Palin e-mail "hacker" found gulity on only two of the four charges!

KNOXVILLE, Tenn. — A federal jury has convicted a former Tennessee college student of two charges in the hacking of Sarah Palin's e-mail account.

The jury convicted 22-year-old David Kernell of unauthorized access to a computer and obstruction of justice. He was found not guilty of wire fraud and the jury failed to reach a verdict on identity theft.

I doubt his sentence will be very stiff. 

Oops I may be wrong according to ABC News:

He was found not guilty on a charge of wire fraud, and the jury was deadlocked on the charge of identity theft.

Prosecutors say they'll try him again on that charge.
He could be sentenced to up to 20 years in prison on the obstruction charge. The jury deliberated for four days before reaching a conclusion on three charges.

Jesus he could STILL get 20 years?

Well I damn sure hope that if they attempt to try him again on the identity theft charge that Wade Davies gets Sarah Palin and her family in the witness stand, and this time, "Grill, baby, Grill"!

My family and I are thankful that the jury thoroughly and carefully weighed the evidence and issued a just verdict. Besides the obvious invasion of privacy and security concerns surrounding this issue, many of us are concerned about the integrity of our country's political elections. America's elections depend upon fair competition. Violating the law, or simply invading someone's privacy for political gain, has long been repugnant to Americans' sense of fair play. As Watergate taught us, we rightfully reject illegally breaking into candidates' private communications for political intrigue in an attempt to derail an election.

I want to thank the public servants who worked so hard on this case, particularly the jurors who gave up precious time from their jobs and families to listen to the evidence and reach a decision.

My family and I appreciate the good people of Knoxville, Tennessee, who showed us true Southern hospitality. We can't wait to visit again - but without having a subpoena in hand.

  6. Was the unauthorized access charge the felony version or the misdemeanor version? The judge will certainly take that into consideration when deciding on a sentence for the obstruction charge.

    I was there for part of the trial. Federal sentancing doesn't have a lot of discretion built into it. The likely sentance will be 36 to 60 months with 12 to 18 to actually serve. Deviaton within the range is ok but outside almost never allowed. Community service isn't on the list for the felony. Long term this conviction will affect college admission security clearance govt employment gun ownership ability to be bonded and admission to state professional board. This young man did something incredibly stupid and absent intervention by the president he will pay for the rest of his life.

    Gryph - Please consider pointing out in the post that the 'unauthorized access' guilty verdict was for a misdemeanor...not the felony Ms. Poutyface expected. I believe this means the prosecution didn't prove intent to disrupt the campaign. I don't know if the class of misdemeanor was ever reported.

    I've read some vicious assumptions that her people believe is the gospel. Because he is the son of a democrat, he is working for President Obama and paid by Soros... crap like that. From there Palin can jump to comparing this to Watergate.

    I don't think the defense will be too happy with the felony. The whole case is a set up.imo. Idk what is next. I don't want this kid to have a felony record or do any time for this malicious case.

    Prosecutors say the packages contained a computer disk labeled "Anthrax Shock and Awe Terror" and a small packet of sugar relabeled with a biohazard symbol and the words "Anthrax sample."

    Keyser is scheduled to be sentenced Nov. 30. He faces up to five years in prison and a $250,000 fine for each count.

  18. Gryph - would love your opinion of Van Flein's statement trying to elevate the verdict. I wonder how much influence he had on prosecutor, the charges and the possibilities given to Kernell for a plea bargain.

    In NYC a PR person was convicted of felonies for hacking (real hacking) into computer and voicemails for rivals, she serves two years community service the felonies are erased.

    So there is leeway.

    Furthermore, it was not the other campaign that guessed her password and took a peek.

    Memogate, also called Cybergate, was the internal U.S. Senate investigation "into whether Republican aides unethically (and perhaps illegally) tapped into Democratic computer files containing private judicial-nomination strategy memos and leaked them to the press."

    I think reference to this case is more appropriate than Watergate but what do I know!

Yes, this young man even though not serving perhaps a lot of time behind bars, will have the rest of his life affected by this when he goes to fill out any application. Unlike Willow for her indiscretions for drunken disorderly conduct, breaking and entering a house and trashing it, Mommie Dearest was able to use her ill-gotten influence to sweep that under the rug. If I never hear the name Sarah Palin again I consider it a gift from heaven. Unfortunately for us all, she is not going away. I am totally disgusted.

    Hey, everyone, this is about Trig. As in, don't invade my privacy and medical records to show that I faked a pregnancy. (After all, faking a pregnancy is a highly private act). Methinks she is deeply worried about her medical records, which do not show she gave birth to Trig and which may reveal a pre-Trig hysterectomy.

    Of course, people live Levi know the truth and don't need to snoop around her medical records to reveal it. What is he waiting for?

  42. Interesting verdict. It looks to me like the jury DID go more for the "prank" characterization: "unauthorized access to a computer" = misdemeanor.

    The jury did NOT convict on the "wire fraud" and "identity theft" felonies.

    The guilty verdict on just one of the felony charges -- "obstruction of justice" -- had nothing to do with the actual "hack," but involved all the stuff that moron did afterward, trying to cover his tracks and hide evidence from the FBI, including deleting the information he'd accumulated, clearing his browser history, uninstalling browser software, defragging his drive, and publicly discussing online whether to reformat his hard drive.

    If he hadn't done all that, he might not even be facing any jail time; just conviction of the single misdemeanor.

    (Also, too, I call bullshit on the Watergate comparisons. JHC!)

    Well shoot I was real close in my prediction in an earlier post. I didn't think they could get him on obstruction of justice because you don't have to help the police or prosecution in their case against yourself. I don't know what he did to obstruct the investigation but I hope the judge is kind in his sentencing. Sarah is fucking crazy this is nothing like Watergate but of course this is from someone who doesn't know anything(Steve Schimdt) especially History. We win ('08) you lose shut up shit down.

    The crime AT the Watergate was an attempt to get information. However, Richard Nixon resigned because of his crime of obstruction of justice. "Watergate" is a term that covers both episodes.

    as for kernell, i am glad that he was found guilty on only two counts - one of them is even questionable. i hope that they are more than fair with the sentencing - he was just a kid and in truth this prank hurt no one.

    I'm not sure if anyone has mentioned this, but... I would think Palin is steaming mad about this verdict. I'm mean, sheesh! He was convicted on a MISDEMEANOR unlawful access violation. The bigger crime was obstructing justice. The crime against our justice system was more important than the "crime" against Palin. I'm still laughing.

    I think the prosecution would look sily, even in TN, in retrying the ID theft. It's not like the kid opened financial accounts or loans in her name.

  57. This is sickening. Sarah Palin is truly a vendictive sociopath. She gets her kids off of all kinds of charges, yet tries to get someone else's child sent to prison for a prank. Her kids destroy property, use illegal drugs, drink alcohol, have sex parties, but a computer prank done by a kid(yes college age is still a kid)is treated like a hardened criminal. Will he have an SIS with the charges taken off his record after probation like Todd's sister Diana who committed several counts of burglary using her child to faciliate entry? We have a two tier justice system in this country. Those on one tier go to prison and have their lives harmed and those on the other tier ususally don't even get charged. If their crimes are so bad they do get charged the corrupt officials and judges make sure their sentences are light.

    Palin's silly "derail the campaign" bullshit hinges on a misdemeanor charge. I wouldn't be surprised if the defense appeals the felony charge of obstruction.
