Parents of two men killed in Benghazi attack file federal lawsuit against Hillary Clinton.

Courtesy of the Chicago Tribune:

The parents of two men killed in Benghazi, Libya nearly four years ago are suing former Secretary of State and current presidential candidate Hillary Clinton, saying the attack resulted from her “reckless” handling of classified information.

The federal lawsuit, filed Monday, comes from Patricia Smith of San Diego, whose son Sean Smith was a U.S. State Department technology officer, and Charles Woods of Portland, Ore., whose son Tyrone Woods was CIA security contractor.

Four people, including Smith and Woods, died after an anti-American militia group attacked the U.S. diplomatic compound on Sept. 11, 2012.

Since then, Clinton and the question of what responsibility she may have had for those deaths prompted a two-year inquiry that revealed she had used a private email server for government business.

A yearlong FBI investigation followed, which found no grounds on which to prosecute her.

You know every time I think I have witnessed the lowest depths to which the Republican party will go to defeat Hillary Clinton I rediscover that there really is no bottom.

Manipulating grieving parents into filing a baseless lawsuit for political gain is right up there with holding a gun to a puppy's head and demanding money.

Of course more than likely this will get tossed out of court due to a lack of evidence, because there is nothing in Hillary Clinton's handling of her e-mails that has anything to do with the attack in Benghazi.

This is just another GOP fishing expedition trying to dig up more dirt on Hillary, and using these grieving parents as bait.

Simply disgusting.

I don't mean to be cold, but the media on the right continually refer to these men as "children." The mothers who spoke at the Republican Conventions lost their "children" they would keep saying. Smith was 34 and Woods 41. I think it's deliberate. They could just as easily say they lost their sons but children sounds even more tragic in a way. More manipulation by the right.

Not to mention that Smith has no standing.

This was spoken of by one of our news anchors.

Smith was married. His WIFE is his next of kin. His mother no longer has that standing.

His WIFE does not in any way feel the same as his mother. She does not blame Hillary, Obama or the government. In fact, she wishes her mother in law would just sit down and shut the fuck up.

My guess is that the relationship was strained while the son was alive. Now it is just totally off the rails.

To mothers and fathers their offspring, if you like that term better, are always and will always be their children. I don't care if my daughter is 43, she is still my "child" and I don't give a shit if that sits right with you or not. With so many reasons to condemn the GOP why would you be so petty as to focus on that?

For the simple reason she is not next if kin! She must take her position in the back seat! She can voice her opinion about her son's death, but to try and sue anyone for her son's death is not her position! Her son was married and if I'm correct she's next of kin for everything! I'm a mom of two boys and I know where my place is as a mother and a son that has a wife! Mom goes to the back seat!

I hope the lawsuits are quickly dismissed. But no doubt the headlines about them will keep on circulating, which is just what the Republicans want -- and encourage. And mountains of spin will flow forth, crying that the judge on Hillary's payroll, or other such bullsh*t.

This suit is a giant waste of time -- both of their sons have surviving spouses, who would be the only people with standing to bring a wrongful death lawsuit -- the parents do not have a valid claim here based on that alone. And the nut job lawyer who brought the suit -- Klayman -- has sued the Clintons numerous times and should have been disbarred long ago.

Even assuming that the parents are the proper parties to bring a claim against Mrs. Clinton - and they most emphatically are not - she has absolute immunity for common law torts committed while she was acting within the scope of her office as Secretary of State. The Federal Tort Claims Act is the exclusive remedy for common law torts that might be alleged against her. And the lawsuit, as filed, is not an FTCA claim. Plus, the statute of limitations of two years has long since run. This claim should be booted immediately. And the layer that filed it should be Rule 11-sanctioned.

I see the GOP's dirty hands all over this. Republicans in Congress know that there was nothing Hillary Clinton could have done about the attack in Benghazi; the GOP's years of witch hunt committees ended in utter failure. They also know that there is nothing in their contrived e-mail scandal. So now they'll attach themselves to the grieving parents of two of the men who died at Benghazi. How callous they are. How cruel.

The sad thing is the spouses have tried to stay out of it, but the Democrats will try to convince them to enter the fray to oppose their parents in law in the court of public opinion and the media. So not only will it be a political battle, it will also tear two families apart.

This is nothing new - other than a new low for them to use grieving parents to achieve political ends. If you can't win legally, go low or fudge the district boundaries. Republicans DESERVE Donald Trump - he is them.

As far as I'm concerned, Republicans have proven themselves to be the 'scum of the earth' since prior to the election of President Obama THE FIRST TIME!

We all now know they are racist, liars, frauds and will tell any story they can dream up to try and defeat Hillary Clinton in her run for POTUS!

Plus, they supported and put Donald Trump in the position of running for POTUS and now they are embarrassed by him and throwing all the blame at him vs themselves.

Vote out Republicans in the U.S.Congress that are up for reelection and in the Alaska State Legislature! We need a major change very, very badly!

And, vote for Hillary Clinton! She will make an outstanding POTUS and is ready to step into the leadership of our country after President Obama has completed his second term!

And - President Obama has done one heck of a job standing up to the Republicans and beating them in many, many instances! His actions against them have been a pleasure to watch!

Then people should get in line to sue George Bush and Condi Rice for September 11. They did not follow up after the warning that Bin Laden was going to attack. The, people should sue Rumsfeld because he did not provide the troops with safe vehicles. Instead, they were easily blown up, and there both injuries and deaths. While we are at it, sue Bush and Cheney for starting that war. Iraq did not attack us.

The woman is grieving, yes, but she's also not all there--anyone can see when watching her that she surely wasn't all there even before her son died. And she's crying defamation yet what she said about Hillary during the convention was fine? if Hillary were not running for any office, she could just as easily sue her.

This woman also acts as though her very grown son--who was living in the Hague and was married with children, and they had lived in the Netherlands and South Africa and at least one other country--was always home at night in her house to feed and tuck in bed. She never mentions his wife Heather. This mother says she wants to send her son's ashes into outer space. She speaks like she has that right. No, lady, Heather was the one who was considered immediate family (it drives the mother mad) and she will decide if something more should be done with her husband's ashes.

Links to two stories on Pat Smith. Both touch on wife Heather and on the mother's thinking that she, as Sean's mother,is the important woman grieving and with rights. Since some memorials and fundraisers a few years ago, Heather has lived her live and not been involved in this stuff that Patricia Smith keeps doing. She was pleased with the investigation back then and has not said anything to the contrary since.

The mother lost her son four years ago and clearly needs to get some therapy. Seriously, she has considered selling her house to raise funds for sending her son's ashes into outer space. She barely acknowledges the wife (she mentions her in one article here but I have seen countless articles with no mention) and speaks as if she is Sean's most immediate family but then there's a quote that Sean had not been hers for a long time. She's angry and in pain and it is going to go on forever. Yes she will grieve forever, but her way of handling things is so unhealthy.

  42. I am a mother. I grieve with these mothers for the loss of their sons. But if every parent sued the US Govt when they lost a son or daughter while in service to America, there would be millions of law suits. That also means that the relatives all 62 diplomatic persons who died while deployed under GW Bush's administration would have legal recourse too. Most public servants sign papers acknowledging the dangers, as my father did when he joined the USAF. At that point the US Govt and the volunteer/employee enters into an agreement not to hold the US Govt responsible for events which it cannot control. I would ask instead why the Congress refused to allocate additional funds for Embassy safety. If you want to place blame, start there.
