Sarah Palin agreed in December to pay a New Jersey newspaper $15,000 to settle a lawsuit over her campaign's unauthorized use of an iconic photograph of firefighters hoisting the American flag on 9/11 — but the deal remains stalled over the former GOP vice presidential candidate's insistence on confidentiality, according to court papers filed Monday in U.S. District Court.
According to the documents, William Dunnegan, the attorney for North Jersey Media Group, which publishes The Record of Bergen County, says that on Dec. 22, 2014 -- four days after the two sides agreed in principle to settle the case -- lawyers for SarahPac, Palin's campaign organization, "asserted that there must be a broad confidentiality clause."
"Shortly thereafter, Palin's counsel, Ronald Coleman, Esq., told me that Palin required a confidentiality clause because her political action committee did not want any hint of a compromise associated with her name," Dunnegan writes.
Dunnegan included with his filing several emails exchanged with Palin's lawyers regarding the settlement.
"We have confirmed with our client, and accept your offer of a $15,000 settlement," Palin attorney Brian Farkas wrote in a Dec. 18, 2014, email that Dunnegan filed with the court. "We assume that this will include a mutual confidentiality/non-disparagement clause in the stipulation of discontinuance.''
Okay this cracks me up.
So after first claiming that the plaintiffs did not have a case, then claiming they lived in the wrong place to file a lawsuit, and then demanding that they move the case to Alaska, finally Palin reaches a deal and it falls apart because she does not want anybody to know that she settled?
Yeah wouldn't want anybody to think she was capable of compromise or anything, right?
I like how Palin claimed that she required the confidentiality clause because "HER political action committee did not want any hint of a compromise associated with her name."

Having just been sued by a landlord for nonpayment of rent -- bogus -- I was required by the judge to attempt to settle with the landlord before the last resort, a trial, which I would easily have won. We settled. Guilt or innocence of either party was never established. The case was permanently sealed. But I got >$15K in the settlement.

She has a severe case of personality disorder. She can't lose, and if she thinks she loses, she can't allow anyone to see that she loses.

Sarah Palin went to a lot of trouble to trademark her image so people could not use it or worse, so people could not alter it and distort it. That is exactly what Sarah PAC did to the iconic 9/11 photo. They changed it from color to black and white. They cropped it. And worst of all, they slapped their logo on it and used it to ask for donations. That is a commercial use of the photo, and the terms of the newspaper's copyright are that a fee has to be paid for using the photo that way. Sarah objected to photos of her being altered yet she did that to a more iconic picture.

Are we seeing a glimpse of how the Palin Enterprise works? They give you what they think you want and then they mention "Oh, by the way, just sign this confidentiality paper and we'll get this finished off."
That way the person has already given in, is looking for the glory and doesn't have time to think or to back out. If they mentioned up front a confidentiality agreement, the person would have questioned it and asked around. (others not the paper, I'm thinking of family, acquaintances and others they' bought off.)
Can't help but wonder if Dakota has signed off on his confidentiality statement yet. No way can I see his family signing off on one. What's in it for them?
I would never sign off on something so that a family member could do something with someone else. That in itself is a Big Red Flag that something is off.
Of course, I don't hang with the likes of the Palins and don't go jumping at free money or get suckered into things because I have a big ego.
And of course, like most of us here. I work for a living and am happy to do so.

Are you saying that anybody who was pressured into signing a Confidentiality Agreement in Alaska while witnessing that person in the commission of a crime cannot be held liable by the Confidentiality Agreement if they disclose said crime? This is a great question and an incredibly reasonable one for reporters to ask.
Finney thinks Palin is showing poor judgement by using PAC money for a family vacation which is masquerading as a presidential campaign testing-the-water trip which is masquerading as a family vacation. I disagree. Palin can answer as she has already – by being deliberately obtuse while performing linguistic gymnastics in response to reporters questions. She can tell her supporters on Facebook and Twitter that these questions are simply the LAMEstream media out to silence her. And she can probably assume that neither the FEC nor the Department of Justice will investigate if she is illegally using PAC money for personal gain, despite the fact that John Edwards is about to be indicted for using unreported political contributions for personal gain.

Sarah's PAC has been for personal gain almost entirely. Very little has been used to finance other campaigns. And the amount spends on postage alone is questionable. Of course, neither Sarah nor her spokespeople would ever come clean on the story. That's why an investigation is warranted. This has been an ongoing fraud launched against really stupid people, probably mostly elderly men, and it should be brought to an abrupt end, with the perpetrator, Alaska's own Sarah Palin, spending time in a federal prison.
