Celtic Diva finds a lawyer willing to wade through the Alaska Fund Trust horse-pucky. Warning! Bring your boots.

Just click the title to visit Linda's wonderful blog.

Here is just a sample of what this lawyer discovered.

I think the AFT's (Alaska Fund Trust's) purpose is unethical on its face.

Pretty much says it all doesn't it?

  1. I have organised the examples of Sarah's handwriting and other documents regarding Sarah's "thank you notes" in a slide-show on my flickr, easy to watch:

That story on Diva's site rocks. I hope the MSM national outlets pick it up.

  3. Maybe a little o/t, however, MSNBC just reported Palin's LOW poll numbers, however it was all spice and honey as they discussed how popular she still is and what she could offer as a broadcaster, etc. Just makes me want to puke. PLEASE release any info that is out there to put this woman where she belongs before it is too late.

  4. Gryphen, I assume you are in direct touch with CD. Can you tell her that I love blue, but the white letters on the blue background are very hard on the eyes. My husband is an attorney and I wanted his input, but he simply cannot wade through with the blue background. Maybe she can post it on a white page as this is a very important document.
    Many thanks

  6. Gryphen: Waded through the entire article. Very enlightening and interesting.

After reading this it appears very clear to me that this is why $P resigned so quickly with what appears an obvious attempt to keep the funds.

Someone asked whether this is a scam or type of fraud? I'm not a lawyer but soliciting funds from those people who are happily shoveling money her way, might be kind of tougt to prove as fraud. The individuals who support her would mail her cash if they were asked. They are quite simply, Stupid For $arah.

Remember the Snake Oil salesmen in the Wild West? There was always some moronic idiot that believed in a miracle cure - and after all, most of that Snake Oil was about 80 Proof.

The Trust may very well be fraudulent, riddled with illegalities and since $P is totally corrupt, she will get away with it.

Then again, I didn't donate to her and those of us who read and watch, certainly don't support her. If there are people stupid enough to send her money (think: Jim Jones, Guyana - David Koresh, Waco), that is their problem.

On the other hand, I totally hope all this investigation and discussion continues. If the Trust is unethical, it should be dissolved immediately.

Someone will need to address this issue. But the State of Alaska is currently staffed by corrupt, questionable, and ethically challenged individuals and it will be difficult for the decent Alaskans to get to the bottom of their current GINO's corrupt Administration.

I hope Parnell is better, but I don't see it yet.

Great article on Celtic Diva's site. Thanks, JHOP.

I used to feel sorry for the Palinites. But as this thing has worn on, and we've seen how stupid and vicious Palin and her minions are, I no longer feel sorry for them.

  9. If anyone wants to read the document on Celtic Diva with black on white letters, just copy it to a word document and change the font color.

A little work but easy to do.

Gryphen, thanks for the link and informative updates, as usual.

Just read the article on Palin's dropping poll numbers on HuffPo. Mostly I liked one of the comments the best:

    A political lightweight named Palin,
When the going got tough said, "I'm bailin'."
    The voters now wise
    To her antics and lies
Caused her place in the polls to be failin'.

Thought you'd get a kick out of that.

I kept wondering about Zaki's comment that was posted for a time on alaskareport.com, which was "big dirty scandal about the hit the Palin universe." I felt like I hadn't really seen anything yet that would be considered a "big dirty scandal" but I get the distinct impression that what is being revealed about this Trust and Cole's and Palin's involvement is truly just skimming the surface. It's just a gut feeling, but those are usually quite accurate for me. There's something much deeper and darker below the surface of this. Plus, Mr. Zaki seems to have been spot on with his hints of additional ethics complaints. Seems to me like politicians and the wealthy set up funds and trusts like this all the time. If there's a mistake in it they can just say oops, didn't know, then be allowed to fix their mistakes. Me thinks she's gonna be really pissed if she has to give all that money to a charity....I'm jus sayin'

  11. I Consider this the "money quote" - THIS is the whole, complete entire purpose of the whole Trust - read it carefully. Think of it as a game - FIND the WORD "legal":
    "
"Each of the beneficiaries of this trust, shall, in each calendar year, have an absolute and unrestricted power to withdraw from this Trust up to the lesser of the total additions made to this Trust during each calendar year or an amount in cash or other property equal the lesser of the total additions made to this Trust during each calendar year, divided equally among such beneficiaries, or an amount in cash or other property equal to the maximum amount which qualifies for the Federal Gift Tax exclusion (...) and shall be exercisable only by written notice to Trustee of the amount Donee wishes to withdraw, but no purpose for said withdrawal need be shown."

    @Livy

You can select the whole text section on CD's page and paste it into Word or WordPad. Once in a text editor, you can highlite the whole document and change the font size to make it quite readable or even print it out if you wish.

    Press on John Coale:

YOU BEAT THE PONZI SCHEME, NOW GIVE IT BACK
Press of Atlantic City, The (NJ) - Sunday, May 30, 2004
Author: E. SCOTT RECKARD Los Angeles Times

Roossien hopes that other Setser winners will follow suit.

"This will either be a very good story, or a sad commentary upon the church," he said. "So far, we are headed toward a tremendous testimony."

There have been few such easy recoveries in the Slatkin case, in which the legal fees have topped $22 million. Pilmer, the trustee's lawyer, said a few investors voluntarily returned profits, but most put up legal fights, the last of which are still playing out two years after Slatkin surrendered to federal custody and admitted his fraud.

In addition to Coyote, investors who resisted repayment included television legal commentator Greta Van Susteren and her husband, anti-tobacco litigator John Coale. The couple made nearly $1 million with Slatkin.

"I'll fight this thing for 100 years," Coale vowed after trustee R. Todd Neilson threatened to file suit in December 2001.

In the end, Coale and Van Susteren, as well as Coyote, returned 80 percent of their profits under a deal with the trustee.

CHURCH PUT TO THE TEST SOME NON-SCIENTOLOGISTS ASK IF MONEY ULTIMATELY WENT TO CHURCH

San Jose Mercury News (CA) - Monday, September 10, 2001
    Author: PATRICK MAY, Mercury News

His assets have been frozen, from valuable artwork and software company stock down to a single share of Krispy Kreme doughnuts. And Reed Eliot Slatkin, co-founder of EarthLink and a millionaire investment counselor, sits holed up in his estate, under the icy glare of federal authorities.

Investigators suspect Slatkin was running a huge international investment fraud, bilking what now appears to be as many as 850 creditors out of about $600 million.

But Slatkin's troubles are also presenting a public relations challenge to the Church of Scientology, a lightning rod for controversy since it was founded in the 1950s. His longtime connections to the church have some critics and investors wondering: Was the church a beneficiary of Slatkin's? A victim? Or both?

  15. Can I interject a slightly OT-but-Palin-related comment here? Gryphen, delete it if it's TOO off topic (but read it, ok?)

I just read on HuffPo that both Senator John Kerry and Senator Barbara Boxer have offered to debate Sarah Palin on the issue Palin wrote about in her Washington Post " 'Cap and Tax' Dead End" Op-Ed July 14th.

Quote: "We share her hopes for a substantive dialogue. But we want to put facts ahead of fiction and real debate ahead of rhetorical bomb-throwing."

I doubt that Sarah Palin will pick up the gauntlet if the venue is a face-to-face debate, but it would be informative and interesting if it were conducted even in a "chat" setting where interested citizens in large numbers could sign in to read the proceedings without crashing servers.

Here's an interesting clip about the ambulance chasing Scientologist who helped create the fund.

    From:

THE LAWYER AND THE THRILL OF DISASTER - JOHN COALE , HUSTLING PERSONAL INJURY CASES FROM BHOPAL TO SAN JUAN

    Washington Post - Thursday, March 12, 1987
Author: Stephanie Mansfield, Washington Post Staff Writer

Some people say he's a nut. Others just call him a maverick. Says Coale: "I consider my ethics much better than the American Bar Association. Those guys who continually depend on the status quo of corporate America ... The law, in big law firms and law school, is set up as a form of slavery. They run a game on these guys. They work 'em 80 hours a week and then if you're real lucky you get to be a partner and if you're real real lucky you'll make some money someday and they let you in the country club."

They wouldn't let John Coale so much as drive past the country club, but he doesn't mind. "I'm interested in upsetting those people."

It seems to me that Kristan Cole and John Coale (Greta Van Sustern's husband), as well as SP and TP (maybe even Bristol, as she is over 18) may be in legal trouble over the sloppy way these funds are being hustled....er, solicited and administered. I hope this gets out into the main stream BIG TIME!

I have the exact same problem with Diva's website. I cannot read it at all. I wrote her her and told her but oh well, she did not seem to care. It is also one site I cannot read on my iphone, period, because of the 3 columns. I she would redo the blog..I don't have problems reading the others. Gryphens, I can't cut and paste but not having other problems now.

Sorry for the OT, I am just glad I am not the only one who had trouble reading her site.

Backrounder on Randy Evans, who also claims to be the person who set up the trust.

Note the close ties to Ralph Reed and Susan Hirschmann, former COS to Tom Delay.

Those schooks, along with his representation of the corrupt Denny Hastert and ethically challenged Newt Gingrich, Evans is a backroom dealer who seems to pull a lot of strings.

Between Cole and her kooky ex-husband and grifter mom, Scientologist and Ambulance Chaser Coale, and this guy Evans, it's a rogue's gallery of characters behind this trust fund.

This woman is an EXCELLENT ATTORNEY.

EVERY PERTINENT ISSUE EXAMINED IN THIS ARTICLE NEEDS TO BE MADE PUBLIC.

DANIELS IS EITHER INCOMPETENT OR CORRUPT AND DITTO FOR THE PERSONNEL BOARD.

I had NO idea Daniels was basing his report on the Fund's site and not on the language on the official fund legal documents that were READILY AVAILABLE TO HIM.

This could blow Palin out of the water and if pursured vigorosusly enough by competent legal counsel could POSSIBLY end up with criminal charges against her. FRAUD ANYONE :)

HOW CAN WE GET THIS ANALYSIS TO THE MEDIA? START WITH HUFFINGTON ??

    ReplyDelete
  21. onejrkitty12:57 PM

IF Coale can be proven to have history of even "attempted" fraud and IF ( cannot remember well right now ) he was instrumental in or at least advised Cole about setting up this fund, then that puts more "lie" to Cole's claim that competent attorney's set the fund up.

I think it is possible to get criminal charges against Palin IF this fund can get investigated by a non-corrupt authority in Alaska. Not holding my breath.

AT MINIMUM, WE "NEED TO LET THE WORLD KNOW" ABOUT EVERY SINGLE ISSUE RAISED BY THIS EAST COAST ATTORNEY IN DIVA'S ARTICLE.

Can Shaynnan and Diva get together on this and get it to Huffington?? THINGS SEEM TO GET NOTICED BY MSM IF HUFFINGTON PRINTS IT !

NO TIME FOR EGOS AND PETTY PERSONALITY DIFFERENCES. THIS IS BIG STUFF AND NEEDS TO GET OUT THERE ! ! ! !

  22. I'm gonna cut Daniel a little slack. It wasn't his job to rule if the Fund itself was set up legally/ethically, just whether the Gov. was unethical in using her office to benefit from it and whether she used her position as Gov. in order to personally benefit herself of her family.

Therefore, he did not need to read the Fund documents themselves to make that judgement - what it said on the web page was enough about the Fund itself for him to conclude that, yes, there is 'probable cause' to suggest SP is in violation of whichever Ethics Act sections/subsections were the subject of this complaint.

    MarvinM:

Sorry buddy but you are totally not using critical thinking skills here !

Yes, the main focus was to see IF Palin gve her permission to the fund, BUT, WHAT SHE GAVE PERMISSION TO IS OF THE UTMOST IMPORTANCE AS TO WHETHER SHE ABUSED HER OFFICE OR NOT !

She abused her office in two ways:

    1) giving her consent for a fund that was constitutionally not legal.

    2) giving her permission for an (illegal) fund that was so ill structured as to appear to---and may acutally be perpetuating a FRAUD !

HOW CAN YOU DECIDE A FUND IS ILLEGAL IF YOU DON'T GO BY THE FUND'S OWN LEGAL PAPERWORK ?

It is so total stupidity/incompetence on the part of ANY attorney to reference the site instead of the legal documents that it appears the attorney was enabling Palin to "get off easy."

It doesn NOT matter that what was on the web page was enough to conclude probable cause ! ! ! !

NO ATTORNEY WITH ONE BRAIN CELL WOULD DO THIS.

An analogy would be reading a newspaper article where the writer gave his iterpretation of the Alaska Constitution instead of referencing the Alaska Constitution itself.

LEGAL REPORTS REFERENCE LEGAL DOCUMENTS, AND ATTORNEYS BY DEFINITION DO LEGAL WORK.
