Thanks to Governor Parnell Alaska now has its own stand your ground law. Gee if only there were an ongoing trial to demonstrate what a bad idea this is.

Today, Governor Sean Parnell (R) signed into law House Bill 24. This landmark self-defense improvement law ensures stronger protections for law-abiding Alaskans from criminals and criminal prosecution if he or she must exercise necessary self-defense measures without retreating from any place they have a legal right to be. HB 24, introduced by state Representative Mark Neuman (R-10), passed in the state Senate on April 11 by a 15-4 vote after approval by the House of Representatives in a 29-4 vote in March. This bill takes positive steps to ensure that the law protects the innocent – not criminals – and will take effect in ninety days. (So hard to tell this is written by the NRA isn't it?)


Under existing state law, if a person is justified in using deadly force in self-defense, there is no duty-to-retreat if the person is in his or her home, business or on his or her own property. In any other place, however, if a person “knows” that he or she can safely retreat from an encounter, the person is legally required to do so. This legislation would extend this protection so a person, if justified in using deadly force in self-defense, has no-duty-to-retreat from any place the person has a legal right to be. Therefore, as the law stood before enactment of HB 24, a person who resisted an aggressor bore the risk of a finding that, although the response was proportional to the reasonably-perceived threat, the person overestimated the difficulty of getting away unscathed and is, therefore, guilty of a crime despite being justified to react with defensive force. Removing the retreat provision shifts some of the risk calculation back to the aggressor.

So in other words if you are feeling threatened while carrying a firearm, rather than remove yourself from the situation so as to to protect yourself and innocent bystanders, you are now encouraged to stand there fingering your trigger until you feel justified in opening fire.

But wait, there's more.

Additionally, Governor Parnell signed House Bill 69 into law today. This bill, as enacted, restricts state and localities from using assets to implement or aid in the implementation of the requirements of certain federal statutes, regulations, rules, and orders that are applied to infringe on a person's right to bear arms or right to due process. This bill will go into effect in ninety days. 

That's right, not only is Alaska now essentially the wild wild west, we are also now encouraged to resist arrest by federal law enforcement. (Where was this law when Schaeffer Cox really needed it?)

Gee I guess Alaska was not already dangerous enough for Sarah Palin's pet poodle.

    The case that really sticks in my head was in Texas in 2007 where Joe Horn saw men breaking into his neighbor's house and called 911. He was told repeatedly by the 911 operator to stay in the house but he grabbed his shotgun and told the operator he could defend property under the new law. He then went out and killed both men saying he was defending himself but a plainclothes officer who had just arrived at the scene said the men were shot while running away. The two men had long criminal records and were from Columbia. Mr Horn was not indicted. There are other examples on line where people used the Stand your ground laws and did not get charged. So now that you have it in Alaska, does that mean that I, as a average size person can got talk smack to some big guy, and when he starts kicking my ass, just shoot him and cite this new law? I was in fear of my life. Never mind I caused the situation just as Zimmerman did.

      I remember many a time when I was a kid that we were accidentally locked out of our house and went through the basement window.

      Good thing our neighbors didn't follow the example of the idiot in Texas and start shooting us.

    Parnell has just invited the State to defend itself against more law suits. Parnell must be the most litigious governor we've ever had. Either he's taking the "feds" to court (and loosing) or he's passing stupid legislation that is just going to cause unending legal difficulties. During the upcoming campaign I invite his opponents to add up all the legal costs this administration has racked up.

    And BTW, this Stand your Ground law is so stupid. We already have "In defense of life and property" so there really is no reason for this added "law".

      The only thing this law seems to do is make people who shouldn't have guns in the first place become more aggressive and confrontational.

      The more places that pass these laws, the more innocent people are going to be killed by wanna-be vigilantes who mistake them for criminals.

    I detest Sean Parnell and the way he is governing. He needs to be voted OUT of office next go around, but I'm 100% sure 'big oil' will be bringing in the money for his reelection.

    Alaska needs to produce some strong Independents or Democrats to take over our state from the Republicans!!!

    Now we can play the 'old west' and have shootouts on the streets killing each other whenever we think we need to defend ourselves and it will all be legal. Then, when the agents come to arrest you, you can defy them and bring out your 'big gun'!!!

      Nothing seems to damper the enthusiasm of the GOP for repeatedly passing bills on the state and federal levels that have already been found unconstitutional in court. A colossal waste of time and money that should be used to do something productive for the citizens of this country.

    I was on a grand jury in Anchorage a few years ago. One of the cases was about two drug dealers. A mutual "girlfriend" was telling each one that the other was out to get him. So they both took guns, went out, got into a shootout in (of course) a trailer park. One died. We indicted the other one for murder.

    Under this idiotic new law we could not have touched him. All he would have to do is say "the other guy had a gun, I was in fear for my life, the law says I can stand my ground, I have the right to defend myself."

    Nice going, Parnell. This new law means more murderers walking free.

    (Too bad we couldn't indict the "girlfriend" who was the cause of all this and knew exactly what she was doing.)

    Even peaceful good-guy armed Alaskan American pastors have stood-their-ground defending 'nothing of value' - killing two men pilfering his basement food bank.

    Just think, Governor Parnell's law would have saved tax payers a senseless court process that acquitted the Pastor from shooting men in their backs.
