A woman in Florida "stands her ground," fires gun in self defense but injures no one, and now faces twenty years in prison. Oh, did I mention she's black?

Marissa Alexander faces 20 years in prison for Standing Her Ground.

Her husband had a history of domestic abuse and even beat her while she was pregnant.

After yet another beating, Alexander fired a warning shot into the ceiling. That shot saved her life.

Prosecutor Angela Corey did not take into account that Marissa Alexander:
  • Had a court injunction against her crazed husband, 
  • Had Given Birth 9 Days Earlier,
  • Was trained to use a weapon and earned a concealed weapons permit. 
She is currently sitting in the Pretrial Detention Facility in Jacksonville, FL, Duval county awaiting a sentence of up to 20 years.

Below are the facts of my concern with the incorrect way the law was applied and ultimately the injustice in my case. 

  • The alleged victim, my husband, under sworn statement in November 2010, admitted he was the aggressor, threatened my life and was so enraged he didn’t know what he would do. 
  • The alleged victim, my husband, was arrested for domestic violence two times, once for abuse against me. The attack against me was so violent; I ended up in the hospital. 
  • Prior to my arrest, I told the office I was in fear for my life due to the prior violence against me. I also told the officer there was a domestic injunction in place to protect me against abuse from the alleged victim. This information was written in detail by the officer in my arrest report, but ignored for some unknown reason. 
  • In July of 2011, a hearing was held, where I along with the alleged victims testified as it relates to the stand your ground law and its immunity from prosecution. 
  • After the hearing, Judge Elizabeth Senterfitt denied my motion, citing that I could have exited the house thru the master bedroom window, front door, and/or sliding glass back door. The law specifically states: No duty to retreat. 
  • My attorney entered a standing objection on the record to the ruling and we proceeded to trial. 
  • During that time, Angela Corey, our State Attorney met with the alleged victims. I also along with my attorney met with Angela Corey, John Guy, and then prosecutor Christen Luikart. I justified my actions to them and the truth as I have told it has remained the same. 
  • Knowing our prior domestic abuse history, Angela Corey was hard pressed for the minimum mandatory, which provisions allow for prosecution to wave those stipulations. I was not guilty, nor did I believe that was fair and just under the circumstances. She also allowed for those same provisions in the State vs. Vonda Parker, same charges different circumstances which did not include self-defense. 
  • Florida uses a law commonly known as 10-20-life as a sentencing guideline when a felony takes place with the use of a weapon. Under this statute, my felony charge of aggravated assault with a deadly weapon without intent to harm carries a twenty year mandatory sentence. 
  • Stand your ground law has been applied in multiple recent incidents, the following is just a couple of incidents. Carl Kroppman Jr was allowed to use this law to avoid being arrested/charged during a road rage incident on the Buckman Bridge in Jacksonville, FL in August of 2011. Marqualle Woolbright of Ocala, FL avoided murder charges due to the stand your ground law when he shoot and killed someone. 
I am a law abiding citizen and I take great pride in my liberty, rights, and privileges as one. I have vehemently proclaimed my innocence and my actions that day. The enigma I face since that fateful day I was charged through trial, does the law cover and apply to me too?

Now we have to remember that this is but one person's account of this incident, and we have not heard all of the evidence that the Florida justice system had at their disposal in making this determination of guilt. 

However having said that, considering that this woman was being brutally attacked by a man with a history of domestic abuse, was trained to use and licensed to carry a concealed handgun, and did NOT blow this man away, how is it that SHE is headed to prison for defending herself, while George Zimmerman, and man who chased a seventeen year old boy and shot him to death, was able to use the Stand your Ground law to walk free for almost a month and a half before being charged with second degree murder?

Part of me wonders if she would have received a lighter sentence if she had killed her husband instead of just warning him off. Is the Florida justice system really that backward?

  2. There is NO logic to the Florida justice system - although in many instances it appears that the color of your skin plays a major part.

    Domestic injunctions are pointless. Violence within a relationship seems to end up with 1 dead and 1 jailed for life. That Marissa and her husband are both still alive is amazing.

    Regardless of 2 sides to the story, women, yet again, are the losers in this situation - always have been - how does one end it?

      I realyy don't understand this world today, nor the people in it? If this is how the justice system treats and defends the innoncent (by giving them jail time); then we are seriously screwed! With all the evidence pointing towards the true aggressor, he still gets to remain free and the innocent imprisoned. A blind man can see the facts here so I am really trying to understand how the state of Florida can be that ignorant to the fact. If you cant interpret the law then you don't need to have laws that you don't understand.     I’m sad she has to be in this situation, but she seems savvy and prepared. Although I no longer follow organized religion, all those young years of sitting in a church pew left an imprint, lol. This seems like a classic case of “God works in mysterious ways.”

Send them to anyone you can think of, there are also some requests to have voters call her representatives with the phone numbers on Marissa's website. The link is at the beginning of Gryphen's post. Look at how the country pulled together for Trayvon Martin. There is no reason why it can't be done for Marissa, too. Her children need her at home and she doesn't belong in jail.

    Sounds like Zimmerman's lawyers have requested that the current Judge step down due to a conflict of interest. This could be good for his case since the other judges have actually had experience applying the Stand Your Ground Law.

    Confirms as we all know -- the system doesn't see minors as worth anything as that bastard could have then beaten the baby to death. She would have then probably been charged with contributing to or abandoning or who knows what. She was in a no win situation.

    What a fucked up legal system. Remember -- Corey is the one that was assigned by the Governor to the Zimmerman case. She yields something like an 80% success rate and has the highest percentage in the state of those convicted on death row.

    BTW I currently live in Texas and if I shot at someone in my home the only thing that would happen was I would get written up in the paper as "the gun shooting Granny) But then, I can "pass" as white ( I am Native American and white)

    Yes, the Florida Justice system is just that f'ed up. I ought to know, I was born in that state and lived there for 13 years before being moved to Ga. (another F-ed up state.) My father and an Uncle were both attorney's in Fla. both now retired. Father was mostly land deals, wills, etc. Uncle was a very high profile criminal defense attorney. His main clients in the 70 & 80's were cocaine dealers. So I can say, with some measure of knowledge, that yes, Florida is one backwards, twisted state. If you got the money, connections and the right skin color, you can get away with a whole lot. If you are black, or brown, especially in certain "white" areas of the state, and you put one foot off the path, you are heading to the electric chair.

    I couldn't wait to leave the South after I graduated from College. And where did I end up? First 5 years were in Arizona and then here to Alaska ----Oh shit! What happened?!? Az and AK are both f-ed up too!! LOL!

    I can't help to think that we're not hearing the whole story. I have lived in Florida for many years and know that our criminal system is as fair as any other. The information we were given would certainly not end with a twenty year sentence for the women protecting herself. Maybe what could be missing is that she asked for him to come over and she voluntarily let him inside. I have to admit Florida has some very strange people that come to our state because of our weather, but our court system is as fair as any. Before say she had an unfair trial, I want to know all of the evidence and if nothing is missing, I'll then say she had a very unfair trial that if appealed she would certainly win.

    I told my wife that I would not want to be the next person involved in a firearm incident because of what happened in the Trayvon Martin case.

    I live in Jacksonville and think what is happening here is pure bullshit. The judge denied the stand your ground defense and Corey is throwing the book at her. Charges include assault with a deadly weapon and child endangerment. Really?? Just for firing a warning shot in the ceiling??

    Looks to me that they are trying to make an example out of her. I don't think the same charges would be brought if the person doing the same thing was white and wealthy.

    'Stand your ground' laws. If there is no commitment to remaining faithfully against those laws then nothing will change.

    This literally screams of hypocrisy.

      Please read about Ms Alexander's efforts to flee, described on the petition page linked to by an earlier commenter. Note also that when she (according to her description) was ultimately cornered, and fired the warning shot, her husband did flee.

      By the way, "literally" is not just another word for "emphatically".

    Gryphen, a strict constitutional originalist would tell you the founders never intended our laws to apply to black people (or cars, the internet or even indoor plumbing), anyway. And, of course, the T-Party would claim that everything in this country was nearly PERFECT until we made two critical mistakes. One was letting an African Muslin man steal the presidency and the other was freeing the slaves. (And they ain't too crazy about letting women vote, neither...)

    I am particularly embarrassed at the backwardness of Florida because it is the state where my own father was born and raised. Most of my relatives on his side of the family reside in various parts of the state like Tallahassee and Gainesville. I thought Angela Corey championed victims, and it is obvious that this woman has been victimized over and over. First, it was at the hands of her abusive husband, and now it's at the hands of that messed-up justice system in that state. There is a case in Georgia where a black man is serving life in prison because he used the SYG law there to kill a white man who was actually encroaching on his property and intended to harm him. He has appealed his sentence, and his conviction was upheld. We need to take a pro-active stance against the double standard that allows people like Zimmerman to invoke SYG inappropriately but penalizes black people for invoking it for the purpose it was intended for.

  31. Let us remember that Florida is an immense melting pot of people from all over the country... a melting pot of a bunch of nuts as far as I am concerned. I was born here, but have always hated the place, the heat is awful and the people who move here are mostly awful, at least the right wingers, which seem to be the majority.

    I am one of the few "libruls" here, wasn't aware of the case against Marissa Alexander until now because I don't watch much Teevee...

    But I have to say I am absolutely APPALLED hearing this news. Especially hearing it on the heels of the Trayvon Martin case.

    I can speak from a womans experience about being feeling discriminated against here because I was stalked in the state of FL, I was physically threatened with violence and was threatened with kidnapping. I had difficulty in obtaining a restraining order against the offender. IT WAS VERY DIFFICULT.
    I could see that the cops and the judge held doubts about my case. I felt a definite and strong bias towards me because of my gender.

    When I showed up at the State Attorneys office with my 10" accordian file bulging with evidence, the LADY State Attorney filed 5, not 1, but 5 warrants against the stalker, while the male cops continued to treat me like a hysterical female. And I can't claim race as a factor.

    I have experienced a definite bias against women in the laws of Florida. I can't IMAGINE the level of fear and outrage Marissa Alexander is and has been feeling since her arrest. And how it must have multiplied given the news of the Zimmerman/Martin case.

    That woman STOOD HER GROUND because she had to. She didn't shoot AT her abuser, she shot ABOVE HIS HEAD. She in no way threatened his life by shooting a warning shot.

    She had NO obligation to retreat if you read the FL state law. NONE. That judge is WRONG.

    But yet, FL law discriminates against women who are being abused by a spouse or boyfriend, making it difficult for them to gain protection under the law.

    It is an absolute and utter outrage that this woman is EVEN in jail, let alone facing 20 years.Florida treats abused and threatened women like second class citizens.

    She harmed No-ONE, yet Zimmerman walked free. What is wrong with THAT picture?

    Ya'll can bash Florida all you want, and I will join you to a certain degree, but like Alaska, there are some very intelligent and compassionate people here too, just don't lump me in with the right wing nut jobs.

      I too live in Florida, Tampa to be exact. I have traveled extensively throughout the state, and if you live in the panhandle you're certainly living in the redneck part of the state. Besides the panhandle, rural central Florida is also redneck and backwards like the panhandle. I had to move to Sebring Florida for about 3 years and I can definitely state from my experience there are plenty of rednecks. Fortunately the larger cities along the coast are not nearly as bad as the redneck area of the state.

      If you look at Anon. at 2:15 comment you get to see the rest of the story and not just her end of it. I wrote in my first comment at 9:04 that I didn't think we were hearing the whole story and according to the court transcripts from the judge we certainly were not. Please go back and read them for yourself and verify what I'm saying.

      Now if we can just get Gryph to do the same, he can add to his comment we maybe missing the other side of the story.

    I and a friend of mine have a strong suspicion this whole story is a hoax. I only found blogs, no hard news stories. I'm always leery when there are no major news outlets reporting; I would think major news would have been all over it since Angela Corey is the same prosecutor in the Trayvon Martin case.

    2. There are several links to this online and there have been radio shows done on it. You're not seeing anything recently because if you read the transcripts from the deposition, they are from November 2010. That's a lifetime ago as far as the media are concerned.

    The problem is with the law itself and how differently it can be interpreted, as evidenced by the same judge in the Trayvon Martin Case.

    Florida has some of the wackiest cases. Casey Anthony is set free, only because she waited for her daughter's corpse to decompose, then led police on lead after lead based on her pathological lies.

    Treyvon Martin's case would have been swept under the rug had it not been for public outcry, and I think Ms Alexander's case WILL get the attention it needs.

    This prosecutor seemed so eloquent in her choice of words in the news conference for Trayvon, yet here's a woman who followed the law and gets 10 years?

    I'm starting to have my doubts the Martins will see justice.

    Maybe they think because she fired a warning shot that she had time to think about a premeditated act against him. If you think your life is in imminent danger, you would not fire a warning shot, you would fire to hit him to stop him. I think she did not want to kill anybody and hoped that by firing a warning shot he would realize she was serious and would shoot him if she had to, but the law doesn't always understand how it is between two people.

      Cops fire warning shots as well. I want you to put yourself in her shoes. Your husband is an abusive person who has a history of beating you. He even beat you while you were pregnant. You get an injunction against him but everyone knows that those things are not worth the paper its printed on. Here he is beating you again, you see a gun and fire a warning shot into the air. He walks free and you go to jail for trying to stop someone from beating you half to death. And does that judge really think that her husband was going to let her get away. 90% of domestic violence cases end with the victim being severly hurt or killed. If this was your daughter would you have the same attitude

      Cops do NOT fire warning shot's. How stupid are some of the people making these post's? With her having a concealed weapans permit. She is now held to a higher standard of knowledge of the gun laws in Fla. & 31 other state's that the license is also valid in. You are not allowed to pull your gun to scare anyone. your not allowed to fire warning shots. you are allowed to pull your gun and shot to kill. when this action is called for. When you are in fear of your or someone else's safty. When your in fear for your or someone's safty. The fear doesnt even have to be real. But at the time. It is very real to you. Well when you pull and fire your weapan. Shot to kill or you better not even let anyone know your carrying a gun on your persons.

    I may be going out on a limb here but the fact that she'd also female,as well as a female who pulled a gun on her husband(the ultimate offense in the eyes of patriarchy),has as much to do with this as her race.No matter how violent and abusive a man may be,women defend themselves against an abusive husband always get harsher treatment than serial killers.The old-guard reich-wing patriarchy sees a woman who defends herself against her husband,even if she didn't even shoot him,as defying Biblical marriage laws.I'm quite sure that if she were white or any other ethnicity,she would still be facing the same sentence.

  38. As a lifelong Florida resident I just want to say YES, FLORIDA SUCKS! This state is 'TOUGH ON CRIME" Which means they put alot of people in prison! Btw, did you know that most prisons in Florida don't have air conditioning? Try living in a concrete block house w/o it when it's 110 degrees and you're cramped in a cell with more people than THE LAW allows! Anyway, I can tell you by experience that the laws ARE NOT, I REPEAT, ARE NOT APPLIED EQUALLY IN THIS STATE! As an adult I have wanted to move somewhere else many times but alas all my children and grandchildreN
    have settled here.

  39. I was taken against my will by someone I trusted and three people (two men and a woman) took me to a dirt road in the middle of nowhere stripped me naked, then strangled me and beat me badly. If for any second I was free from their control I would have ran for my life. This woman doesn't deserve 20 years but once she could of left and fled the house but didn't her "stand your ground" went out the window. Anyone who has truly truly almost been killed or stabbed knows that no one would ever go back into the danger when you fear for your life. Get over the Stand your ground thing. That doesn't even apply here. My sympathy to the woman, and surprise surprise now people who have not personally been involved in our unfair justice system are finally getting to see how stone age and "witch Trial" like some of our court rooms are.

    It's funny that you mentioned at the end of your blog entry about Zimmerman chasing down T. Martin and shooting him to death. Isn't it a little presumptuous to come to such a conclusion on an on-going trial when the evidence hasn't been presented? I figured, with your stance on Marissa Alexander that you would be against such overzealous approaches to case?

    You know that her bail was revoked after she drove to his house and punched him in the head and then lied to police about not having been there, right? You now that on the day she married him, she had a protective order against him, right? You know that she pointed a gun "in the direction of all three victims," including her own children, "nearly missing his head," right? You know all of those facts, right?
