Sarah Palin is shedding ethics complaints like water. But is justice really being served?

Governor Sarah Palin has been cleared of accusations that she violated the state ethics act in forming a political action committee and in traveling to Indiana near the end of the legislative session to make a speech to a right-to-life group.

The investigator for the State Personnel Board dismissed the ethics complaint filed by Sondra Tompkins on the basis of the law only, requiring no need for further evidence or a hearing.

The governor’s attorney, Thomas Van Flein, noted that of 14 ethics complaints filed against the governor or her staff, nine have now been resolved without any finding that the law was broken. Another five complaints are still pending.

(This is the first time I am hearing that ANY ethics complaints have been resolved, except this latest one by Sondra Thompkins. If this is indeed true than why has the administration not been publicizing this fact with the same barely concealed glee they have demonstrated with this one? Something smells a little fishy.)

“This one was so clear-cut that all the investigator had to do was read the complaint and compare it to the ethics statute,” Van Flein said. “Ms. Tompkins simply did not allege any facts that constituted a violation of the law.

(Ms. Tompkins consulted a lawyer while filing her ethics charge and I doubt very seriously that it "did not allege any facts that constituted a violation of the law.")

“Moreover, the investigator states that the governor has a First Amendment right to speak out on issues.”

Daniel also rejected Tompkins’ assertion that the governor’s relationship with SarahPAC amounted to “employment” and said Tompkins offered no explanation why the relationship with the group was incompatible with her duties as governor.

(I am not going to make any disparaging remarks about Thomas Daniel since it appears that he is a much respected lawyer and very qualified to be making judgements on these cases. But I do have to wonder how he could be so certain that this charge is so invalid without bringing it to trial. I have read Sondra's complaint, and the statutes involved, and I felt that it had a great deal of validity. You an do the same by clicking here. What do you think?)

Regarding the trip to Evansville, Indiana, near the end of the legislative session, Daniel concluded that Tompkins was wrong again about the governor using her official position for personal gain. “The governor was not invited to speak at the right-to-life dinner in Indiana because she is governor of Alaska. Rather she was invited because of her national standing, her outspoken opposition to abortion, and her recent personal decision to forego an abortion.”

(Keep this last sentence in mind. One of the longest running disagreements I have with some of my progressive friends is whether Palin will be stopped by ethics charges or by the revelation of the "babygate" information. I have felt for a very long time that it would be the scandal that would signal the end of her career. And the more I learn, the more I am certain of that fact.)

That is a clear PRO-choice statement that can not be dismissed as "out of context" or "a parable". The GOP "base" voters are either going to have to accept PRO-choice or abandon Palin.

    Palin is _officially_ p.r.o.-.c.h.o.i.c.e.

    Even better than a valid ethics complaint for ending her political career.

    I'm with you, Gryphen. Many (or most) of the GOP don't care about ethics and governing scandals. If they did, how would Bush have stayed in office (and his DOJ, and Condi, and Rumsfeld, etc.) for 8 years. Even now, you can listen to people like Sean Hannity defend waterboarding on a daily basis. Yes, that's right, defending TORTURE against the GENEVA CONVENTIONS.

    But we're a tabloid world now. And any secret regarding children, and how they are treated, especially in regards to Palin who commodifies her "Motherhood" for personal gain and political traction, will be the final straw.

    I mean, honestly, from the lower 48, she is a joke already. Calling Carrie Prejean (before the 2nd semi-nude photo was released) was another hilarious Palin PR move. Did you see the satiric story called "All My Palins" yesterday? Google it.

    Plus, Palin keeps standing up the GOP on a national level. I don't think anyone trusts her to show up for work. She's always MIA and now, "stupwittering" (my new word for Palin's tweets--or is "palinittering" better?), as if that compensates for her no shows. Palin is a flake.

    But we need the truth to come out about any secret, esp. if it involves young innocents.

    Neither the ethics complaints or "babygate" is going to end my career. You think you know something regarding Trig, but you don't. And in the end you all will look like the fools. Don't pin your hopes on Levi "spilling the beans" either. Isn't going to happen. And since you don't seem to have the guts to tell what you supposedly know either, nothing will ever come of babygate. No one is going to tell what they think they know. No one will put their reputations behind the ridiculous speculation including you. No one has concrete proof, its all ridiculous speculation. Sorry but you will not win on this one.
    A couple ethics complaints may stick, but they won't be career enders, you won't bankrupt me either, the public is providing enough money to counter your phony attacks.
    So keep it up, I will not back down, and I will win, you don't threaten me at all.
    Polls are down now because of my position on the stimulus money, not because of anything the bloggers did. They will go back up...you'll see.

  10. I may be mistaken, but didn't Sarah appoint the personnel director? My understanding was that with the first Troopergate investigation, she filed a complaint on herself so it could be handled by her friends. The legislative investigation showed ethics violations, and the personnel one didn't.

    It's like watching the Bush administration. You don't get officially reprimanded if you hold Congress and the Supreme Court and the media all at the same time- you're capable of ignoring the people who know the truth.

    Ummm who knew about her "foregoing a abortion" before the RTL thingy? And National standing? So she didn't get a per diem for that visit? Even though she was like a freaking tour guide for Alaska??? Wasn't that the ethics violation?
    Of course the Personnel board is not going to find her guilty of anything, Complaints need to go to FBI, CREW directly. The handpicked personnel board found her not guilty of anything in troopergate after Branchflower found her guilty.

  14. I have two questions ... (well, many, but I'm only asking two right now...;-)

    Firstly, if the governor was not invited to speak at the dinner in Indiana because she is the governer of Alaska ... did the state of Alaska pick up the tab for the flights, hotels, meals, shopping, etc., for herself and family?

    And secondly, could the reason the FBI (as far as we know) is dragging its feet be because the local Alaskan office was assigned to find out? As in ... her tentacles reach far and wide in that area of Alaska and they are scared of retribution/vindictiveness of some kind? We all know how able and competent she is in this regard.

    Enquiring minds want to know ...

    I also live in AK and we are just waiting for the Trig truth to come out, I live just down the road from Wasilla and rumor has it that the truth is going to be revealed very soon, when the "time is right". I fact that she is "supposedly" anti-abortion, and that SHE had Trig is why people support her, that's what she runs on. Well guess what - that is all getting ready to change. So stand by everyone, there are ALOT of people here who want ALL the truth about her revealed. I also talked to someone who is trying to reveal the truth about her house, when she was Mayor she changed some of the laws that would provide the paperwork. But guess what there are some pissed off people ready to talk (to the FBI!!!!!!!!!!!!!!!!!).

    I hope you can keep track of the specific ethics complaints and " who " it is that is responsible for looking at each one.
    I thought I heard that there was a 3 person board or Committee to evaluate each ' individual' case. (I may be wrong though)If these are Palin appointees doing the evaluation... it would certainly be very fishy if the same 3 or 4 biased friends/appointees/political appointments were to oversee each case. I would expect different people to evaluate each case 'individually'. The same 3 names should NOT be popping up over and over.If they do... it would seem like a good time to bring in the 'Feds' to investigate then.Don't ask the Ted Steven's Feds for help though. Someone NEW.... and more competent.

    O T- Glad to hear you are a Jon Stewart Fan. between him and Colbert they have had some GREAT material to work with though. The GOPosaurs just keep on giving.
    Can you give us a prediction on what you think JTP's NEW job will be when he gets finished 're-branding' himself...? I mean he has had at least a half-dozen jobs since the election... and has failed miserably at ALL of them.

    The reason I know you are not the real Palin is because of your IP address. I work in IT and you are clearly not Sarah. You also don't really know the facts.     Finally, the truth will come out! Sarah is not Trigs mother. Her career will be damaged by this. She still has a chance for people to empathize with her reasons for her lying if she comes clean on her own volition. If she had the guts to do that (and she doesn't) her political life might be saved. You forget wannabe that some of us really do know the truth.

    What is most disconcerting though are her fans! When this comes out I will bet all if you they will make ecuaes for her! Team Sarah, C for peers, etc will still idolize Palin and she will play the protective martyr mother card! Wait and see.

    PS to the person who lives near Wasilla... When will the time be right? Have you heard approximately when. The people should be mad. She portayed herself a certain way to be elected and there are too many lies!

    It's FBI - the I blends in with the !!!!!!!!!!!!!The people here are just plain tired of her, but at the same time there are plenty of die hards, and then you have the people here who just don't care, they hunt they fish and as long as you're not stepping directly on their toes they just don't care. I work with people from Wasilla that hang out with SP's sister's kids, and you would not believe the number of people that hang on her every lie, and sadly believe what she says. I'm hoping the people that are mad, will go ahead and make the contacts that they said they would, and do it soon, I just know that there are many things in the works.

    I guess the question is WHY don't people speak up? There are plenty of people who would listen and take the story seriously, and if it is something that is so well known, then why are people afraid of saying anything? If the story comes out with the qualifier that people are worried about a backlash, and then it happens, that is all the more proof that they were right to be concerned, it gives more validity to the story and people in general will stand up for those folks who come forward.

    But her national standing came as a result of her being Governor, and the things she had done and said as Governor. The two, governor and standing are inextricably bound to her position as Governor.
    She is the one who says she is on call 24/7. So she was speaking on Alaska time both because she was on Alaska's payroll and because she says she's 24/7.
    I would also be willing to bet she talked about her position a Governor during that presentation. And as Governor, anything she says or does in public reflects on Alaska.

There's a point though where enough is enough and really I hope they know in the long run they are helping the state and country. And the Palin kids. I hope they do the right thing and the right thing is to tell the entire truth..

  31. Living in a small town, you have to be tolerant and discreet, especially in a more rugged geography. You need each other. Those of us from the lower 48 cannot understand what it's like in AK, so I say we trust them to do the right thing. You can't put the genie back in the bottle.

    Here's the next ethics complaint that should be filed.

    Sarah is withholding information about the true parentage of Trig. In doing so, she is vulnerable to blackmail from a variety of outside sources, countries, and interests. Under blackmail she could easily be coerced to make decisions that go against the Governor's duties, which go against what her voters expected of her when they voted her into office.

    Therefore, withholding information about Trig's true parentage is a direct threat to the office of the Governor being able to fulfill its sworn duties.

    Even now, Sarah Palin may be making decisions in office due to being blackmailed about Trig's true parentage.

    Until the truth is openly revealed, citizens have every reason to suspect that she is compromised in her decision making or might be compromised in the future by those who have access to the information about Trig's true parentage.

    Therefore, she cannot fully and competently exercise her duties as Governor because blackmail might (this very moment) be compromising her work.

    Citizens of Alaska need to file an ethics complaint to this effect.

    I know I am late in posting this but I do have to ask a question...She may not have been asked to speak as the Gov. of Alaska, but she did go to the event as the Gov. of Alaska because she did not turn the duties over to the Lt. Gov. in her absence from the state. Am I correct in this assumption?
