A federal judge in Austin, Tex., blocked a stringent new rule on Friday that would have forced more than half of the state’s remaining abortion clinics to close, the latest in a string of court decisions that have at least temporarily kept abortion clinics across the South from being shuttered.
The Texas rule, requiring all abortion clinics to meet the building, equipment and staffing standards of hospital-style surgery centers, had been set to take effect on Monday. But in his opinion, Judge Lee Yeakel of the United States District Court in Austin said the mandate placed unjustified obstacles on women’s access to abortion without providing significant medical benefits.
The rule “is unconstitutional because it imposes an undue burden on the right of women throughout Texas to seek a pre-viability abortion,” he wrote.
Of course this is exactly what Wendy Davis was fighting against when she staged her 11 hour filibuster in 2013. Sadly however the Republicans and Rick Perry, have worked overtime to erode women's rights since that event.
This is how things would have turned out if the judge had not found the new restrictions unconstitutional. |
1. Texas GOP introduces anti-choice, anti-abortion HB2 Bill in the Spring of 2013
2. Wendy Davis holds a 13-hour filabuster in June 2013
3. GOP passes HB2 Bill anyway in July 2013
4. Planned Parenthood sues September 2013
5. Judge Yeakel strikes down abortion restrictions declaring them unconstitutional in September 2013
6. DU Greg Abbott appeals and wins in October 2013. Restrictions reinstated.
7. Judge Yeakel strikes down key abortion restrictions August 29, 2014 (see above)
8. Prediction: Greg Abbott appeals, but will he win?…
Of course electing Davis as the new Governor would change this scenario completely.
Come on Texas have you not yet had enough?
This is a victory for women but for how long?
ReplyDeleteIn the last election in Texas only 5.7% of the population voted. They are last in the Nation in % of voter turnout and next to last in voter registration. There are more registered Democrats, but they don't vote.I can Not imagine less that 6% of people voting. That's absurd. In Australia you are fined in you Don't vote.
ReplyDeleteI just love her!

Good news for all of us...
ReplyDeleteSarah hasn't been on Fox News since July 21. That's SIX weeks tomorrow. Her Fox contract must have ended when she started up her private blog.
The ONLY reason this "law" passed is because asshole Perry called a SECOND special session to force...just as a rapist does - his dick down where it's not wanted, even after Wendy's successfully filibuster. Perry... you are toast and so is your unconstitutional rape "law" upon women across this state. I hope you're someone's prison bitch, soon, Perry. Very.Soon.
ReplyDeleteCom'on Texas Ladies, there's just way too much oil and testosterone down there. Y'all need to clean out the (legislative) house and put Wendy in the Governor's seat. (For the record, I graduated from UT-Austin 1971. Hook 'Em!)
ReplyDeleteI guess I should not have been surprised, but when I clik on any posting on Facebook about Wendy Davis, the comments section is chock full of horrendously obscene things about her.
ReplyDeleteThe Republicans are pushing for the easily misled to believe she's actually the Biblical Whore of Babylon, come to prominence, just as predicted in Revelation.
Sadly, one in four of this kind of hate spewing is coming from other WOMEN. (I have a suspicion it stems from Wendy being quite attractive.)
I fear this is only a slight taste of what we'll be seeing when we get to the point where Hillary Clinton declares, and begins her campaign.
I saw a "discussion" about this on one of the news shows. To make them comply to full medical clinic status costs from 20 to 40 grand, and it would do nothing to ensure a woman gets a safe abortion in a sterile environment. The "pro life" "lady" kept talking over the young lawyer involved on the abortion clinic's side of the case. She was so livid she could spit, and she made his case for him as he spouted off facts and that it's purely a political ploy.
ReplyDeleteYes, ladies and men of Texas, please vote for Wendy, she's got your back on Abortion, Family Planning and Equality under the law.
I've never seen a study done on this, but I suspect if they asked 1000 people if abortion is illegal, at least three quarters would say yes.
DeleteThankfully, there's no one like a judge that understands the need for abortion.
ReplyDeleteI understand it sounds callous, and it can be- but poverty and crime go hand in hand. And unplanned, unwanted children often speed the descent to poverty, as well as bearing the brunt of the impact of poverty.
