After pages of her book "America By Heart" leaked all over the Internet this week, Palin's publisher HarperCollins announced on Friday it is suing Gawker Media for posting the excerpt and refusing to take it down.
The lawsuit was filed Friday in New York, a HarperCollins spokeswoman confirmed to The Associated Press.
The day after Gawker published the pages, Palin saw them circulating around the internet and took to Twitter to protest.
"The publishing world is LEAKING out-of-context excerpts of my book w/out my permission? Isn't that illegal?" she wrote on Thursday, linking to a conservative blog which had posted the leaked material as well.
Gawker responded with a post titled "Sarah Palin is Mad at Us for Leaking Pages From Her Book," which, in the site's typical snarky style, referred the ex-Alaska Gov. to Wikipedia's page on "Fair Use."
"Or skip the totally boring reading and call one of your lawyers," Gawker added. "They'll walk you through it."
But Palin's lawyers don't seem to think it's that simple.
Their lawsuit pushes to stop Gawker from "further copyright infringement," and demands the website return the leaked pages so they can be destroyed.
HarperCollins is also seeking financial damages, according to the AP.
Harper Collins wants the leaked pages destroyed? Well I for one am in complete agreement with Harper Collins. In fact I support them destroying the entire manuscript before it can do any more damage to the minds of the naive and low functioning Americans that are hoodwinked into purchasing that steaming pile of Palin flavored mooseshit.
You know they are only prolonging the inevitable. Eventually we are all going to see it and it will leave no doubt that Sarah Palin is the most immature, nastiest, most ignorant, narcissistic woman in politics today.

with sarah's love for division and hate and controversy, this is the best early christmas present anyone could have given to her. still, i am glad that these sites exposed her wast of paper for wht it is and i hope they don't back down. i doubt they are really in serious legal trouble, anyway. this is one of her many publicity stunts.
and i forgot to add, you don't see her going after palingates. she wouldn't want people running over to the site that clearly exposes her many "gates" with a multitude of documentation to back them up, especially the mysterious and never cleared up by sarah herself gate having to do with the birth of her youngest son - those pictures and thorough research are pretty convincing, sarah. good move choosing gawker instead.
Posting her comments so people can read what she says makes them out of context? Do you have to read the whole thing where you can see she also says "...but I'm not a racist."? Or "..not wanting to rub salt in the wound." before pouring a whole bucket on it? Or "...not that I really want folks to grab their guns and get in their pickups and drive to the nearest democratic office and start blasting away..."?

ReplyDeleteWe know that the Palins were once good to Levi and treated him like family. They took him in when his learning disorder made him drop out of school. Todd helped him out a lot (forgot which interview this was). He looked to Sarah like a mother. What made Levi think it was Sarah and Todd pressuring Bristol to dump him and why does he think this was? We know from several accounts neither parties were faithful, including in May 2008. During the summer 08, Bristol seemed attached to her family. I've said it before, any story Levi could tell is centered around Bristol and it would ruin his chances of ever seeing tripp again to go after her. Of course the parents of a knocked up girl are going to turn on the father. Thats natural. But I think Bristols true feelings about Levi lies at the heart of the answer as to why the relationship didn't work out. It sounds like she used him and his cock. Wouldn't be the first.

OK, tell me if I'm wrong here, Harper Collins files a lawsuit for a couple hundred dollar filing fee, Gawker has 20- 30 days to respond, depending on the court's rules. By then the book's been released. Moot case, no? How can they prove posting pages of the book damaged book sales? As soon as the book is released, everyone else will chime in. Are they saying by having seen actual pages of the book, it would convince people not to buy the book? Nonsense. They've spent a couple grand to appease their client.

ReplyDeleteI think that the book is ghost written, lifting rants from Fox News, Right Wing Radio and the failed Hollywood script writer, Rebecca Mansour. It is Rebecca who must miss the day when movies that made people feel patriotic during World War II. RAM must not like the neo-realism of some of today's films. And judging from this book, she might not be a very good writer, either.
The other thing about Sarah's criticism is that it is not aimed at us. She is preaching to the ever shrinking choir. The book is filled with buzz words about the good old days (we want to take back our country). She invokes images of a time when THOSE people knew their place and didn't get government handouts. If this is an example of the kind of speech we will hear from political candidate Sarah, then she will have negative ads and no solutions, just piss, poison and venom.
I can't understand the furor over a few pages of the book being leaked when the entire book is being released in a few days, especially since it's standard practice to provide advance copies to reviewers. Unless Gawker took parts of sentences and recombined them in new paragraphs or picked only a few words out of a sentence, they're merely printing what 'she' wrote. HOW can reprinted pages taken directly out of her book possibly be 'out of context'???

There is no foundation to copyright infringement in showing pages from a soon to be published book. It is "fair use." Further, in order to be granted monetary damages Harper Collins would have to prove "loss." Given the publicity this has generated and the potential sales that this will yield, I highly doubt that is the case. *yawn*

I think it is all about money. If people have already seen all the "good" parts, they won't buy the book...no royalties. ReplyDeleteI encourage everyone to boycott all episodes of her reality show, since everytime we tune in to see the train wreck, it makes her look good in the news the next day, when they discuss the "record" number of viewers.
By not tuning in at all during that hour, the count will be much lower than the first week and it will be a strong message to Palin & TLC that her appeal is declining fast. Publishers and networks will start to think twice in dealing with her if she's not profitable anymore for them.
Toilet paper manufacturers are the ones with the losses caused by the leakage (every mother knows leakage is a bad thing!) of this Paylin book.

Aren't most books leaked prior to their big outtings? Seems like it to me. She's a sue happy idiot as usual - certainly hasn't stopped others from leaking exerpts of it.

You know they are only prolonging the inevitable. Eventually we are all going to see it and it will leave no doubt that Sarah Palin is the most immature, nastiest, most ignorant, narcissistic woman in politics today.
You can't take a book by this whackjob or her any of her comments out of context. Reason? They generally are not in context or based in personal understanding or truth! She thinks she is some kind of god and what she writes is thought of like as scripture. So her upset with the "out of context' statement is revealing in her mind and her followers crazy minds that every word she tosses is thought of as canonical and sacred.. To me this is blasphamy! Just like she signed a birth announcement as GOD... This woman is sick in the soul!
ReplyDeleteThe reason it's on sale at Sam's Club is that the store broke the "Strict On Sale" date. You can report this to H/C if you buy the book and send them your dated receipt. They will reimburse you the cost of the book. If Sam's Club does this repeatedly, H/C will take action and no longer ship them SOS books.
