Anti-gay Kentucky clerk sent to jail. Where's your God now?

A federal judge ordered a defiant county clerk to jail for contempt Thursday after she insisted that it would violate her conscience to follow court orders to issue marriage licenses to gay couples. 

Rowan County clerk Kim Davis and her deputy clerks were summoned to appear before U.S. District Judge David Bunning after she repeatedly denied them marriage licenses, cited her religious beliefs and "God's authority." 

The judge said his only alternative was to jail her because he did not believe she would comply with his order even if she were fined. She was escorted out of his courtroom by a deputy, although not in handcuffs, to be turned over to the custody of federal marshals. 

Just goes to show that stubborn superstition will always give way to intellectual progress eventually.

This woman was not only an anti-gay bigot hiding behind the Bible, but she was also stunningly hypocritical: 

Court records detail Kim Davis’ turbulent marital history: She has been married to her current husband twice, with a divorce and another husband in between. 

She married her first husband, Dwain Wallace, when she was 18, and divorced him in 1994. 

She acknowledged in a 2008 divorce filing having had two children in 1994 while she was not married. 

In 1996, at age 30, she married Joe Davis for the first time. They divorced in 2006. 

The next year, at 40 years old, Davis wed Thomas McIntryre, though their marriage lasted less than a year. She re-married Joe Davis in 2009. 

I have no use for religion anyhow, but I have to say that a person like this does not do Christianity any favors.

      She's apparently been sentenced to remain in jail until she agrees to start issuing marriage licenses to gay couples. The judge said he wouldn't fine her because her supporters would just pay for her (she already had groups raising money).

      At what point does "martyrdom" get boring, and all the fanatical supporters drift away?

    All the deputies are going to issue licenses except Kim Davis' son. But, he's an employee not an elected official, so it seems that he can be fired for not doing his job. Kim Davis was elected so to remove her from office, there would have to be a legal action followed by a new election.

    Although I had not been a supporter of same-sex marriage, I have to say that I disagree with what this woman is doing. If she finds giving out marriage licenses to gay couples is a violating of her religious principles, then she needs to get another job. She can't interfere with the workings of the law. This issue has been decided by the Supreme Court. I know that evangelicals are offended that this is what America has come to, but they need to face it. There is simply nothing in the Constitution that says your job is guaranteed never to change in ways you find morally or religiously objectionable. Her discomfort at SSM doesn't mean her rights are being violated here. If her faith is strong she should search for another job. She believes she has eternal life? Then getting another job while here on earth is a pretty minor inconvenience in the whole scheme of things.

    This advice comes to her from a fellow evangelical.

      "What America has come to" is an incrementally advanced understanding that civil rights apply to all, including the right to civil marriage.Civil, not religious, and I'm still waiting to hear from the first member of any clergy who was "forced" to officiate a same-gender marriage.

      Even Kim Davis is not being asked to do that. Her job is to pass out marriage licenses to two - and only two - U.S. citizens who meet the current legal requirements. Everything beyond that is none of her damn business.

      If it's difficult for evangelicals to "face" that, perhaps they're not nearly as read up on civics (and our Constitution) as they are the Bible.

      Here's why. (Hat tip to Amanda Marcotte for the insight). In a ssmarraige, responsibility, chores and decisions are negotiated or shared. And ssmarraiges work - happier parents and kids. So if THE FUNDERNUTS LIVE next to JOE And John, and Susie FUNDERNUT sees one or both of them changing a diaper or doing the lawn and overhears them sharing decisions she may begin to question why in her marriage her husband never lifts a finger with the kids or the housework, never shares the checkbook or the decisions because MEN don't. JImbob FUNDERNUT really doesn't like where this line of questioning is heading. Hence he's agàinst same sex marriage or even openly gay relationships.

      However, I think that what they really want isn't for god to trump the constitution, but that they, the Fundies, are persecuted. Once a group has been convinced that they are being persecuted, they are much easier to contol and manipulate. It's divisive politics, plain and simple, and it's very harmful to our democracy.

      Instead, she chose to seek a very public martyrdom in the media and insist that everyone else follow the tenets of her particular church.

      I suspect that she hoped to cash in on right wing indignation like the owners of the pizzeria in Indiana that refused to cater to gay weddings. The last total I read they had collected was ten times what Davis makes in a year - a pretty tempting payday for refusing to do your job!

Not to say they will take it, but there are always opportunities for appeals. It could definitely go somewhere, these kinds of situations have legs, and it will be interesting if it does.

    Imagine if Kim Davis were to discover she's actually a bigamist, because the clerk in charge of finalizing her divorce papers didn't do it since the clerk was a Catholic. Next, she discovers she doesn't have any job-related health insurance, because THAT clerk was a Christian Scientist....which becomes a huge, huge issue because the head clerk of the whole office is---wait for it---a Pentecostal SNAKE HANDLER, whose conscience impels her to worship on the job!!!

    When she goes to buy a gun to take the head clerk out in self-protection, she can't get a permit because the clerk in charge of that happens to be a Quaker, and selling guns goes against his sincerely held pacifist beliefs.

    If the clerk does not want to do her job properly and serve all of the citizens without prejudice then she should resign. Problem solved. Maybe her church can hire her as church secretary or something. She should not be receiving a salary from all of the taxpayers if she is going to refuse to serve some of them.

      Her Dad held the job for over 20 years and she worked under him.

      She ran in 2014 and won, took the oath in January of 2015. I'm sure she's counted on being re-elected for as long as we wanted to serve until she got herself a big, fat retirement pension.

      Then her son would run and win, coming from a long line of clerks.

      Even though it's an elected office, it's not unusual for an elected office to go from parent to child.

      We've got Duncan Hunter locally.

      Then there are the Cuomos.

      And of course, the Bush dynasty, Jeb being the most recent hopeful.

      If the local political machine is behind them, then yes, they are inheriting the job, elected or not.

      For the record, Muslims have no general prohibition against women driving. They can't get drivers licenses in Saudi Arabia and perhaps a few other places, but it is certainly not the case everywhere.

    My state had a governor who served two terms in office. The state had capital punishment and several death row inmates. The governor decided that since his religious beliefs were in conflict with execution, he would commute all their sentences as a final act. Many were upset. His political career ended once he finished his term.

  19. I was reading an article where it stated her Oath of Office she took as County Clerk. It states (in part) as follows:

    "I will support the Constitution of the United States and the Constitution of this Commonwealth, and be faithful and true to the Commonwealth of Kentucky so long as I continue a citizen thereof, and that I will faithfully execute, to the best of my ability, the office of Clerk..... according to law" and ends with "so help me God"

    Based on that, I would state with no equivocation that she was legally, morally, and ethically obligated to issue the marriage licenses. I agree with the Judge that by "picking and chosing" what she would enforce based on HER personal beliefs, and not the laws, rules, and regulations at a local, State, and Federal level, she was not following the Oath she took and swore to.

    An oath is typically taken by some power, and most people no doubt believe they’re swearing by Almighty God to uphold the Constitution and laws of the United States (and of the state, in the case of these state officials). Would it make sense to swear an oath in God’s name and then go and obey that oath in violation of God’s word? It wouldn’t, of course, but that’s beside the point. Whom you swear the oath by is VASTLY from WHAT you swear to do.

    Elected (and appointed) officials in the America don’t swear to uphold God’s law. They swear to uphold the Constitution, which never mentions God at all. And they swear to uphold laws enacted under the Constitution, which means laws that are in compliance with the establishment clause that prohibits any established or official religion.

    That’s the main reason the framers didn’t include God in the oath of office. It would’ve contradicted the proposition in the Constitution that said no religious test would ever be required to hold office under the Constitution.

    Of course, there’s nothing wrong with doing like Washington and adding God to the oath. But the key point is that doing so is a personal decision, not an official or professional one. And the consequence of that distinction is all-important.

    It’s just fine for a public official to say that he or she won’t enforce any law that’s fundamentally immoral and in contradiction to God’s laws. But the only way to keep that promise consistent with the oath of office is for the official to resign when she thinks enforcing the law would be wrong. Given Davis’s statement of faith that it would violate her interpretation of God’s will to issue a marriage license to a same-sex couple, she should quit her position as county clerk. Indeed, she must, or she’d be living in a position of hypocritical sin.

    But by saying she won't issue the marriage licenses while serving in office, Davis is also, if I may humbly say so, committing a sin: violating an oath she made before God to uphold the Constitution and laws of the U.S. The Constitution requires her to issue licenses for all couples, and that includes gay couples. Every moment she disobeys the Constitution, she is violating her oath. The Bible doesn’t look kindly on oath-breaking. The only way for her to emerge from the state of sin is to resign.

    Under the Constitution, the government can’t force you to engage in a religious action or stop you from exercising your freedom of religion. Normally, it shouldn’t coerce you to act against your faith. But no one was or is coercing Kim Davis. She’s free to serve the public and obey her oath to God to follow the law. And she’s free to quit and absolve herself of that oath. The choice is hers.

    Before you tell me that the Constitution doesn’t require gay marriage, that the reason we are having this argument is because "the Supreme Court is the people requiring gay marriage", think again. The Supreme Court’s interpretation of the Constitution is binding, and that’s a cardinal constitutional principle that can’t be denied by anyone who works for any part of the U.S. government. If you don’t agree with that, there’s a Civil War that needs fighting, again.

      If she feels that her commitment to god supersedes her duty to uphold the constitution, she should have never run for this office or taken that oath.

      She should also have never issued any marriage licenses to any divorced people. Her issue with gay marriage is at best ambiguous in the scripture, and many don't even see it exists at all. However, JC himself was crystal clear that divorce and remarriage is a sin. She apparently has no trouble aiding and abetting those sinners.

      She is such a freaking hypocrite on so many levels. I hope she has a nice, loooooong stay in jail. That ought to cool her Jebus jets.

    With just a few days in the jail, this woman will be singing a different tune. You cannot pick and choose the laws you follow. They are what they are. Yes, she has First Amendments rights to believe as she pleases, but she cannot use those rights to deny others their rights.

    If she cannot or will not do her job (remember her salary is paid by the taxpayers), then she must resign. But the bitch doesn't want to leave her $80,000 a year job. She wants it both ways and that a'int going to happen.

    So, in jail she sits and rightfully so.

    As an American I just find it completely insane that other people find the need to press their own beliefs onto others. Just because this woman believes in something else does not give her the right to tell or dictate how others live their lives. She's breaking the law, period. There shouldn't even be a debate about this because the courts made gay marriage legal. If people don't like it then they should keep it to themselves. It's completely perplexing to me that people care so much about strangers lives that they feel the need to get involved and dictate how they live. It's none of their business nor are they "God". If they think that way they should get out of United States and live somewhere that has similar beliefs and makes it the law.

    If Kim Davis were being denied a marriage certificate by a Muslim who did not believe in multiple marriages, she would be screaming Sharia law at the top of her lungs.     Ms. Davis needs to respect the fact all her name on the license is indicative of is the county in which it was issued. It does not represent her personal endorsement or approval. No one is looking for that nor is it required, except in the mind of Ms. Davis.

    Given the length of time she's served in that office, both under her mother and since taking over her mother's office, she may believe she owns it and has a say in the practices of that office. However, she is just a public employee who must follow the law in these cases, no more, no less.

    A public official should follow the law, no matter his/her personal religious belief is. If she cannot do the job, she should find another job. The judge did the right thing in throwing her in jail for contempt of court. After tasting the jail food for couple of weeks , she would be singing like canary to be let out. This woman admits she had done wild and wicked things in the past. Now all of a sudden she found salvation. What a bull!!

    I originally came here while searching for info about Bristol Palin's pregnancy. But I came to find this site interesting. I did the same with the gay website Towleroad. I started out being "anti-gay" politically but came to be more liberal after reading that website for a number of months. I think it's important to read from a variety of viewpoints. And truthfully, the right-wing echo chamber gets boring after a while.

    The thing that bothers me the most is that she had the gall to say she wouldn't discriminate ('cause that would be wrong), so she would issue no licenses. And instruct her staff to do the same. (What does she have over them? She can't fire them without enduring a long legal battle over whose word is predominant - hers or the Constitution.) However, it's not discriminating if she gets her way and has sanctioned permission to discriminate. Huh?

If there was only one true religion, fanaticism wouldn’t be all that bad. But there’s the rub, honey. Not only are there many different religions; there are many different versions of each religion. These days religious beliefs are like a backside. Everyone’s got one and often times they stink.

      I practiced empathy with this woman. I was Catholic so in her shoes I would refuse a license to any person remarrying but no I am not like her. If I was Baptist and worked at a restaurant that began serving liquor so in her shoes I would enforce no alcohol but no I am not like her.

      She wants to force her principals and beliefs onto others outside the law. I clapped my hands that she was sent to jail for refusing to comply with the law. She has the choice to get another job. Maybe prison will help her see the light.

  50. Had she been a school teacher, could she have refused to teach gay children and those whose religion is different from her's or who expressed beliefs she didn't share? Why draw the line at County Clerk. How about emergency responders, care givers, doctors and nurses, or even police.

    Who cares what the law is and the courts say? As Huckabee points out, the supreme court is not the supreme being. If belief and faith are everything, anyone anywhere at any time can practice those deeply felt conviction however they wish.
