Kentucky county clerk Kim Davis loses in court, but kinda wins at the ballot box.

Kentucky County Clerk Kim Davis has lost another bid to delay issuing marriage licenses to same-sex couples. 

The Sixth Circuit U.S. Court of Appeals on Thursday denied her latest request for a reprieve.

So according to the courts Davis has to issue marriage licenses even if she thinks that by doing so the same sex couples will drag her to Hell along with them for all eternity.

Bummer.

But wait, all is not lost. Here comes newly elected Governor Matt Bevin to save the day: 

Republican Kentucky Gov.-elect Matt Bevin said he plans to sign an executive order removing county clerks' names from state marriage licenses in the hope of avoiding more controversies like the one that arose a few months ago when Rowan County Clerk Kim Davis refused to issue marriage licenses to same-sex couples, Reuters reported. Bevin will be sworn in to office Dec. 8. 

In his first media availability since the win Tuesday, Bevin said he hopes the executive order will protect the religious beliefs of officials who are opposed to gay marriage, WLKY reported.

So to be clear,  Rowan county will STILL be issuing marriage licenses to everybody, gay, straight, or bi. But now they will be issued without the name of the county clerk on them. And somehow THAT makes everything alright with Davis and her whackadoodle religious beliefs?

Got it.

Nice to see this Bevin guy come right out of the gate pandering his ass off to the crazies.

You know that does not bode well for the people of Kentucky. 

Of course what can you expect from a guy who got the Sarah Palin seal of approval

    That picture just kills me. You'd think Davis won an Academy Award for best actress or some other fucking thing. Rarely have I seen, as of late, such a contemptuous expression of gleeful hatred and ignorance. She would do well to remember--as many Christofascists seem to forget--that not all sins go unpunished in this life.

If she gets an inoperable malignancy, it won't be her Jesus 'calling her' to sacrifice and humility, it'll be something gays and liberals caused by putting her 'righteousness' to such stress, or even outright inflicting on her with witchcraft.     Frankly, I don't care if her signature is on it and, if I were gay, I don't know that I'd want hers on it. Some might for "in your face, witch" purposes, but gay friends I have known are a peaceable group and just want equality. I fail to see the harm in that. Bitch on, x-tian Kim.

    It has been pointed out on another site that the Governor cannot legally remove clerk names from the form with an Executive Order. It must be done by the legislature.

If when Mr. Bevin becomes Governor he's going to change the text on state marriage licences, wouldn't it be simpler—and more straightforward—to just have it say that the issuing authority has determined that the legal requirements have been satisfied? Anything in the current text implying that the issuing authority personally approves of the marriage should of course be removed.

    I think Kim Davis is wrong. and sincere. and misguided. I personally don't think she is necessarily mean or hateful (although I do agree her actions are hurtful. I don't know her well enough to know if she is a mean or hateful person. I just know other people who are generally kind and generous, and IMHO very misguided on gay marraige). If taking her name off the marriage license allows her department to issue marriage licenses that are perfectly valid, and as valid as every other marriage license, and identical to heterosexual marriage licenses, who cares whose signature is on the paper.. I dont' think it helps equal rights to shove it down her throat. Lots of people who used to be against gay marraige have change their minds. Usually this happens when given time and space to reconsider, and not bludgeoned and put on the defensive. Sometimes victory comes without being called "the victor." I dont' see what is gained by insisting her signature go on the marriage licenses.. Eventually the county will accept gay marriage and will Kim and others, and their position, will be part of history. Allow the water to seep up through the sand and pull down those against gay marriage, rather than meeting resistance with resistance.

      BTW, this isn't to suggest that the oppressed should "be patient." That isn't right or fair. In this case, there is a solution that doesn't require patience, and doesn't require force. Of course she should have issued the licenses yesterday and the day before and the year before. And perhaps live with the consequences of her decisions (civil disobedience isn't about getting out of the consequences) But the licenses will go more smoothly for everyone if her signature is removed.       She is not—and never has been—required to signify her personal approval of any particular marriage. What does have to be impressed upon her is separation of church and state. A state-issued marriage licence is not a religious document … but she is trying to have it perceived as one. However sincere this misrepresentation is, it remains misrepresentation.

      I agree. It's a misrepresentation. A civil document is not a religious document. She should have issued the licenses a long time ago. She should have to live with consequences of her actions of civil disobedience, although I'm not confident the people who elected her, and those around her will require her live with the ramifications of her choices.

      In the meantime, if taking the County Clerk's signature off the marriage license for all people smooths things out, I'm not sure it's worth the fight to insist she sign the form if the alternative is just as valid. Lucy

      But somebody has to sign off on the checking of the legal requirements. Otherwise marriage licences could simply be dispensed by a vending machine. Her declared "oppression" is based on her assertion that she would be attesting to something more than is really the case, namely that the wedding in question also satisfied the requirements of her individual beliefs.

      I don't disagree with you that her signature is merely ministerial and an obligation of her office, and not an affirmation of gay marriage.

      I believe the governor-to-be (unless the election is called a fraud) has said he will take off the requriement for CountyClerk's signature, statewide, and the license will still be valid. That's what I am supporting. If I have my facts wrong, I might retract what I've said. Lucy.

      I didn't read you carefully enough. As I understand it, Kim is willing for somebody else to check off the legal requirements and it's just a shifting of responsibilities that are perfectly legal. Happens all the time in offices.. Her only objection (unless she comes up with something else) now is her signature on the document. Lucy

      There's more to running the County Clerk's office than issuing marriage licenses. She'll be doing other things required to run the office.

      Authority, and work, can be delegated, but not responsibility. As the person in charge, she is responsible for ensuring that whoever checks the requirements has been properly trained, knows what to check and how, doesn't do a sloppy or biased job, etc. That's her responsibility as long as she draws that chief clerk's salary, whether her name appears on the license or not. All her other duties as well, of course.
