Sarah Palin makes noise about suing the New York Times. She won't.


Aww, poor baby.

Okay well first off this is never happening.

Palin has threatened to sue all kind of people over the years, yours truly included, and never follows up on those threats.

Secondly the Times corrected their story, which essentially shields them from any such lawsuit:

"An earlier version of this editorial incorrectly stated that a link existed between political incitement and the 2011 shooting of Representative Gabby Giffords," the Times wrote on Thursday. "In fact, no such link was established."

And thirdly the only reason that Palin is making this noise is because a couple of news outlets attacked the Times over their story. 

Smelling blood in the water, and an opportunity to get a little attention, Palin fired off those tweets.

I would bet money that she has not talked to a single lawyer about this, and that any legal conversations she HAS had more than likely have to do with keeping her first born out of jail.

As for the Times story itself, yes it is true that no link between the SarahPAC map and Loughner was ever proven, but it was still an outrageous thing to do and there is also no definitive proof that Loughner DIDN'T see the image. 

But we are agreed that he was a deeply troubled young man, but then again Palin herself is clearly also deeply troubled, or she would not tweet out these cries for help.

    I've taught libel law for more than 25 years. Any reputable libel attorney (and any judge) would tell Sarah to go home and save her money.
    First, no malice is attached. And it was in an editorial.
    There is no reckless disregard for the truth. It would be hard to prove that the crosshairs and the Giffords shooting were directly linked. But it would be hard to prove that they weren't.
    Finally, under the decades of Supreme Court definitions of "public figure," Sarah Palin probably was one back in 2011.
    She'd have to prove that she is one now. The more stringent requirements that the Court has set down allow a former public figure to become a private figure.
    But, even as a private figure, she'd have to prove that her reputation has been damaged.
    That would be like John Edwards or Dick Cheney -- or Hillary Clinton -- claiming that their reputations have been damaged. After a certain point, there's nothing new that can be said that can damage you any further.

    There's a case to be made that Sarah Palin has libeled a slew of public and private individuals. Luckily for her, they haven't sued her. She's lucky they don't care enough to sue her.

    This will go no where, because she can't prove even one leg of a libel suit, but she's having fun pretending anyone cares enough to say something allegedly mean about her.

  7. Keep in mind that anyone can sue anyone for anything. Even a case that you are sure to lose can be filed. If suing them brings her a few more minutes of fame then I think she might just do it. And although the NYT would know she couldn't win, they might settle just to avoid the time and expense of defending a lawsuit. Just saying. Prior lawsuits were not filed because she was not as desperate for attention as she is now.

    Trump's inability to extend a better-than-usual public moment has been the telltale sign of his campaign and presidency.     Trump may want to stay away from the topic of "pols who endanger national security by failing to take precautions against the Russians." More important, each accusatory tweet sounds like one more instance in a pattern of trying to stop or divert investigators and lean on potential witnesses. Meanwhile, Trump's surrogates launched ham-handed attacks on special counsel Robert Mueller (which virtually no elected Republican thinks are warranted).

    Friday morning the tweet storm continued.

    ...Trump's inability to restrain himself under pressure is nothing new. We saw him dig deeper and deeper when it came to attacking the Hispanic judge in the Trump University case or insulting the Gold Star family of Army Capt. Humayun Khan. Now, however, his obsessive attacks take on legal meaning — perhaps instances of obstruction of justice in and of themselves, or, at the very least, powerful evidence that Trump would have tried just about anything to throw the FBI off the trail.

    Trump likely will become more unhinged as headlines dog him day after day, a parade of witnesses troop in to talk to the special counsel and the investigation metastasizes.

    Who does Sarah Palin blame for her son's violent outbursts during his youth hockey games? President Obama, Iraqi PTSD, or the NYT?


    Curt Menard, a longtime family friend, said he would often sit next to Ms. Palin’s parents to watch their grandson play. If Mr. Menard arrived after the game started, he said, he would ask if he was too late to catch him.

    It is not "slander and libel" keeping you out of the public eye, Sarah.
    You are no longer relevant because of your own mouth:
    a) your voice is like fingernails on a chalkboard and
    b) your message is one long, hateful screed

    You were overwhelmed by crowds of adoring fans, but Sarah - those crowds are a tiny fraction of the entire electorate.
    That the majority can't stand you has nothing to do with "libel and slander" and everything to do with your messaging.

    The more you spoke, the fewer the people who liked your message.

    On a less amusing note, yes, Loughner was seriously mentally ill. But take it from someone who has a front-row seat to mental illness in my own family: even a person who is very far removed from reality on this planet does not exist in a bubble. Many people with serious mental illness are functional enough to use the internet, watch TV, etc. The kind of mean-spirited, conspiratorial BULLSHIT that Palin, Trump, and their ilk dish up daily feeds DIRECTLY into paranoia arising from mentally illness. Trump's one true genius, and Palin's to a lesser extent, is their uncanny ability to zero in on & then throw gasoline on smoldering fires. I'm convinced, being better educated on the subject than the average bear, that a significant fraction of the Trump/Palin base -- not all, but the most rabid core -- meet the DSM-5 criteria for thought disorder including delusional/paranoid/etc traits.
    But the claim that "Palin wasn't responsible because Loughner was crazy" is grotesquely off-base.
