Bristol Palin's ex-fiancé Levi Johnston has come out swinging in the latest round of their long-running, bitter custody battle after she claimed he owes more than $80,000 in unpaid child support for their son.
Johnston filed court papers on January 26 pleading with the judge to reduce his payments for seven-year-old Tripp.
In court papers seen exclusively by Daily Mail Online, Johnston, 25, claims his earnings have dropped since a temporary child support order was granted in 2010.
That order had been based on his estimated income which was in excess of $100,000 - and now he claims he makes nowhere near six figures.
Johnston was ordered to pay $1,750 a month for Tripp to a then 20-year-old Bristol.
My understanding is that the courts could not address the child support until a child custody agreement had been hammered out. Now that the first part is finished now comes the part that Bristol REALLY cares about, getting paid.
Part of the problem of course is that Levi was betrayed by his former lawyer Rex Butler, who not only did not represent him adequately but seems to have sold him out at every opportunity.
So now Levi is left try to explain how he got into this mess, and the reality of his life as it is today.
Of course he cannot afford to pay $1,759 each month in child support, there are very few electricians working in Wasilla who could.
And even if Bristol really wants all of that $80,000 that she feels she is entitled to, I think that after Levi shows his pay stubs and tax info the judge will recognize that it is and obscene and punitive amount.
However like I said this is really only a minor concern for Bristol at this point the far bigger concern has a name, and that name is Dakota Meyer.

And Bristol's feud with Levi is not the only custody fight that she is currently embroiled in; the Alaska native and daughter of former vice presidential candidate Sarah Palin is also caught up in a battle with her ex Dakota Meyer, the father of her daughter Sailor.
Medal of Honor recipient Dakota is now being forced to take a paternity test as part of the former couple's increasingly bitter custody battle over her new baby.
Court documents seen by Daily Mail Online reveal that Meyer's bid for joint custody in a suit filed in Kentucky and Alaska has stalled pending the results of the paternity test. A question has also been raised over the actual birth date of Bristol's baby.
The Instagram photo posted by Bristol announcing the birth of Sailor on December 24, places the birth date one day earlier. The date of birth on court papers filed in the custody case is also given as December 23.
But the same Instagram picture posted by Dakota with the caption 'Best Christmas present ever!!' reveals a detail whited out in Palin's account – the date scribbled on her IV line.
There, in black and white, is a date that appears to read November 4 – placing the birth almost two months before Bristol claimed.
Yeah like I said, FAR bigger concerns.
Once the paternity results are released and Dakota is revealed not to be Sailor's father, Bristol will be certified as an official slut.

DeleteIt's an interesting question as to what will happen if the paternity test results show what we widely suspect, that Dakota is not the father of Sailor. At that point, there would be no need for Dakota to go forward with his custody suit since he's not the father. While there may not be an announcement, per se, the termination of the suit by Dakota and his attorneys would certainly speak volumes about the paternity results.

FYI, you don't need credentials to get copies of public court documents. Anyone can go to the courthouse and get copies (provided you pay for them). The idea is that the child should live in the same manner/lifestyle as he or she would if the parents were together, so if one parent earns substantially more than the other, that parent contributes to the other's household as child support. That's the case with a neighbor, whose wife gets $600 per month for child support even though they share 50/50 custody.

Unless there are provisions in state law determining that in addition to wages, other types of income such as investments can be included when calculating support obligations, Bristol could make her income appear to be far less than it is, which of course would hurt not only Levi, but also Tripp.
DeleteOne other thing, child support is not meant to only provide direct support to the child in the form of consumables like food and clothing. It is also intended to enable the parent to maintain suitable shelter for a child. For example, enable a parent to pay for the rent/mortgage, taxes, utilities and so on for a home with more than one bedroom.
The intent is that the child to the best extent possible can maintain a similar standard of living as when the parents were together.
Whether the $1760 ordered years ago was reasonable at the time, I have no idea, but whan a parent's circumstances change drastically, a child support case can be re-opened.
BTW I happen to know many union electricians, none of them are paying that kind of support for their kids. That average is about $500 for one child.

As for Levi, he was young and impressionable; now he's older, married, has a regular job, and obligations. No judge will make him pay you all that money without investigating how you've had a house, now another, a boat, trips to here and there, designer clothes, a new truck -- all on your stated income from your very part-time job. Cash payments from your mother can't exceed $13,000 a year without her having to pay tax on it. We know she hasn't. Both you and she are going to be in hot water, with the family court and with the IRS.
You'll have to get a real job, 40+ hours a week, and live like any other single mother supporting two children. When that happens, don't complain. It's the result of your spoiled, uneducated self that has put you where you're going to be.
The manipulative born-again-virgin-valley-ho needs to be forced to take the DNA test too because she might just switch the baby when they come to collect the baby's DNA. Just saying, Medal of Honor should be prepare for manipulation and obstruction of justice by the Heath'n Palins.

DeleteApparently reality tv shows really have a gray area when it comes to child labor laws since they are considered more of a documentary. Bristol may have gotten all the money and Tripp none. The courts need to look into that when considering child support. if i was Levi i would be asking if Tripp received any money from Barstools reality show and if so what happened to it. But boy did he grow up and better than a lot of great guys. Works hard, loves and respects his wife and madly in love with all 3 children. It seems like when a child is born you do one thing after getting the birth certificate and that is getting a social security card. I'm pretty sure you need to have the correct date of birth when applying for one of those. And all this bullshit about HIPPA laws are totally ridiculous when it comes to Palins trying to continue their lavish lifestyle by using a birth as a paycheck every month for the next 18 years. What a way to make a living!!

ReplyDeleteIf Dakota really thought that he was Sailor's father, why hasn't he been up to Alaska see Sailor? He is the one who sued for custody. That was a neat way of getting the court to order a DNA test. As a MOH recipient, he has to protect his image, and he does need to know if the photo that he got Bristol, showing the 11/4/2015 date on the IV was an accident or a well placed clue. We also don't know what kind of confidentiality agreement Sarah and her lawyers had Dakota sign.
