The Fox News contributor and former Alaska Governor says a copyright infringement lawsuit against her for use of an iconic photo of the U.S. flag being raised at Ground Zero on September 11 should be tossed out. “A New Jersey Sarah Palin Signs Copies Of Her New Book "Good Tidings and Great Joy: Protecting the Heart of Christmas"newspaper has chosen New York as the forum to sue defendants located in distant states, based on conduct with no particular connection to this District besides the subject matter of the photograph — a consideration that is irrelevant for purposes of venue,” lawyers for Sarah Palin wrote yesterday (read it here) in a filing in NYC District Court. “Defendants therefore seek dismissal…on the ground of improper venue or, in the alternative, for transfer of this action to an appropriate forum,” the motion memo adds.
Okay I am not a lawyer so I am not completely clear on how the place in which a lawsuit is filed has any impact on the fact that Palin used a copyrighted photo of firefighters raising the American flag on the ruins of the World Trade Cente, slapped a SarahPAC logo on it, and then posted it to her Facebook page to make money, has any bearing on the fact that she illegally used their product to make money?
Here are the papers that SarahPAC filed, which falsely claim that Palin is a resident of Alaska by the way, so perhaps one of you legal eagles can explain how her argument holds any water.
Palin, as we know, is incredibly slippery when it comes to lawsuits, having wriggled her way out of several in the last five years, so it would be no surprise to see her slither away from this own as well.
P.S. Okay having looked a little harder at the document, it appears that the problem is that the company may have filed the lawsuit in a district in which the company does not have a physical presence. In other words the lawsuit itself is not being addressed, only the legality of where they filed it.
So this is a delaying tactic that SarahPAC hopes will drain the company of resources and convince them to drop the suit, because it appears to me that they have a pretty good case.
I hope that if the court agrees with the venue argument that the North Jersey Media Group refiles and pushes forward. Because SOMEBODY needs to hold this woman accountable for SOMETHING.
I believe the media group that owns the copyright offices in New York. So they filed in New York. I believe her attorney was arguing in his brief that the suit should have been filed in Alaska. That would be incorrect. I think a judge will rule that the suit was correctly filed in New York State.

DeleteMotions like this are very common and almost never work getting a case dismissed. All they are the defense attorneys grasping for straws hoping they can get the case dismissed, but judges seldom dismiss a case unless it'e based on frivolous claims to begin with. Palin's attorney's I'm sure has warned her not to get too excited that her case will not be dismissed.

DeleteSarah's use of the photo was nationwide, and not confined to Alaska. Heck, her blog goes around the world. New Jersey, where the owner of the picture, is domiciled, is the appropriate place to file suit, and the court will decide that in short order.

Anon 12:42, she needs a psychiatrist more than she needs a nutritionist. Her problems are mental, and obviously being anorexic she needs to be placed in a treatment center for at least 3 months to get her wight back and to help her control her disease. During her treatment, she will also have a nutritionist teach her healthy eating habits, but after she is released it will solely be up to her whether she follows what she's been taught. It is also not uncommon for anorexic's to through many multiple admissions before they can get their problem under control, and if they don't they usually die. I'll bet her family is well aware of her problem, but she refuses to get treatment because she's afraid she'll lose her fans, or what fans she has left, when they learn about her illness which she sees as a weakness.

There is a special theatrical glue that is used to hold on all sorts of hair pieces, prosthetic features and facial hair.
There's also special tape that's used by models and other performers to prevent 'wardrobe malfunctions'. Either of those could probably be used to keep her fake hair on her empty head.

Anyone familiar and experienced with copyright law knows the rules about venue, which can be complex and confusing.
I'm guessing that there is sufficient nexus for the suit to be filed in NY. that's just a gut reaction. Maybe my assumptions are wrong.

I would assume that this is not the first time that the photo copyright holder has had to file suit against people living in a wide variety of places who appropriate the photo without attribution or permission for their own gain.

I also imagine that the Plaintiff has been through this before, and so the cost the plaintiff to argue their position is probably not nearly what it is to SP. Unless she is making huge amounts of money off the photo and hasn't take her PAC request off, I'm just not seeing the value in delaying. Even if she has, the plaintiff can ask for damages.

If the game is to drain one of the parties of money, the paper has more money and more resources than Sarah does. The advertising on the copyright protected image was for Sarah's PAC, whose address is a post officer box in Virginia. That's where the money would be deposited. Follow the money. Sarah flits around, signing books here, living there. The money is in Virginia, but the image that is protected is registered with the paper-- and their ownership just might be where the case was filed. It's their image and someone stole it from them. You don't sue the robber where the robber lives. You take the robber to court where the crime took place.
ReplyDeleteShe is seeking a transfer of venue, as well as a dismissal on the merits for failure to state a claim for violation of the Lanham Act (unfair competition) and failure to state a claim under the Copyright Act. Her lawyers are claiming that using the photo constitutes "fair use" under the Copyright Act. I'm a lawyer (but not a copyright expert), and based on my read of the motion, the Lanham Act claim may be dismissed and the Copyright Act claim may survive. Venue will depend on whether the photo's owners have a presence in NY. If not, NJ seems like the best venue.

The paper has a lot deeper pockets than Sarah but they wouldn't bother taking a high profile person into court unless they were sure they will win.

Hi, this is Anon 10:59. I agree that the PAC's use of the photo is not "fair use" which is why I opined that the Copyright Act claim would likely survive the 12(b)(6) motion. Mlaiuppa is probably right; the copyright owners would not have sued in the SDNY if they believed that venue was improper.

Anyone can figure out this case. Here is the website for the photograph: http://www.groundzerospirit.org/ The newspaper protected it with a copyright because the moment that it appeared, the response was so overwhelming; it became an iconic image of September 11. Any money from fees to use the photo are donated to first responders. It doesn't take a genius to read the information at the bottom of the website:

The words "please contact us" are highlighted in blue, linking you directly to the place to report abuse. And what was Sarah's abuse? She used it to advertise her PAC, with the logo and website added in the lower right hand corner of the photo which she posted on her Facebook. Even if someone posted it for Sarah, it's in her name, her Facebook and her PAC.
The other thing that Sarah did was to change it from a colored photo to black and white. The copyright protects the image from being altered. In color, it shows the ashes on the firefighters, the grey somber background and the red, white and blue American flag. It is a work of art, and Sarah tampered with it. That is simply not allowed, for any purpose.

When he first adopted the photo, other Pee People were doing the same thing. It happened after the newspaper sued Sarah for copyright abuse, and their attitude was "I can use that photo, too, so there."(With no legal research, they decided that if it appeared in a newspaper, it was fair game.) They did to show support for Sarah. Most of them have changed their avatars, but one particular Pee Person still uses it. I have clicked on the "report abuse" link and reported him. He is listed in the White Pages, and he makes no secret of his identity. I hope that if you are as pissed off as I am that you will report him too. If they want to stand with Sarah, they ought to be prepared to go down in the sinking ship with her.

DeleteBack in September when Sarah was first served with the Cease & Desist order (which she ignored), Pete announced on Sarah's fan website that he was using the same photo, daring them to come after him. He has used it since the middle of September as a act of defiance.

ReplyDeleteThe resources of Sarah's PAC are around a million dollars. Sarah was originally handed 12 million when she signed up with Murdoch. How much of that do you think that she has left? If it's going to be a contest to see who drains who, let me introduce Stephen A. Borg, the current head of the media group that owns the newspaper that controls the copyright of the photo: http://stephenborg.tumblr.com/ Bog is the head of the New Jersey Media Group, which publishes newspapers, magazines, and their printing plant (and distribution center) is so big that it prints USA Today along with other publications.
Since it is the PAC that used the photo for advertising, and the PAC's address is in Virginia, I can't imagine why the case belongs in Alaska. And good luck with that PAC money going up against New Jersey Media's money.
I really question that Palin has the net worth that is being spewed around - 12 Million. Somehow don't think so! Plus, she is funding her entire family. Friggin' amazing!
DeletePalin was not handed $12 million for her Fox contract. She was signed up for three years initially at a $1 million per year contracted amount. The rest of her net worth has come from speaking fees, when people actually paid her to speak, and from the advances and sales for her first two books.

I know Alaska didn't sign up with the Affordable Health Care Plan but how does it happen that a person making $15,000 a year can get tax help with premiums (which are high) and one making $8,000 does not get any help at all. Cannot afford the $500 and up premiums so does anyone know if there is something else I can look for. Cant believe my State would throw me to the wolves like this. I will be penalized if I don't sign up but cannot afford to pay those premiums and not be able to buy food!! Thanks
ReplyDeleteParnell didn't sign up for the extended Medicaid benefits (it would not have cost our state anything for the first three years) so unfortunately it is the very poor who don't qualify for insurance. If something catastrophic happens then you will have to just go the emergency room and deal with medical bills. Our state is one of the worst when it comes to helping the poor.
DeleteAlaska is on a downhill slide due to our decreasing oil revenues and an obstinate republican governor. Housing prices will begin to decrease and once again a major portion of our road belt populace will leave the state.
I wish I could give you better advice but unless you can afford private insurance then our governor has made sure that you are uncovered and basically screwed.
Sounds like you haven't thoroughly looked through the federal exchange. It is very large, and can be very confusing to shop all the available plans. If you need help, there is the ANTHC ( I think that's them) and Planned Parenthood - the only 2 in the state I think, that have health care web site navigators to help you locate a plan that you can afford, and will help you to understand any subsidies that you may qualify for. The State of AK will not help you and will actually give you false information in order to discourage you from signing up. (as are Fla, GA, AZ, NC, OK and others) I have a health care plan through Premara Blue Cross, the only health insurance company available in AK through my husband's insurance. The plan is expensive, high deductible, and low coverage. I will be shopping the exchange for a better plan for our family.

When Sarah was in Alsaka politics, she knew how to manipulate the local media. This is the woman who wrote letters to the editor in praise of herself, the governor, signing the letters Louise Heath or Lou Sarah. (LOL). She also had a group of friends who did this. In a state of less than a million people, Sarah was the darling of the press. The ADN had a special daily column devoted to "Our Governor," posting photos and covering her as if she was a movie star.

It was no longer cute to talk in run on sentences that didn't mean anything (but sounded important). She couldn't fool the national media. And, I doubt that she can bully them or run them out of money. Their rules for the photo were posted on their website. Just because it appeared in a paper doesn't mean that you can use the image as advertising for your PAC or change the color photo to black and white. Sarah has been good in court when it comes to scare young men who don't have the resources to defend themselves. (The kid in Tennessee who hacked her email, the PA stalker kid or poor Levi). Sarah is good at bullying people who are smaller than her. I don't think that Sarah is going to run the newspaper out of business any time soon. It's not a good idea to pick a fight with someone who buys ink by the truckload.

The owners of the copyright are the New Jersey Media group. They own a number of publications, mostly in Northern New Jersey. You have to look at the photo as a work of art, and it was created (taken) at Ground Zero.

Jon Stewart had to goad the Senate and House into passing a bill authorizing payment to them because ten years later, they were suffering terrible health problems. The government is responsible for sending them into the ashes without protective masks and gear because Christine Whitman, then the head of the EPA, told them that it was safe. NO IT WASN'T. And, if there is a judgement against Palin, it would not go to the newspaper. It would go into the fund for the first responders, the same place that the fee would have gone if Palin paid for the rights to use their photo.

I view the photograph as a work of art, a singular special creation protected by a copyright. The newspaper knew how special it was which is why they did copyright it, with the proceeds from sales and fees going to first responders. The newspaper does not profit from the photo. The photo was taken, created in New York City. It is OF NYC. And, the people who benefit from the copyright protection (the people receiving money from the sale or fees) are the first responders who came mainly from New York. They are the ones who are the injured parties.

I am not really surprised that they didn't respond to the letter from the attorneys, given how totally chaotic and dysfunctional they are. (Isn't that why they pay the T attorneys such big bucks?)
But what really eggs me on is:
1) She could have just apologized, pretended she felt bad about the "confusion" and "innocent mistake". A bit of a donation to the First Responder Fund would probably have ended it.
2) Why is she having her attorney pursue it? Does she think she'll win? I don't see how. And as more people become aware of the violation and flagrant disregard for the First Responder Fun, it will only turn Real Americans against her.
In fact, until I saw this post today I thought it was already said and done and that she and her attorney's had already taken care of it.
Now I will calm down and ignore the crazy woman because crazy people do crazy things and it's a waste of time for us non-crazies to try to figure it out.
