Sarah Palin may have used one unauthorized image too many.

So you all remember this image from yesterday right?

And some of you, as well as I, wondered if it was okay for Palin to use this image of our military personnel to raise money for SarahPAC.

And the answer? Hell no!

Use of DoD Personnel and Materiel in Advertising, Marketing or Promotional Material. 

Endorsement of a non-Federal entity, event, product, service or enterprise may be neither stated nor implied by DoD or DoD employees in their official capacities, including through use of their images. Additionally, titles, positions or organization names may not be used to suggest official endorsement or preferential treatment of any non-Federal entity, except in limited circumstances outlined in DoD Directive 5500.7-R. In all cases, Military Service-specific insignia must be removed from advertising, marketing or promotional material. 

The use of Department of Defense still and/or motion imagery that includes people who can be personally identified in the image is not authorized, unless the requestor contacts the person(s) and obtains written permission for the use of their identifiable image.

Now, do we think that SarahPAC bothered to ask permission to use that image? 

You know like they certainly must have asked to use this image?

Or this image?

 This image?

And of course this image?

Or did they simply Google the image, find it attached to this article, and then use it, with the SarahPAC logo attached, to attack the President while also begging for money that Palin can then use to go on vacations and pay her ghostwriters?

I'll tell you what I think.

I think that Palin is in a blind panic, over this:

As I reported before this was the first time that SarahPAC spent more than it raised, with $496,505 spent (Mostly on "consultants.") and only $460,537 raised from her few remaining dimwitted supporters, and as somebody pointed out early it appears that SarahPAC spent just about $1 for "fundraising" to every $2 actually raised.

THAT is a business model which is unsustainable. So apparently that has inspired somebody to start using images without permission to promote SarahPAC.

However THAT decision could end up costing SarahPAC dearly, since if ANY of these military personnel or celebrities decide to legally protest the use of their images it could end up costing SarahPAC the very last of their reserves and essentially shut them down forever.

I know, what a shame.

And hey, if any of YOU would like to help usher in the end of SarahPAC you know what to do.

      jcinco-- yes, and those unemployed and retired folks don't have lots of spare cash to give to Sarah. Many of them will be dying off -- although some may get better health care under the ACA.

      Many of them may decide to give their donations to actual candidates running for actual offices, rather than fork over money to Sarah, who they're dimly realizing will never again run for office,
      so that she can pick and choose who will get her $5,000 donation each year.

    “I’ll never forget it — it’s one of the few times in my life I’ve been speechless,” Carney added. “It would have been easier for her to finesse it. She had the votes on the council by then, she controlled it. But she just pushed forward. That’s Sarah. She just has no respect for rules and regulations.”

    No lowly soldier would have the resources to sue, and the DOD has more important things to worry about right now, but she'd better watch out, because photo agencies and news organizations do go after those who infringe their copyrights.       The DOD may not bother with her, but there's no doubt that Ashton Kutcher has the money and lawyers on retainer to pursue legal action if he chooses to. I'm sure the King family does as well.

    Was that by any chance Channel 2 in Anchorage where Palin was a 'sports announcer' for a very short time? The channel normally gives their employees 'fond farewells' when leaving, but it wasn't done w/Palin! She was never mentioned again.

    Just within the past year Channel 2 ran a special on some of their past employees (they've had some neat ones!) and Sarah Palin was NEVER mentioned (not even as a past 'quitter' governor)! I found it especially interesting because I feel the channel tends to lean right/Republican as to its take on state and national news.

      I keep reading comments that make it sound like this will be Palins downfall. First off, no one knows whether sarahpac paid for the rights to use these items. Second, even if they didn't they would likely just receive a cease and desist. And as long as they do so, end of story. While it would reinforce the lack of intelligence she surrounds her self with, this is not going to get her thrown in the slammer.

      No, it's not a crime to imply some type of affiliation or endorsement or to use someone's likeness without permission or proper attribution.

      However, she can be held liable for financial damages, and be forced to forfeit any ill-gotten financial gains (read:contributions) in which she has used fraudulent inducement to deceive potential donors. This is tort law, not criminal, although a judge might add punitive damages to a claim awarded to a claimant (or a group of claimants) who was (were) deceived as a result of blatant misrepresentation and/or egregious, irresponsible behavior in an effort to deceive others,thereby extracting benefits from the claimant to the deceiving party.

      In other words, anyone who is persuaded to give to her PAC by any of her unauthorized representations can get their money back, and if a judge thinks her bad acts are not only ill-conceived but also done on purpose to deceive or confuse potential donors, she can be sanctioned by the courts and punitive damaged added to the amount of claims awarded to plaintiffs. This is in addition to the damages (and legal costs on pursuing a remedy) caused to the owners of the copyrights or licenses to use the likenesses owned by the estates or foundations, ad well as any harm to their reputation by a person who "hijacks" someone else's trademarks, etc. for unauthorized commercial use. Sarah always brags about her years and decades of CEO managerial experience, so her having declared her abilities to make conscious, sound, business decisions, would certainly be used as proof by plaintiff's attorney that Sarah Palin knows better than to steal using the marks owned by another legal entity. The tarnish on the reputations those organizations will be her financial responsibility for causing intentional harm to benefit herself and organizations she exercises control over.

      If everyone will help bring these violations to the attention of these organizations, they can use these notices as evidence to prove that Sarah's unethical uses of these likenesses damage their brands and marks. Given the fact that Sarah Palin claims to have over 3million supporters and claims such a large influence over the popular appeal and public opinions, it should be obvious that her deceptions are harmful and damage the goodwill earned prior to her transgressions and encroachments on property owned by others.

      My wishes here for Sarah are not meant to be malicious, as I would be forthcoming if I witnessed someone stealing her physical or intellectual property or other assets. But in this case, she is purposely thumbing her nose by her lack of ethics, and I would love to see her ass handed to her in a court of law as a result.

    For much of the past week, Congress has grown louder and louder with calls that President Barack Obama go through them for any authorization of military action in Syria.

    On Saturday, Obama gave them their wish.

    Congress is now the "dog that caught the car," tweeted former senior White House adviser and chief Obama campaign strategist David Axelrod.

    Obama blinked, but he blinked with a dare. He is daring Congress to say no to limited action against a dictator for the brutal use of chemical weapons against his own people — an attack that the U.S. says killed 1,429 people, including 426 children.

    "Here's my question for every member of Congress and every member of the global community: What message will we send if a dictator can gas hundreds of children to death in plain sight and pay no price?" Obama said in a statement from the Rose Garden Saturday.

    "What's the purpose of the international system that we've built if a prohibition on the use of chemical weapons that has been agreed to by the governments of 98 percent of the world's people and approved overwhelmingly by the Congress of the United States is not enforced?"

    In taking this move, Obama answered the waning enthusiasm from the American public and his allies overseas for intervention. He answered the calls from more than 100 members of Congress who sent him a letter saying he needed their approval. And he answered the American public, 80% of whom want congressional approval.

    The move satisfied both sides of the aisle. It satisfied Republicans, who praised him for his decision while asserting the authority to declare war lies with Congress. GOP senators as ideologically different as the hawks John McCain (R-Ariz.) and Lindsey Graham (R-S.C.) and the libertarian Rand Paul (R-Ky.) applauded Obama's move to include Congress.

    This is a key notion in the debate about whether the U.S. should again choose to meddle in the Middle East.

    The president gave three reasons:

    1) "It risks making a mockery of the global prohibition on the use of chemical weapons."

    Earlier this week Ian Bremmer told Business Insider the U.S. "has to respond given international norms against the use of chemical weapons" because the "costs of not responding at this point are too high."

    The international norm argument underlies Obama's "question for every member of Congress and every member of the global community: What message will we send if a dictator can gas hundreds of children to death in plain sight and pay no price?"

    2) "It endangers our friends and our partners along Syria’s borders, including Israel, Jordan, Turkey, Lebanon and Iraq."

    The U.S. stated, in a law signed by Obama in July 2012, that the strategic environment in the Middle East poses "great challenges to the national security of the United States and our allies in the region, particularly our most important ally in the region."

    And several of America's other allies in the region are calling for U.S. intervention aimed at toppling Assad so that the devastating 29-month conflict ends.

    "Obama never needed to go searching for a coalition of the willing for Syria; one ... has been knocking, in fact, at the door of the Oval Office for quite some time," Interpreter Magazine Editor-in-Chief Michael D. Weiss wrote in Foreign Policy. "Israel, Jordan, Kuwait, Qatar, Saudi Arabia, Turkey, and the United Arab Emirates, all see Syria as a grave short-term threat to their national security."

    3) "It could lead to escalating use of chemical weapons, or their proliferation to terrorist groups who would do our people harm."

    This reason involves the fear that Assad would transfer chemical weapons to Hezbollah, the Lebanese-based terrorist group and Iranian proxy that has more than 60,000 rockets pointed at Israel.

    Furthermore, Michael Gordon of The New York Times reported that effective strikes "may also send a signal to Iran that the White House is prepared to back up its words, no small consideration for an administration that has proclaimed that the use of military force remains an option if the leadership in Iran insists on fielding a nuclear weapon."

    In Obama's words: "If we won't enforce accountability in the face of this heinous act, what does it say about our resolve to stand up to others who flout fundamental international rules?"

    So, unlike the invasion of Iraq, it appears that the Assad's regime's perceived large-scale use of chemical weapons — and a response to such an action — actually involves legitimate national security interests.

    May 31, 2011. MSNBC's Martin Bashir accused Sarah Palin of a possible breach of federal law, saying that the flag (painted on her bus) should never be used for advertising purposes. There can be no breach, as the Flag Code is only advisory. There is a long unchallenged tradition of politicians using the flag. However, the partial flag on her bus is recognizable as a flag, so does constitute a US flag. Bashir is correct that the Flag Code states that the flag should never be used for advertising purposes.

    There are a lot of good people in Alaska who depend on and trust their state and city officials. I asked these state and city employees at all levels who has worked for Sarah Palin all these years, why did you remain silent and still do?

    There are Alaskans with backbones like the lady who confronted Sarah as the worst governor, the lady who filed the ethic charges against Gov Sarah Palin and a few others who stood up.

    To all of you Alaska state and city employees who are aware of the skeletons in Sarah's closet and her incompetence during the 2008 campaign, why didn't speak up? You owed it to America to reveal what you knew and this is what upsets a lot of true Americans.
