well, well now. That sounds like a b**tch of an iceberg to me. I don't live in Alaska but hearing this in conjunction with that particular lawsuit, all I can say is that I wasn't expecting anything to come out of that left field. I imagine others may feel the same.
However, if the charges stand, that certainly will shed some light on how $arah really did run things, not to mention it should send red flags up to many other agencies who may be interested, if they're not already. You reap what you sow.....
I'd like to just say one thing. I read the complaint filed in the court. Evidently the "defendant" refused service of a subpoena.
My friend sued someone and they refused service. The court also sent a subpoena by U.S. mail (not certified or signature-required).
When the case came to trial, the defendant said she was not served. The judge ruled that refusing a summons or subpoena, and using the U.S. mail does legally constitute "being served".
As for the complaint, I'll leave that to others as well. These individuals ARE serious.

I read through the pdf on Alaska Report. This seems to be about some private citizens submitting a complaint for Palin's refusal to issue a Juneteenth proclamation.
So now these private citizens are citing attempted bribery?
Also note that this story isn't cited as breaking news on even Alaska Report. Doesn't seem to be much activity on the google news wire either.

To clarify: Go to the .pdf file and read item (2.) - they are amending the complaint to CRIMINAL due to information she tried to bribe someone to drop the original complaint.
They HAVE something - and a lawyer has a sworn deposition to back it up. Otherwise they wouldn't do this, it would be too risky without backup.
The lawsuit, a public document filed in the federal court for the District of Alaska, is a civil action that originated when the Personnel Board informed the (then lone) plaintiff that it could not deal with his complaint (about the ex-Gov not issuing a mandated Juneteenth Proclamation) under the Ethics Act because it didn't involve a claim of financial gain. The plaintiff then filed a civil rights action against the ex-Gov in the federal district court, under federal civil rights laws.
It looks like in the course of discovery in the lawsuit, the defendant disgorged certain material that the plaintiffs believe discloses an attempt to bribe third-parties with offers of substantial benefits if those third-parties could dissuade the plaintiffs from pursuing their lawsuit. The plaintiffs are seeking to amend their civil rights complaint to reflect this new information they received in discovery.
If the same information discloses a violation of criminal law, there would have to be a separate proceeding by law enforcement authorities to seek criminal charges if appropriate. If federal criminal charges were warranted, then there ordinarily would be testimony before a federal grand jury. Such proceedings would be secret, and the public would not hear anything about federal criminal proceedings unless/until indictments were returned, at which point any criminal indictments would be a matter of public record unless they were sealed. Any proceedings on criminal indictments, from arraignment on, would be public proceedings.
L.A. in S.F. - original lawsuit regards the Palin Administration NOT honoring the Juneteenth Proclamation. Could likely be overlooked/dismissed with an apology or a "we forgot and it will not happen again". BUT, amended complaint alledges that a bribe was offered to drop the complaint. If true, offering a bribe is the big deal - and such a dumb thing to do. I suspect the "bribe" will have to be on tape or in writing to prove.

I can assure you, the "feds" were notified and are involved on some level. Just because you don't hear about it doesn't mean it isn't happening. Look at Norm coleman (R) -- he was also sued by an individual for something which was a federal crime (pay to play) and he's being investigated by FBI. This was widely known but never reported until recently (the FBI part).

Sorry: I misread a clause in the amended complaint and no longer think this information was revealed in discovery. It sounds like the new information which forms the basis of the bribery allegation (and amendment to the complaint) came from some other source but only recently came to the plaintiffs' attention.

RE: Failure to accept service, read (4.). That really isn't a big deal since people assume they can claim they didn't get it. Mailing it to a home address is considered "service" and you are "served". Judges may indeed be wise!

Wow! A pro se litigant located in Washington, D.C. has evidence of the crime of attempted bribery in Alaska which he wants added to his civil lawsuit. He better have names and affidavits and recordings. Courts take a dim view of abuse of process. And in many states, perjury is frowned upon. Anon @11:38, I agree with you, as discovery would certainly not be going forward yet. No responsive document has been filed yet (as the leave motion indicates). Discovery won't happen until after that. BUT if no response is timely filed, they can probably file for summary or default judgment (not up on the terminology used in the US Federal Courts, sorry) on the basis that the suit is uncontested.

Scooter Libby was accused of revealing the identity of a covert CIA operative. He was found guilt of lying to the grand jury, and would have had to serve time except for Bush commuting his sentence.

It's only an allegation in a civil lawsuit. Period. It's NOT a criminal complaint, and even if it went to trial and a federal civil jury believed the bribery allegations, it wouldn't necessarily mean there's enough evidence for any state or federal agency to pursue criminal charges.
Just because someone files a civil suit in federal court doesn't make it "the feds" or make it a criminal complaint. And while refusing or avoiding service is stupid, it's not a crime.

Since I am not privy to this information, just got the info off of the complaint, it's obvious that evidence has come into Kim's hands. It was not itemized or detailed on the complaint to amend. The complaint states that she wants to amend the complaint due to new information.

Just what I have been saying, she stated the cost to AK to be millions, and it is less than $300,000 with almost $200,000 due to her Troopergate mess. So it stands to reason she greatly inflated her cost, to generate funds. Not to mention John Cole said she has not been out of pocket any expenses, not even payback on her children's travel. I hope she enjoyed those $700 hundred a night hotels, free vacations at least twice a month, $60 a day stay home pay, plus $60 phone calls. She quit because she couldn't get paid for the book deal while governor and it is worth a lot more, plus she knew a lot of the the stuff about to hit the fan could make them back out of the deal.

My read of the Amended Complaint is that KimC does not have an attorney; the first line of the Complaint indicates the plaintiffs as pro se, representing themselves. (That's not to say that they're not getting some help with drafting of documents and legal research though ...)
Of course, Alaska Report spins this as if its the Feds making the case against Palin, when it is not. A little research makes this clear, but apparently research is something that site and this blog have completely abandoned. You want to know who funds the smear campaigns and "spontaneous protests" of the Right? The same kind of people who read collections of wild accusations, propaganda and lazy "journalism" and think it the truth. I thought they were purely a creature of the Right until I found scores of them on the left, reading things like Alaska Report and this blog.
While there is no force on earth that could make this little blog comment show you how adopting the tactics of the right does the cause you purport to believe in far more harm than good, even if you yourself see some short term popularity, I would hope that you could at least try to see how what you are doing is the complete opposite of what you purport this blog to be about. Not only to reach the heretofore unconvinced, but to the general public, most of whom have never even heard about “babygate”. I did not hear about the fake pregnancy until AFTER the election. When I have mentioned to some people about the fake pregnancy, they scoff because they do not believe that ANYONE would fake a pregnancy, especially not a governor! Aaaarrrrgghh!
I am frustrated beyond belief when I try to make comments even on Huffington Post articles. If you have “fake pregnancy” in your comment, it is usually rejected. I do not use foul language, but I see so many comments containing some pretty foul remarks, but those are not rejected. Any babygate comments seem to be suppressed. Is that Arianna Huffington’s position, or are the moderators free to express their political views by allowing outrageous comments about our President but reject comments about babygate?
Some ideas to get the message out there:

Anonymous at 2:21 is right. My husband read it and said "it's nothing." Husband is a lawyer. He noted that it's a civil suit and the bribery alligation is criminal - apples and oranges. He said the only point of the amendment might be to call attention to the bribery, but bribery is criminal not civil.
I've read all the comments about how this is an allegation in a request for amending a civil lawsuit. I get that. It's quite minor in itself. But the act isn't minor.
I tend to be a bit reserved on where these minor allegations are going. I remember, vividly, reading a brief news article- two or three paragraphs, only- about 35 or so years ago. Some guys broke into the Democratic Headquarters at the Watergate Hotel in D.C. What a nothing story! I certainly didn't think anything would come of that.
So yeah, this is pretty minor. It's an allegation of illegal activity. There may be proof. And none of us know where it will end up.
What I did was take the pics of her that showed how impossible it could be that she had been pregnant to my gynocologist and asked her opinion. I then posted the results to my web page.
At the end of the page, I ask other women to do the same and post what your doctor says. It needs to be a OB GYN doctor if at all possible since they are specialist in knowing how a woman is supposed to look at each week of pregnancy.
My doctor really was shocked when I presented the pictures. I had her face covered so that she wouldn't know who I was talking about until she gave her opinion. I then told her about the 'Wild Ride'. She was just flabbergast.
I feel like if enough women do this and post what their doctors say, it might grow to be enough to have more news coverage and might for Palin into making a move.
And, I'd like to say, if any of you do this, please make a post on my blog with a link to it. I would love to report and have more links to other people who post what their doctor has said.
@3:01, gee. My dad's a lawyer, my brother's a lawyer, my uncle's a lawyer, my best friend's husband is a lawyer. Two close friends are lawyers. I could ask all of them for an opinion on this case. But since they all practice different sorts of law, why is their opinion more important than mine? It isn't.

I'd like to just say one thing. I read the complaint filed in the court. Evidently the "defendant" refused service of a subpoena.
ReplyDeleteMy friend sued someone and they refused service. The court also sent a subpoena by U.S. mail (not certified or signature-required).
When the case came to trial, the defendant said she was not served. The judge ruled that refusing a summons or subpoena, and using the U.S. mail does legally constitute "being served".
As for the complaint, I'll leave that to others as well. These individuals ARE serious.

I read through the pdf on Alaska Report. This seems to be about some private citizens submitting a complaint for Palin's refusal to issue a Juneteenth proclamation.

I can assure you, the "feds" were notified and are involved on some level. Just because you don't hear about it doesn't mean it isn't happening. Look at Norm coleman (R) -- he was also sued by an individual for something which was a federal crime (pay to play) and he's being investigated by FBI. This was widely known but never reported until recently (the FBI part).

ReplyDeleteSorry: I misread a clause in the amended complaint and no longer think this information was revealed in discovery. It sounds like the new information which forms the basis of the bribery allegation (and amendment to the complaint) came from some other source but only recently came to the plaintiffs' attention.

Wow! A pro se litigant located in Washington, D.C. has evidence of the crime of attempted bribery in Alaska which he wants added to his civil lawsuit. He better have names and affidavits and recordings. Courts take a dim view of abuse of process. And in many states, perjury is frowned upon. Alaska laws seem different from anything I've worked with, so maybe it's okay up there. I'm just saying....

Discovery won't happen until after that. BUT if no response is timely filed, they can probably file for summary or default judgment (not up on the terminology used in the US Federal Courts, sorry) on the basis that the suit is uncontested.

Martha Stewart served 5 months in Federal Prison. Although the original charge was insider trading, Martha ultimately served 5 months for lying to federal officials in the course of the investigation.
ReplyDeleteScooter Libby was accused of revealing the identity of a covert CIA operative. He was found guilt of lying to the grand jury, and would have had to serve time except for Bush commuting his sentence.
So, with Sarah accused of using state resources to bribe individuals to change their complaint-- it wasn't the original complaint. It may or may not have had traction. But trying to cover it up, aaaaah, that's another thing. It isn't the crime, it's the coverup. And, this time it's a federal charge, not something easily dismissed by pals on a personnel board.
Sarah Palin has always thought she was above the law. Just wave those skinny little hands dismissively, "oh that". ReplyDeleteIt's only an allegation in a civil lawsuit. Period. It's NOT a criminal complaint, and even if it went to trial and a federal civil jury believed the bribery allegations, it wouldn't necessarily mean there's enough evidence for any state or federal agency to pursue criminal charges.
Just because someone files a civil suit in federal court doesn't make it "the feds" or make it a criminal complaint. And while refusing or avoiding service is stupid, it's not a crime.

Since I am not privy to this information, just got the info off of the complaint, it's obvious that evidence has come into Kim's hands. It was not itemized or detailed on the complaint to amend. The complaint states that she wants to amend the complaint due to new information.
In other words - stay tuned ......

ReplyDeleteAlso from the AKreport: "Palin has claimed she has over $600,000 in legal bills from these complaints, documents so far have shown only $120,000 in bills." Just what I have been saying, she stated the cost to AK to be millions, and it is less than $300,000 with almost $200,000 due to her Troopergate mess. So it stands to reason she greatly inflated her cost, to generate funds. Not to mention John Cole said she has not been out of pocket any expenses, not even payback on her children's travel. I hope she enjoyed those $700 hundred a night hotels, free vacations at least twice a month, $60 a day stay home pay, plus $60 phone calls. She quit because she couldn't get paid for the book deal while governor and it is worth a lot more, plus she knew a lot of the the stuff about to hit the fan could make them back out of the deal.

ReplyDeleteanon@2:31: How about we do this? Civil lawsuit to begin with. Now allegations of bribery by a public official sort of takes it to a new level? I believe that this "civil" case will now include information to indicate a crime has been committed. Oops - civil becomes criminal.
We are truly about to see how smart her lawyer is. She will not dare allow this to default with these accusations - and we know she can't keep that big fat mouth shut.

ReplyDeleteMy read of the Amended Complaint is that KimC does not have an attorney; the first line of the Complaint indicates the plaintiffs as pro se, representing themselves. (That's not to say that they're not getting some help with drafting of documents and legal research though ...)

Of course, Alaska Report spins this as if its the Feds making the case against Palin, when it is not. A little research makes this clear, but apparently research is something that site and this blog have completely abandoned. You want to know who funds the smear campaigns and "spontaneous protests" of the Right? The same kind of people who read collections of wild accusations, propaganda and lazy "journalism" and think it the truth. I thought they were purely a creature of the Right until I found scores of them on the left, reading things like Alaska Report and this blog.
ReplyDeleteWhile there is no force on earth that could make this little blog comment show you how adopting the tactics of the right does the cause you purport to believe in far more harm than good, even if you yourself see some short term popularity, I would hope that you could at least try to see how what you are doing is the complete opposite of what you purport this blog to be about. Perhaps you *already* know, and this is just a quick way to get some strokes... at least *that* I can understand.
To make just one more small point, I quote from an earlier entry in your blog:
"I also learned that there was an incident back in the summer of 2008, before the McCain campaign officially tapped Sarah, where Todd Palin pulled a gun on Levi in a heated exchange concerning his relationship with Bristol. The "next week" is now over and no such story has hit the papers. Palin would tell her fans to "just be patient"... or blame the local papers themselves for being timid or biased...

Re BABYGATE, what is the best way to present the info we have right now so as to be clear -- like an "elevator talk," something we could present in 2 minutes to some important person (or even our best friend) to convince him/her?

It seems so obvious that she was not pregnant -- hoaxed us all, hoaxed the whole country -- but it's also puzzling that this obvious concept has not gone viral or been covered in the MSM. Why is that?

What? Some relatively benign Hitler-diary hoax gets miles of coverage in the MSM, the politically unimportant Edwards case ditto, but not this one which has SO MANY more important implications -- Why?

ReplyDeleteOh, did I mention I am also a Christian? I'm not for abortion, but I don't want to make it illegal. I teach my daughters to keep their levi's zipped, and I teach my son's to do the same. While some on this will disagree with me, I think it is possible to wait until marriage to have sex. Abortion problem solved. I also don't use my kids as cannon fodder to advance my personal career. Palin needs to go away. I pray this will put her away forever, so our beloved party can start to rebuild with leadership that has brains cells that operate.
Mom 7:07 thank you for posting. I am also a Republican Christian. I blame John McCain 100% for unleashing Palin. She is appalling! I am starting to wonder how many true fans she has and how much is nonsense. I don't know anyone who respects her! We belong to an evangelical church and people do not think highly of her. ReplyDeleteNot only to reach the heretofore unconvinced, but to the general public, most of whom have never even heard about “babygate”. I did not hear about the fake pregnancy until AFTER the election. When I have mentioned to some people about the fake pregnancy, they scoff because they do not believe that ANYONE would fake a pregnancy, especially not a governor! Aaaarrrrgghh!
I am frustrated beyond belief when I try to make comments even on Huffington Post articles. If you have “fake pregnancy” in your comment, it is usually rejected. I do not use foul language, but I see so many comments containing some pretty foul remarks, but those are not rejected. Any babygate comments seem to be suppressed. Is that Arianna Huffington’s position, or are the moderators free to express their political views by allowing outrageous comments about our President but reject comments about babygate?

Anonymous at 2:21 is right. My husband read it and said "it's nothing." Husband is a lawyer. He noted that it's a civil suit and the bribery alligation is criminal - apples and oranges. He said the only point of the amendment might be to call attention to the bribery, but bribery is criminal not civil.
ReplyDeleteI've read all the comments about how this is an allegation in a request for amending a civil lawsuit. I get that. It's quite minor in itself. But the act isn't minor.
ReplyDeleteI tend to be a bit reserved on where these minor allegations are going. I remember, vividly, reading a brief news article- two or three paragraphs, only- about 35 or so years ago. Some guys broke into the Democratic Headquarters at the Watergate Hotel in D.C. What a nothing story! I certainly didn't think anything would come of that.
So yeah, this is pretty minor. It's an allegation of illegal activity. There may be proof. And none of us know where it will end up.

At the end of the page, I ask other women to do the same and post what your doctor says. It needs to be a OB GYN doctor if at all possible since they are specialist in knowing how a woman is supposed to look at each week of pregnancy.
My doctor really was shocked when I presented the pictures. I had her face covered so that she wouldn't know who I was talking about until she gave her opinion. I then told her about the 'Wild Ride'. She was just flabbergast.
I feel like if enough women do this and post what their doctors say, it might grow to be enough to have more news coverage and might for Palin into making a move.
And, I'd like to say, if any of you do this, please make a post on my blog with a link to it. I would love to report and have more links to other people who post what their doctor has said.

@3:01, gee. My dad's a lawyer, my brother's a lawyer, my uncle's a lawyer, my best friend's husband is a lawyer. Two close friends are lawyers. I could ask all of them for an opinion on this case. But since they all practice different sorts of law, why is their opinion more important than mine? It isn't.
