Thank you for being here today. My name is Kristan Cole, Trustee to the Alaska Fund Trust. And this is the Trust's attorney in Alaska, Jon Givens.

I am here to address the unusual letter that was leaked yesterday, the contents of which are unprecedented in the history of our country, suggesting that a legal defense fund could somehow be unethical. This is particularly notable, and concerning, in light of the fact that the Trust, on my instructions, has not paid even one penny to Gov. Palin or her lawyers. I issued that instruction because I was aware the Board was reviewing this matter.

This Trust was created by a team of expert lawyers from around the country. It was thoroughly vetted for compliance with federal and state law and trust law. So far Mr. Daniel is the only lawyer in the country who has questioned a legal defense fund despite the fact that his firm has set up legal defense funds for other office holders. Because his initial review was unprecedented and contained factual errors it was my understanding that Gov. Palin's legal team, including Mr. Van Flein, were in on-going discussions with Mr. Daniel. The matter was not final.

I want to be clear on a point that has been misrepresented: The Governor is not and was not involved with the Trust. The Governor has never worked on or with the Trust. The Governor has not even accepted or requested one penny from the Trust or quite frankly anything of me. And I have never expected anything from her. Really it’s quite the contrary; as I, and many other caring folks across the country have only sought to help with this legal burden.

The first and only time I have spoken with the Governor about the Trust was yesterday to alert her that I was responding to this violation of the law and leak of preliminary and confidential materials from the complainant.
(The FIRST and ONLY time? Isn't Kristan Cole one of Sarah Palin's best friends from when they were kids? And yet we are to believe that they have NEVER talked about this fund?)

There is a loophole in Alaska law. Alaskans can file frivolous complaints against the Governor - violate the law and alert the media they are doing so, all the complaints can be dismissed and yet the Governor has to personally pay for representation. Legislators covered themselves with a law that warrants automatic dismissal of a complaint if it is leaked to the public.

It has been quite obvious to me, and to other every day citizens like me, that over the last several months that something needed to be done to help the Palins with the overwhelming crush of frivolous ethics complaints.

In their own humble way, the Palins never asked for help. The Governor never even asked anyone to contribute to this legal expense fund.
(Really? Then why did her official spokesperson at the time tell her supporters to wait until this fund was formed to start giving donations? Are we to believe that Stapleton made this decision without ANY direction from the Governor?) This trust, and the thousands and thousands of dollars raised, were the results of hard working Americans and their outpouring of support. It is disgraceful that anyone would assume that the thousands of people who sent in $5, $10 or $50 intended to "influence" the governor's official actions in Alaska! And this in a state where a half dozen legislators have been convicted of corruption as well as the previous governor's chief of staff. Not one ethics complaint was filed against these individuals who were convicted, but this governor is harassed for having her picture taken with a fish, wearing a jacket, answering press questions and giving a speech.

A few select people have abused our ethics act. The public release of a preliminary document in violation of state law follows that pattern. The people of this state are losing hope that the ethics act has any real purpose anymore and that’s incredibly sad as ethics are so important. Mr. Daniel's preliminary assessment, unprecedented in history and harshly criticized by legal scholars, does nothing to restore credibility to this process.

Numerous individuals thought to help the Palins - not just me. But when I was asked, I was doing research of my own and determined that I would put my name on a Trust already going through an intense legal process throughout the country to ensure that this one was airtight and complied with every possible law under the sun. And this one does. It is one of the most restrictive and transparent trusts of its kind. The validity of the Trust is strong. It is unprecedented in every way imaginable... all donations must be under $150, no donations from lobbyists, and nothing accepted from foreign nationals to name a few. No trust has ever been found to be a violation of ethical standards for any governor, former president, senator, or house member, or former member of Congress. But this Trust which has more severe donation and donor limits than any trust in the history of legal defense trusts might violate ethical rules?

Some Trust funds are formed and accepted to defend politicians in true Courts of Law with regard to some very serious criminal charges. And yet, this Fund was created by others to help the Palins pay for their legal bills due to frivolous complaints - each of which has been dismissed thus far. I will let my attorney speak to the legal issues but I wanted to take this opportunity to speak to yesterday's blatant violation of the law.

You know, we have witnessed time and again the blatant abuse of process when it comes to people filing these complaints and illegally discussing them and leaking them to the press- but this latest move further crosses the line and we are all reviewing action for the reputational harm caused by Ms. Chatman based upon the leak of Tom Daniel's preliminary thinking on the matter - a product that may have ultimately been remarkably different and perhaps even dismissed. Where is the accountability for those who blatantly disregard the requirement to keep the issue confidential?

There are many questions which need to be asked following my read of what was leaked.

And, if I may digress - this is how backwards our laws are - I had to go online and read the preliminary letter about the Trust and me because Mr. Daniel and Mr. Van Flein cannot violate the confidentiality of the Ethics Act (even though it appears the complainant has)and therefore cannot even forward the preliminary letter to me. Now that I have read it, I still hope to inform Mr. Daniel of the important information that Mr. Van Flein had requested from me to be shared with Mr. Daniel.

What was the reason for my involvement? The preliminary letter suggests that perhaps I served as Trustee so I could get some job with the state. This is amazingly wrong and so incredibly hurtful. That is the last thing I want. I did this because it believed it was the right thing to do for our Governor. I love Alaska. I have lived here 40 years and I have always served the state when asked - and despite the fact that I am entitled to public monies in the form of expenses, per diem and wages - I have declined every single penny.
(I wonder if this is verifiable.)I have served as a volunteer on others boards, and commissions (The Real Estate Commission and the Agricultural Revolving Loan Fund Board) under a previous Governor so volunteer work has been part of my life for a long time. I was approached to serve as Trustee for the legal defense fund. I did not seek out this position just as I have never sought out any other position but was willing to step up to the plate and serve when asked because that’s what we all do when asked to serve our country, our state and our communities isn’t it? We do it because it’s the right thing to do and by all of us serving where we can, we all benefit. My sons and my husband have served our country. I have served our state and our community here in the Mat Su Valley with the hope that we are making a difference where we can.

So how unfair is it that the Governor can be told she was wrong for putting together the Fund, soliciting Funds, accepting the Funds and spending the Funds when she hasn't been involved at all----And no money has been spent on her legal defense?
(Once again John Coale refutes this claim.)

If the Governor only accrued the bills because she is a public figure then why is it wrong for a Trust to collect funds to defend her as a public figure? Alaska law specifically states that there is only a problem if there is "intent" to influence the Governor. How can there be intent to influence a Governor in Alaska with a $5 voluntary donation from Kansas? To date, approximately 90% of the contributions are from Outside Alaska and many are $5, $10 and $20 donations. Not one penny has been paid to any law firm or entity for the Governor's financial gain. If the Governor has not solicited or accepted personal gain, how can she be in violation of soliciting and accepting monies for personal gain?

Let’s review what has been deemed lawful. Creation of the PAC and fundraising was deemed lawful. Writing a book was deemed lawful. All other legal defense funds similar, but not as restrictive as this one, have been deemed to be lawful. The very firm who put together Senator Kerry’s legal defense fund which was deemed lawful was put together by the very law firm that Mr. Daniel is employed by. These are inconsistent conclusions and defy common sense. That is why this matter was not final and Mr. Daniel and Mr. Van Flein were discussing these issues.
(In other words it was not FINAL because Palin did not like the outcome of the findings.)

Potential future gain, based upon no active solicitations, in one of the most stringent legal expense funds in the country does not merit a situation much less a violation. Mr. Daniel says that because the Trust was an "official" Trust he felt it violated the law. This overlooks the necessity of having one "official" fund. The unofficial funds are the very ones that had the potential to harm the public by unscrupulous people.

We knew that in fairness to Alaskans and Americans, this site needed to be official because of the potential scams that could arise. How ethical would it be for a pensioner in Iowa or a single mother in New Hampshire to have their donation diverted by someone who had no intention of helping the Governor and may keep the money for themselves or other equally harmful things?

But let's think through the same logic, if a foreigner wanted to set up his or her own fund, collect a handsome payoff, and accept $5 million donations from rogue groups even, as long as that person did not tell the Governor, that would be okay? That is the conclusion that is being reached here in Mr. Daniel letter and flies in the face of good logic, common sense, and the good necessity of protecting the public.
(Read that last paragraph again and see if you can locate this "logic" thing that she speaks of.)

Every aspect of the Alaska Fund Trust follows the law. Precedent allows for it. The Palins haven't been involved with it. It is unfortunate that some in the media were so quick to point the finger at the Governor for something others are responsible for and have established to assist her in the fight against these outrageous attacks. And this acceptance that the law can be continually violated for pure political gain ... is wrong.

Look I don't want to call Ms. Cole a liar, but she might want to get her pants off quickly because they very well may be on fire.

(By the way there was only 38 minutes notice given to the press before this announcement. Which did not give some Anchorage news outlets time to send out their reporters. Sound familiar?)

    Their biggest defense is that Sarah Palin never took a dime from the Fund. No, it was established to pay her legal expenses. I'm guessing that the check was made out to the law firm. Remember that John Coale bragged that they had paid a substantial amount of Sarah's legal bills from this very same fund. Yet, how can that be when the lawyer said that he never got anything. Oh what tangled webs we weave........

    For Sarah to protest that she had nothing to do with the fund is laughable. Her picture is all over that website. The purpose of the fund is to pay her legal bills. It says so in any number of ways, to protect the integrity of the office of Governor of the State of Alaska, her family, etc.

    If Coale is correct, and Sarah's legal bills were being paid, where did that money come from? I know that SarahPac can't be used for legal bills. And if they were paid with the Trust Fund, then Sarah's Ass is in big trouble.
    I'd like to see that quarterly report that was due today regarding the trust fund.

    HOWEVER: This woman is also as dumb as Palin because sHE DID NOT EVEN READ THE INVESTIGATOR'S REPORTS WELL ENOUGH TO SEE THE PART WHERE HE EXPLAINS THAT THESE OTHER FUNDS I.E. FOR KERRY ETC WERE OK UNDER FEDERAL LAW.

    Federal Law is what made the funds for Kerry & Clinton ok. It is ALASKA LAW THAT MAKES PALIN'S FUND ILLEGAL.

    I won't reiterate, and I forget which blog, I think Muckrakers, but there is so much history showing Palin did know of and approve the fund that Cole is making opposing counsel's case by stating in writing the opposite, i.e. she is showing herself to be a liar.

    AGAIN, IF YOU READ THE INVESTIGATIVE REPORT, DANIELS ADDRESSES THE FACT THAT COAL TOLD HIM IN DEPOSITION THAT PALIN AGREED TO THE FUND, ETC. I forget his exact wording, but he questioned her and she admitted Palin knew and gave her consent. SO COAL IS MAKING A TOTAL ASS OF HERSLEF NOW.

    I know the legal documents can be confusing and lengthy, but if you take the time, read them carefully, and think about what is being said, you will see that most of your questions and arguments are addressed in the paperwork.

    Only problem: this is the same investigator that handled the Arctic Cat complaint so he is not on "our" side. On the other hand, not being on "our" side, he still had to give a finding of probable guilt as the law was so obvious.

    Remember: the investigtor is not the authority as to her "guilt or innocence." That has to be decided by the personnel board. ALL he is ALLOWED to give is the "probable" wording because he is not the "judge" not the "arbiter" her, he is JUST the investigator.

    Like a detective investigates, and the prosecutor decided whether to go forward with the case or not and then the judge is who determines guilt or innocence.

    Each person has their part to play.

    Sorry, but Phils's "breaking news" was just a lack of careful reading of the article.

    It does NOT say the personnel board is who leaked the report. It says the report FROM the board was leaked, NOT who leaked it.

    It was just sloppy wording on the part of the reporter who was likely trying to express the fact that the report, which was going to the board, got leaked.

    Legal paperwork takes careful AND THOGHTFUL reading. You CANNOT just glance at it and go off on what you think it just said.

    Lawsuits have been won/lost over single words, the more infamous being the words "and" and "or." There are others as well.

    The reporter who wrote the article Phil quotes can easily defend what he actually stated.

    If WE don't read the legal work carefully, we cannot criticize Cole and Coale and whoever when they don't read it carefully either.

    As I stated earlier, there is Federal law and Alaska law and this stupid stupid woman is writing nothing but "word salad" as she tries to blow off this report.

    To state that she has over reacted with he choice of words is a gross understatement.

    These statements are from a woman who is too ignorant ( dictionary meaning, not name calling) to know what there is that she does not know i.e. she is too ignorant to understand there is much involved that she is simply to ignorant to guess even exists.

    THIS type of thinking is an attorney's worse nightmare cause now, Van Flein is gong to have to explain away this ignorant woman's abuse of "free speech."

    IF she had read Daniels' report, she would have seen where he addressed the $150.00 cap and would have been smart enough to NOT bring it up in her release. Daniels clearly explains that $150 give by one person on a multiple gift level would be just as objectionble as a gift for say $450 ( $150 x 3) In other words, the law recognizes the "end run" attempt to give more than allowed by giving a maximum amount more than once.

    JEEEZZZZEEE PEOPLE, JUST READ THE DAMN PAPERWORK AND 3/4 OF YOUR QUESTIONS AND CONFUSION ARE ANSWERED!

    I don't think these people are pathological liars. I think it's all very calculating. All too often that mean ole liberal news media simply quotes what Palin or her minions say without even a token effort at fact checking. Even when someone does actually do their job and points out the discrepancies in fact, her base simply quotes her original lying excuse and says, "See, she's innocent and wrongly accused."

    Sarah has been very good at "branding" herself as a "real American from the heartland who hunts and fishes and births babies and talks straight rather than just giving everyone politics as usual." We need to find a way to brand her as a lying, batshit crazy idiot.

Seems to me that putting out the word that some contributors have gotten thank you notes is a great way to increase donations because, in this ebay era, everyone knows those signed letters have a resale value. All she'd have to do is write a few and the word would get out and she could sit back and wait for the money to pour in.

    With only three more days to go before Buttercup is officially out of office, I just cannot wait to see what happens next! Cole is as stupid as Palin is. I am so glad the Palin bots that received a hand written note from the good governor was so elated as to spread it all over the internet. And I would really like to know how Ron Devito "knows based on research and on information from several contacts she works from 18 to 20 hours a day seven days a week" and that "she also has familial obligations, volunteer work; has to eat, exercise (yes, she makes the time and she runs marathons) among other things". Well, my goodness, obviously I have not been giving Sarah Palin enough credit. Let's be conservative (just this once) and cut her work day down to 16 hours a day. Correct me if I am wrong here, but that still leaves her with only 8 hours out of a 24 hour period, but hey, she still manages to eat, exercise, run marathons, fulfil her familial obligations. Wow, what an incredible person she is!! Oh, yeah I forgot. When does she sleep? Just wondering.

    I am convinced, after seeing handwritten examples by Bristol and Sarah, that Bristol is penning all those thank you notes and then all Palin does is put her signature on them. The handwriting style between the two is very different. Oh, all those people who think they have a genuine thank you note written with care by Sarah..... sorry. Is Bristol on the AFT payroll?

    It doesn't show or say pending.

    In a May 2007 article Sarah said Todd only sleeps one or two hours a night. I've read where she said similar about her sleep habits. This is not new, you can only imagine what years of sleep deprivation would do. I first read about their sleep habits before I learned that they lived in the meth capital of Alaska.

    On the Alaska Fund Trust site there is a link to Media/Documents and a download for a pdf file of the trust agreement. On page 8 Disclosure Provisions it says the name, amount and date of each donation is disclosed to Sarah Palin and the public every 30 days. Is there a link where the donations can be viewed?

    These allegations concerning the "thank-you" cards are complete fabrications. I received a card in May, 2009 after I donated to SarahPac and before (I say again, before) I donated to the AFT.

    Of course Gov. Palin knew about the AFT; so what? How is that an ethics violation? Read the trust document: she has no control over the funds. Even that idiot Daniel says there is no ethics violation unless and until the trust pays one of her bills. Even that white-shoe hack didn't claim that her knowing about the trust or even being involved with its creation was unethical.

    Full disclosure. I have been a practicing attorney for many years. I am a civil litigator in federal court, trial and appellate. The reason I am so hard on QC Daniel is because his report to the personnel board is the worst piece of legal reasoning I have seen in many a year. It reads like a failed 1st year attempt to get on the law review. The board should demand their money back. First rule of statutory construction is that a stature cannot be construed to create an absurdity. And that is exactly what he does. I, for one, would love to see him try to make his ludicrious arguments to a court.

    On another note. I am sick and tired of people who post on here claiming to have some special connection to Gov. Palin and then getting all upity when someone else refutes their arguments or accusations. I am tired of their "inside baseball" critisims of every dad gum thing connected to the Gov. or Alaska. They are all over RedState and they are insufferable. Even if these people actually do live in Alaska, that does not give them some kind of special immunity.

    Notice how they suddenly appeared after Trustee Cole issued her statement, now claiming to have some special connection to her too. What hooey.

    I don't know Gov. Palin and she doesn't know me. I don't even know what Trustee Cole looks like. But, I do know how to read a statute and I do know how to read a trust document and I know a lying liberal media gossip monger when I see one.

  49. A couple of weeks ago...I felt awkward when someone said they thought Palin was bipolar. As someone who has lived with this illness for many years, I did not in any way, want to be equated to her.

    However...after some terrible events caused by my illness...and the terror of my family for my well being, I was diagnosed and have been on meds that work well and have kept me healthy for a very long time.

    I am seeing now though...some familiar behaviours in Palin. The manic late night twittering. The inability to control herself...saying, twittering and doing things that can do nothing but cause further problems.

    I am a social worker who specializes in mental health work. I hate when people are dx over the net or in general conversation. I am making an exception here, because if she is bipolar she is extremely ill...and if things get worse for her...she is in actual danger to others....and perhaps even to herself. Many with bipolar commit suicide when they finally crash and that earth swallowing depression hits. And it will....with a vengeance.

    As much as I wish she would just fade away into the sunset and get some help..look after her family....I dont wish real mental illness on her.

    I finally am admitting that her actions lead me to believe this could quite possibly be her problem. The fact that she changes jobs quickly...goes gung ho...then quits. She has done this a lot. A sign of mania is grandiosity and paranoia. We must admit she has both of these.

    My feeling is that she has been ill for a long time and has been able for the most part to get by without people knowing. That campaign for VP pushed her over the edge. It built her up...and then let her down.

    She needs help...but she needs to never ever be near political office again.

    Kristan's mother was charged in Canada with fraud, theft, breach of trust and forgery related to her former real estate business in British Columbia.

    Cheryl Moseley, known in Canada under the name of Cheryl King, used to be employed at the McQuaid Agency in Clear Lake, Iowa.

    Charges were filed against Moseley after an investigation into business affairs of her former business in Kamloops, with court documents saying she committed fraud in excess of $5,000 between May 1999 and December 2001 and left debts and missing trust funds totaling more than $700,000.

    A perusal of the Mat Su Property Index
    shows that Kristan and her ex, Don, own quite a bit of real estate in the Valley.

    A check of Alaska Corporations, Business and Professional Licensing shows yet another long trail of LLC's and businesses owned by Tanner, Cole and their family.

    One businees of particular interest is EROBERN SIE, INC, " Lessors of Residential Buildings and Dwellings

    Interesting name for a company, if you know German that is.

    Don Tanner has a checkered past, he was involved in a scandal with Bruce Kendall, early on in the Hickel administration. Kendall was sacked but Yukon Don Tanner was kept on to wreck even more havoc in the Hickel administration.

    There are unsubstantiated rumors that the Tanner's lived in South Africa prior to living in Alaska. The earliest record in the ADN of either Don or Kristan is 1986.

    It's interesting also, looking through the court records, to see how far these two go to keep things compartmentalized.

    I'll bet there's a lot more out there on KC.
