Sarah Palin reaches $15,000 settlement over 9-11 copyright lawsuit, but only if the deal remains confidential. Well we're talking about it, so guess what?

Courtesy of New Jersey.com:

Sarah Palin agreed in December to pay a New Jersey newspaper $15,000 to settle a lawsuit over her campaign's unauthorized use of an iconic photograph of firefighters hoisting the American flag on 9/11 — but the deal remains stalled over the former GOP vice presidential candidate's insistence on confidentiality, according to court papers filed Monday in U.S. District Court.

According to the documents, William Dunnegan, the attorney for North Jersey Media Group, which publishes The Record of Bergen County, says that on Dec. 22, 2014 -- four days after the two sides agreed in principle to settle the case -- lawyers for SarahPac, Palin's campaign organization, "asserted that there must be a broad confidentiality clause."

"Shortly thereafter, Palin's counsel, Ronald Coleman, Esq., told me that Palin required a confidentiality clause because her political action committee did not want any hint of a compromise associated with her name," Dunnegan writes.

Dunnegan included with his filing several emails exchanged with Palin's lawyers regarding the settlement.

"We have confirmed with our client, and accept your offer of a $15,000 settlement," Palin attorney Brian Farkas wrote in a Dec. 18, 2014, email that Dunnegan filed with the court. "We assume that this will include a mutual confidentiality/non-disparagement clause in the stipulation of discontinuance.''

Okay this cracks me up.

So after first claiming that the plaintiffs did not have a case, then claiming they lived in the wrong place to file a lawsuit, and then demanding that they move the case to Alaska, finally Palin reaches a deal and it falls apart because she does not want anybody to know that she settled?

Yeah wouldn't want anybody to think she was capable of compromise or anything, right?

I like how Palin claimed that she required the confidentiality clause because "HER political action committee did not want any hint of a compromise associated with her name."

As if SHE wasn't the person completely in charge of what the PAC wanted or did not want.

Well gee, guess what? We all know about it now.

her political action committee did not want any hint of a compromise associated with her name

That's like a raving lunatic person saying she does not want any hint of sanity associated with her name.

She doesn't want "a hint of compromise" associated with her? Compromise is what normal human beings do, every day. Compromise is necessary to function in society and in life. She doesn't want to be associated with compromise? She might as well not be associated with breathing.

Calling this ruling a 'compromise' is insane in itself.
She (or her minions) did wrong, and now she's gotta pay for her stupidity.
That's NOT a compromise, that's the very definition of punishment.
Her lawyer can try to spin it any way he wants to, but facts are facts, SarahPAC's getting spanked.

6:58 : no, they probably DID compromise - they settled for just $15K instead of $75K!
I hope, the paper is now going after her PAC for the full amount, PLUS court costs.

Did SarahPAC compromise or did they negotiate the price down? It's sort of like a plea deal -- "we'll let you get by with paying $15,000 now or you can refuse and we'll go to court where you'll end up paying $75,000 because you are guilty".

Palin’s lawyers said in their court filing that she was “unwilling to settle claims if the decision to compromise would be used by plaintiff, a media organization, to make political and headline-generating hay.”

Now that is funny. The story was out over a year ago and now she doesn't want the the organization she stole the picture from to be able to talk about it. That's because SHE wants to control the narrative, SHE wants to be the only one that could possibly use it for "political and headline-generating hay" at her super VanityPAC to beg for donations because don't you know there's more dollars to be made because this is actually libel against her because she's the only true victim here and it's a matter of protectin' her free speech.

It's just like her & Bristol's pre-emptive public trashing of "Ricky Hollywood" because he might use Tripp to make money off of when in actuality it was because THEY are the ones who wanted to use Bristol's baby as a money-maker for themselves and boy did they ever milk it in Hollywood for every last possible dime they could.

Yes if Sarah got her way you betcha she'd use the confidentially clause to make money off of it because she's that desperate. In her mind she did no wrong and because it was her action she should be the only one that could ever possibly profit from it.

Well guess what Sarah. YOU didn't build that! Just ask Metallica. . . .

No, it's not an admission of guilt. Having just been sued by a landlord for nonpayment of rent -- bogus -- I was required by the judge to attempt to settle with the landlord before the last resort, a trial, which I would easily have won. We settled. Guilt or innocence of either party was never established. The case was permanently sealed. But I got >$15K in the settlement.

Conservatives, think the Bush administration, have never been considerate of the problems first responders to 9/11 have had. To the GOP 9/11 became a campaign backdrop (only) until 2008 when they suddenly wanted everyone to forget all about it. It wasn't until President Obama took office that the federal government did anything.

So Sarah would not want to think that any of her penalty money would go to help those people who have been permanently injured by their work in the building debris in those dreadful early days and weeks.

Of course we know about it, and a couple of other news sites, like New Jersey Law, have an article on this. This behavior of hers displays what we know to be true. She has a severe case of personality disorder. She can't lose, and if she thinks she loses, she can't allow anyone to see that she loses.

In Sarah's mind, she's in constant battle with the bad guys, where she's the good guy/gal. Even if she breaks the law, and requires to fix it, she's still the good guy, in her mind, having being forced to obey the laws that the bad guys put out there to make her life miserable.

Other people, to Sarah, are just people, who need laws and rules and must obey. But Sarah, in her eyes, has every right to disobey. She can't operate in her Esther ways, if she's blocked left/right/center with stupid laws.

This time, she won't be able to claim she's the victim. The word is already out that she broke the law, the cat is out of the back, the toothpaste is out of the tube, Sarah.

Sarah Palin went to a lot of trouble to trademark her image so people could not use it or worse, so people could not alter it and distort it. That is exactly what Sarah PAC did to the iconic 9/11 photo. They changed it from color to black and white. They cropped it. And worst of all, they slapped their logo on it and used it to ask for donations. That is a commercial use of the photo, and the terms of the newspaper's copyright are that a fee has to be paid for using the photo that way. Sarah objected to photos of her being altered yet she did that to a more iconic picture.

Her donors can now see that she is disobedient and when caught, won't admit her faults. She'll wrestle and try to wiggle out of it, at the EXPENSE of her generous donors. They send her the money to her PAC, she breaks the law, their money pays for her indulgences and disobedience, as well as for her dragging the case in court for months.......just because she won't claim she's 'lost'.

Once a donor supports Sarah, there's no telling where their money goes. Right now, it's fighting against the right for a photographer to have his art be used for charity, to raise money for the 9/11 injured and sickened firefighters.

Only a vile person like Sarah Palin would use that image illegally to raise money for HERSELF.

Let everything come out about her - especially in Alaska! She is truly a criminal at heart. She's always operated on 'silencing' those against her and gotten somewhat away with it - especially in Idaho and Alaska.

What specific evil deed did she do prior to quitting as Alaska's governor? It's known she did not birth that last kid with the mental disorder. She would never provide his birth certificate when it was requested.

She is obviously one evil woman and Hell truly awaits her nasty soul!

I assume that confidentiality agreements do not apply if the confidential issue is the commission of a crime.
Levi: If you signed a confidentiality agreement with the Palins, the agreement could be void and invalid as you may have been a minor and the agreement was in order to cover up a fraudulent crime (voter fraud) against the people of the United States of America.
Dancing with The Stars participants: any confidentiality agreement you may have signed with regard to Bristol Palin, the ape that could not dance, may be void and invalid. Since, it was clear that Bristol Palin was pregnant with a child during her DWTS competition, AND there was never any news reports of Bristol giving birth or miscarrying the child, or giving up a child for adoption, it is possible that the child could have been aborted or murdered and tossed in a dumpster. Thus your silence due to the confidentiality agreement you may have signed may be covering up a crime which voids the agreement.

All these years Sarah Palin received all the benefits of having a political action committee but when it comes to being sued for wrong doings, Sarah Palin wants what?

So much about this does not make sense. A Palin trademark.

Why did they wait until they settled to come up with the idea of confidentiality? Shouldn't that have been PART of the settlement if they wanted it?

Do they think they can bully around the newspaper?

Are we seeing a glimpse of how the Palin Enterprise works? They give you what they think you want and then they mention "Oh, by the way, just sign this confidentiality paper and we'll get this finished off."

That way the person has already given in, is looking for the glory and doesn't have time to think or to back out. If they mentioned up front a confidentiality agreement, the person would have questioned it and asked around. (others not the paper, I'm thinking of family, acquaintances and others they' bought off.)

Can't help but wonder if Dakota has signed off on his confidentiality statement yet. No way can I see his family signing off on one. What's in it for them?

I would never sign off on something so that a family member could do something with someone else. That in itself is a Big Red Flag that something is off.

Of course, I don't hang with the likes of the Palins and don't go jumping at free money or get suckered into things because I have a big ego.

Why are you guys complaining about Sarah Palin’s SarahPac? On SarahPac's website they are soliciting money from the public for political use and not for personal use.

Wait a second, I think I understand why you are all upset.

    The Hill:
Is it legal for SarahPAC to pay for the Palin family vacation? Palin has been emphatic, repeatedly saying it’s not a campaign trip, not a prospective campaign trip, not a political trip, not a “publicity-seeking tour,” just a family vacation.

Four days into her free media tour, reporters finally started to inquire. Not surprisingly, Palin’s response referred reporters to her political action committee’s (PAC) website, deflecting with her usual verbal gymnastics: “I don’t know why in the world you would ask a question like that. I’m just thinking about America and our foundations and our freedoms and our opportunities.” There is no mention of trip costs — the elaborate bus wrap, staffing, hotels, meals, gas, etc. — on the site. There is, however, a nice green button soliciting donations for the family vacation.

Jeremiah 12:13 - They have sown wheat and have reaped thorns, They have strained themselves to no profit But be ashamed of your harvest Because of the fierce anger of the LORD."

Proverbs 22:8 - He who sows iniquity will reap vanity, And the rod of his fury will perish.

Hosea 10:12-13 - Sow with a view to righteousness, Reap in accordance with kindness; Break up your fallow ground, For it is time to seek the LORD Until He comes to rain righteousness on you. You have plowed wickedness, you have reaped injustice, You have eaten the fruit of lies Because you have trusted in your way, in your numerous warriors,

Campaign finance questions emerge around Palin’s trip

Given that Palin has so emphatically stated that this personal family vacation is not related to any political purpose, is it criminally fraudulent — federally punishable as mail or wire fraud — if the PAC funds, reasonably contributed for political purposes, are unlawfully converted for personal use?

This is a great question and an incredibly reasonable one for reporters to ask.

Finney thinks Palin is showing poor judgement by using PAC money for a family vacation which is masquerading as a presidential campaign testing-the-water trip which is masquerading as a family vacation. I disagree. Palin can answer as she has already – by being deliberately obtuse while performing linguistic gymnastics in response to reporters questions. She can tell her supporters on Facebook and Twitter that these questions are simply the LAMEstream media out to silence her. And she can probably assume that neither the FEC nor the Department of Justice will investigate if she is illegally using PAC money for personal gain, despite the fact that John Edwards is about to be indicted for using unreported political contributions for personal gain.

Sarah's PAC has been for personal gain almost entirely. Very little has been used to finance other campaigns. And the amount spends on postage alone is questionable. Of course, neither Sarah nor her spokespeople would ever come clean on the story. That's why an investigation is warranted. This has been an ongoing fraud launched against really stupid people, probably mostly elderly men, and it should be brought to an abrupt end, with the perpetrator, Alaska's own Sarah Palin, spending time in a federal prison.

Can you post information the contact information for Sarah Palin's family liability insurance company? This is only one situation. How about the hacking and stealing of private personal info from thousands of her enemies? Time to file.liability claims. Lots of complaints from Alaska to DC.

This is Sarah's NPD driving the bus. And why would her lawyers give her honest advice? They get a cut of her PAC as well , perhaps hourly .

Actually, Sarah Palin was extremely lucky that the plaintiff was willing to settle. She's got it wrong as usual. But her attorneys ought to be smarter than that. Or did they get law degrees from Liberty University.
