Well Sarah Palin will get at least one New York Times journalist to testify in her defamation lawsuit.

The author of a New York Times editorial will have to testify under oath in a defamation lawsuit filed by the former vice-presidential candidate Sarah Palin, a federal judge ruled on Thursday. 

The Times filed a motion last month seeking to dismiss the case, and the judge, Jed S. Rakoff of Federal District Court for the Southern District of New York, said the testimony was necessary to help him determine whether to grant that motion. Judge Rakoff set the hearing for Aug. 16. Judge Rakoff said last month that he would rule by the end of this month on the motion to dismiss the case. 

A spokeswoman for The Times said in a statement that the news organization would provide the testimony the judge had ordered. David McCraw, deputy general counsel for The Times, said the witness would be James Bennet, The Times’s editorial page editor.

As you may remember Palin was blocked from bringing in almost two dozen New York Times reporters by the judge in this case, and instead only the journalist who wrote the op-ed will show up to testify.

There is of course a strong chance that once this individual explains the thinking that went into the piece, and points out that the portion Palin objects to was later retracted, that the judge will go ahead and throw the case out completely.
Personally I hope that the paper counter sues Palin since she is clearly being used as a conservative canary in the coal mine trying to find a chink in the Times' armor so that others can follow after and also file suits against the paper  which has caused their president so much grief.

Remember Palin has not spent one minute in this courtroom, and I believe that if she were subpoenaed by the Times she would quickly fall apart under cross examination and the Times' might quickly learn who is bankrolling this bullshit.

That seems like something which would be in the public's best interest to report.

    It's an editorial writer who's going to testify.
    Not a reporter.
    They do two very different jobs in very different departments.
    Sarah's complaining about an editorial, an opinion piece.
    A news story, of facts, is written by a reporter.
    This is a significant difference in how a suit will be seen by the judge.

  6. Even though no verifiable link has been established between "political incitement" and the tragic 2011 Tucson shooting, I believe that Sarah Palin is responsible for what happened. Her out-of-bounds rhetoric, her use of a gunsight, her deliberate demonization of Democrats, and her pandering to the racism, nativism, and provincialism all played a role. Is there definitive proof? Probably not. Nevertheless, she is one whose bully pulpit should be removed now and forever more. To be a public figure is to be responsible, to contribute positively to the exchange of ideas, to foster a greater good. Palin gets an "F" and be banned from the public arena. She is a taker, not a maker; she is a fraud whose flippant gibberish led to the murder of six innocent people.

      That was federal court. Bristol lied about living in the woods and having no communication. The Best Western is almost next door and the Secret Service had a building on the property.     I sincerely hope that correction by the NYTimes was at least a little "tongue-in-cheek." Every sentient person in this country realizes that Sarah Palin was an instigator during the 2008 presidential campaign of the ugly politics that have dominated the GOP ever since. Her behavior made the vicious attacks against John Kerry's Vietnam experiences in 2004 look like child's play. And Palin's PAC did produce that ad with a group of Democratic candidates, including Gabby Giffords, in the "crosshairs." Even she would have to admit, under oath, that she was responsible for that. Whether Palin really hoped that anyone would be insane enough to act on her hyperbolic graphic, no one knows but Sarah herself. Will she be asked that question under oath in a deposition? I hope so.
