Sarah Palin threatens to sue Random House for publishing "The Rogue."

Sarah Palin’s family attorney John Tiemessen has written a letter to Maya Mavjee, the publisher of the Crown Publishing Group, a division of Random House, that Palin may sue her, the company, and the book’s author Joe McGinniss “for knowingly publishing false statements” in his book released last week, “The Rogue,” ABC News has learned. 

A source close to the Palins tells ABC News that the “Palins are fighting back and demanding answers from Random House.” 

“Random House is at the top of the food chain and published a book based upon acknowledged unsubstantiated gossip,” the source said. “The revealing email is key as evidence of this defamatory approach to politics through proxies.” 

Tiemessen writes in the letter that the email “clearly describes the fact that Mr. McGinniss researched and investigated many false and scurrilous allegations, and concluded that there was absolutely no evidence anywhere backing these allegations.” 

Palin’s attorney writes that it is “malicious” for Crown to publish the book when it has proof McGinniss and Crown “were fully aware the statements in the book were false, intended to be false, and were intended to harm.” 

“The final work that was published contains most of the stories that Mr. McGinniss complains were nothing more than ‘tawdry gossip’ that amounted to the wishful fantasies of disturbed individuals,” 

Tiemessen writes. “Since both your company, and the author, clearly knew the statements were false, admitted they had no basis in fact or reality, but decided to publish in order to harm Governor Palin’s family, you and Mr. McGinniss have defamed the Palins.” Tiemessen ends the letter by warning the publishing house not to “delete emails or destroy records” that may be used in the suit. 

The email Tiemessen cites in his letter to Mavjee came to light last week when conservative blogger Andrew Breitbart posted an email between McGinniss and liberal Alaskan blogger, Jesse Griffin. In the email posted on Breitbart’s site without explanation for how they got access to it, McGinniss writes, “Legal review of my manuscript is underway and here’s my problem: no one has ever offered documentation of any of the lurid stories about the Palins.”

I don't know how Joe feels about this but I say "Game On!'

Those of us who have been blogging about Palin for years have been dying to get her into a court room just for the opportunity to go through the discovery portion and watch her try to prove she DID give birth to Trig Palin on April 18, 2008.

Of course Joe did not make that allegation exactly, but he DID make some rather scandalous allegations that I am beyond confident he has the sources to back up.

By the way Palin is famous for threatening to sue people, and then backing off.  I have to doubt that THIS time she will actually go through with it either.

Oh sure it will excite the Palin-bots into a masturbatory frenzy, but does anybody REALLY think she wants all of these scandalous stories played out in a courtroom in front of the national media, who will all of the suddenly take a MUCH more intense interest in a book that she wants everybody to ignore?

But hell if she DOES sue, how much would you give to be a fly on the wall and hear Alaska Republican Lyda Greene, ex-Head of Security Gary Wheeler, Troopergate victim Walt Moneghan, and ex-boy toy Glen Rice testify under oath concerning what THEY know about the Grizzled Mama?

I swear I will clear my entire calendar the minute they start jury deliberations! I would not miss it for the world!

    Grrrrrrrr......... Al Sharpton at the end of a segment said "And breakingg, ABC news is reporting that Sarah Palin is not running for President." Then he went onto something else and that was it. I watched the rest of the show and nothing, nor can I find anything on the web.

I told the dickweek at Alaska WTF on Saturday that he was implicated and ratted out by McGinnis. I told him to liquidate and take his money and run while he could. He's gone today, vanished into thin air, at least on the web.

    Knowing lawyers like I do and how litigation works you little person are possibly going to suck wind if they do a google search. Like WTF you might want to consider leaving town. Years of lawsuits could be in your future. You might want to clear you calendar for that. Heh.

    Anyone with a brain knows how near impossible it is to sue a blogger or a writer when the "stories" they put out are gossipy in nature.

    1. The suit will take years
    2. The proceedings will cost shitloads of money
    3. There's really NO point unless it's a Michael Jackson type case that ruined his reputation. (I feel comfortable saying no one's opinion was changed regarding Sarah, as most people 1. don't pay attention to petty anon gossip and 2. most don't BELIEVE petty anon people)

    She's caught between the proverbial rock and hard place. If she doesn't sue then she has tacitly admitted to the actions. If she sues (or makes the motions to do so - a la her "presidential bid") she is defending herself. But if she actually takes it into a court of law, then she's toast. Palin probably doesn't realize that Random House has way more money and lawyers than she does. And they won't be scared of her threats. She's never had that experience before where the one she bullies doesn't cringe from her wrath, or where she wasn't able to cut and run from being forced to answer for herself. I think Sarah is going to find out that it won't be so easy to do so now.

    According to you and Joe, Gryph, Random House lawyers disallowed things in The Rogue. Hence, there CAN not be a lawsuit because it's proveable.

    I just finished the book and it was a great read. My opinion, and my opinion alone: The reason MSM/TV is not devoting time to it is Chapter 19. Joe does an excellent explanation on media and the press, and AGAIN ties it up in a nice bow at the end.

    We know Sarah does not know any Supreme Court cases (Katie Couric asked) and evidently neither does her lawyer because this case is a total non-starter under long ago established Supreme Court decisions. I am sure the publisher has a form letter legal is marking up advising her "legal" team of this.

    I love how the whole basis for her "potential" lawsuit hinges on a scurrilously acquired private e-mail. What a hypocritical witch. Who is the unnamed source who provided Breitbart with that e-mail? It's only fair that they disclose their source since she hates anonymous sources so much.     This from a woman who made sure a 20 year old was charged and found guilty for hacking (guessing the password)her yahoo e-mail account and sharing it's contents. She felt violated. I guess other people's e-mails have less meaning to them if you can use them to your benefit.

    Plus the whole logic of the argument is a bit off. McGinnis is saying he didn't find proof for some of the stories back in January. That doesn't mean he didn't find proof later on before it went to press. If anything, to me, the e-mail showed his integrity. He wanted solid sources before adding the gossipy items to the book.

    This is an empty ridiculous threat that will probably get more people to read McGinnis' book. She knows McGinnis is smarter than her and she knows he'd love to defend himself. Discovery would be a bitch especially since he included a chapter about Trig!

    I think Random House can get a much better and effective attorney than that poor kid did during that sham trial over Sarah's yahoo account. She lied her butt off and then Bristol lied her butt off (a much harder task apparently).

    Both Sarah and Bristol should have been up on perjury charges. It would have been easy to blast their lies about living out in the boonies. But no, the defense team didn't do that - great opportunity wasted.

    But if Sarah thinks Random House will roll over, she may want to think again. There just may be people sending in money for a legal defense for Joe. Wouldn't that be ripe? Lots more of us than bots and even in this tight economy, I bet there would be money flowing in for him.

    So Sarah, go think on this for a while and then think some more. Do you really want to milk your bots for money like that. When the truth comes out, they will be very, very angry and you know how badly they behave on your behalf, consider how badly they will act towards you once they realize you've been defrauding them all along.

It's the unknowns, the what-ifs, the "am I taking a stupid, thankless risk...? which give me pause. (although not enough to change my mind about doing this)


    I have said all along, my main reason for being scared isn't Sarah herself; it's the out of control vitriol employed by her army of sycophants.

    As for me being "rill"...today I've had a fabulous chance to prove my "rill-ness"--I know for a fact Sarah is having two speeches written right now. The OTHER one (the one my gut tells me we will hear) explains how "even though it breaks my heart to disappoint those who have stood by me during this difficult decision process, at this time in my life I cannot pursue the presidency"...

    Now, the "dill" is...I got some very specific details about both speeches. But instead of posting it now, or sending it to Gryphen...and then her just changing it enough to make me look wrong, I'm going to wait until we hear from fox or CNN or whomever that "the governor" is going to make a speech shortly...and then post the details! I think it's a great idea to one, drive her mad--always a plus and two, even the most "me-nostics" will have to concede that I couldn't get SUCH specific details without a window to the inside.

    Is anyone else getting a chuckle out of Sarah's lawsuit chatter against Joe and HC? At the VERY first mention of "evidentiary discovery"...Sarah's going to be all "law suit? Noooo, I said....raw fruit, see..."

    If a politico could sue for "lies" and actually win, don't you think Santorum would sue over the definition of his name. After all, it can be traced to someone who coined it. There is a Spreading Santorum website.

I usually have a lot of housework to do, and I get so caught up in reading (my favorite hobby) that if I bought the hardback, I'd not get anything done until I was finished...and while I DO read fast, it's still not good to get so sucked in.     The plaintiff must prove actual malice in a libel suit. That means Palin will not only have to prove that the allegations were false... she would have to prove that they were knowingly false and used to harm the individual.

    However, one defense that can be claimed is that the plaintiff is libel-proof - or that their reputation is so bad that the even though a tort with malice is proven, the defendant wouldn't be liable for damages (like shooting a corpse).
