Governor Greg Abbott finds a way to work around the recent Supreme Court decision to continue restricting access to legal abortion in Texas.

Texas anti-abortion lawmakers aren’t letting the Supreme Court stop them from standing between a woman and her reproductive health. Four days after the court’s June decision to block HB2, the Texas law that would have shuttered many of the state’s few remaining abortion facilities, Texas Gov. Greg Abbott (R) quietly set a new anti-abortion strategy into play. 

His tactic: Requiring abortion clinic staff to bury or cremate the remains of every abortion procedure that takes place in their facility. 

Unlike past state anti-abortion laws, Abbott sidestepped the state legislature by simply proposing a new “rule” for the state health services agency. The public has just one month to comment on this rule before it could potentially go into effect — effectively cutting out months of debate and rewrites commonly found in legislature proceedings. This is a red flag to abortion advocates.

This guy might as well just walk around with a t-shirt that says "I Hate Women."

I bet there are a whole lot of ladies in Texas who wish they had worked harder to get Wendy Davis elected in 2014, instead of getting stuck with this asshole.

      11.24 You are completely incorrect. No woman having a termination has ever been attended by a philosopher, she is attended by a nurse.
      If you support this law to the extent that you think it's a matter of philosophy and not medicine then you don't belong at IM.

      It didn't work well for Pence, which is probably where he got the idea.

      He'll just get slapped upside the head in another series of lawsuits he'll lose. The media will sell more advertising and whoever runs against him will have more fodder.

    EXTREME gerrymandering has produced the vile pairing of Abbott/Patrick. All the major metropolitan areas in TX voted democratic. One particular egregious example actually extends, in a rather irregular shape, from around the west side of far north Dallas to almost Houston, with slight jog off the the east to get the swamp folks! We don't want them. They were pressed upon us.

    It's more than obvious in everything they do including the nasty merchandising about Hillary Clinton at the RNC that the Republicans hate women. Or rather they hate women who are not bimbos, arm candy or dutiful wifey types who stay home and cater to man's every whim. One need only look at the historical comments made by their oh so great leader to verify this.

      They likely don't have a problem with that, as they want to change millenia of cultures to thinking of pre-viable zygote/embryos/ fetuses (z/e/f) as "babeez" as persons with rights, the first o f those is funeral services.

      I think that mindset is going to change but not the way they think. Dad is going to be looking at that little red smear and then the funeral bill and going WTF?

      Single moms and those on assistance will insist the state pay for the funeral costs. I.E. the expense will be passed on to the taxpayers, who will look at that little red smear and go WTF?

      This might just get a Democrat elected governor of Texas.

      I have ALWAYS said that we have just as many assholes and idiots as any other state. Maybe more. And I have said it often.

      And yes, I have heard every nasty ugly thing said about my state (probably half of it true) and endless jokes about the people that live here, (which more times than not makes me laugh my ass off.) There are some truly creative, funny people out there.

      Do we have some real winners from my state? Oh yes we do. So bad I won't even name them. Did I vote for them? Hell no! Do I support them? No! See? We couldn't control our idiots either.

      Perhaps for a live birth where the child died shortly after birth. But they're talking about abortions. Abortions that occur at a point in pregancy where the fetus might be developed enough to breathe on its own don't usually end with intact fetus.

    Pence signed a similar law in Indiana and it was just halted by a federal judge on June 30.

    Here's what the judge said:
    The judge Pratt said, "the court would likely still be to rule in favor of Planned Parenthood, because the law does not recognize a fetus as a person. As such, she said there was "no legal basis for the state to treat fetal remains with 'the same' dignity as human remains."

    "To be clear," Pratt wrote, "whether or not an individual views fetal tissue as essentially the same as human remains is each person’s own personal and moral decision. ... The Court cannot resolve this moral question. But as a legal question, there is currently no basis which would allow this Court to recognize fetal tissue as such."

    It's unlikely Texas would fare any better.

      Bingo!! It is the imposition of a religious belief. Much as pet burial - some people see FIDO as part of the family, others are quite content to use the dumpster route. Neither is regulated beyond health regs. So too for fetal remains/products of conception - individual choice.

    Her's the defense, plain and simple: The idea that a fetus is from conception to at any time before viability is a "person" (legal and philosophical term) is a matter of belief, as shown by the range of chronologies held by various religious groups across time and denominations. Therefor choosing to treat any non-viable fetal products of intentional or spontaneous abortion is an imposition of religious beliefs on non-believers in clear violation of the Constitution. Further, imposing this rule opens the door for legal action for any woman who throws away a used feminine hygiene product without benefit of examination under microscope to decide if a zygote or embryo is present.

    11:24, Your last sentence prompted me to tell you the following. After Mike Pence passed this ridiculous law, that was to take effect July 1st but was stopped by the Supreme Court ruling. many women in Indiana decided to protest. Many menstruating women would call the Governors office monthly to report on the status of their periods. They couldn't send in their used tampons or pads because that could be a health violation. I can imagine calls received at the office got quite comical.
