Second federal appeals court rejects Trump's Muslim ban.

A second federal appeals court has ruled against President Trump’s revised travel ban, delivering on Monday the latest in a string of defeats for the administration’s efforts to limit travel from several predominantly Muslim countries. 

The administration has already sought a Supreme Court review of a similar decision issued last month by the United States Court of Appeals for the Fourth Circuit, in Richmond, Va. Monday’s decision came from the United States Court of Appeals for the Ninth Circuit, in San Francisco. 

The two courts employed different reasoning to arrive at the same basic conclusion. The Fourth Circuit said the revised executive order violated the First Amendment’s prohibition of government establishment of religion. 

The Ninth Circuit, by contrast, rested its conclusions on statutory grounds. It said Mr. Trump had exceeded the authority Congress granted him in making national security judgments in the realm of immigration without adequate justification. 

“The order does not offer a sufficient justification to suspend the entry of more than 180 million people on the basis of nationality,” the Ninth Circuit’s opinion said. “National security is not a ‘talismanic incantation’ that, once invoked, can support any and all exercise of executive power.”

This news of course pissed off the Orange Fuhrer.
"As predicted?" I don't remember Trump ever suggesting that this ban would fail. All I remember is hearing him talk about all of that winning.

I love the fact that not only is Trump under constant fire from the various investigations into his dealings with the Russians, but virtually everything he promised to do during his campaign he is now failing to deliver.

By the way when was the last time anybody even heard any talk about that stupid border wall?

    So I'm waiting for this case to make it to the Supreme Court and see how they rule,and how the vote breaks down. Will Gorsuch support Orange Hitler? And after having his tweets used against him, he quadrupled down and called it a travel ban again. And how will a travel ban protect us against the white supremacist terrorists who are from this country?

    As President, Humpty Trumpty does have broad powers concerning national security. What he doesn't understand, what he CAN'T understand, is that the power MUST be used within the confines of the laws of the country which are based on the Constitution.

      Hey there snowflake, New Zealand is by no means perfect, and you know what? Peter Their is quite the asshole and would probably never allow you into his "compound" if you can't even to manage to spell the world "lose" properly. He's an acknowledged elitist that doesn't suffer fools so you'd better head off and look for a different utopia.

      I can tell you what you'll find though, places are just people and people are assholes the world over and no matter where you go there are problems, there's no escaping it. America, yes, it's on the way down but Trump is but a symptom of the decline of the country as a whole, it doesn't mean a whole lot, just that we're not the leading world power any longer, except in military might, and yep, we can pretty much blow everyone up if they come our way, but we've lost the rest of the war; educationally, technologically and governmentally were heading downhill, but it happens to even the best countries so sit tight and you'll find that very little will change in your life or even lifetime, even with Trump.

      The sky started falling nearly 40 years ago, and now has finally met ground. Weren't you paying attention? You should have been beginning to lose hope around 1980 because this is nothing new, been a long road to our current perdition.

    I'm not an adherent to any of the religions but judging a person based on their adherence to any of them is akin to judging an innocent person that just happened to born with the surname Trump; I just betcha that there are some decent Trumps out there, just like there are some decent christians, muslims, jews and all the rest.

    He will dangle the border wall whenever he feels he needs to agitate the knuckle-draggers but I suspect doubts are starting to creep into the tiny brains that are not completely incorrigible. Mexico's Vicente Fox often gives Trump a well deserved slap-down when the wall comes up. I look forward to that.

    He won't pay and he won't follow directions.

    Let's see if Trump takes it to the Supremes. If he does, could be they will decide that his tweets constitute "documents" and have to be preserved with all other documents and recordings. That would do an endrun around the proposed COVFEFE act but accomplish the same thing.

  15. So the ninth district is going by Sean Spicer's statement that Trump's tweets are official. That means Trump may be in hot water for blocking at least 40 people from his twitter account.

    And the ninth circuit basically implied that they were.

    Now we come to Rep. Mike Quigley's COVFEFE act.

Mike Quigley, D-Ill., would amend the Presidential Records Act to include social media, meaning that Trump’s prolific Twitter missives would be documented and preserved — including deleted tweets."

    And it would also bar him from blocking any critics he didn't like.

    "The Presidential Records Act lacks an explicit requirement that mandates archiving a president’s social media posts. White House officials confirmed to the National Archives that they are saving the president’s tweets, including those he’s deleted, but have not detailed the process."

    "Press secretary Sean Spicer confirmed last week that Trump’s tweets are “considered official statements by the president of the United States,” despite earlier insistence from top White House officials that the president’s tweets are “not policy.”"

    We all know Trump's relationship with the First Amendment isn't a cordial one.

    It will be really fun to watch him get slapped upside the head with his own twitter account. That he'll have to unblock everyone, will not be allowed to block anyone and that all of his tweets, including the deleted ones, including all of the typos, will have to be preserved.
