In attorney Van Flein's statement responding to the leak of the report, as posted on Palin's Facebook page yesterday, he may have defamed the complainant, Alaska resident Kim Chatman by declaring, as fact, some action of hers to have been "illegal".
"All options are open in terms of legal remedies," Van Flein threatened, in response to his apparent belief, as ABC News characterized it, that Chatman is the one who leaked the confidential preliminary report. "It is a clear violation of Alaska law that Mr. Daniel explicitly reviewed with Ms. Chatman prior to her illegal actions. We will be contacting the appropriate authorities for review and action."
It's unclear whether Van Flein was asserting that the alleged "illegal action" of Chatman was the leak of the preliminary report, as ABC implies, and, if so, what his evidence is for that. None is given. But he has very clearly stated, as a fact, that Chatman committed "illegal actions".
We can understand that Sarah has no clear understanding, or respect for the law, but Van Flein is supposed to be an attorney for God's sake! You would assume that he would have a little more self control than this.

The report by Daniel was addressed to the Personnel Board. The report states copies were sent to Palin and Chatman. This kind of narrows the field of who would have leaked the report.

I feel such a sadness for these children. They are the ones who should have received Sarah’s consistent time, care, attention, love and nurturing.
Right now, at this moment, I wish Sarah would be awash in the Truth of what she has done in so many areas and be riveted, cognizant, and overcome by the magnitude of Reality. What a fairy tale of wishful thinking. Somewhat like an iceberg.
Oh juju you are so naive! Maybe Sarah leaked it to bring her back in the media? And just because the letter said that.. It doesn't mean no one else saw it or heard it. I have to laugh at some of the ridiculous comments on the C 4 pee page about this. Very entertaining but also a very sad commentary on our education system.
ReplyDeleteThe bottom line is whether Sarah vilated Alaska's ethics laws and it seems she did. All of you sound silly. Yes other people have had these funds but Alaska has differerent laws. The laws are pretty clear and it's childish to blame Kim for anything. And to say Daniels found her guilty only because before he voted for Democrats? Are all of you in 3rd grade? Have you read the Alaskan ethics laws? There is no doubt Sarah has violated them quite a few times!!

ReplyDeleteActually it does NOT say that copies were sent to Palin and Chatman. It says "Notice of this decision will be communicated to the governor and to Ms. Chatman."
ReplyDeleteThat letter/report was sent to Ms. English as an email attachment, addressed "Dear Debra" and was not the official communication sent to either Palin or Chatman.
They would have received an offical communicate sent to them, addressed to each individually, and NOT saying that they would be notified, as the letter/report in question does.
Standard common business/law practices apply in this situation.
Defamation is an actionable offense and a lawyer earlier commented on a different web site that Van Flein's wording could be construed as actionable.

There's currently no proof that Chatman leaked the report. Van Flein and Palin are defaming her without having proof. The KTUU reporter on Rachel Maddow last night stated there were people other than Chatman or Palin who had copies of the report.

Just curious. As I understand, there is no official way to know where precious Trig came from or if he is getting the proper theraphy. Although an entire nation was subjected to what looked like drugging a baby in order for him to perform as the parents desired, there is no way to insure the babies well being. Circus animals have better watch dogs. As a nation, the world for that matter, we have suffered along with this child. Some of us feel a strong bond to that beautiful boy they call Trig. Here is what makes me curious. Where are the gifts I sent to the Palin family when I believed he was both Sarah and Todd's child? Do I have a right to find out if my gift was received and opened? Do I have a right to know if I was defrauded? I want Trig to have his gifts. If he is the victim of fraud I would prefer to send money to learning the truth instead of sending cute fish picker jammies at $125.00. If they are sitting in a warehouse he out grew them by now.

ReplyDeleteJuJu - I think someone on the Personnel Board leaked it - and while I do not approve of that, I think that person did so in order that it would get National attention - and it did, when the AP picked it up. I actually AGREE that Palin should have had time to repsond to the recommendations before the info was illegally made public. Maybe the Board member as weary of everything being swept under the rug, and thus went rogue. I see no way Cahatman would leak it.

That they were probably waiting for Sarah to agree to rememdy. I envision lots china breaking around 1 Jul when she got wind that this one wasn't going to be swept under the rug (aside: all lawyers have twisted themselves into pretzels to find no violations. AFT circumstances must have been flashing neon signs for them to find a violation.) Then when she kept accepting donations after being informed, and giving no signs of stopping, some one connected with the board decided to let the cat out of the bag and end her suckering money out of folks.

They may have released it early themselves so as to be able to frame and spin it their way exactly because the true illegality points directly to TeamQuitterface and her trained flying monkey, VanFlein as well as the rest of her brainless minions.

IF THE REPORTED WANTED TO TELL THE AUDIENCE THE PERSONNEL BOARD IS WHO LEAKED THE DOMCUMENT, HE WOULD HAVE SAID SO I.E. The report was leaked by someone on the personnel board. OR Someone on the personnel board leaked the document.
As it is written, the reported is stating the report FROM the personnel board was leaked, BUT THE REPORTED DOES NOT RERERENCE WHO LEAKED IT!>!
Trust me IF the PB had actually been the party that leaked the report, it would be hugh headlines ! ! ! ! AND THE REPORTER WOULD HAVE SUPPORTED HIS/HER STATEMENT.
They didn't because they did NOT say the report was leaked BY the personnel board.
This is not nit picking. Lawsuits have begun and been won or lost over wording like this.
