Alaska Supreme Court rules parental notification for abortion to be unconstitutional. Yay, Alaska!

The Alaska Supreme Court on Friday struck down a state law requiring parental notification for girls under age 18 seeking abortions, agreeing with pro-abortion rights advocates that the mandate approved by voters in 2010 violates the constitutional rights of underage abortion seekers. 

Justice Daniel Winfree, writing for the majority, said the court was not deciding whether abortions should be available for minors but that the abortion notification law violated Alaska's constitutional equal protection provisions giving the same rights to all Alaskans. 

In a concurring opinion, Justice Dana Fabe disagreed that the law violated the girls' equal protection rights but said she believes it violates their right to privacy. 

"I believe that the Alaska Constitution permits a parental notification law, but not one that contains provisions that are among the most restrictive of any state's notification laws," she wrote. 

Yes we are a backwater barely civilized group or neanderthals up here most of the time, but once in a while we get one right. 

Considering how few and far between progressive victories are up here I am going to celebrate the crap out of this one.

    Good for the court. Even though such laws do not affect me personally anymore (older than dirt), the restrictive legislation propped up by Prevo and his ilk, made it easier for me to leave a state I'd spent over 1/2 my life in.

    Very good news. Continue to keep an eye on Minnery and his minions attempts to take apart the Judicial council. They are already trying to pack it with their right-to-lifers.

      Do watch out for a man like Minnery who is nothing more than a bastard as far as I'm concerned! What fucking right does he have in trying to control a woman's body? Just hearing his garbage makes me want to get in his face and slug the shit out of him! These men do NOT control our reproductive rights and decisions.

      Girls who have been involved in incest think he (and men like him!) is/are fucking nuts! Abortion saved my life and I'd do it again! Thank God I could get one and have the matter kept quiet back in the very late 50's!

      And, I've never once regretted having had it done! There is no way I was bringing that child into the world - it would have ruined both our lives and that of my extended family. The exposure of the incest - back in those days - would have been horrid to experience. I could not imagine shining light on the subject of 'incest' then! It was the late 1950's! Incest was never openly discussed or made public by anyone back then!

      I have always supported abortion - have helped others obtain them and will continue doing so if I'm called on to help!

      The religious folks are WRONG about this issue! The majority of women I know have never regretted having had their procedure. I know that I've never looked back! A fetus was aborted, not a child!

      So is mine, I have lived for thirty years unable to forgive myself.
      Don't be so quick to volunteer to help others. For some it is a life of torture. Truly, mans war on women.
      It is no longer 1950, people have no reason to be ashamed that they had intercourse.
      When you see a heartbeat, it's a baby. Lucky for you, to be able to convince yourself otherwise.

    I remember, Sarah Palin and Jim Minnery had a falling out over this after she dudded him.

    Minnery will be back again and again until he finds something that the court can agree on. Somebody should expose him, he has way too much political power in Alaska.
