Trump supporters file lawsuit claiming Ted Cruz is not a natural born citizen and therefore cannot be President.

Donald Trump supporters have filed a lawsuit challenging the eligibility of one of his primary rivals, Sen. Ted Cruz (R-Texas), to run for president. 

The lawsuit, filed Feb. 3 at a district court in Alabama, seeks a judgment “declaring that Rafael Edward Cruz is ineligible to qualify/run/seek and be elected to the Office of the President of the United States of America” due to his Canadian birth. 

Cruz was born in Calgary, Canada, to an American mother. 

Several of the five plaintiffs — Sebastian Green, Shannon Duncan, Kathryn Spears, Kyle Spears and Jerry Parker — are backing Trump in the Republican primary, their attorney, Thomas Drake, told The Hill, although he said others are still undecided. 

 "The only thing they can agree on is Mr. Cruz is not eligible to be president," Drake said.

Gee I wonder if Donald Trump has a team of investigators in Canada who "cannot believe what they're finding."

      Even if all of other factors are in Cruz's favor (his mother never renounced her US citizenship, etc.), if a CRBA form was not attached to Ted's birth certificate, he is not a natural born US citizen.

      "A child born abroad to a U.S. citizen parent or parents may acquire U.S. citizenship at birth if certain statutory requirements are met. The child’s parents should contact the nearest U.S. embassy or consulate to apply for a Consular Report of Birth Abroad of a Citizen of the United States of America (CRBA) to document that the child is a U.S. citizen. If the U.S. embassy or consulate determines that the child acquired U.S. citizenship at birth, a consular officer will approve the CRBA application and the Department of State will issue a CRBA, also called a Form FS-240, in the child’s name."

      8:02, Ted is not a natural born US citizen if his parents failed to file for a Consular Report of Birth Abroad or obtained a valid passport at the time of his birth. This can not be done retroactively. This is a time-frame involved to obtain either of these two things. Cruz has not produced the evidence.

    If Ted panders to Trump, then Trump will ignore the law, but if Ted dares to call it like it is, Trump will exercise the law.

    One thing in this whole fight (between Trump and Cruz), I find that Cruz is an utter wimp in defending himself. He thinks showing restraint and smiling and suppressing any anger towards Trump's accusations is a 'he shoots, he scores!'

    What is Cruz so afraid of? Why doesn't he fight back? He has no problem using sly tactics with others. He is a real weasel. But, with Trump, he runs to the dog house with his tail between his legs.

    ...Maher marveled at how ridiculous the claim is. Maher pondered what exactly an America with a 40% unemployment would look like.       Yep, Trump is in sync with leaving the the Army Sargent son to oversee all the weapons and arsenal strewn about the property at 1140 W Parks Hwy. It is their constitutional right to think an Army Sargent is the one who is a good caretaker for weapons and all the ammo. An Army Sargent would know top gun safety. Trump would be proud and respect the Palin judgment when it comes to having the weapons you need to hunt for food and protect yourself. Trump and Palin are like one and the same.

      I can't believe the media is not asking Trump more about important matters like home safety and guns.       I saw Tad Devine get grilled over this as to why the Sanders sampaign misrepresented the photo. Devine stated they removed the caption, falsely identifying the photo as Sanders, from their website. Devine further stated that they are using this photo as an example of protests at the time, not an example of Sanders per se.

      Facts are indeed easy to find and the most recent news about this photo is that it is Sanders. Here's video of Jeff Weaver, Sanders' campaign manager, telling Jim Sciutto last night on CNN that they are certain the photo is Sanders. The photographer confirmed the photo is Sanders.

He gave Time other pictures he took right before the photo in question that show Sanders sitting on the floor in the same room in the same dark sweater. University of Chicago has changed the caption of the picture back to Bernie Sanders.

      You'd have to ask the Sanders campaign about what they do with pics on their website.

      There's no question the assertion of the photographer who was there who has photographic evidence (time.com link above) from the same day showing Sanders in the same clothes, carries substantially more weight than what the ex-wife, who admits she wasn't there, says she believes from looking at a picture. He's an eyewitness. She's not.

      According to the original Time article from Nov, Sanders was sure it was him.

And as another poster pointed out, with this eligibility thing he's not even basing it on moral grounds--it's a big "if" and he'll do this or do that if someone doesn't conform to what he wants. Well, there was already a ruling a while ago saying that Cruz is a viable candidate. Given how that matter was determined, Trump will have a hard time trying to get other states to side against Cruz. I'll paste in a link. people can also, if interested, look up articles on Mitt Romney's dad and how it was determined that he, who was born in Mexico (it was not the same kind of situation as McCain's) was able to run for pres.

  25. This is not decided law by the Supreme Court, although, similar cases have inferred that Cruz is not eligible. So take it all the way to the Supreme Court Trump and lets settle this once and for all.
