Cease and Desist order from the attorney representing Frank Bailey, Ken Morris, and Jeanne Devon.

Dear Sir:

I write on behalf of Ken Morris, Frank Bailey and Jeanne Devon (collectively, the “Copyright Owners”). The Copyright Owners are co-owners of the copyright in the unpublished manuscript entitled “Blind Allegiance to Sarah Palin: A Memoir of our Tumultuous Years” (the “Work”).

Between February 16, 2011 and February 19, 2011 you were the recipient of an unlawfully distributed version of the Work. The Copyright Owners kindly request that you do not violate US copyright law by distributing, coping, reproducing or displaying any portion of the Work. The Copyright Owners are currently assessing their legal position with regards to those parties that violated the copyright in the Work. In an effort to assist the Copyright Owners, we kindly request that you provide exact details as to how you obtained unlawfully distributed copies of the Work and which parties (including names and contact information) sent you the Work

This letter is not intended as, and may not be construed to be, a complete recitation of the facts or circumstances connected with this matter. Furthermore, any statement contained in this letter is not intended as, and may not be construed to be, a waiver or relinquishment of any of the Copyright Owners’ rights or remedies under law, all of which the Copyright Owners hereby expressly reserve.

I knew this was on its way and personally I am glad that it has arrived.

This has been sent to ALL of us who, without authorization from the owners of the copyright, received this manuscript in our e-mail boxes on Friday.

I have already told you that I planned to comply with the wishes of the authors to NOT disseminate important facts from this manuscript, and except for letting you know that there is nothing relevant about babygate I have kept that word. (By the way I am not considered out of compliance with this Cease and Desist order.)

However as you know there are a number of news sites and blogs that have been putting out large portions of the manuscript without authorization, who WILL be facing some serious repercussions if they continue.

Look believe me when I say I completely understand the desire to read and discuss what is in this wonderful book-to-be, but ALL of us who want to get the truth about Sarah Palin out into the mainstream have to help protect this intellectual property. What is contained in these pages simply MUST make it into the bookstores.

So if you know of a blog, website, or forum that has post a portion or ALL of the manuscript please notify Mr. Steinbeck and let him know.

P.S. I will NOT be providing the name of the person who sent me the manuscript to this attorney.  In all other ways I will be compliant. But you know me, a source is always to be protected.

  1. Never thought I'd be glad to see a Cease & Desist letter. I confess I'm glad the information leaked because it was damning against Mrs. Palin, GINO (AIP). But, I do support the authors getting their work out in an orderly (and, I pray, quickly) way.

    I am a fan of your website, Cooler heads believe that complying with said C&D order will, in the end, separate the IM website from the sleezy ones.

  5. I agree. Good to see this. I don't want anything to prevent this book from being published. I'm already looking forward to buying it.

    One tactic tried on this blog by a Palin apologist: this book merely demonstrates that Palin is a politician, so nothing to see here, move along.

    I think that ardent fan has missed the point: Palin has been running on her "unique" platform as outsider, non-politician, non-business-as-usual, servant leader, transparent administration, etc, etc, etc, for every public office she has held. This book blows the lid off that image, and better yet, plants her firmly on thin ice.

  8. For those worried about my getting into trouble for not giving the source, don't be. It will not be too hard for the authors to figure out where it came from, but I am not going to confirm or deny anything.

    As for rumors that this leak was done purposefully I am certain that was NOT the case.

    However I am also one of those who believes that ultimately the leak may prove to be a good thing.

    I plan on buying the book from a store after it is published. I appreciate the hard work these people put into their work. From what I read so far I can't wait to read the rest of the book.

    Dee U Sarah and the rest of your grifting family, your time is now over. You have done enough damage and crooked things to Alaska. All your nastiness is coming out through Ms. Tripp and Mr. Bailey and I hope Levi comes out with his story, but I doubt he will. That's okay because others will come out with their story. We hope the Alaska attorney general comes out with Palin's email soon, but keep in mind that the bull shit you try to hide that Sarah did will emerge with emails that others have in their possession. So don't try to protect the Palins. The truth is coming out and the truth shall set us all free.

    Am a bit disappointed that Frank Bailey didn't just release the emails to a trusted news agency. Waiting this long to write a book and find a publisher is profitable for the authors of course, but it doesn't fit responsible citizens who care more about their responsibility first to country to release these as soon as possible before the Palins amass more power and control?

    How come it seems that anyone associated with $P with proof of her wrongdoings refuse to do the right thing and just release anything to authorities, but choose to take the $$$ path.

    I am glad to see the letter. It saddened me to see so many sharing parts of the book without permission and they had to know it was copyrighted.

    Still, I think in the long run if this wasn't intentional it will still prove beneficial since now it is possible for a few publishing houses to make their best offer. That can never be a bad thing.

    I wonder if the information that has been leaked can be taken back if there is information about illegal activity.I think you have to tell the police or it is with holding information.
    Now is the race to get the first book out.When the readers buy the first book they will less likely to buy the others especially if the book is complete and well written.

    Not releasing the name of where it came from - that's not uncommon at all. In fact, it is the norm.

    They are more concerned with not having further info and/or large portions of it posted or having it further distributed.

    For those that think Gryphen is wrong in not providing the name, please understand, he is not doing anything different than any others do in similar situations. You would understand this if you were in the industry. The letter issued is the standard boilerplate type letter.

    And I would supply the source. Because this is a matter of the law and that person committed an illegal act but passing on this manuscript. Without this information, they may not be able to trace the leak back to the original source zero. And I think that is very important.

    Sorry, but I do not consider this to be on the same level of your other sources and protection should not apply. This is not gossip. It's committing an illegal act.

    You said even you knew the law regarding copyright. Your source should have known too. They intentionally violated copyright. They should not be shielded.

    This book is not public domain.

    Just because it's on the internet does not negate copyright. That is a huge fallacy in the general public's understanding of copyright.

    Just because it's on the web doesn't mean it's free and copyright does not apply. In fact, just the opposite. Unless the owner states such, always assume there is an owner and copyrighted and a work, be it a picture, video, text or music is owned and without express permission from the copyright owner may not be copied, redistributed or shared in any way, whether proper citations and attribution is given or not. It does not have to have a © with name or date watermarked on it either.

    How do we know that the emails actually came from Joe McGinniss? I think back to all the fake Bristol Palin and Levi Johnston Twitter and Facebook accounts....it is easy enough to do. I feel like he is being somehow set up. Even ADN says they received numerous copies...why do they only name Joe McGinniss?

    As for me, I will reserve judgement until we hear from Joe M.

    I hate that we all have worked for two years to expose $arah Payme and now the wolves are eating their young. Sad, just sad. Divide and Conquer...that's how she rolls.

    Who are those other sources? This is more about damaging Joe McGinniss's reputation than dissemination of the rough manuscript, isn't it?

    And the letter over at Mudflats to McGinniss appears to be directly sent from Bailey, Morris and Devon, not from the law firm, and it contains libelous accusations against McGinniss.

    People need to be careful about who they are accusing. After all, anyone could set up an email account and call themselves "Joe McGinniss"--like that has never been done before...

    I smell a rat.

    I will wait for further info. before making a final decision about his book but it doesn't look good. I'm sure most of us would have been buying both books - definitely curious about what actually happened and what was he thinking *shrugs*

    You have an obligation to protect sources that you cultivate, and they have an obligation not to lie to you. Trust on both sides.

    I'm dubious that this protection extends to those who deliberately put you in a compromising position, or who encourage you to act illegally.

    This is NOT a case of a whistleblower revealing illegal activities which would otherwise be concealed: deadly pollution, bankster fraud, collusion and racketeering... where the revelation works to the public good at the expense of a criminal enterprise.

    The book was in the hands of an agent. It would be published and everything made public. The premature revelation of contents in dribbles and dabs does NOT help it get published, but muddies the process.

    The people who deliberately leaked this, including McGuiness, are guilty of copyright violation, and perhaps more.

    Qui bono?

    To whose benefit? Not to the public benefit.

    If the person who emailed the manuscript to you is someone you HAVE been working with for a long time, you may have a point about protection. If it is a recent contact or someone who appeared out of the ether to clusterbomb the news sites with the manuscript, it isn't your personal source.

    And what about your obligation to Jeanne Devon?

    WTF does that mean? "Romeo and Juliet" DIED because their families were warring. What kind of a comparison is that?

    This isn't careful writing, just hackery. I'm sure there's lots of good dirt in the book, but if Bailey AND Devon AND Morris don't think Babygate is worthy of touching on, I'll be forever asking myself "what ELSE did they leave out?".

    I have a feeling this enterprise is going to be as self-serving as can be under the circumstances. Don't forget Bailey is a serious R fundie.

    It appears that Joe McGinnis received a copy of the manuscript and he then leaked it. If true, he knew better and knows all about copyright laws as he is an accomplished author.

    Joe also has been very silent over the last few days as his name was mentioned as the leaker.

    I had NOT pre-ordered Joe's book and now I am glad I didn't. If he is truly innocent then he needs to say something. Joe is really getting a lot of flak over this and if he is guilty then it is deserved.

    I can't wait for the book to be published and know it will be a best seller.

    I was thinking the same thing 9:54. What better way to discount a book that HAS been purchased for publication? Make sure that the leak of another unpublished book on the same subject is traced back to him. Something stinks like the dead fish of Lake Lucille as far as I am concerned. As with anything in the Plain world, it is better to reserve all judgment until more facts are known.
    If McGinnis's book has real facts about Babygate in it from people who were around and saw Palin, now all that will be discredited. See how that works? I want to know who sent the work out initially. The further leaks could be from ANYONE as anyone can fake who they are over the internet (there are programs out there already that can do this).
    Until McGinnis peaks out about this, I won't judge anyone.
    And that lawyer needs a better spell checker or secretary who knows how to use one.

    I totally agree. On Jeanne's blog, the C & D order clearly names the person the consider responsible for the leak. I, too, am baffled by Jesse's allegiance to someone who would betray a fellow Alaskan blogger.

    What am I missing here? Is Jesse so starstruck by a particular famous author that he's willing to stand up for AK Muckraker? Please tell me I'm wrong, because throwing your friends under the bus to protect someone as unethical as the man who leaked this manuscript seems more like Palin that Gryphen.

    Joe McGinnis would not have done this. AKM, Mr. Bailey, and Mr. Morris, your anger is justified, but misdirected. Who benefits from this dissention and disgrace of character? Someone, very talented and well-funded is behind this. Everyone dissing Mr. McGinnis and vowing not to buy his book, is music to Sarah and her puppetmasters’ ears. Turning authors, who are penning negative books about Sarah Palin, against each other is just what they want to happen. Please don’t take an advisarily stand before learning all the facts. Joe McGinnis would not do this to anyone, especially other authors.

    I agree with 7:31. The facts should have come out long ago. I find it strange that Bailey claims to be deeply religious and has finally had a moment of truth and seeks redemption. The price of redemption seems to be the price of the book. He has beeen trying to sell this book for two years. If he wanted to cleanse his soul, he should have come forward years ago, before Palin's death panel killed health care reform.

    If Palin committed crimes while in office, then Bailey was her accomplice. In continuing to keep evidence of wrong doling hidden, he is still her accomplice. I reluctantly include his two co-authors, who have put in so much time in writing and research, but they have knowledge of crimes committed in office, and as good public citizens, they should present the evidence to the proper authorities.

    The problem is that the proper authorities to pursue a course of action against the former governor are the very people that she appointed to state office.
    So, I am requesting that any good citizen who received a copy of this book, evidence of Palin's wrong doing in office, send it to the U.S.Department of Justice. It would be the act of a good citizien who care more about what is right than how much they can make off of it.

    Two observations:

    1. This is not a "cease and desist order". An Order can be issued only by a court. This is more a "friendly" reminder that the copyright holders are serious about enforcing their rights, while seeking information to go after the culpable parties.

    2. The situation reminds me of the "outing" of AKM. It was unexpected, sleazy and unsettling, but in the end set her free and led to many good things. This leak will too.

    I really hope to see a post soon in which you condemn the man for what he did to Jeanne, Bailey and everyone else involved with that book.

    It should not have been leaked, and there are some moral fences that should not be straddled.

    There is something not quite right about all of this. I'm not familiar with how the publishing world goes so this is just a guesstimate on my part. I assume that the authors are shopping the manuscript around and i assume that publishers want an entire manuscript rather than snippets. But as to how multiple people outside of these various publishers came to own a copy is murky. Someone in a publishing house leaking it to various sources including Joe McGinnis? I fail to see the motive for Mr. McGinnis to leak this to the press. And how do we know it isnt someone claiming to be Joe McGinnis?

    I remain skeptical of this whole scenario. Mr. Bailey's Christian conscience should have directed him far earlier to call the dogs out on SP and her wrong doing. I have little sympathy for him at this point.

    And as the previous poster noted...this is not an order but simply a letter from an attorney's office. Big difference.

    The rush to judgment by some of the folks here is appalling. The facts are not totally known here, but it seems that there was at least some culpability on the part of the literary agent, who may have mishandled the manuscript. It is not at all clear that it was properly labelled as confidential or copyrighted, for example -- in fact, the information I have read indicates the opposite. So, don't get the gallows ready just yet! My sense is that this feud is rescuing Palin from what would otherwise be a very miserable week. Personally, I can't wait to read the book, and Joe's book too. The sanctimonious, judgmental attitude expressed by some people here and elsewhere, who cannot possibly know all the facts, is disturbing, to say the least.

    I do not understand why everyone is so quick to beleive Joe McGinniss would put his name to this. I know AKM/FB/KM believe him culpable, but Sarah palin has BIG MONEY behind her and MANY OTHERS' reputation is as stake. Pretending to be Joe McGinniss is child's play for these guys. I get how upset they are, but to not even consider this was done do divide all the potential book buyers, and discredit all the authors at the same time, is upsetting to me. I politely posted my opinion at Mudflats, and she/they wouldn't let it through. Others are saying the same thing, so maybe they are realizing they have been played. I would just suggest that everyone should take a deep breath before we find out what really happened. Some are referencing wikipedia as proof he is a bad guy, but have you seen the BS about SP there? I just think we should not jump to conclusions.

    It appears from the Mudflats post this morning that Joe McGuiness is the culprit who emailed Bailley's manuscript to everyone. If that is the case, it saddens me. In fact, his actions seem Palinesque in appearance, i.e. your manuscript might compete with my book.

    Unless Joe can provide a good explanation or he has been wrongly accused, I will no longer buy Joe's book. I thought he was a stand up guy, not unethical.

    I've seen this too often on this blog (and most other blogs I am on). Not everybody, but a significant number. Actually, both groups are acting in predictable ways for humans. People tend to be passionate about what they believe strongly, and particularly things that scare them - and while I don't understand the passion FOR SP, and I do understand the passion AGAINST SP (SP scares me), it doesn't mean the process on both sides isn't sometimes similar.

  60. One would think if Joe McGinniss didn't do this and were a true friend to the Alaskan bloggers he would have been out front of this controversy making sure EVERYONE knew he had nothing to do with this.

    What part of this guy's silence is confusing to you people? If you were accused of doing something like this wouldn't you rush to clear your name? If Sarah Palin had someone impersonating Joe McGinniss leak the Bailey manuscript, don't you think he'd be using that information right now to reinforce just how scared she is of anyone writing a book about her?

    But not a peep from Joe, and the longer the remains silence the more one has to be convinced that the truth is as ugly and simple as it seems: Joe McGinniss betrayed beloved Alaskan blogger AK Muckraker, and some people who should have stood by her did not when they should have.

    And believe me, I want to be wrong about this. I want to be so wrong about this. Because if I'm not then it means I've not just lost faith in Joe McGinniss but Jesse as well.

    I don't know if Joe McGinnis was the sole person to whom the yet-to-be finished book. Why was the entire book sent out anyway? That makes little to no sense.

    I am anticipating and looking forward to Bailey's etal final copy when it becomes available. Sooner than later would be just fine.

    makes any statements re this or not,
    I seriously doubt he's responsible for a malicious act. Let's wait to see what happens. Both authors are
    writing about Palin, but each from a very different angle - not in competition of each other. So, no motive for Joe to 'knock-out' Bailey.

    It sounds like the leak may have been intentional in order to stir the interest of publishers - maybe the three authors didn't know about it, but perhaps it was the ploy of the agent. I can't imagine that anyone other than the authors and the agent had a copy of the manuscript - so the only way Joe McGinness could get a copy was through one of them. How come no one has asked the agent to comment on how this book got leaked - one of them must have sent it out.

    yeah I'm with those who say something about this really stinks.

    it seems to me that the only person who would be hurt by this is mcginness. would he really ruin his own reputation? really? hard to believe.

    people are pointing out that he hasn't said anything yet. well if I was in his shoes and I was not the leaker, I might hire some hackers to find out where the leak really came from so there is evidence when I deny. perhaps that is why he has not spoken up.

    let's not forget the $ that is behind palin. those kind of people employ a variety of folks to monitor their investment. it is possible that someone's email account has been compromised (one of many many people who don't like palin) and that every email they receive is "copied" to another account set up to monitor the anti-palin emails. joe sent the manuscript to that person, and it was received and forwarded by the palin protectors posing as joe or someone else. there are many other devious ways this could go down, too. it would not surprise me in the least if this was proven to be a set up. I really have a hard time believing that this guy would sabotage himself.

    I'm curious about those who say they received the manuscript "from Joe": was it sent from his normal email address? Because I cannot believe an author would do this, and this is such a typical Republican tactic to sow discord amongst their enemies. It would be very easy to set up a fake email address and leak the manuscript pretending to be JM.

    Didn't the wingnuts just do this to someone else? Remind me here.

    What strikes me as odd about this leak is how widely the manuscript, apparently in its entirety, was disseminated. Both of those elements, as best as my knowledge goes, are unusual.
    And why all of it and why to so many?

    The who and why would seem to be very important. The what, we know a the when we know fairly closely.

    My guess at the moment is that it was done to try to prevent the authors from profiting by it.

    Depending on when the presumed publish date would be, also, to blunt the impact of the book close to the primaries.

    Before, when Sarah accused him of moving next door so he could peep into Piper's window, he had his lawyer release a statement.

    I'm sure he's in touch with his lawyer and will follow his advice.

    Forwarding an entire book to a newspaper: I can't see Joe McGinniss being that dense. There would have been no reason for him to forward it to anyone at all. What purpose would it serve? The people who want to take Sarah down would certainly still buy the book as well as McGinniss' and Dunn's as well.

Also, too, who is the fucking moron who sent the entire manuscript out without requesting confidentiality? It's not like Joe McG crept into their houses and ganked it from their computers to spread it far and wide. I hate that it leaked if that isn't what the authors wanted, but they are culpable too for being so careless with their work. I don't really feel bad for Bailey, though. He's trying to cash in on being Palin's dirty little bitch, and I don't care if he gets filthy rich from it or not.

    I smell a rat. It does not make sense that Joe would do this-he is an established author and does not need to resort to dirty tricks. I do notice that the kerfluffle has the AK bloggers at each others throats again--could there be someone behind that?? Who really benefits from this controversy? To me it seems that someone is trying to smear Joe before his book comes out but I will not make a judgment until ALL the facts are known.

That he could be in Bali or Jamaica or where ever? That he's getting legal advice before he issues a press release? That hijacking someone's email account is easy? That people have probably received emails ostensibly from you offering to sell them Viagra?     BEnefits to Joe M are iffy regarding his book and risky regarding his career (and possibly the respect of friends and family). And I don't think he needs the money although perhaps being a bestselling author (of books made into movies) isn't as lucrative as I think.
    SP can, if she chooses, now vilify one of her arch-enemies - Joe M -
    It causes serious harm to another arch-enemy - Jeanne.
