, Trump’s two troublesome adversaries have a bigger platform than ever before.
By Saturday, Daniels and McCabe were the subject of wall-to-wall cable news coverage — much of it unflattering to the president. And the White House was back on the defensive, facing uncomfortable questions about whether the president’s repeated criticism of McCabe influenced Attorney General Jeff Sessions’ decision to fire him, and whether Trump was directly involved in efforts to silence Daniels.
The sequence of events began late Friday night, when Trump, through his personal lawyers, weighed in for the first time on the legal fight stemming from allegations that he had an affair with Daniels. The president’s team asserted that Trump has the right to seek more than $20 million from Daniels for repeatedly violating a non-disclosure agreement.
If Trump’s lawyers follow through on the threat, discovery and depositions could result, pushing Trump further into the middle of the legal fight over the allegations, on which Trump has avoided commenting in public.
...Michael Avenatti, Daniels’ lawyer, pounced on the president’s legal tactic, casting it as a strategic misstep.
“This clearly was not well thought out before it was done — either that or they haven’t been paying attention over the last two weeks,” Avenatti told POLITICO in an interview Saturday afternoon.
“These tactics only work if the other side blinks, and in our case, neither my client nor I have any intention of blinking. As a result, the president and Mr. Cohen have only compounded their problems by bringing suit against my client for $20 million of bogus damages,” Avenatti said, referring to Michael Cohen, Trump’s personal lawyer.

ReplyDelete...In his Thursday late-night show TV host Jimmy Kimmel gave a boost to Daniels’ fundraising goals when he said that making a donation to her legal would would be “act of patriotism.”
“I never thought giving money to a porn star would be considered an act of patriotism, but then again I never thought a guy who got into a Twitter war with Cher would become president,” Kimmel said during his show, ‘Jimmy Kimmel Live!’
“And remember, every dollar you donate potentially brings us one step closer to seeing photos that will haunt our dreams forever,” he added.

‘Where is this guy?’: Daniels attorney taunts Trump ‘fixer’ Michael Cohen for ducking press and hiding behind another lawyer
ReplyDelete...“Where is Michael Cohen?,” Avenatti asked. “I mean, this guy prides himself on being a fixer, he ends his tweets with #raydonovan.”
Ray Donovan is the title character in a Showtime, who is a “fixer” for a powerful law firm in Los Angeles.
“He actually refers to himself as the fictional character Ray Donovan, and yet for the last two weeks no one can get him on the phone, he refuses to go on any show, he refuses to answer a single question,” Avenatti teased. “Where is this guy?”
“Well, I can tell you, Michael Avenatti, I think you’re impressing a lot of people with your skills as a fierce defender of your client,” host Joy Reid concluded.

The grand irony here is that this means that Trump is de facto admitting to the affair. While the NDA signed by Daniels is not explicitly about the affair (though it does reference an “intimate relationship,” it is about certain “certain still images and/or text messages which were authored by or relate to” Trump. You know, dick pics. Daniels would not be violating the NDA if the NDA had nothing to do with them having an affair. Whoops!

Delete“The President is trying to legally silence public employees from *ever* speaking or writing about what they see while doing the people’s business,” tweeted Dartmouth political science professor Brendan Nyhan. “Chilling and scary. What would you think if you saw it in another country?”
ReplyDeleteEmployees of the White House work for the American people, not Donald Trump. And so, as Nyhan points out, these NDAs, like provisions of the contract Trump has now admitted to signing with a porn star who he had sex with and then paid hush money to, are likely unenforceable. But that doesn’t make it OK.
“Even if the White House NDAs are unenforceable, they (a) still could have a chilling effect and (b) are inconsistent with the principles we expect the leader of a free society to uphold,” he wrote.
