FBI will not recommend charges against Hillary Clinton over e-mail server. Update!

The FBI won't recommend charges in the Hillary Clinton email server investigation, agency chief James Comey announced Tuesday. 

"No reasonable prosecutor would bring such a case," Comey told reporters. 

Federal investigators did not find evidence of intentional wrongdoing, he said — but there is evidence the presumptive Democratic presidential nominee and her staff were "extremely careless" during her tenure as secretary of state. 

Comey said 110 emails sent or received on the Clinton server contained classified information. He also said it's possible "hostile actors" gained access to the server.

From what I am hearing this does NOT exonerate Hillary completely over her carelessness in using the server, but it does remove any possibility that she will be indicted.

There is still plenty for the Republicans can use to attack Hillary's judgment, but since they are running Donald Trump as their candidate it works to undermine that argument.

Speaking of Trump this is how he responded to the news.

Later today Hillary will appear on stage with President Obama.

It will be interesting to see if they address this or not.

Update: Here is a more detailed report on FBI Director Comey's statement:  

"Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case," Comey said in a news conference. 

"In looking back at our investigations into the mishandling or removal of classified information, we cannot find a case that would support bringing criminal charges on these facts," he added.

Sounds like what I kind of predicted all along.

Yes she made a mistake in judgement, no it is not something for which she can be prosecuted.

Despite what Bernie Sanders supporters and Republicans might want to believe.

Update 2: And another question answered:

A spokesperson for Sen. Bernie Sanders (I-VT) reportedly told media outlets Tuesday that the FBI's findings on the investigation into Hillary Clinton's server use wouldn't impact Sanders' decision to stay in the race for the White House.

Of course it won't. Wish I could say I was surprised by this, but I'm not.

    Comey was very descriptive of the investigation, and I really felt he went way above and beyond what I expected. He gave Clinton a public lashing up there about being, at best, incredibly reckless with confidential information that any reasonable person in those positions would have taken better care. He pretty much said she wasn't a reasonable person capable of assessing whether the information should be shared in a non-sanctioned server whether marked or not.

      Not making excuses but there are two issues here:
      1) most people are clueless about technology and security. How many times have you heard people give their credit card info over a phone in a public place? Or shop online from a public server.
      2) In order to protect against #1, there should be clear guidelines for government electronic communications. But technology moves very fast and government is hopelessly tangled in indecision so that it can't possibly keep up.

They couldn't go after Clinton because there were no laws broken at the time because there weren't any in place other than those who knowingly shared classified info, as in Petraeus.     Interesting that no mention of prior use of private email accounts by Powell and other right and left wing folks - Dean, Jeb Bush (also used personal server), Jindal, Perry and Rice. Both Rice and Powell had classified messages on their private email accounts.

    Powell said it was difficult to get the state department to install an internet-connected computer installed in his office and he used his personal email account from it.

    However, Comey also explained that there was absolutely no evidence that those emails had been deleted as an attempt to cover anything up. He even explained the process by which her lawyers would have unintentionally deleted emails they should have turned over. This may sound like he was defending Clinton but he was simply explaining the process that led the FBI to their conclusions that no criminal actions were taken.

    Comey also explained that while there is no direct evidence that Hillary’s servers were hacked, they were definitely at risk and there is no way to know that they weren’t hacked because of the way the system was set up. That might sound like splitting hairs but it’s an important distinction. If the proper precautions had been taken, it would have been easier to definitively know if something had happened.

    USA Today reported:
    In 2006, when a judge ordered Donald Trump’s casino operation to hand over several years’ worth of emails, the answer surprised him: The Trump Organization routinely erased emails and had no records from 1996 to 2001. The defendants in a case that Trump brought said this amounted to destruction of evidence, a charge never resolved.
    At that time, a Trump IT director testified that until 2001, executives in Trump Tower relied on personal email accounts using dial-up Internet services, despite the fact that Trump had launched a high-speed Internet provider in 1998 and announced he would wire his whole building with it. Another said Trump had no routine process for preserving emails before 2005.

    Judge Jeffrey Streitfeld was stunned. “He has a house up in Palm Beach County listed for $125 million, but he doesn’t keep emails. That’s a tough one,” he said, according to transcripts obtained by USA TODAY. “If somebody starts to put forth as a fact something that doesn’t make any sense to me and causes me to have a concern about their credibility in the discovery process, that’s not a good direction to go, and I am really having a hard time with this.”

    Trump brings up Clinton’s emails during every speech. The Republican nominee is fond of saying that Clinton should go to prison for her use of private email, but it turns out that Donald Trump has been destroying emails that were related to court cases that he was involved in, a.k.a. evidence, for years.

    Donald Trump willfully and knowingly destroys evidence in legal matters, but Republicans want voters to believe that Hillary Clinton is the criminal. Congressional Republicans have spent years trying to dig up something on Clinton’s emails only to have their party nominate the one person who has no credibility when it comes to emails.

    Trump destroyed the only argument that Republicans might have had against Hillary Clinton as life with Donald Trump continues only to get worse for the GOP.

    FBI Director James Comey made a point in his statement to kill another Republican conspiracy about Secretary Hillary Clinton. Comey said they found no evidence “that any of the additional work-related e-mails were intentionally deleted in an effort to conceal them.”

    “I should add here that we found no evidence that any of the additional work-related e-mails were intentionally deleted in an effort to conceal them.”

    Instead of a deliberate effort to hid her emails, the FBI found, “like many e-mail users, Secretary Clinton periodically deleted e-mails or e-mails were purged from the system when devices were changed. Because she was not using a government account—or even a commercial account like Gmail—there was no archiving at all of her e-mails, so it is not surprising that we discovered e-mails that were not on Secretary Clinton’s system in 2014, when she produced the 30,000 e-mails to the State Department.”

    So while they found emails that were not turned over, the FBI found no evidence that Secretary Clinton deliberately concealed them.

    Meanwhile, Donald Trump has his own email problem, as court records show that he has a history of destroying email evidence in cases where he is being sued.

    However, James Comey has a strong reputation for objectivity and fairness, and he certainly conveyed the impression that it was a fair and thorough investigation.

    I'm satisfied with the result. Besides, if conservatives can't trust this guy, who can be trusted?

    No doubt the Republicans are planning to make a fuss out of this, but without that precious indictment, it will be hard to keep this scandal from joining the lengthy list of Clinton non-scandals, from Benghazi to Whitewater to Monica Lewinsky. The pattern still holds: The right makes a lot of lurid accusations, the mainstream media gets caught up in it, investigations are conducted, and inevitably it turns out the Clintons didn’t do anything illegal and their sins are venial ones committed just as surely by the accusers as the accused.

    (How many Republicans pointing a finger at Clinton have blown off security recommendations to update their passwords, because they weren’t willing to put up with inconvenience in the name of security?)

    There is a deep irony here, because the last effort at creating a Clinton scandal — Benghazi — swirled around accusations that Clinton wasn’t swift and responsive enough in doing her job. (It was a false accusation, but that was the premise of the accusations.) Now the accusation is that Clinton was too swift and responsive, which made her unwilling to engage with security measures that slow you down. It’s a neat reminder that the two decades-long effort to demonize the Clintons as corrupt has never once, for a single second, been about good faith concerns over corruption, but just about blowing so much smoke that they can convince the gullible among us that there’s fire.

    In a normal election cycle, this gambit might just have worked. The mainstream media, which naturally orients towards breathlessness and scandal, is portraying Clinton’s behavior as out of the norm, when in fact it’s sadly all too common for people, whether high-powered executives or average Joes, to get sloppy with security because dealing with all the rigamarole is too much trouble to deal with. Without that context, Comey’s language about Clinton being “extremely careless” could impact voters who don’t quite understand the tech issues at stake here to think that Clinton was motivated by more than impatience with inconvenience.

    Sadly for Republicans, however, Clinton’s opponent is Donald Trump, a man who radiates corruption out of every single one of his spray-tanned pores.

    HRC is the most vetted / known quantity ever to run for the presidency. She has been squarely in the cross hairs of the GOP for the past 25 years. They’ve thrown everything at her, including the kitchen sink and enough conspiracy theories to make a faked moon landing look plausible by comparison. Just in the last week, Benghazi and Emailgate have bitten the dust.

    We need to keep that in mind as we move toward November, because there will be more dredging (drudging?) of old silt in river beds that have been panned by the GOP for political gold over the course of an entire generation, yet bupkis other than iron pyrite, otherwise known as fool’s gold.

    What’s most disappointing is that there are Dems who buy into some of the CT — or who have tried to exploit the GOP talking points.

    Honestly, I think HRC operated in the grey zone deliberately, and with good cause. The Congressional “watchdogs” — if they had hundreds of thousands or millions of emails to sift through — would have sought to hang her on endless innuendo, and would have shamelessly revealed state secrets and non-classified but sensitive info from and about foreign governments in the process. Ultimately, her use of a private email server was — from the national interest perspective — well-handled, and well-worth her being branded as “careless”.

    They need to be asked if they have confidence in the integrity and honesty of the many dozens of FBI agents who participated in this investigation.

    Someone needs to do a comparison of the Petraeus and Clinton matters. Trump says Petraeus got prosecuted for something “less". My recollection and understanding of the facts is quite different - Petraeus willfully shared marked classified information with his mistress, who was also his biographer and the two of them expected to make money off of the resulting book. There were no similar factors here in the Clinton matter.

    3. 110 emails out of 30,000 ... tap tap tap, yep she's .... 0.03666% careless and reckless.

      And remember, that was not 110 emails MARKED classified, it was 110 that had classified info IN THEM. If any other person working in the state dept. at that time had their email usage scrutinized the way Hillary's has, I bet many people would come up as being at least as careless and reckless.

      The point is, email communication was still a relatively new thing and the protocols to officially deal with it were not all in place at the time (true, because they have changed over the years).

      And that's another important point - it was not last year she did this, it was over 4 years ago, and she has 'learned her lesson', as it were. She will not be careless and reckless as president, because she now understands more than she did then.

      I have no such hope that Trump ever learns anything over time. He is just like Sarah, thinks he knows it all already and doesn't need to listen to or learn anything from anyone.

    It was amazing to watch Mr. Comey say that Mrs. Clinton did do what her critics said she did, but there will be no charges. Mr. Comey confirmed Mrs, Clinton did wrong and in another case would face discipline actions, but, he said, that's not what this investigation was about. If this went to a grand jury, would there be no charges?
    Mr. Comey also confirmed that hostile actors did get access to her server and emails. That is dangerous, especially since she was the Secretary of State for the United States.
    This will not help Mrs. Clinton's negative ratings, which are driven by a lack of trust.
    Prosecutors make these kind of decisions everyday and guilty people do go free. Elected officials should be held to a higher standard, especially officials as high up as Mrs. Clinton.
    The public perception will be that Mrs. Clinton did nothing wrong, which Mr. Comey himself said was not true, she did, but perception is everything. I get tired of people doing whatever they want, legal, or not, and just saying, I'm sorry. That's letting them off to easy, and to many elected officials seem to be saying, I'm sorry, to often.
    If Mrs. Clinton becomes president I expect some scandal. Her tendencies to bend the law is part of her working character.
    Respect for the law just took another hit.

Or what about when Cheney basically told everyone to fuck off that he wasn't part of the Executive branch and he could do whatever the hell he wanted with his emails, as in delete them?     Positing bias does not change information and facts. If you take the time to read the articles you'll see the the laws regulating the handling of classified information were broken according to the opinion of other lawyers and jurists.

    And others have been fired, charged, fined and even jailed for less in the handling of classified information.

    The FBI's recommendation to not pursue criminal charges is a show of leniency--it does not mean no laws were broken. The leniency with Hillary, as with General Petraeus who simply got a slap on the wrist, might be palatable IF the same leniency extended to others accused of mishandling classified information. Unfortunately, less powerful people have been harshly punished, again often for less, some even sentenced to prison (see Jeffrey Sterling, John Kirakaou)--some for simply reporting government crimes and war crimes.

    What do you think about the double standard this reveals in our justice system: the powerful go unpunished while the less powerful, among them whistleblowers, are harshly prosecuted? Doesn't this add to the already eroded confidence citizens have in the government and courts of the US?
