Hours after claiming that they successfully passed some of the toughest abortion restrictions in the country, Republican lawmakers reversed course on Wednesday and said a disputed late-night vote on the bill did not follow legislative procedures, rendering the vote moot and giving Democrats a bitterly fought if short-lived victory.
The reversal capped a remarkable day in the Texas Legislature here. A petite Fort Worth Democrat in pink sneakers staged a 10-hour-plus filibuster marathon in which she never sat down. Abortion rights activists succeeded in disrupting Republican senators, and the fate of a bill that Gov. Rick Perry had made a priority devolved into a legislative mess so thick that even senators who had voted on the bill could not say for certain whether they had indeed voted on the bill.
The state Senate’s vote came right at a midnight Tuesday deadline, amid widespread confusion the noise of a chanting crowd of the bill’s opponents in an upstairs gallery. Senate Democrats said the vote took place past the deadline at 12:02 a.m. or 12:03 a.m., while Republicans disputed those claims, saying the vote was legitimate.
But at 3 a.m., Lt. Gov. David Dewhurst, the presiding officer of the Senate and a Republican supporter of the bill, told lawmakers and reporters that although the bill passed on a 19-to-10 vote, the bill could not be signed in the presence of the Senate and was therefore dead, blaming “an unruly mob using Occupy Wall Street tactics” as the primary cause.
The reversal served as an embarassing episode for Mr. Dewhurst and Republican senators on a divisive bill that was closely watched around the nation, both by anti-abortion activists and supporters of abortion rights.
“The G.O.P. Senate leadership comes out of this whole process looking somewhat disingenuous, deceptive and disorganized,” said Mark Jones, a political science professor at Rice University in Houston.
In the final minutes before the midnight deadline, Republican senators had interrupted a filibuster that began at 11 a.m. But their attempts to push forward with a vote on the bill caused the bill’s opponents in the gallery to erupt into screams and cheers. Attempts to bring about order failed.
Beating an anti-abortion bill in Texas is no mean feat, and Senator Davis is a hero to both men and women in that state.
Chalk one up for the good guys! Especially since by doing this Davis also clearly exposed the underhanded methods that Texas Republicans are willing to use in order to take women's rights over their own bodies away from them.
I am going to keep a close eye on Senator Davis I see very big things for her future.

DeleteThe first thing Texas did yesterday after SCOTUS canned the voting rights act, was institute their requirement about a voter ID, which had been ruled unconstitutional just recently... Minority voters and poor voters will be disenfranchised by this, and will quite likely not be able to vote, since they cannot afford to pay for an ID.
I saw a WendyforSenate hash tag on Twitter last night, and in the spirit of what's been said above, you need her more in TX than we need rational voices in Congress, even if it's a close second!

I was watching the live-stream at midnight and after midnight, when they were taking the vote, I was all "wait, the special session is over...why are they still voting?" Then Douchehurst was acting like "yep, we got that done. Time to close up shop" and there were howls of protest, senators started bunching into little groups, it got quiet...and at12:30, after nothing happening for half an hour, I gave up and went to bed. I figured that with over150000 "witnesses" on the Internet that saw the vote go down after midnight, they would not have a leg to stand on but figured it would go to court. The time stamp thing? Despicable. And, I think, prosecutable.

Texas Dem Senators showed amazing, smart teamwork and were backed up by screaming masses of women and some men in orange. Senators Watson, Zaffrini and especially Van de Putte, who returned from her father's funeral to come to the floor and help out, all deserve special shout-outs, as well.
ReplyDeleteI agree completely. I watched the live feed last night, and was so proud of ALL of them. Zaffrini did her best to keep the clock moving, Watson was amazing (former mayor of Austin; terrific guy) and Van de Putte kept Dinglehurst on his toes. Combined with the POWER exhibited by Ms. Davis, it was a fantastic display of teamwork.

Last I heard/read, there were over 150,000 watching it live -- can you imagine the ratings boost that would have given CNN or MSNBC at that time of night? On Monday, the Texas State House voted overwhelmingly to pass a draconian proposal that would ban all abortions after 20 weeks, as well as adding stringent new restrictions on how clinics get licensed. The intent was clear: Supporters of the bill, known as SB 5, openly acknowledged that the law would have closed 37 of the state's 42 clinics, leaving hundreds of thousands of women in Texas and neighboring states like Oklahoma with no way to access abortion care. With a conservative majority in the State Senate and the support of Governor Rick Perry, the measure seemed certain to become law.
But on Tuesday, Democratic State Senator Wendy Davis, backed by an army of feminist supporters, launched an epic 13-hour filibuster and shut the whole thing down.
Davis began her filibuster just after 11 A.M. yesterday, reading aloud testimony from doctors and women who would be impacted by the restrictions. For the filibuster to work, Davis had to speak until midnight – the deadline for the end of a 30-day special session called by Gov. Perry to address left-over GOP priorities like closing nearly all the abortion clinics in the state and redistricting. This wasn't the kind of symbolic filibuster in name only seen in the U.S. Senate: Under Texas' parliamentary rules, Davis was required to speak continuously and only on the topic of the bill the entire time. She couldn't take breaks to eat, take a sip of water or go to the bathroom. She could not lean against anything for support. If Davis broke any of these rules, the filibuster would die and SB 5 would become law.
Just before the midnight deadline, Texas Lt. Gov. David Dewhurst sustained a third and final challenge to Davis' filibuster – this one on the germaneness of discussing the 2011 law that forces Texas women to undergo invasive ultrasounds – and called for a vote. Hundreds of protesters who had gathered in the senate gallery erupted in outrage.
With the clock still running, Davis' colleagues stepped up. State Senator Leticia Van De Putte, who arrived at the Capitol in the afternoon after spending the morning at her father's funeral, challenged Republican leaders at the podium who did not recognize one of her attempts to speak: "At what point does a female senator need to raise her voice to be heard over the male colleagues in the room?" Van De Putte's procedural mic drop prompted even louder, sustained cheering from the crowd; Republicans pounced on the chaos, trying to force through a vote.

There may be a problem ahead for State Senator Davis due to the recent Supreme Court ruling. Seems she was able to keep her seat because the Texas GOP wasn't able to carve up her district map for voting They now are determined to make sure to redraw her district to favor the GOP.

Wendy Davis grew up in a trailer park, the daughter of a single mother. She started working to support her family at 14; by 19, she was a mother herself.
On the recommendation of a classmate, she went to her local community college to become a paralegal. Went on to graduate first in her class from Texas Christian University, and, ultimately, to get a law degree from Harvard!
Bristol, if you're reading here, this is an example of what you can do, even as a young single parent. Right now, you could be enrolled at your local community college, then go on to the University of Alaska, if you'd like to. You have the money to do so. Graduate work is there as well, if your inclination is to get an advanced degree.
The only requirement is that you have a goal and work toward achieving it. That means studying late at night while Tripp is asleep; balancing part-time work with classes; and putting your shoulder to the grindstone. It's all there for you, if you want it to be.

Wendy Davis is intelligent, regardless of her humble beginnings she was genetically gifted with an operating brain. Bristol is dumb and I doubt has enough intelligence to even attempt to mimic what Wendy Davis was able to do. Bristol has found her niche in reality TV and in being a "single mom"with a hellion to attempt to keep out of jail as he matures. That is her lot in life. She is stupid and challenged, just like her mother and just like her siblings.

But, as you point out, one must have ambition and drive -- the determination to work hard, to do extra work if necessary, to move forward and not stay in the same darn spot. And if one decides to stay in the same darn spot for the rest of one's life, then it's not fair to complain about it! Life can be better -- or different -- if you want it to be.
Davis is amazing! She did have help from some of her colleague and also from thousands of citizens who sent in their stories so she would have material to keep going.

This is what we get when smart, hard-working and talented young women are invested in no matter their backgrounds. I sat behind Senator Davis for the whole day, 13 hours never leaving for a break because I knew I would never get back it. Yes we were an unruly mob,all 3000 to 5000 women and men tired of being told to shut up and take what we are given. It had to be the most amazing day of my life. There are so many interesting stories that I witnessed that day.
ReplyDeleteMost of us knew there would be another session and the bill will be probably be passed at almost one million dollars of tax payers money but I am going back again to Austin.
By the way, it is estimated Wendy Davis will need over eighteen million dollars to compete for governor..
