Sarah Palin to be sued for copyright infringement due to use of iconic 9-11 photo. Update!

A North Jersey newspaper company on Friday slapped Sarah Palin with a lawsuit alleging the former vice-presidential candidate and her political action committee posted copies of an iconic 9/11 photograph on their websites without permission. 

The trademark-infringement suit, filed in Manhattan federal court by North Jersey Media Group, alleges Palin posted a copyrighted photo of firefighters raising the American flag on the ruins of the World Trade Center on her PAC’s website, her official Facebook page and other web pages. 

North Jersey Media Group’s holdings include The Woodland Park, NJ-based The Record and the Herald News. The photo was taken by Thomas E. Franklin and appeared on the front page of the Sept. 12, 2001 edition of The Record. It earned him Pulitzer Prize nomination and was the focus of a CNN documentary “The Flag” that aired on Sunday. 

“North Jersey Media Group is concerned about the infringement of its photograph and people taking credit of the photo who are not entitled to,” the company’s lawyer William Dunnegan said. 

Reps for Palin’s PAC could not be reached for comment.

The lawsuit asks the court to stop SarahPAC from using the picture. It also seeks damages.

      I sent an email to the MLK email address for MLK's son but didn't hear back. I'm on my iPhone in Petco with 2 dogs so I can't look it up or they'll throw me out of here. But if someone has a link for the suit by North Jersey, please forward it as an attachment to the King Foundation.       I will say, from personal experience, that firefighters are the BEST people. We had a wildfire run next to the house, and the firefighters could have taken anything, we left so quickly valuable stuff was laying around, but they took one cookie, and only on my insistence, lol.

    2. Be sure to capture it and save the MLK pic with the Sarah PAC logo superimposed on it in your hard drives. IIRC, the statute of limitations is two years here to make a claim for damages for this type of impropriety. I guess it would depend on which state it is filed in. For MLK, I think they're in Georgia. Anyone familiar w/ the statutes in GA? I believe the State of GA has the statutes on Lexis-Nexis available to the public online, but I'm not at my office to be able to research the statutes on a readable font. But if any attys reading here (or others familiar with the code in GA and care to look it up, it would make for a quick "good deed for the day" if you dropped the annotated code for the applicable law to the King Foundation. If I haven't read anything in the comments here by tomorrow morning, I'll try to go by my office for a few minutes. This is worthwhile to do, folks. We already have one arrow in the bullseye. Lets get another one!

    This proves that Sarah didn't really pay attention to her journalism classes, if she ever took any. One of the first lessons in journalism would be to put a quote in quotation marks. Reporters usually carry a small tape recorder or video the interview to be sure of getting the quote right. The same class would teach about what is covered when material has a copyright, and that you have to attribute the source and get permission first.

    Can Sarah turn the colored photo into black and white and crop it? No, she can't.

    if it is copyrighted, you cannot take it/use it at all. you cannot use it wether you change colour, crop it, rotate it etc.

    you must contact the owner and get permissions, and ask them what he/she is and isnt willing to let you do.

    its their decision.

    Sarah Palin trademarked herself so people would not put her picture on a t-shirt or a mug for the purpose of making money. She resents Begich using her in his election campaign. Sarah Palin, of all people, should respect the trademarked, copyrighted and protected images of other people, people far more famous than her, especially since she uses these images to raise money for her PAC.

    At the end of 2001, the Associated Press Managing Editors Association and Editor & Publisher magazine named it the best picture of the year. The photo was on the short list of photographs considered for the Pulitzer Prize.

    The use of the firefighter photo for profit became so rampant that by December 2001, the flag trio and The Record finally hired the New York law firm of McCarthy & Kelly to protect the paper's copyright and block unauthorized uses for commercial purposes.

    "While most claim to be donating all or part of the proceeds to the World Trade Center disaster charity funds, we are not confident that the revenue generated by the sale of these illegal products is actually finding a way to the families that have suffered," partner Bill Kelly said in a statement.

    One revenue generating venture was approved -- a "Heroes 2001" stamp issued by the US Postal Service with the Franklin image. President George W. Bush, as part of the six-month remembrance rituals of 11 March 2002, unveiled the stamp in the Oval Office. Franklin, Johnson, Eisengrein and McWilliams attended the ceremony.

    The stamps had a plus sign instead of a price. They cost 45 cents rather than the usual 34-cent first class price. The extra revenue was to go the Federal Emergency Management Agency; a little paid for Postal Service operating costs.

By altering someone else's work with her placement of her PAC logo onto it, Sarah is implying an endorsement of her PAC by the individual on the photo, especially those who are alive at the time she used their image or likeness.. At the very least, they will make her make a public apology, but for what? Because she is stupid? Selfish? Selfish AND Stupid? A Grifter of the Nth degree?       They're all in the hopper, already being processed. Her attorney has obviously told her that the only way to mitigate any damages is to get them all down ASAP.

      But after having had them up for several weeks, the damage is done already. The clock on the statute of limitations will begin when she brings them down on EVERY site.

      Still, bringing them down is the first step in complying with the instructions of a decent attorney. It also takes away any defense that you thought you were doing right. Obviously an expert business person AND a journalist would know that you ought to ask first before you do something stupid like steal somebody's property just because you might be able to get away with it. After all, isn't that why Sarah trademarked her own name?

    FYI, Sarah PAC seems to be making a habit of using the intellectual property of others without attribution, permission or compensation. For instance, a photo of Martin Luther King, Jr. was used in a similar manner earlier this year. For instance, it took me all of five minutes to search for the copyrights and ownership of the King photo, which was recklessly appropriated under similar conditions to yours. Perhaps a judge might consider that fact to be material in determining punitive damages for such a disregard for the property and copyrighted material of others, especially an individual who often touts her degree in Journalism! Additionally, if you are not aware, Sarah Palin has also has gone to great lengths to protect her own name. Sarah Palin is a registered US trademark, serial number 85-170,226. In any event, it seems that Ms Palin has a high awareness of the value of trademarks and copyrighted material, but is more careful to protect her own without concern for injuring the rights of others. These are just a couple of tidbits to give you the scope of understanding of a layperson here who has grown very weary of witnessing this individual grift off the treasuries of her state and our nation, while also taking advantage of the good intentions of so many. If there's anything I can do to help, don't hesitate to contact me. I have no interest in this situation financially, politically, or in any other manner other than a personal desire to see you folks made whole from the damages that Ms Palin has inflicted on your business.     Let's be honest about who is at fault here. Sarah's consultants, the ones being paid hundreds of thousands of dollars, probably hunt around the internet for a suitable photo, quotation, and write the facebook post. Then, they put the PAC logo on the photo, because that's what pays their salary. (I'm assuming that's there is more than one. It could be one dumb bunny, too). But, the person who is ultimately responsible is Sarah Palin because it is posted on her facebook. That's her name on it, and that's her name on the PAC. And the person who profits from the donations is Sarah. She also uses those posts promote herself. So, she is the one who benefits, even though someone else may have selected the photo, added the logo and written the post.

Ignorance of the law is no defense, especially for a National Political Analyst with a "Journalism" degree and her years and years of CEO-level Executive Management (Many more than the President!), and successful Entrepeneurial Savvy and Expertise in business operations that Ms Palin claims as her forte.

      The buck stops with the boss, and her name is on the PAC and its website, including her Facebook, both of which she is the primary benefactor. While she might not face any personal liability on behalf of the PAC (only fiscal liability for the PAC's assets), her own personal Facebook page ( the incredibly popular one with over (3.6 MILLION likes!!!) is possibly an entirely different animal, because she has a separate PAC site(s) from her personal Facebook.

    I'm so glad this got picked up! What's despicable is exploiting those who died and those who loved them on the anniversary of the attack, with her logo on it to raise money.

      That was wonderful, what Kate and william did for the DS girl. I have come to the conclusion that the reason Palin does nothing for DS fund raising is because too many questions would be asked. Too many people know the TRUTH, so she keeps Trig in the background, unless someone gets mad enough to tell the whole sordid story.     If the images were on her personal page in addition to the pac page then it is not just the pac that should be sued. The palins should be sued for damages up to and including emptying the pac and the value of both compounds and the plane. That should do it. Let em go live with bristle.       Like Fawn Hall hauling ass to the shredder for Traitor Ollie North, Sarah will be making a mad dash to destroy all the documentation. But that's okay. Everything is on multiple servers and besides, nothing disappears. And if a judge wants to see something that you destroyed to keep it secret and its incriminating, that just adds to the criminal nature of an activity that might otherwise be a damage claim instead of a tort. But people who steal intellectual property and put it out there for their "3.6 million " supporters (actually about 125K, but she's gotten a good deal on the rest of the names) aren't usually the sharpest crayons in the box.

I haven't been able to read but a few comments so far since I've been researching this issue and writing correspondence to the Licensors of Dr King's Estate.

    Just as North Jersey Media Group has been diligent in protecting its copyrighted material, I hope that IPM will be just as aggressive in protecting the licenses to Dr King's body of work and his likeness and all of the copyrighted material owned by his estate.

      Bravo! Right on! Even if the photograph of Dr.Martin Luther King Jr. is in the public domain, I doubt that his center wants his image to be used to solicit funds for Sarah's PAC. The placement of the PAC logo directly over his head implies that he is asking you to donate to her PAC. That is absolutely the wrong way to have honored him.

    Whew, I just poured the last glass of wine from that bottle. I was so happy to hear about the lawsuit that I spent 90 bucks on my dogs (includes $40 for dog food. I ain't THAT stupid) at Petsmart so I wouldn't feel guilty about taking them in the store and then dragging them out after 5 minutes, when we had a puppy-play dates arranged with a friend who has two pups that are the same size as mine and they're all big buddies. I was just throwing treats and nylabones and chewey stuff in the basket like they were closing the store forever. I think her dogs wanted to come home with us just for the goodies. Now I've got to ride up there again tomorrow or I lose my brownie points for unloading her 50lb dog food bag at her house for her. Since she weighs about 70 lbs, it's a big deal. No, actually that's her pit bull that weighs 70lbs and has a man-crush on my German Shepherd-something something Animal shelter rescue mix that weighs about the same as her Pit, but my Germie is a foot taller. Really I don't know what my friend weighs but she's lean and mean, and I'd rather not get punched in the neck (or the goulies, not that she would, but why risk it?).

    Last sip. Hey, I was just thinking. Isn't it a great week when Little Georgie Zimmerman and also too the Grifter- Quitter both palinize themselves? Haha. Damn right, that's a good week. Now onto the weekend...

    Well my hair is on fire. Just looked at Quitter Twit's Facebook page, and noticed her (her bots') Thursday post based on the AFL-CIO complaint that there is a glitch in the Affordable Health Care Act when it comes to some union health care plans. She totally misstates it, which is her right, but she might have taken care in using the picture.

    I assume she used it because she likes the about-to-give-the-mic-a-hummer pose, but what's with the 4 in the banner behind her, it doesn't appear in any other pics of that day and it is flopped (notice the 4).

    Also, the people on the right do not appear in any of the videos from that day. Most of the folk behind her were bussed in by the late Breitbart for the Tparty rally for the Koch toady Scott Walker and did not identify themselves as union folk.

    I suspect she might have rights to the left side of the picture, but I am not so sure about the right, where her hoof-print appears. Copyright bar members, Sarah's Facebook page could be a gold mine.
