Sherry Johnston hopefully headed home for the holidays, and my afternoon with "Team Levi".

Today was Sherry Johnstons's sentencing. And I decided that since no other media in town seemed interested in covering it, that I should go and report back what I witnessed.

I left my house at 9:00 A.M. to make the hour long drive to the Palmer Courthouse, in order to be there in time for the 10:30 sentencing.

I have to say that Alaska was really putting on a quite a show today, with a brilliant blue sky and frosted trees along the road that were quite breathtaking. With such scenery to keep my eyes entertained it seemed that I was at the courthouse in no time.

I drove up and took a seat inside courtroom number 7, at about 10:15 and waited for the proceedings to begin.

The room had only a few people inside. I saw my friend Dennis Zaki setting up his video camera and waved hello to him, saw a print journalist from, I think CBS, and the rest were just looky loo's who were there to get a look at Team Levi.

A few minutes later the door opened up and the massive Tank Jones stepped into the room. He was quickly followed by the rest of the team, Rex Butler, Mercede Johnston, a young man whose name I did not catch, and Levi himself.

The whole group was dressed in expensive clothes and looked like they could have stepped right off the pages of GQ magazine. (Of course with cameras on them all of the time now they have learned not to go out looking shabby, because guaranteed THAT is the one picture that will show up in a tabloid.)

As the rest of the gang sat down, Tank walked over to shake my hand, and to give me hard time about being a "pretend journalist". We bantered back and forth for a few minutes and then he went back and sat with the kids.

A little after ten thirty a door at the side of the courtroom opened up and Sherry Johnston was escorted in wearing handcuffs. I immediately noticed how thin she looked in her yellow prison outfit, and wondered if her health had taken a turn for the worse.

Sherry looked up, and seeing her children immediately caused her eyes to well up with tears. As she took her seat next to attorney Rex Butler, I noticed as she reached up to wipe a tear away and suddenly realized just how hard it must have been for her to be separated from her family for these last three months.

We all stood up for the entrance of Judge Eric Smith. Then the prosecutor read the charges that Sherry had plead guilty to, Rex Butler spoke a few words about Sherry's medical situation and some special conditions that they previously worked out, and then Judge Smith was ready to read the sentence.

The Judge seemed very sympathetic to Sherry's plight and made mention of the fact that this was a very unusual case. (Gee, ya think?) Still, he said, she had broken the law, and selling prescription medication was a serious crime in the Valley. He wanted to make sure that she understood how serious it was and that other potential drug dealers did as well. Still, he said, she had a very clean record up to this point, and had sold her Oxycontin to just ONE person, a total of only three times. And he did not anticipate her making this mistake again.

Then the judge delivered his sentence; 3 years in prison, a $2,400.00 fine, and three years of probation, (She should be able to serve her three years in her home with an ankle monitor, once the state checks and makes sure her home is compliant with the regulations). He further stated that he did not expect to see her in his courtroom ever again under similar circumstances, but hoped that someday she might return to serve on one of his juries. Rex Butler told the judge not to worry, that Sherry would NEVER be back in front of him again. And then Sherry thanked the judge for his kind words.

Sherry was then led away in handcuffs as her family stood by and waved to her as she passed. (It will take a few days to process, but there is some hope she will be home in time for Thanksgiving.)

(I had hoped to get some pictures, or video, to post with this story. But Dennis made a deal to sell what he filmed to another media outlet so I have to wait, and link to them when they post it, or borrow it and embed it here once its online. Either way, I will make sure you all get a chance to see some video.)

With the sentencing over we were asked to clear the courtroom for the next trial, so we all poured out into the hallway.

Once there Tank called me over and introduced me to Levi. I had never met young Mr. Johnston before and found him to be a very typical nineteen year old, with a good sense of humor and pleasant demeanor.

I spent about an hour talking to Levi and Mercede in the hallway as Tank and Rex made business calls. We spoke about Levi's adventures, and how happy he was to be back. I listened as Mercede engaged in some good natured teasing of Levi about his clothes, and we both gave him kind of a hard time about a laptop carrying case that looked suspiciously like a "man purse". (Later when they went outside for some photographs I suggested that Levi give the bag to somebody else to hold, just to give his detractors one less thing to give him crap about.)

I know you are all wondering if I asked about "babygate" or Levi's book, and to be honest, no I did not. We were in a fairly crowded hallway and I did not want to talk about those sensitive topics with so many ears close by. We DID talk about a number of things, but I cannot share too much with you here because, in order to put them at ease, I told them our conversation would be off the record.

I can share with you that Levi has NO idea what Sarah is building on her property however. He also shared some of his feelings about Sarah, but I will not repeat them here. He also misses his son and hopes to be with him soon. Beyond that I need to honor my promise.

I will tell you that I was again struck by how attractive and well spoken Mercede is in person, and impressed with how natural she is in front of the camera. Even though she says she wants to pursue a medical or law degree, I think she could have a future in broadcasting. I am just saying.

All in all I really enjoyed meeting Levi and was very impressed with his dedication to his family. (He interrupted his publicity tour for Playgirl and flew back into town just to support his mom) It is easy to ridicule Levi for being a fame junkie, or for chasing after attention ala Sarah Palin, but that is missing the point entirely.

Levi is doing the only thing he can to pay the bills. He has a son that he loves, a sister that is just now finishing school, and a mother who has been locked away from her family for three months! Who else is there to bring home the bacon? Levi is the only person with the means to support this family. Who do you think is going to pay that $2,400 fine? Or the house payment? Or the utilities?

I know what you are going to say, "Then why doesn't he just write the book?'

And my answer, "Who says he isn't?"

    There's no reason Sherry can't serve her time at home. She's not a flight risk and she's not a danger to the community. I'm sure if she has an electronic anklet on there's a way to get her to her doctor's office and to church, if she wants. Actually keeping her in jail makes her an expense to the community and for something that most people get probation for.

    I am so happy Sherry can go home and do her home confinement. Its so very obvious..."had sold her Oxycontin to just ONE person, a total of only three times....."This was a setup! I hope that all gets cleared up also.
    I hope Levi, Mecede and Sherry get to have a nice Thanksgiving together! Tripp too!
    Meanwhile people need to be speaking out about the Ms queen teabagger.

    Surely Keith Johnston has to pay some sort of alimony as Mercede is still in school?

    I'm not saying that it will be enough but it is likely to be reasonably substantial.

    My heart goes out to Sherry Johnston and I hope that she can serve her sentence at home. Prison in this case doesn't serve anyone.

    We all make mistakes. Sometimes, we make terrible, horrible and hurtful mistakes. But one thing that is part of our American story is the second act and the possibility of redemption. I hope that Sherry Johnston, and her children can support each other, learn from the past and move forward into a positive future.

  15. Two thoughts:

    1) Where is Keith Johnston and why is he not responsible for supporting Mercede and Sherri? Why is the burden being put on 19-year old Levi. Was there no alimony and child support order in the divorce?

    2) I am so happy for Sherri and the Johnstons. But I fear this means that Levi will never tell what he knows. I think had she been sentenced to prison - he might have told the truth out of anger. But now he has no real reason to say anything, when doing so might hurt Bristol.

    It is good news today for the Johnston family. I am sure they recognize the severity of the situation and have learned much from this experience.   17. I am glad there was not many there. But shocked that there were not. I would not go as i thought there would be goobers gawkers goollywogs galore. Not something i would care to partake in. But we are glad you did. And you got a chance to shoot the nuggets with Levi! So the question is...does he follow whats being said?....is he now going to follow whats being said? Is his humor jaded or free flowing? And And are you going to get a sitdown interview?...I know you wont tell. Dawg.

  19. Gryphen this was very interesting - thanks for giving us the details of this day. Many people who have followed this family's saga will be pleased overall that Sherry can serve her harsh sentence at home at least where she can get proper medical care and be with her family.

    Levi and Mercedes - way to go both of you. You have a lot of love and support from strangers like me who appreciate what you've been put through and your values and your willingness to fight. And Tank - good job with the advice. It didn't seem maybe quite the right road at first, but now with time your strategy has gelled and Levi has a fresh, young and positive image which reflects who he is accurately. You've gotten a buzz going and protected your charge all at once. You are sort of a big groovy angel aren't you?

    If you can make enough money to do so Levi, both you and your sister should go on to higher education. (just my two cents)

    I've a huge family... we reach all over the state... it amazes me how much they support Sherry and her family.

    It is like they (my family) are even talking about it. It is quite positive.

    I am thankful to see even my elderly aunties are giving her a little prayer.

  24. It does appear that the Daily News got the sentence completely wrong. They say three years in prison AND three years probation. From my 30+ years of experience with Alaska's court system, such an extreme sentence would be most unusual for a first-time offender. I hope they make a correction.

  28. Since ADN is reporting that Sherry has to serve three years (and mentions a SPECIFIC facility), and Gryphen states she "should" be able to serve the time in her own home - what do we surmise?
    IF they are actually considering the house confinement (after checking out the home), WHEN do we know for sure? Timeline on this Gryphen?
    IMO Levi cannot talk (write book) until he knows for sure that mom will be at home - he would be stuck waiting for 3 years, lest his mom be abused in a prison (don't forget that scarah's ex BF is in charge of the prisons).

  30. The decision over whether Sherry can go home or not has to be determined by an investigator, who will go to Sherry's house to make sure it meets all of the criteria.

    I talked to both Tank and Rex about this and they both felt that it was just a formality and that she would be home. But they don't know if the inspection will happen before Thanksgiving.

    Now just to make you crazy let me share this little tidbit. Sherry COULD have been put on house arrest originally and completely skipped going to jail, but for the fact that she had not had the money to pay her phone bill. Without a land line in her house she was unable to be assigned an ankle bracelet. Tank paid that bill immediately when he found out, but the courts refused to revisit the issue until this sentencing.

    When I say that Sherry was desperate for money to pay her bills, I am not kidding. And that is why Levi is trying to get some greenbacks in his pocket. In order for Sherry to stay in her home she has to have her electricity turned on and a working land line. Let one of these get turned off and she is right back in prison to serve her sentence the hard way.

    And the ADN did get it wrong because all they did was call the courthouse. They did NOT show up and interview the lawyer, the family, or Tank. If they had, they would know what you all know.

    But then again maybe not, because SOME people are a little fed up with them.

    More info on Alaska's House Arrest Program - costs go beyond having the lights on and a phone line. It costs prisoners $99 per week to be on the program, payable in cash at the required weekly visit w/ the state corrections people. That adds another $400 a month to her living expenses for the next 3 years. Ouch. Double ouch on the alternative though....

    Gryphen, it is stated in court records that Sherry Johnston receives child support and medical disability payments.

    Can you confirm this? Have any of those payments stopped due to her imprisonment?

    I don't even know this family, and this whole situation gets me so angry. This thing sounds to me like a set up. Why so long for a first time offender? I just don't get that.

    I just want to jump in here and note that here in Eastern Kentucky there are many MANY people who are arrested for selling hundreds of Oxycontin tablets and they are still walking on the streets.
    The shopper-doctors are ALSO walking around (or if in jail..they are in local county jails on work release).
    Methlab arrrestees don't have this much court/jail stuff (including th ose who have child abuse charges because there are young children in methlab homes).
    Sherry's experience is outrageous.

  49. Gryphen, don't you find it more than a little bit outrageous that Sherry Johnston has to grovel to get ankle monitoring while Officer Alleged Serial Rapist has no problem? Was this event today a change of plea and sentencing, or had she already pled to the charge? I understand that OASF has pled innocent, and that he has not yet been tried, but it still bothers me that bail was so easy for him.

  52. Sherry Johnson's case highlights the huge problem of malicious prosecution that goes on in Alaska due to political pressure. It also highlights that harsh sentences are given out for first time offenses when probation is the best answer. The sentences BTW are set by our legislators and the judges have to go by those guidelines. A 3 year sentence would be reduced to 2 years with good behavior. She can apply to have home monitoring and there is no reason they should turn her down. She has to have a dedicated phone line just for the monitoring equipment and pay for it. Many people can't apply because they can't afford it.

    I agree! Not only that but he is such a worm & deceitful bastard that he wouldn't be truthful about his bad choice & judgment after the election or allow his staff to be thus leading the way for Sarah to rise again. If he had done the right thing she would be finished by now.

    Tank is a clever fellow & a good PR man. He must read the blogs & realize what a great way to spread the news. What a sad situation. Retalliation is a real problem. around there & I thnk maybe that makes Levi very careful. The Palins are from hell. They have no more respectibility than the Johnstons & I think Levi & Bristol more or less ran the Palin household while Sarah & Todd were busy. Sherri sentence seems very harsh to me .

    This is such a miscarriage of justice. $carah gets her revenge, after all, is how I read it. Drug laws are breaking up families in tough economic times and I'm sure $carah "Mrs. Family Values" is having a hoot over Sherry's sentence.

    May the people involved in this set up burn in hell. And may Sherry, Levi and Mercede succeed in keeping family, and hope, together. Congratulations to Rex and Tank for looking out for the best interests of their clients and protecting them as no others would.

    This is NOT prosecution it is PERSECUTION.

    What good did this do anyone, except Sarah Palin's relish, in causing terrible trouble for this family?

  58. $99.00 per week seems excessive. I know that Emergency Response buttons here in GA are about $32.00 per MONTH. This is also a monitoring system.

    What would make this system cost over 12 times as much? In 3 years, the state will have made over $14,000 on this woman who hasn't even been able to afford a land-line. Even if she just has to serve 2 years, that is still over $11,000 dollars!

    Something seems very wrong with this. It would be interesting to look at the state's books and see how many first time offenders have been put on house arrest and how much of a profit margin has been worked into that $99.00 per week cost.

  60. Absolutely outrageous treatmen of Sherry. This has the Palin smell all over it. It was obviously a set up. Levi has been keeping his cool and will probably do so until the custody/visitation issues with his son can be worked out; but after that I think he will consider his options. The Johnson family has suffered enough and I applaud him for doing what he has to in order to take care of his family. Unlike, Scarah, who just takes money from anyplace she can get it, just to build a monstrous eyesore and get cosmetic surgery, etc, etc. and keep on lying. Palin is toxic.

    To all who are interested in what Sherry's income is (alimony, etc), it is not our business. That being said, I would be willing to donate a small sum to help.

    Either the family is destitute or not. Mercede went on a huge holiday at the beginning of the year. She always looks remarkably well groomed and Levi has a gym membership.Levi has a shiny new truck. Why can't the family pay a telephone bill?

    The phone bill part makes no sense.

    Sadie was just harping about her cell phone being hacked. She has a cell and lets Mom go to jail? Didn't Sadie graduate from school last year? Is she saying he is in high school now?

    If Keith is only getting a divorce now, he was responsible.

    There is something very wrong with that part of their story. Why make Palin look right about their character now?

    Someone needs to do more fact checking or re-check sources. Sadie is spellbinding and pretty, but not that different from Palins. Have you talked to the Chandlers?

    I am sorry to see the Johnstons come off as liars or flakes. Sherry has pain and meds to excuse her. Sadie and Levi are young, but old enough to know not to lie or fudge. Keith has it on him if he is allowing children to forsake their sick Mom and he is not taking care o her health necessity.

    This stinks to high heaven. Why give Palins this blessing? ADN is useless.

    The informant who is part of the close knit family community. Don't be shocked if they have three-time customer/informant over for turkey dinner.

    What happened to Sherry in the system should be of primary concern. Not protecting certain people. McCain/Palin are not the only ones who get the privilege of special treatments.

  66. I know that Sherry is receiving some disability payments but I am not sure how much they are, and I am not about to ask. As for other sources of income they were not quite enough to pay Sherry's bills which is why the informant was able to talk her into selling him her medication.

    Concerning Sadie's cell phone bill, I have no idea who pays that. For all I know she may pay it herself, or her dad might pay for it, or even Team Levi.

    As for Sherry's land line, it was definitely turned off, but it is possible that she chose to use only her cell phone and not have to pay two bills. Whatever the case it caught Rex by surprise as they did not know her phone was not in working order. The ankle bracelet requires a hard line phone, for obvious reasons.

  67. This whole thing about the land line bothers me. In many cases every member of the family now has a cell phone. If so, the land line can be redundant. I know several families who have gotten rid of the land line and they all just use their cell phones. There is a recession going and and that was a factor in getting rid of another bill for something they were not using.

    I really have to wonder, if you are "well connected" or a big shot and you don't have a land line, will they let you have a few days to get one in and THEN schedule the inspection? I find it hard to believe that *every* person who could otherwise qualify for home monitoring would be denied for this reason AND given no chance to fix the situation before the next hearing that is months away. Just another aspect of this case that smells...
