Okay well first off this is never happening.
Palin has threatened to sue all kind of people over the years, yours truly included, and never follows up on those threats.
Secondly the Times corrected their story, which essentially shields them from any such lawsuit:
"An earlier version of this editorial incorrectly stated that a link existed between political incitement and the 2011 shooting of Representative Gabby Giffords," the Times wrote on Thursday. "In fact, no such link was established."
And thirdly the only reason that Palin is making this noise is because a couple of news outlets attacked the Times over their story.
Smelling blood in the water, and an opportunity to get a little attention, Palin fired off those tweets.
I would bet money that she has not talked to a single lawyer about this, and that any legal conversations she HAS had more than likely have to do with keeping her first born out of jail.
As for the Times story itself, yes it is true that no link between the SarahPAC map and Loughner was ever proven, but it was still an outrageous thing to do and there is also no definitive proof that Loughner DIDN'T see the image.
But we are agreed that he was a deeply troubled young man, but then again Palin herself is clearly also deeply troubled, or she would not tweet out these cries for help.
She and Trump are two of a kind. What fucking idiots! Both of them!

There is no reckless disregard for the truth. It would be hard to prove that the crosshairs and the Giffords shooting were directly linked. But it would be hard to prove that they weren't.
Finally, under the decades of Supreme Court definitions of "public figure," Sarah Palin probably was one back in 2011.
She'd have to prove that she is one now. The more stringent requirements that the Court has set down allow a former public figure to become a private figure.
But, even as a private figure, she'd have to prove that her reputation has been damaged.
That would be like John Edwards or Dick Cheney -- or Hillary Clinton -- claiming that their reputations have been damaged. After a certain point, there's nothing new that can be said that can damage you any further.
There's a case to be made that Sarah Palin has libeled a slew of public and private individuals. Luckily for her, they haven't sued her. She's lucky they don't care enough to sue her.
This will go no where, because she can't prove even one leg of a libel suit, but she's having fun pretending anyone cares enough to say something allegedly mean about her.

DeleteOn a less amusing note, yes, Loughner was seriously mentally ill. But take it from someone who has a front-row seat to mental illness in my own family: even a person who is very far removed from reality on this planet does not exist in a bubble. Many people with serious mental illness are functional enough to use the internet, watch TV, etc. The kind of mean-spirited, conspiratorial BULLSHIT that Palin, Trump, and their ilk dish up daily feeds DIRECTLY into paranoia arising from mentally illness. Trump's one true genius, and Palin's to a lesser extent, is their uncanny ability to zero in on & then throw gasoline on smoldering fires. I'm convinced, being better educated on the subject than the average bear, that a significant fraction of the Trump/Palin base -- not all, but the most rabid core -- meet the DSM-5 criteria for thought disorder including delusional/paranoid/etc traits.
