The birther movement is now targeting Chief Justice John Roberts for impeachment if he swears in President Barack Obama for a second term later this month.
Craige McMillan, a columnist for the conservative publication WND.com, wrote a piece last week asking Roberts to not swear Obama in, because, according to McMillan, Obama does not meet the Constitution's definition of a natural born citizen. In the piece, McMillan claims that Obama is not a citizen because his father was a citizen of Kenya and the United Kingdom, and that Obama cannot be "a natural born citizen" because his father was not an American citizen. Obama's mother, Stanley Ann Dunham, was born and raised in Kansas by parents who were born in Kansas.
McMillan wrote:
Your failure to investigate these citizenship issues surrounding Mr. Obama at the time questions were raised during his first term places you in a terrible position. You are now confronted with a most difficult choice.
Your own oath of office, sworn before God and the American people, requires you to uphold the Constitution. (If not you, then who?) If you now administer the oath of office for the presidency to a man who by his own admission fails to meet the natural born citizen requirement imposed by that Constitution, you have violated your own oath of office and are rightly subject to impeachment by any House of Representatives, at any time, now or in the future.
McMillan then suggested that the outcome for the country would be "Illegal wars. Illegal debts. Illegal laws." The New Civil Rights Movement reported that the National Memo responded to McMillan's piece by noting that Obama has met all the qualifications for being a natural born citizen, including being born in Hawaii and his mother being born in Kansas.
You know I have heard of beating a dead horse, but damn these people take it to a whole new level!
Here is what the National Memo wrote in response to this lunacy:
It’s been proven over and over over again that the president was born in Hawaii. But let’s say for the sake of argument that he wasn’t… here are the requirements for American citizenship with one American parent and one foreign parent, if you’re born on foreign soil:
If you are born abroad to one United States citizen and one foreign citizen, you may be considered a U.S. citizen if you meet the following requirements:
• One of your parents was a U.S. citizen when you were born. CHECK
• The parent who is a U.S. citizen has lived at least five years in the U.S. before you were born. CHECK
• The parent who is a U.S. citizen must have lived in the U.S. for at least two years of these five years after his/her fourteenth birthday. CHECK
Our laws are quite clear: If you spring from an American womb, you’re an American. Whether you’re born in Kenya, Panama or on Mars, if your mom was a born-and-bred, Kansas-cornfed American — like Stanley Ann Dunham Obama — you’re an American and thus eligible for the presidency. PERIOD.
Now for the love of all that’s holy and lucid, stop it.
By the way, the process for impeaching a Supreme Court Justice is not exactly a simple task, and there is actually NO chance this would ever make it pass the initial phase where the "articles of impeachment" were presented to the House of Representatives. After that, once the laughing had stopped, it would end up being filed away under "lost causes."
The funny part is that he will be sworn in TWICE, on Sunday and Monday.
ReplyDeleteImpeach Justice Thomas because his wife is a paid lobbyist for the healthcare industry (against Obamacare). Thomas has a financial interest in her work. He should have recused himself in any matter regarding healthcare that came before the Supreme Court.
ReplyDeleteAccording to Thomas's 2011 financial disclosure report form, filed on May 15 and obtained Friday by Whispers, the Thomas’s invested up to $15,000 in the political lobbying firm Liberty Consulting, where Ginni Thomas continues to earn a salary and benefits. The firm lobbied actively against the healthcare law, according to liberal news magazine Mother Jones.
I would also like to impeach Justice Scalia, who ruled on matters concerning his personal hunting buddy, Dick Cheney. He gives political speeches in spite of the fact that he is supposed to be impartial and non-political.
What in the hell does Justice Thomas have to do with this thread, about the swearing in of our President? This thread is about Justice Roberts.
DeleteHe was just pointing out that there are people who deserve to be impeached, and they are sitting on the SC.
DeleteRight on, NOT!!
DeleteAnd Scalia has clean hands?
They're coming out of the woodwork, but they scatter when the lights go on. Cowards!!
I wonder if Donald Trump is going to parrot this nonsense and if, should he do so, the head of NBC, or whatever network he works for, will fire him.
ReplyDeleteBeaglemom
Donald's kids should self deport and take their father with him.
DeleteWhat idiots. Even Trump’s three oldest children told him to cool it (nicely of course).
ReplyDeleteYou know they’ve got nothing on the president when they keep worrying this meatless bone.
President Obama was born in the US. So it is immaterial what the racists are spewing.
ReplyDeleteGot to love the birthers, they never fail to provide delusion and comedy. I wonder what they will do if the tea party darling, Marco Rubio, is ever nominated for President.
ReplyDeleteBetter yet, ted Cruz, who was actually born in Canada to one American and one Cuban.
DeleteWhere were these idiots during the 2008 election when John Sidney McCain III, born August 29, 1936, at Coco Solo Naval Air Station, Panama Canal Zone was running for president? Who questioned his citizenship? Oh yeah, he was a Republican and therefore above suspicion...
ReplyDeleteWhite skin, free pass.
DeleteOh, and don't forget, McCain is somehow a war hero for geting shot down and captured on his very first mission.
DeleteJohn McCain was NOT born on a Naval Air Station. He was born in a regular hospital in Panama.

Oh, no. They passed a special law for McCain and remember a few yrs ago, they wanted to get rid of the law for "Arnold"
DeleteAhhhh--let 'em try to impeach Roberts. Orly Taint can go before the supremes. Hopefully they will break tradition and televise the whole thing. I'd love to watch that three ring birther circus freak in front of the court. Scalia would filet her while dripping slime everywhere.
ReplyDeleteThe truly stupid part is that if they somehow got what they wanted, President Obama would get to pick a young liberal in Robert's place. WIN. The birthers are some of the dumbest people on the planet.
republicans are just so ignorant, they don't understand what impeachment means.
ReplyDeleteSo why aren't they doing this now after the first swearing in? You know why , because there is no basis for this at all. They are mad Justice Robert held up ACA.
Boy, republicans are all as stupid and ignorant as Sarah Palin.
But I do hold out hope, I, myself have helped at least a dozen or so people recover form republicancy. Happily recovering republicans can and do live long happy educated lives as democrats break for it.once they make a b
A 2011 Congressional Research Service report stated
ReplyDeleteThe weight of legal and historical authority indicates that the term "natural born" citizen would mean a person who is entitled to U.S. citizenship "by birth" or "at birth", either by being born "in" the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship "at birth". Such term, however, would not include a person who was not a U.S. citizen by birth or at birth, and who was thus born an "alien" required to go through the legal process of "naturalization" to become a U.S. citizen.[1]
http://en.wikipedia.org/wiki/Natural-born-citizen_clause
These stupid, fucked up whack-a-doodles should not be called "birthers." They should be called what they really are - RACISTS.
ReplyDeleteThey added that a viable alternative is for Obama to stop being so Black.
ReplyDeleteThere was a little something left out in your information -- why it DOES MATTER that Obama was indeed born in the United States. The law is actually this for people not born in the U.S.: "if only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16." Since both of McCain's parents were citizens, McCain was born a citizen. The one and only reason Obama was born a citizen, due to the fact his mother was only 18 when he was born, is because he was born in the United States.
ReplyDeleteThey needed a special law to make McCain eligible for a presidential run.
DeleteWhat does age of the mother have to do with it. His mother was an US citizen no matter what her age she was when he was born. Besides that, he was also born in the US giving him every right to be a citizen, without question.
DeleteAhhh, again the short sightedness of the right. They want to impeach a conservative SCOTUS, yes he gave us Obamacare, but in most matters he will vote with the right. After the impeachment President Obama would get to appoint his replacement. I think the LGBT group is under represented on the SC, don't you think?
ReplyDeleteI think just the right pick could cause all the wingnut heads to explode at once. Perhaps a gay, atheist, of arab descent, with PHD in meterology and a member of PETA.
He, he you beat me to it, the stupid, it burns, doesn't it?
DeleteHillary Clinton as Chief Justice would be enough to send these idiots spinning into space. (Besides, didn't you know she is Lesbian, a space alien, and God knows what?)
DeleteJust remember the whole birther movement was started by a Hillary Clinton supporter/funder.
ReplyDeletehttp://www.canadafreepress.com/index.php/article/22345
However, the entire issue of Barack Obama’s eligibility was first brought to the fore by lawyers acting on behalf of Hillary Rodham Clinton in 2008.
Specifically, Phil J. Berg, hardly a member of any vast right wing conspiracy, was an ardent supporter of Hillary Rodham Clinton, and her candidacy for the presidency.
You seem to be conflating terms there 8:30. an "ardent supporter," who happens to be an attorney is NOT, an attorney acting on behalf of Clinton.
DeleteWHo cares where it started? What matters is that the issue was ultimately laid to rest.
Delete...For most of us, anyway.
Need I remind you that Rebecca Ann Mansour was also an ardent supporter of Hillary Clinton? So was that Hillbuzz lunatic.
DeleteWho are these people?
ReplyDeleteWhat are they sooooo afraid of? In McMillan's address to Justice Roberts, he suggests the "outcome for the country would be "illegal wars, illegal debts, illegal laws."
Has the past 4 years really been that unpleasant for this McMillan fellow? I'll bet he enjoys a pretty good lifestyle. Does he really care about the outcome of his country? To suggest that POTUS is not a real American is bad enough, but to then suggest that if this were indeed the case, that present-day wars, debts and laws became illegal because of it, is juvenile. If the man cares about his country, he'll get out of war, debt, and cumbersome laws and WORK with the President to make that happen. Who gives a #$%^ if war is legal or illegal? War is horrid. A legal war or an illegal one: both are horrid.
Sounds like these folks at WND just want to be able to fight, kill, violate, other countries in good conscience, having their consciences clear that it's a LEGAL war.
There's a reason it's called WingNutDaily.
Deletelol, just when you think they can't get any loonier...
ReplyDeleteThis has been a four-year "Shhh! He's black!" temper tantrum for the airheads on the extreme right. It's like a spoiled six-year-old whose mommy won't buy their favorite toy, so they'll wheedle, plead and make up fantastic, intricate reasons why they NEED it. Every time they see it on TV they'll bang their little fists on the floor and threaten to hold their breath until Mom runs out and gets it. Ummmm, did I say threaten to hold their breath? Hey now...
ReplyDeleteIt truly is a curious sight, the far right GOP eating their own.
ReplyDeleteGeorge Washington's father was not a U.S. citizen, so by this reasoning it was impossible for George Washington to be a natural-born citizen, so he was not eligible to be president.
ReplyDeleteOops. Time to get King George on the phone and apologize for that whole American revolution thingy.
There is a clause exempting the founding fathers who were in the country before independence.
DeleteYou are correct. I should have looked it up. "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States."
DeleteHawaii is one of the 50 U.S. states.
ReplyDeleteBeing born in a state makes you an American citizen.
Recent presidents, born in Mass, Texas, California, Michigan, Illinois, Connecticut, Arkansas, and Texas again. All Americans, like anyone born in Hawaii.
I wish Daniel Inouye, just deceased Senator from Hawaii, wounded in WWII, could go up against these birthers. He worked for, fought for, and served his country for decades.
The birthers are probably stuck to the webbing of their aluminum chairs, the kind that have holders for their beer cans, while they laptop to each other about how THEY are the rul 'mericans. Their cousins, small-town tax preparers in tiny fake-wood-panelled offices, have their U.S. birth and nothing else to brag about.
But it would be interesting to impeach the Chief Justice and have the President replace him with one of those others that are here only because of our generosity: a Mexican-American, a black American, an Asian-Americans.
All Americans.

ReplyDeleteSuddenly Mr. Fancy Pants Alaska Librul Blogger is a constitutional expert???? Listen here, Gryphen, - which I seriously doubt is even your actual real god-given name- as the birther-patriots will patiently explain to you - due partly to this Obama character's inexplicably darkish skin pigmentation - there are MANY, MANY reasons to question the legitimacy of his so-called presidency. (ok, I'll be honest here. The skin thing is really the only reason, but still...)
Naturally, this isnt a question that can be easily answered and it can't be answered quickly. Consider it the racial equivalent of tabletop cold fusion reactors. We absolutely know they work, we just can't prove it yet. The proud and twitchy tea-baggin' protectors of the Constitution - whether they be wealthy real estate developers/media puppets or they be not - are paradoxically a patient group and I GUARANTEE they will work tirelessly for DECADES if that's what it takes to determine beyond any doubt that this Kenyum-born muslin socialist nazi community organizer that you so admire is NOT the legitimate president of the United States!
And if that proof is - someday in the distant future - revealed and if you are HALF the man you claim to be and are still alive late in this century or possibly early in the next century, I challenge you to make a PUBLIC and hopefully humiliating admission that you were wrong all along!
Otherwise, there might still be some tickets left for the rapidly approaching inauguration...
Welcome Back, Comrade Conehead (Though I seriously doubt that's your REAL name)!
DeleteDamn Beldar, I and probably the rest of us "satire-connoisseurs" have missed you!
ReplyDeleteYou are in fine fettle with this comment.
Keep Going!
Beldar is in the house! So he can be the Speaker of the House!!!
ReplyDeleteThe child also has to have lived in the U.S. before their 18th (or 21st) birthday. Not sure of the ages. CHECK.
ReplyDeleteYes, the birthers are insane. They are also ignorant, stupid and bigots.
This is not a patriarchal society, no matter how much as they'd like it to be. Nor is it a theocracy, ditto.
I think they're going to see a new version of President Obama in the next four years! And I can't wait!
ReplyDeleteGet your popcorn ready!
I say -- go for it! I'm all for booting the idiot who couldn't even bother to remember the swearing-in ceremony last time and who brought us, "Corporations are people."
ReplyDeletePssst.
Don't tell them that booting John Roberts will mean legal gay marriage!
AND, when the fleet of WHITE buses show up to carry these fake Klan members off to a state mental hospital for their all-expense paid electro-shock treatment, just applaud once and walk on down the road...
