A jury on Thursday found an undocumented immigrant not guilty in the July 2015 death of Kate Steinle, a decision that reignited the debate over immigration policy.
Jose Ines Garcia Zarate, 45, was acquitted of murder and involuntary manslaughter charges, as well as assault with a deadly weapon. Jurors convicted the Mexican citizen of being a felon in possession of a firearm, which could bring a three-year sentence.
Prosecutors had argued Garcia Zarate intentionally shot Steinle, 32, with a Sig Sauer .40-caliber handgun as she and her father walked on San Francisco's Pier 14. But Garcia Zarate's defense attorney said the shooting was accidental and the bullet ricocheted off the ground and traveled about 80 feet before hitting Steinle.
Federal immigration officials said they will try to deport Garcia Zarate. He had been deported from the United States five times prior to Steinle's death.
This woman's death became a rallying cry for conservatives, and a tool for Donald Trump to make his argument that we needed to build a "big, beautiful border wall."
She also was the inspiration for Kate's Law, which suggests harsher penalties for illegal immigrants who have repeatedly broken the law.
Of course as soon as Trump heard about this he was all over Twitter.
A disgraceful verdict in the Kate Steinle case! No wonder the people of our Country are so angry with Illegal Immigration.— Donald J. Trump (@realDonaldTrump) December 1, 2017
The Kate Steinle killer came back and back over the weakly protected Obama border, always committing crimes and being violent, and yet this info was not used in court. His exoneration is a complete travesty of justice. BUILD THE WALL!— Donald J. Trump (@realDonaldTrump) December 1, 2017
I'm not sure what Nancy Pelosi and Chuck Schumer have to do with this, but as usual Trump needs to attack someone. The jury was not told the killer of Kate was a 7 time felon. The Schumer/Pelosi Democrats are so weak on Crime that they will pay a big price in the 2018 and 2020 Elections.— Donald J. Trump (@realDonaldTrump) December 1, 2017
Trump was certainly not the only one to take to Twitter over this.
Oh yeah, if only there had been a wall. Simple minded moron.Jury convinced that illegal alien killed Kate Steinle accidentally. She would still be alive if we had a wall.— Ann Coulter (@AnnCoulter) December 1, 2017
Even the Wasilla Wendigo contributed her two cents.
Actually they were given the same rights, as both sides were represented and the jury delivered its verdict based on the evidence.Such an insane recent news cycle, and now this?? Outrageous “not guilty” verdict in murder case of Kate Steinle. The illegal alien who shot her was just given more rights, grace and favor than the devastated Steinle family. San Francisco is NOT a safe place. - SP— Sarah Palin (@SarahPalinUSA) December 1, 2017
That is how justice works in this country.
It is indeed a tragedy that this young woman lost her life, but it is also just another among the thousands of deaths each year caused by gun violence.
The only reason the conservatives give two shits about this incident is that it involved an undocumented immigrant.
Period.
But if the victim was an unarmed black man who was shot in the back by a police officer who was found not guilty, rhey would b praising the court system. So lets say that if we had a wall that somehow kept this man out, Kate Steinle still might be alive, but the church goers in Texas would still b dead. The victims in Vegas would still b dead. The other mass shooting victims from this years would srill b deas.
ReplyDeleteI agree 100%. Where was the Trump/Coulter/Palin outrage against all of the white mass murderers who have killed many fellow Americans with their "weapons of mass destruction" (assault rifles)? Same with the police officers who have gotten off scott-free for murdering black males? The hypocrisy among Trump and his sheeple is astounding (but not surprising). Instead of focusing on building a wall, how about vetting the home-grown guys? While we're at it, why isn't there a rush to address gun safety?!
DeleteWhy no rush to prevent mentally ill people buy guns?
DeleteThey may build their wall but that wall will not protect anyone from evil wrong doers amongst us. Every race or nationality has an element of criminally minded people. It could be a neighbor you had a beer with or a real estate agent you never suspected would be a pedophile, rob, serial killer, rape, to mass murder coworkers or strangers in a church or community. Instead of accepting these truths they need to scapegoat. I don’t hear them up in arms or even admitting crimes Palin’s son committed!
No point to attempt to reason with them.
O/T, Libyan newspapers are saying that the CCC report on African refugees being sold onto slavery in Libya is fake news, and the video isnt real. Geez, i wonder who they got the idea to say that from
ReplyDeleteThe bullet richoted 80 feet to hit her. It was impossible to prove the crime the guy was charged with. Yes terribly sad but murder? No.
ReplyDeleteTheir contempt for the rule of law, fairness, and justice is despicable and anti-American.
Either the prosecution failed to present the case or the defense was really good. And of course jury selection. I'm not sure if priors or deportation information was presented. He claimed to find the gun and it went off as he picked it up. Hmmmm?
ReplyDeleteI'm glad to know that I'm not the only one that believed him!
Delete11:41, what's your point? The prosecution overcharged this, it was not murder or even manslaughter. The bullet ricocheted off the ground 78 feet away from the woman; he could not have been firing at her if he was firing at all. And no, priors or deportation records were kept out, because they are irrelevant. Again, what's your point?
Delete2:01, this is absolutely manslaughter. Gimme a break.
Delete"Involuntary manslaughter is the unlawful killing of a human being without malice aforethought, either expressed or implied."
The prosecution overcharged, yes..
Deletewhy?
Trump outrage, RW pressure, anti Sanctuary City?
Not manslaughter if he dropped the found gun by accident and it went off. Is the cop whose gun it was guilty of manslaughter because he left it loaded and unsecured and it killed someone? The jury obviously believed the defense assertion that the defendant did not pull the trigger; therefore, no manslaughter was found.
DeleteThe jury did their work, based on the facts they were presented and obviously did the right thing. Plain and simple!
ReplyDeleteWe had a wall- between church and state and wingnuts tore it down for the good of their party.
ReplyDelete3 time felons get life in prison. Why not keep this guy behind bars for awhile-like life. Bet he won't kill Kate Steinle again. But, then poor widdle wingnuts would not have their straw men to raise campaign cash on.
They also made fertilized eggs “people” while at the same time taking healthcare away from millions of actual people, threatening their existence by threatening Social Security and increasing their tax burden by 50% over the next 10 years.
Delete(On Monday Trump is going to start destroying our National Monuments.)
I can only hope that if they pass the final bill, as it comes out what they’ve done to America, more and more people vote these fuckers OUT of office. I hope it destroys their party and “Republican” because as vile a word as Fascist, Communist and Nazi. I hope this ushers in decades of Democratic power because that is what it is going to take to clean up their mess.
The fact that the likes of you are reveling in this verdict, for someone who shouldn't have been here to begin with, is one of the primary reasons Trump won. And anti illegal immigration sentiment is growing, Trump or not.
ReplyDeleteReveling? Do you apply the same standard to the white child who accidentally shot his father killing him?
DeleteWow, it must feel safe to live in a self made reality bubble that no white teens have babies out of wedlock to no US citizens (white ones) traffic drugs, are pimps or shoot people or rape. Also only citizens, never an immigrant can possibly accidentally discharge a firearm.
You missed the point of twisting something to use as proof.
What does this have to do with anyone's skin color 12:46, the man was illegally in the country, and had no right to possess a firearm.
DeleteOh right, liberals, the true party of division and racism.
Drumpf didn't win. Russia interfered and soon Drumpf will be a distant, albeit stoopid fucking wingnut, memory of how far wingnuts have fallen.
DeleteLeon Panetta, President Obama’s former Secretary of Defense, told NBC's Chuck Todd on Friday that it was a "stretch" to say the Trump transition team broke the law with their contacts with the Russians.
Delete"We have one administration at a time," Panetta said, warning that the Trump transition team undermined long-standing political norms in the United States by engaging in diplomacy while the Obama administration was still in office.
However, the former defense secretary doubted that dealings with the Russians rose to the level of criminal violations.
"Their contact with Russia was very unusual. Whether it breaks the law or not, I think that's probably a stretch," Panetta predicted.
where did your people come from ? did they have guns? people have never stopped coming here- and it's people of colour that get rejected. i bet your white ancestors had no trouble getting in.
Delete2:34. Do you even have the slightest idea what would happen to an American, illegally in Mexico, shooting and killing a Mexican citizen with an illegal firearm?
DeleteBye bye forever in prison.
2:25
DeleteThat’s all well and good on the surface. But if they were dealing with the Russians for political favors (I.E. dirt on Hillary, hacking, etc.) before the campaign in exchange for favors they would provide if they won, then that IS a crime. And that is what this investigation will uncover or not. (Help us win and we’ll rescind those sanctions would be an excellent example.)
This isn’t just about “contact”. It’s about much more.
McConnell just announced they have the votes!
ReplyDeleteThat fucker Flake just turned for a “promised on DACA and using some half ass formula they KNOW is wrong to pretend it won’t cost a trillion dollars.
WE ARE ALL TOTALLY FUCKED!

Republicans Aren’t Sharing Any Information About Their Tax Cut Bill With Democrats As National Disgust Grows
ReplyDelete...Republicans are carrying out an act of theft in broad daylight on the Senate floor. Instead of a bipartisan process that respects how a legislature is supposed to function, Mitch McConnell and company have been secretly railroading the American people by not providing information and details on what will be voted on.
http://www.politicususa.com/2017/12/01/republicans-sharing-information-tax-cut-bill-democrats-national-disgust-grows.html
They can’t hold their cards that close. The public knows, the public is livid and they don’t care.
DeleteThis bill isn’t for the public. This bill is to pay off their donors, who have threatened to cut off funding for their re-elections if they don’t pass it. Everything in this bill is to funnel money to the rich or to pay someone for their vote. (I’m talking about YOU, Lisa Murkowski. But she’s not the only one.)
This is a bill worthy of the Trump administration. Sloppy, cruel, fiscally irresponsible. And above all stupid. This is a stupid tax bill. It isn’t reform. It’s Deform. It is handing as much pork to the wealthy as possible, with Donald Trump being the chief beneficiary. (Oh and Betsy DeVos got some narrowly targeted pork herself.)
Trump owns golf courses.
Trump own private planes.
Trump has income from rentals.
Trump has income from licensing.
Trump pays interest on business loans.
Trump’s income is a “pass through” from his businesses.
Alternative minimum tax.
Inheritence tax.
You look at that bill and Trump stands to gain from every bit of it. He will cut his tax bill by more than 50%.
It’s beyond corrupt. It’s beyond a scandal. It’s worse than a third world dictatorship. You might as well call him Donald Mugabe Trump.

ReplyDeletePaul Ryan goes into hiding after Flynn’s guilty plea endangers Trump’s presidency
ReplyDeleteHouse Speaker Paul Ryan has gone missing since former Trump National Security Adviser Michael Flynn pleaded guilty to lying to the FBI.
Reports have indicated that Flynn is set to give special counsel Robert Mueller inside information on actions by Donald Trump, his family, and top administration officials about collusion with Russia and the cover-up that followed.
Ryan, as speaker, is second in line to the presidency behind Mike Pence. He is the highest-ranking Republican elected official in the United States outside of the executive branch.
Despite this position and role in the U.S. government, Ryan has not uttered a word about the Flynn plea and its implications for the country.
https://shareblue.com/paul-ryan-goes-into-hiding-after-flynns-guilty-plea-endangers-trumps-presidency/
Boy, he’s sure acting guilty. One has to wonder why he thinks he might be next.
DeleteThere were six days of jury deliberation with the Steinle case. I live in San Francisco. My husband and I receive jury duty summons on a regular basis. I don't get compensated by my job for jury duty, so if I have jd I need to work during the evening to catch up. My husband does get paid but he always has so much work to do that he too works at night when he has jury duty. We never try getting out of jd. We never try hurrying through deliberations. However long it takes to get to a verdict, so be it. And that's the experience we've had with our fellow jurors--they've all wanted to be very thoughtful and thorough. My husband has ended up on some long cases, like one time when he was on a jury to decide if someone was guilty of attempted murder on a police officer and this year when he spent months on a foreclosure scam case. The bigger cases change so much about a juror's and his/her family's work and daily life. But we accept it. Being asked to help find justice is something we take very seriously. Anyone on here kvetching about liberal San Francisco and saying that of course the defendant wasn’t going to be found guilty can shove it. The Bay Area has one of the most educated and aware populations in the country and we don’t take the easy route when it comes to working through any issues, issues that seem to always be so black and white and easy for those with no interest in ever putting their brains to good use.
ReplyDelete5 times deported illegal immigrant and a convicted felon. Can't even find the common sense to charge him with manslaughter? The "Bay Area" is such "an aware and educated population" lol.
DeleteIf you find a gun and knock it off a chair accidentally, what should the charge be? In California, does the law allow a lesser charge instead what a defendant is tried for? I'm not sure about either question. What about the Ranger who poorly secured his loaded gun in his vehicle? Is it allowed to be loaded when not in his possession? Does he have some culpability?
DeleteInvoluntary manslaughter 2:52. This isn't that complicated.
Delete“Their contempt for the rule of law, fairness, and justice is despicable and anti-American.“ True

-Allan David so THIS is part of muellers witch hunt and essentially part of the deep states attempted coup of President Trump.-Mueller should have been fired when the President took office. He and his cohorts are part of the deep state, and the Clinton machine.Sessions NEEDS TO GO also. -Still a witch hunt....so why don't they go after the queen of witches .. hitlery ? -How the hell can a man who committed treason and massive money laundering be given a plea on a BS charge! What happened to his son and all his crimes? This snake will live a miserable life! #flynn - When will Hillary have her day of accountability concerning lying to the FBI- Comey lied under oath, Flynn lied under oath . . . it seems like the Washington DC thing to do
Palin always loves to spout the line "rule of law", she used and uses it frequently and somewhere, back in the day she heard someone else use it, actually in context, and now she parrots it to make it seem like she's intelligent, which she isn't.
DeleteShe's just a human mynah bird that spent some time around people who actually know stuff because she got lucky and McCain lacked judgment and she actually remembered a few key phrases that she throws out ever now and then.

So there you have it. According to the Democrats in Congress, Jared Kushner is about to be arrested, and Donald Trump is going to be ousted from office. Plenty of contrarian political pundits are still insisting that neither of those things will ever happen, but those are the same pundits who told us that Paul Manafort would never be arrested and Michael Flynn would never cut a deal.
ReplyDeletehttp://www.palmerreport.com/politics/congress-kushner-ousted/6387/
I think Kushner is in big trouble but is Trump? We'll just have to wait and see. An impeachment trial takes a whole lot of support from the Senate to make it happen, I don't see that happening even if the House impeaches him.
DeleteI also see a very proud turd of a human unwilling to step down in the face of an impeachment, so I believe it will be a standoff and we'll be stuck with him until 2020.
I thought when you are an illegal alien, you have no rights, constitutional rights are only for citizens.
ReplyDeleteI find this story a little bizzare, like the magic bullet that ricocheted and killed Kennedy.
That being said, a wall wouldn't have changed anything,he could always use on of the many tunnels.
