Supporters of the Oregon protesters are claiming that LaVoy Finicum was gunned down in cold blood. FBI surveillance footage tells a different story.

You can see at the 9:18 mark then Finicum exits the vehicle, and then reaches into his pocket, and is shot by the officers at the 9:32 mark.

Here is the FBI statement regarding the footage: 

The video picks up a few seconds before the FBI and OSP vehicles pull in behind the jeep -- the second vehicle in line. The jeep quickly pulls to a stop while the white truck -- driven by LaVoy Finicum -- continues some distance up the road. Some law enforcement vehicles stay with the jeep while others continue following the white truck. Over a period of several minutes out of camera view, the following people exit the jeep without incident: 

*The driver -- who was not charged and will not be named 
*Ammon Bundy 
*Brian Cavalier 

Looking at the white truck... about four minutes into the video ... Ryan Payne exits through a back door. It's difficult to see behind the trees, but in the lower right hand corner you can see him with his hands up being approached by the law enforcement officers and being taken into custody. 

There is a period of approximately 3 minutes and 47 seconds where the truck sits on the road. We have edited it for time here, but it is available in the raw, unedited version on the FBI's YouTube channel. Throughout this time, agents and troopers are providing verbal commands to the occupants to surrender. We can't comment on what may have been going on in the truck at this time, but those details may come out later as part of the overall shooting investigation. When we come back to the video, the white truck leaves the scene at a high rate of speed. It travels some distance... quickly approaching a vehicle roadblock in the roadway. 

As the white truck approaches the roadblock, there is a spike strip across the road but it appears Finicum missed it as he attempted to drive around the roadblock. He nearly hits an FBI agent as he maneuvers to the left. The truck gets stuck in the snowbank. 

Finicum leaves the truck and steps through the snow. Agents and troopers on scene had information that Finicum and others would be armed. On at least two occasions, Finicum reaches his right hand toward a pocket on the left inside portion of his jacket. He did have a loaded 9 mm semi-automatic handgun in that pocket. 

At this time, OSP troopers shot Finicum. 

Approximately 30 seconds after the shooting -- law enforcement officers at the scene deployed flash bangs to disorient any other armed occupants. Shortly after that, they deployed less-lethal sponge projectiles with OC capsules. Those OC capsules would be similar to pepper spray. 

Over a period of several minutes agents and troopers worked to safely remove the remaining truck occupants, and to take them into custody. Those people included: 

*Ryan Bundy 
*Shawna Cox 
*And another woman, who was not arrested and will not be named.

I think that's pretty clear.

This Finicum guy jumps out and puts his hands in his pocket, which was later shown to contain a pistol, and was shot dead.  

Which was clearly the choice that he purposefully made, since there was no way he was going to get out of there without facing jail time.

These guys started this protest for irrational reasons, and they are now facing the very obvious and predictable consequences of those actions.

As far as I'm concerned the survivors should be thanking their lucky stars that all of them are not lying in the snow alongside a road in Oregon.

They should have to do community service projects remotely (for the Paiute tribe) FROM PRISON for all the damage they've done.

How many artifacts would they try to steal if they hadn't searched their vehicals? And that's one of their requests was to not be searched as they left.

      What they are "fighting for" is their dream of revolution against the government. The Bundys and Finicum are FLDS. Bundy's family ties go back to Colorado City, AZ where the FEds raided because of underage plural wives. His ancestors moved to NV and AZ after the raid. Same sort of raid happened in El Dorado,Tx except that raid put their "Prophet" Warren Jeffs in prison for the rest of his life where he is said to "rule his kingdom from his Texas prison cell." FLDS hates the government but they dont mind taking government handouts. Do searches on EWG website for all the farm subsidies Bundys get in Clark County NV. They're all greedy grifters who cant seem to get enough.

      Let's go back to the origin of the incident. Google "Hammond arson poaching" and the first items that come up are the federal charges against the father/son ranchers who were leasing federal land for grazing their cattle. Poaching deer, then setting a fire (on federal land that they were leasing NOT land that they owned) in order to hide the evidence. This was NOT their only arson charge. Arson is a serious crime, endangering lives and property of their neighbors, as well as potentially killing firefighters fighting the blaze.

      Five years imprisonment for repeat offenders doesn't sound unfair to me.

      As the Hammonds were (finally!) reporting to serve their sentences a whole slew of folks from out of state decided to occupy a wildlife refuge that all of us own. Damage has been done to my property and yours- and we're not even beginning to discuss the invasion of sacred Paiute tribe lands and the disruption of bird migration.

      I have as much sympathy for this group as I would for a group setting up a meth house in my neighborhood.

      That federal land belongs to all of us. I like it that way, too. States that have federal land have way more opportunities for recreation, hunting, fishing, horseback riding, hiking, etc. If it was privately owned, there would be fences and gates with no trespassing signs. State owned would have fracking, oil & gas exploration, and whatever else That could make money. There is only a so much open public land, and I'd prefer it was used by everyone instead of a couple ranch families.

      The problem with your argument is these terrorists do not want to give the land to the state, they want it free for themselves.

      They should not only do prison time, but they should also be required to pay restitution for the damage they did to the ecosystem.

      Also in the real constitution, not the made up one you fake patriots use, only a regulated militia has the right to bear arms ie the National Guard, not a bunch of moochers.

    Gryph -- this is not factually correct. There were 2 vehicles -- one with Ammon Bundy in it (Jeep) and another with Finicum in it (pickup truck).

    The vehicle originally stopped. Ammon Bundy and two others exited the vehicle, which then sped off only to be stopped a few miles up the road.

Thanks to Big Beef, it is a buyer's market.       Persdonally as a cattle rancher from Texas I think the federal lands need to be saved for the wild horses instead of slaughtering them so we can lease lands to a few handfuls of ranchers. The flood the market with cheap beef and we, the ranchers that actually have to either buy or lease land ( at much more than the pennies these fuckups rent federal land) to raise our beef on. I want a fair playing field.

      5:51. I like your way of thinking. what are they charging per head now? I remember how Simplot in Idaho was using our wild horses to feed his hogs. Absolutely sickening. He also poluted our waters with mining. On the Soda fire. we lost 28 head of wild horses. Ranchers could care less about the wild creatures. Its all about them getting cheap fees and over grazing our lands so nothing is left for the wild animals that depend on the grazing to survive. We brought the rest of the wildhorses in to winter them up above boise in the wild horse corrals. There was nothing left for them to survive the winter on.

      The FBI did not fire the fatal shot. It was the OSP which had every reason to shoot. If a suspect has made statements that he would not be taken alive, tried to break through a roadblock, known to always carry and always to carry not only a long gun but a shoulder harness, jumped out of his vehicle and reached into his jacket with his shooting hand, it doesnt make any difference whether it was a bag of peanuts or a 9MM, it's justified. BTW, by running the road block he effectively put every passenger in that car in danger including an 18 yo female who was not likely in agreement to end her life on that day. Just sayin'

  14. I live here, in the high desert of Central Oregon. The Bundy Bunch said they'd leave if the town didn't want them here. We didn't and that was voiced loudly at community meetings. While it was frustrating to see them damaging the refuge, including sacred Indian lands, going through Indian artifacts, and coming and going as they pleased really made their egos overtake their common sense. Their "branching out" into Grant County, set them up. There aren't a lot of roads out here. The only interstate is I-5, and that's over in the Valley. I'm grateful they are in jail and hope they stay there. It's going to be a long time before the area gets over this. These people are NOT patriots. They're delusional nuts playing dress up. They think their interpretation of the Constituation is correct. They are wrong. LaVoy Finicum had said many times he wasn't going to jail. He made his choice and now a lot of people have to live with it. He was not a hero.

      Yes, and news reports said it is unprecedented that the FBI would release such graphic footage and knew it would cause controversy, but proper procedures were followed.

      Taken from a news helicopter, one cannot tell what was being yelled back and forth. His hands were also not up the air but to his sides.

    I know of some Mormons in Nevada who lent their support to Clivan Bundy and they are up in arms over this! LaVoy according to them was a loving, wonderful father, husband, and Christian who was murdered in cold blood. Yup, they believe it and are spreading it like wildfire.

    Managing the National lands, historic sites, antiquities etc. is costly. Western states are larger in dynamics. Ranchers are important. They feed America. The land has been managed accordingly and balanced for all the citizens of america. Some ranchers are faced with many challenges, drought weather disasters insects. The lease agreements are not unreasonable or costly. Ranching is a way of life. If you don't own the land then you must lease it. Just like any business. This terrible event is very stupid sad. There are reasons that we have law and order today. There are reasons for laws and regulations. This land belongs to Good ol mother earth. Respect it. This event was about something else.

      I worked for the BLM in the Mojave Desert and experienced first-hand what a multiple-use agency has to do to balance all the pressures on public land, including mining, ranching, agriculture, recreation, and preservation of historic and natural sites. Lots and lots of time and money go into these decisions: which areas are best suited for what activities. Lots and lots of public input is considered.

      The BLM, the multiple use agency, has a very difficult mandate to balance all these pressures on the resources of OUR public land.

      3:07. So true, the amount of effort to make policy that is amenable to user groups is enormous. In the Malheur area there are active and congenial meetings regarding the refuge. And, there are ranchers, Native groups and interested citizens on all boards. It is ridiculous to think policy isn’t well considered by all invested. Apparently, the group occupying the refuge had little insight into process in that area. I was so irritated when I saw the video where the fellow “despairs” over the way artifacts are stored in the refuge. Firstly, the artifacts could easily have been without provenance given how much potting goes on out there. Secondly, the refuge is not the last place such artifacts would be studied and/or cataloged. The ignorance and hubris of the men “occupying” the refuge eludes most intelligent thought.

      My understanding is that the people who lease BLM land for grazing are getting a sweet deal, bcause:

      1. To lease private land would be much more expensive.

      2. On BLM land, the feds pay for predator control, fire control, erosion mediation, roads, and the like.

      3. Lease payments don't cover the fed's costs.

    Gee, why wasn't this called "an accident"? This militia of mensa rejects were warned, and got carried away, thinking the bureau of land management and the FBI were just playing games.
    Where's Queen No Teefus's death panel facebook screed? I'm glad they got the entire thing on film, kind of negates the "his back was to them and his hands were in the air when boom went the gun". Hope he died quick and didn't suffer. There's a cure for stupidity, but it's too little too late.

  21. After he drove his truck into the snowbank, it is pretty clear that Finicum had a hard time trying to flee in knee-deep snow, thus his arms out sideways. It is also pretty clear that he had no intention of stopping before facing the roadblock. If anything, he sped up before crashing into the snowbank on the left side of the road. That he didn't injure the officer who jumped from behind a vehicle when it looked like Finicum's truck would hit it is just pure luck.

    I watched the video several times, pausing it down to slow-motion. Finicum did indeed reach into his jacket or belt at least twice before being shot. Even if he hadn't stated - multiple times - that he had no intention of surrendering peacefully, the video doesn't lie. It shows a man who thinks he is either butch or sundance. It shows a man who wants to die in a hail of bullets.

    Somehow I cannot feel sorry for him, or his compatriots who are charged and will be convicted.

    hmmm. confusing? they said that they all had bullet proof vest and always had their guns attached to hip. The words that these americans repeat is the propaganda distributed at gun shows every weekend. The little booklet that they wave is probably from the heritage foundation.     Oregon judge this afternoon ordered the Bundy boys and several of their terrorist accomplices held without bail -- judge said they are a threat to others and are a flight risk.

    Ought to arrest old man Bundy, too.

    Seize their guns, vehicles, real property, livestock, cats, dogs, bank accounts, brokerage accounts, the clothes on their backs, and ship 'em off the Gitmo.

    I have watched the video several times and have a few questions.

    1) What time did all of this occur? The video is clear and reads from a zero time stamp which means after midnight when it would be extremely dark outside. If so, that would explain Finicum not seeing the other officer coming up behind him and startling him. It would also explain why Victoria Sharp thought she heard 100 shots coming into the car when it was only the flash bangs going off.

    2) Did anyone else notice the flashlight that kept going across Finicum's face after he got shot? Was it from the people inside the vehicle he was driving or from the officers?

    I am probably way too vested in the minute details of this event.

    If these were heavily armed Black Lives Matter protestors, it would have taken one day before they were all teargassed and/or shot and taken into custody.

    If these were armed MUSLIMS, just imagine the outrage and umbrage taken. The Palinbot Teaparty White CHristian nut cases would have been screaming for just bombing them all.

    But if a bunch of armed white men spouting Jesus loves us and misquoting the Constitution occupy a Federal building, well we have 30% of the country applauding them, and the Feds have to proceed very carefully.
