Fox News misrepresents lawsuit to imply that President Obama is curtailing military vote.

This is the relationship that Fox News wants to damage.

A Fox News report Friday night suggested that the Democratic National Committee and President Obama’s campaign were suing to strip voting privileges from members of the military and their families in Ohio, even though the lawsuit in no way cuts back on that group’s voting rights. 

“If President Obama gets his way, the special voting rights of some of America’s finest will be eliminated,” host Shannon Bream said. “The campaign is suing to keep members of the military from having extra time to cast their ballots in one key battlegound state.” 

In actuality, the complaint filed by the Obama campaign would reinstate special voting rights that, until recently, extended to all Ohioans and not just those serving in the armed forces. 

The issue stems from the Republican-controlled legislature’s decision late last year to alter early voting procedures. In the past, all voters could cast ballots in the three days prior to the election. But under the new law, only members of the military would be allowed to vote through the Monday immediately before the election, while early voting for non-military citizens would end the previous Friday. 

Naming Ohio’s Attorney General Mike DeWine and Secretary of State Jon Husted—both of whom are Republicans—as plaintiffs, the DNC, Ohio’s Democratic Party and Obama’s campaign filed suit arguing the the new law creates an unconstitutional tiered voting system. 

“This disparate treatment violates 42 U.S.C. § 1983 and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution and can be rectified by the Court enjoining enforcement of statutory changes that eliminate early in-person voting for most Ohioans during the three days before an election,” the parties wrote in the suit. 

The suit would not prevent military members from, “having extra time” to vote, as the Fox report insinuated. Rather, it asks that the court, by blocking enactment of the new law, reinstate the extra time all voters used to enjoy for casting their ballots.

You know because of the constant Olympic coverage on MSNBC I have found myself watching Fox News more than a few times, just to have some background noise on while I work, and have heard THIS particular lie stated more than a few times. 

The problem is that without clarification the Fox News charge sounds legitimate. In fact THIS was the first comprehensive explanation for the lawsuit that I found.

As you can see it makes perfect sense, and in fact the President and Ohio DNC are protecting the rights of MORE voters, not infringing on the abilities of military members to vote. But you would NEVER have been able to figure that out from the lies that Fox was telling.

It is THIS absolutely naked attempt to lie to the American people that demonstrates why NOBODY should ever get their information from Fox News. I cannot tell you the number of times I have found myself actually shouting at my television when I hear them misrepresent an issue or out and out lie about it.

My most fervent desire is that the News Corp phone hacking scandal arrives on our shores as soon as possible, and that Fox News is fully implicated.  I have no doubt they were involved, so now I just want it to be proven, and hopefully it will be enough to damage their credibility enough to get most people to stop listening to them.

  2. There is a segment of our population that will NEVER believe anything that isn't uttered on the "Fair and Balanced" network. I know...I live among them. Fox and the rest of the right-wing noise machine reinforces their world view. They have their opinions and facts be damned. Nothing will change their minds. Nothing.

    Like you Gryph, because of all the Olympic coverage I found myself watching Faux noise the other night and this very subject came up. I thought to myself, hmmm I need to look into this, thinking it was highly suspect that Dems would want to disenfranchise military voters or any voters for that matter. Thanks for getting to the truth.

    They had a post up about this yesterday on CofP, getting it all wrong of course.

    An intrepid inmate by the name of George wrote this-

    What is says is that current Ohio law violates the Equal Protection Clause of the U.S. Constitution and 42 U.S.C. 1983 because it permits in-person absentee voting in the three days immediately preceding Election Day for some voters but not for others. Specifically, the complaint states that voters using the Uniformed and Overseas Citizens Absentee Voter Act can vote in the three days prior to an election but voters not using this Act cannot. The plaintiffs ask the court for an injunction, effectively restoring in-person absentee voting in the three days prior to an election for all Ohio voters.

    If you don't want to believe it, here is the first paragraph of the Complaint -

    "Plaintiffs bring this lawsuit to restore in-person early voting for all Ohioans during the three days prior to Election Day – a right exercised by an estimated 93,000 Ohioans in the last presidential election. Ohio election law, as currently enacted by the State of Ohio and administered by Defendant Ohio Secretary of State, arbitrarily eliminates early voting during the three days prior to Election Day for most Ohio voters, a right previously available to all Ohio voters."

    George was backed up by, I presume, a non-Palinista and between the pair of them they got the correct information out.

    What happened next? The inmates ignored it and changed the subject! Its worth looking at the thread for no other reason than it's a fascinating insight into what happens when faced with facts they can't refute.

      I saw that yesterday... for a website that states "Just the Facts", they sure don't like to face the facts when those facts are not in their favor or narrative.

      Hating Obama and Liberals is far more important than getting their facts right.

    Gryphen, please do yourself a favor and do not ever watch Fox News. Please learn from my mistake. When I watched it in the past, a pattern quickly emerged. One of the talking heads (usually Hannity) would be fired up about something outrageous coming from the Democrats. It would sound ludicrous to me, so I would do some investigating online, only to find it was completely misrepresented by Fox. Lather, rinse, repeat. Their viewers are rage junkies looking for their next fix. I don't think they really care about politics. I have a couple of smart, conservative friends (they do exist), and they wouldn't be caught dead watching Faux.

    I kept running into people who were whining about this on HUffPo, so I actually looked it up, and found just what you did..this keeps early voting for all, not JUST the military. It extends voting rights,. But never let facts get in the way at Fox Noise. God I hate these people. I'm sure the servicemembers are smart enough to understand that this is all a bunch of lies because the GOP is so desperate to lie their way back in to the WH again.

    The only way for the WH to be repub. again is for the gop to lie and broadcast these lies on Faux. Nobody with an I.Q. in high double digits would believe what Faux spews. Look at who represents them - Palin (dumb) Hannity (dumb) O'Reilly (dumb) and the blonde bimbos in the short skirts. Not a serious journalist in the entire motley crew. Rove be;lieves that if a lie is repeated often enough, people will believe it. Maybe DUMB people will, but no intelligent person will.

      If you think banning guns is going to stop the shootings you are wrong, though I doubt you would be able to admit it. Its the person that kills. They will find a way to do it. Especially since the criminals will be the only ones with the guns, and that is a fact!

  16. As opposed to the RNC stripping voting rights from just about everyone using voter ID laws?

    Of course they got it wrong.

    More importantly, I don't think the RNC realizes that not everyone in the military votes Republican. And since the military put their lives on the line to ensure that everyone has the right to vote, not sure how stripping the rights to vote early for all but the military is going to go over with the very people they claim they're protecting.

    OT I have been told that priests in FL are telling parishoners that Obama is going to make the Catholuc Church "pay for abortions".

    Has the Catholic church been able to customize their emplyee insurance plans to exclude covering birth control medications? What about medicly necessary D&C for incomplete miscarriage?

    Do any insurance plans pay for elective abortions?

    I was alsi tild that after the President respectfully reconsidered relugious position, arranging for Catholuc employees to get their own civerage for birth control, a Bishop ordered his letter be read at mass. His letter told parishoners Obama is makung the church pay for birth control!
