In a stunning blow to the explicit wishes of Bristol Palin that she be awarded primary interim physical custody of daughter Sailor Grace and that Dakota Meyer only be allowed 'reasonable' visitation and no overnight visits, an Alaska Superior Court Judge has ruled that the couple must share both legal and physical custody.
In explosive court papers seen exclusively by Daily Mail Online, Alaska Judge Herman G. Walker Jr. has decided that it is in the best interests of Sailor Grace, born last December, to remain in Alaska for the time being. But Meyer will be able to make the 3,600 mile trip from his home in Kentucky to Alaska twice a month for four consecutive days each.
'The mother objects to overnight visitation because the child is currently breastfeeding nightly,' said the Judge.
'However the court finds it in the best interests of the child that overnight visitation [with the father] occur. Mother is to provide father with an adequate supply of milk or formula for overnight visitation.'
Meyer's visits with his daughter will begin this month. Overnight visits will begin in May.
Well this is awkward.
Here Bristol thought that the whole breastfeeding thing would help her to keep her daughter away from Dakota, instead the judge has ordered her to milk herself like a dairy cow in order to accommodate him.
However since we know that Bristol lied about the breastfeeding now she will either have to admit to Dakota that she is full of shit, or Sailor will suddenly be weaned off of breast milk before his first overnight visits in May.
Well I am going to have to say at this point that Dakota must have been convinced by that DNA evidence that he is indeed the father, so now instead of accusing Bristol of lying about the paternity I guess we can simply focus on the fact that she purposefully got herself pregnant in order to trap a Medal of Honor winner into marrying her.
I am not sure that makes her look any better actually.
Update: I think this demonstrates Bristol already trying to fudge facts in order to cover for her lies.
I think she is going to get found out.
She doesn't want visitation but she definitely wants money for medical bills, interim support and regular support. She pops out babies like a gum ball machine, looks for money, then complains about "takers" by posting the Bernie sign. Classic.

There is no photoshopped DNA result, because no DNA result has been released. What was released is Bristol's Answer to Dakota's petition in which she referred to a DNA result.

The Palin's have tried to make it appear that Dakota met Bristol while he visited Alaska for Sarah's stupid AA show but Bristol wasn't in Alaska at that time. They met the night of the Shot Show in Vegas, late January of 2015. She got pregnant the first night they met, proposed to the star-struck MOH once she found out she was preggers, mom bought a ring and planned a wedding complete with a professional photographer to document the lies, and it backfired. So all the lies are designed to protect Bristol's image and reputation thereby protecting Sarah's grifting ability (which is really what it's all about). Nasty family.

DeleteIt is impossible to legally force a non-breastfeeding mother to breastfeed. They are more likely to want to get to the truth about why she keeps 'changing her mind'. It is more realistic to say she keeps changing her lies. The sooner that is revealed the better for everyone. Bristol is stuck believing she is the star of a fabulous popular reality TV show.
Don't forget this is the legacy Bristol is giving her daughter. Sailor may learn to read if she can go to school in Kentucky. She will learn one day all about her mother's lies and how her mother did not think about her at all. Drugs will do that. Plus some mothers just do not have a heart.

The court will not take an infant from the parent it has resided with from birth and send it to live with the other parent in another state unless something drastically is wrong with the parent with physical custody. Like arrested for murder, drug dealing, parent is proven in a court of law to be unfit. Bristol is not unfit under the law, no matter what you think. But with joint physical/legal like Sailor's parents have will result in a long distance parenting plan. I have 2 family law attorneys as friends. You can look on any legal forum to find out the same thing I posted.

7.49, according to the documents, Ms Palin made the decision to remove herself to Alaska. Had she married Mr Meyer, the baby would have been born in Kentucky. Since Mr Meyer had no say in her returning to Alaska, the court might take that into consideration at a future point.

DeleteWomen can't turn off their breastmilk during the day and turn it back on at night. If she's breastfeeding at night, her breasts will fill up periodically during the day, too. She either has to pump or nurse.

If that's what she's doing, then it won't matter because the baby will be off the breast completely very, very soon.

Let's not forget that Bristol told the Daily Mail they had worked all this out and "agreed to more limited access instead." They reported that just yesterday! That didn't sound plausible, because the briefing for the motion went forward (Response and Reply). If they had agreed, the docket would have shown a stipulated agreed order. Turns out it was just typical Palin lies, making it appear that Bristol was still in control and keeping that mean-old Dakota Meyer in his place. Karma, Bristol. Karma.

ReplyDeleteIt's not 50/50 physical custody. According to the Alaska formula, Dakota will be obligated to pay a large sum. There will be extra on top of that for Sailor's day care and medical insurance. The formula could crank out a cs obligation of 2k, as Dakota does not have enough overnights yet to make much of a dent.
DeleteHowever, some courts have leeway to do travel-cost deductions. Since Dakota is paying fo travel to, during, and from his parenting time, twice a month, the court could deduct at least half of his travel, which could be a 1k deduction.
It's going to be interesting to see if Bristol really argued against 50/50 joint legal custody. I cannot imagine a lawyer agreeing to that nowadays if the other parent is an adult of sound mind, which Dakota clearly is. Initial media reports stated she agreed to it but "would have the last say if there was a disagreement." (Lol that's not shared legal custody.) Dakota had to waste time responding, and it looks like the court ruled for joint legal custody. That doesn't impact the amount of cs, but it may make it so Bristol has to complete the financial affidavits, which could be embarrassing to her.
Likewise, joint legal custody means if Dakota says "Do not publically publish Sailor's photo unless I agree," that's how it's going to be. I sure hope Dakota seeks this prohibition. There are some celebrities which post photos of their kids and many of the comments are so cruel - horribly critiquing a toddler's / child's looks. And those comments last the life of the Internet.

Breast feeding only at night? That's not how it works. The baby nurses, taking lots of milk from the mother-- which stimulates the breasts to produce more milk-- which the baby takes from the mother--- stimulating more milk production. It's not like a faucet that you can turn on at night time. Bristol's excuses sound like her mother's attempt to sell us a Wild Ride story. The facts get in the way of the Palin Fiction.
DeleteIt is possible to breastfeed only at night but it is quite messy until your body gets accustomed to producing milk only then. It works best after 5 or 6 months of breastfeeding. I can't imagine Bristol would have the patience or the desire to do that.
DeleteBy the age of a year, when the baby is drinking from a sippy cup and eating solid food on its own, a mom may breastfeed for comfort at the beginning and end of the day. By then, of course, it's not necessary for nourishment.

ReplyDeleteBTW, one can infer that Bristol's "unsigned affidavit" (which has now been filed signed) said she breastfeeds at least every 4 hours. The reason we can infer that is that was what was reported to be her reason for requesting a different schedule. An affidavit is a sworn affidavit under oath. Dakota's text saying she only breastfeeds at night (which I doubt she even does that) likely shows Bristol submitted a perjured affidavit to the court. If her attorney knew she was not breastfeeding during the day, he suborned perjury.

I think you are onto something, 7:48. Otherwise, why was a text admitting only breastfeeding at night submitted to the court? Normally, very very few exhibits are submitted to the court. Most of the arguing occurs in letters back and forth between the lawyers, few of which are filed with the court. Necessary exhibits to bother the court with are medical and daycare receipts, financial affidavits, paternity findings. But not ridiculous texts. Courts hate anything filed which is not pertinent. So why the heck did those texts get filed with the court?

I went through a custody action and the only affidavit I submitted were my financials. But I don't think that is what Bristol filed, unless Alaska Courtview doesn't label the financial forms as such, like they do with all of the other motions and orders. Plus it's a little early for Bristol to have done that, as the actions before the court were legal custody and physical custody.
Also 7:48, if Bristol is caught in a lie to the court, a lie deliberately made to hamper Sailor's right to bond with Dakota, then Bristol may have to reimburse Dakota for his attorney fees. And maybe even costs associated with that late Feb trip he took up to Alaska for his parenting class - and yet still couldn't see Sailor.

Had the Meisner's left the guns out of cases they would have handled them different. Definitely Sarah Palin is right about home gun security on this one. The court in Alaska will back her up and her son will be able to go on handling guns in the Palin fashion. Carry conceal too.
I don't think there is a court ordered or legit DNA test. Dakota is fine carrying on with this performance without that. He may want a baby and this works for him. He can be the legal father if the court so states one day. He may be paid off. He may be giving her plenty of rope. For now he has the temporary custody he wants.

ReplyDeleteIt's great that you've let go of the DNA doubts, which were starting to seem like a particularly sad conspiracy theory a la Obama's birth certificate, but I don't think you've gotten all the way there yet. Bristol MAY have been trying to trap Meyer by getting pregnant, but her behavior more strongly supports something a little different: that she was fucking multiple guys and truly did not know who contributed the winning sperm. She wouldn't name the father for all those months she was pregnant, she resisted a DNA test, she may have tried to settle with Meyer without said test, etc., etc. These are not the actions of someone who knows who her baby is going to look like.
I have no idea if she faked the birth date, but if she did, it would suggest lack of certainty about paternity. If she didn't, her reticence about naming Meyer as the father speaks volumes about the non-exclusivity of her sexual favors (ugh, I vomited in my mouth typing that last word) even after becoming engaged to him.
Bottom line: you can't go wrong assuming Bristol is a ho, because her pattern of conduct uniformly supports that.

I still think it is wrong to separate an infant from their primary attachment figure for 4 consecutive days. I don't care who the mother is unless she is a danger to the child, and this one isn't. Babies have different developmental needs than older children, and this is not healthy for them. Parents rights should never trump the well being of the children. This a bad decision, regardless of all the shadenfreude felt here.(sp)

This judge obviously does not want to create the terrible situation for the child that the other judge created for Tripp and his father - a situation that lasted for seven years.

Is she admitting to not breastfeeding during the day, as we've all pointed out because her pictures don't suggest that she does breastfeed? Or is Palin objecting because she thinks Dakota will insist on having Sailor sleep in the same room as he does and this will mean that Bristol has to come in to feed? The problem is that Bristol is not doing good when she keeps a father form his child, or worse, if she lies about the paternity and birth of the child. Bristol lied about a rigorous schedule of breast feeding when she also said that she leaves Sailor with a sitter all day while she works as a dermatologist. Lying is not doing good, Bristol. Running away to Hawaii to escape a court ruling isn't good, either.
Wouldn't it be funny if Dakota stayed with Levi and Sunny when he came for his visits to Alaska?
