Robert Mueller obtained thousands of Trump transition team emails during the summer and the Trump folks had no idea he had them.

Special Counsel Robert Mueller has obtained “many tens of thousands" of Trump transition emails, including emails of Jared Kushner, transition team sources tell Axios. 

Trump officials discovered Mueller had the emails when his prosecutors used them as the basis for questions to witnesses, the sources said. 

The emails include 12 accounts, one of which contains about 7,000 emails, the sources said. 

The accounts include the team's political leadership and the foreign-policy team, the sources said. 

Why it matters: 

The transition emails are said to include sensitive exchanges on matters that include potential appointments, gossip about the views of particular senators involved in the confirmation process, speculation about vulnerabilities of Trump nominees, strategizing about press statements, and policy planning on everything from war to taxes. 

“Mueller is using the emails to confirm things, and get new leads," a transition source told me.

Mueller apparently circumvented the transition team by going to the government agency that hosted their email system.

Apparently the transition team had been sifting through their own emails all of this time in preparation for a subpoena from Mueller, and taking out the ones they considered privileged or sensitive.

However unbeknownst to them Mueller has already had the emails in his possession since the summer and has been using them to crosscheck against testimony from Trump folks who have come in for questioning.

If you think that might panic the Trump team, well you are certainly right about that.

A lawyer for President Donald Trump’s transition team is accusing special counsel Robert Mueller of unlawfully obtaining tens of thousands of private emails during its investigation into Russian meddling in last year’s presidential election. 

Kory Langhofer, an Arizona-based attorney representing Trump for America, spelled out the complaint in a seven-page letter sent Saturday to the main House and Senate oversight committees where he raises potential violations of attorney-client privilege and the Fourth Amendment, which protects against unlawful search and seizure. 

Mueller’s office got the records earlier this summer from the General Services Administration, the government agency charged with holding all transition materials, even while it was “aware that the GSA did not own or control the records in question,” Langhofer wrote. 

The Trump attorney also argued that Mueller’s office has “extensively used the materials in question” during its investigation even though its prosecutors were aware some of the materials were subject to claims of attorney-client privilege and other protections.

That accusation received a response from a Mueller spokesman:  

Mueller spokesman Peter Carr defended the special counsel’s work in a statement issued just past midnight on Sunday, several hours after this story first posted. “When we have obtained emails in the course of our ongoing criminal investigation, we have secured either the account owner’s consent or appropriate criminal process,” he said.

Now I am not a lawyer but I am pretty sure that translates into "Boo hoo, you lose." 

Do not forget that Mueller's team is made up of top prosecutors who know full well what they can legally do to obtain information, and this is perfectly legal.

Now Trump's lawyers are of course going to challenge this and attack the Mueller folks for outsmarting them, but essentially, and remember I am not a lawyer, the Trump folks are fucked.

      -Mueller was also criticized for his time as head of the FBI. He led the investigation into the deadly anthrax attacks in the years after 9/11 for nearly seven years, ultimately leading in the prosecution of the wrong suspect, who later successfully sued the government for $5.8 million.

      After agents successfully traced back the anthrax to an Army microbiologist who committed suicide once he was informed of the impending charges, Mueller “was reluctant to publicly address the missteps” in the case.

      As for Mueller's team - I'm quite confident if any weaknesses exist they are covered by each members expertice. That would be why he assembled A Team.....

    As a former U.S. Attorney stated today on MSNBC, when an attorney (Trumps's attorney) sends a complaint to the House and Senate, it is a political complaint, which will be looked at from a political standpoint. If Trump's lawyer felt it was a true criminal complaint, he would have filed it with the courts for legal action. In other words, this will get the Republicans and Fox news all wee-wee'd up. However, they also believe this will help with the next step which will be a reason to fire Mueller.

    Watch and see.

    1. They can't shut this down by firing Mueller and they can't make it go away by replacing Jeff Sessions. It has a life of it's own now.

      If they try anything to stop it, someone, somewhere is going to leak and leak big every damned deposition and piece of evidence. They'll let the public, the media and the pundits sort through it all and come to the same conclusions as the Mueller team. It will take longer but the result will be the same.

      If they try, the Republican Party will be destroyed.

It’s certainly being played that way on Fox. Certainly there’s some of that. But my guess is that they’re genuinely surprised. And since they’re surprised they assume Mueller cheated. (Is it possible Mueller did something wrong? Sure. Who knows? If so, I’m sure we’ll find out soon enough. But I doubt it. And none of the legal commentary I’ve seen suggests he did.) Beyond that, however, I suspect they now fear (no doubt rightly) that Trump officials lied during their interviews with the Special Counsel’s office and the investigators already had the emails that proved they were lying. That’s a real SINKing FEELing for everyone involved."

      There is a warning when you use the GSA system that all emails will be monitored and there should be no expectation of privacy.

      Here's the deal. Trump appointed a dude to head up the GSA who gave them a VERBAL agreement to keep these emails hidden from the public. Problem is, the guy died unexpectedly and so did the Super-secret-handshake-deal-to-hide-the-emails. That was probably the only unlawful aspect of the whole thing.

      Karma sucks for Trump.

    I remember a line from To Kill a Mockingbird, paraphrasing, never ask a question u don't already know the answer to. It meant u don't want,a witness surprising u with an answer and screwing ur case. Senator Kennedy from Louisiana already knew the answers to his questions for that judicial nominee (he had a questionnaire the nominee had answered). He just wanted to embarrass trump for putting up the unqualified person. Mueller questioned jared before anyone knew Flynn had flipped, so he already had Flynns account to compare with jared. And so of course they would get the emails and use them to verify if they were getting true answers to questions. And does that trump still really think that Bob effing Mueller did not adhere to the letter of the law? Give me a break

    1. They had the e-mails in AUGUST. Before Gates, Manafort, Papadopoulos and Flynn. They all went down two MONTHS after Mueller had the e-mails. They probably went down because when they tried to lie, Mueller had the e-mails to show them that they were committing perjury and they better come clean fast or he'd add another indictment.

      Mueller isn't stupid. Trump says he hires the best people? Really? Well, his lawyers are pretty stupid. (Remember the conversation overheard by a reporter?) What would you expect. Trump wants loyalty and no defiance so he'd hire lawyers that would do what he wants. Yes, men aren't particularly smart. They' don't have to be. I'm sure these guys are fine when it comes to some civil litigation where they can bully people using Trump's deep pockets. But this is Federal and criminal and they are way out of their element.

  6. While the FBI and Mueller have probably had them since August, the Trump team didn't find out until around December 12-13. Now, what happened around December 12-13. Was that when the attack on Mueller started full force with all this lovebird texting crap? Gee, I think it did. Sounds about right.

    Smear campaign in defense and high anxiety? You betcha. Also too.

    Trump must be shitting kittens now. *IF* he even knows. Anyone want to bet that Trump doesn't know or understand exactly how bad this is? That he is being sheltered from the implications and possible outcome?

    I simply cannot believe that Mueller who has years of experience would have made the stupid, rookie mistake of obtaining the Transition Team's emails in an illegal manner so that they could not be used in a court of law. I wouldn't be surprised however if he bypassed the Trump administration for these emails and obtained them legally directly from the GSA (warrant maybe) because it's possible that many emails would have been excluded with all sorts of excuses if he had obtained them from the Trump team. It's also obvious that Mueller was able to verify if the people from the White House that he interviewed were telling the truth or not from the information contained in the emails. That's probably what is making them so nervous these days and why they're trying to discredit the investigation any which way they can with the help of their propaganda agency, Fox News, and other right-wing medias and with the politically-motivated letter that Trump's lawyer sent to both Congress investigations. Mueller must be getting too close for comfort.

    The Trump transition team used offices, computers, cell phones, tablets all belonging to the General Services Administration.. All of them would have signed acknowledgement that ANYTHING on these devices is government property. Mueller did not need a subpoena for that treasure trove. If Mueller had something, then asked the Trumpsters for it and the hid it . . . Which is likely what happened . . . They are in DEEP SHIT !     ...The simple fact is that they were caught off guard, something that has happened numerous times through this saga. Criminal investigation is in a way like a war. Within the law, it is part of the process that you want to keep the other side guessing as much as possible. But if you’ve watched the investigation closely, there have been numerous occasions when the Trump team appears to have been caught totally off guard by developments they likely should have had at least some inkling of. They’re upset because they didn’t do their homework on the legal status of those emails. As my friend Garance Franke-Ruta archly puts it, always read the terms of service!

    Let’s put aside the brain-melting irony of the guy who “loves Wikileaks” and encouraged Russia to hack Hillary Clinton’s emails bitching about having his communications “unlawfully” accessed in a criminal investigation. If we stop to point out every clanging hypocrisy in Trumpland, we’ll never get to the point that this new tantrum from the Trump transition team lawyer is UTTER BULLSHIT!

    ...And before we finish here, we’d just like to point out the Mueller has had these emails the whole time. He’s interviewed the entire Trump brain trust, asking hundreds of questions based on the transition emails, and it took them until now to figure it out. Was it White House counsel Don McGahn who finally had the Eureka! moment during his second interview this week? You know damn well it wasn’t Kushner, who is probably congratulating himself for using his own server and is too dimwitted to realize that Mueller has the emails he sent to other members of the team.

    In sum, this is all just more bullshit to try to discredit Mueller. People are panicking that Trump will try to kill the investigation by firing Mueller (or Rosenstein) over Christmas, and it is the opinion of Your Five Dollar Feminist that we need to be ready to TAKE TO THE STREETS if that happens.     Appearing on MSNBC, Trump critic and Republican Richard Painter assailed GOP lawmakers who are attacking the FBI and undermining the rule of law, calling their attacks “a bunch of B.S. and baloney.”

    “What’s going on here is that members of Congress want to carry President Trump’s water, here, in attacking Robert Mueller,” Painter said, “but it’s not going to work because Robert Mueller is a Republican. He was appointed by a Republican Deputy Attorney General.”

    Painter said that if a second special counsel is appointed, that person should be looking into the millions of dollars donated to Republicans by Putin-allied Russians living in the U.S..

    “These members of Congress are clearly very defensive about Robert Mueller,” Painter said. “And none of those claims against Mueller have any basis.”

    Republicans like Rep. Devin Nunes (CA) who are trying to hamstring the Mueller probe are “fronting for Vladimir Putin,” said Painter.
