The Supreme Court struck as unconstitutional part of a restrictive Texas statute that threatened to shutter half of the state’s remaining abortion clinics and deny millions of women the right to a safe abortion.
The ruling in Whole Woman’s Health v. Hellerstedt represents the most significant victory for abortion rights at the high court since the turn of the century, as states have scrambled to pass and defend similar laws across the country, seeking to chip away at the landmark Roe v. Wade.
Writing for a 5-3 majority, Justice Stephen Breyer said the two Texas laws at issue in the case are unconstitutional.
“We conclude that neither of these provisions offers medical benefits sufficient to justify the burdens upon access that each imposes,” he wrote. “Each places a substantial obstacle in the path of women seeking a previability abortion, each constitutes an undue burden on abortion access, and each violates the Federal Constitution.”
Damn there is so much going on today I can barely keep up.
And I imagine that these are the kinds of decisions we can continue to expect from our Supreme Court once President Hillary Clinton replaces the now deceased Antonin Scalia with somebody who actually respects the laws in this country.
Damn kids, things are really starting to look up.

ReplyDeleteI told my husband, though, that I don't know if more conservative white Dem males are going to be able to handle seeing those two out there together along with that "This is my fight song" song playing all the time. Could be too much in-your-face girl power for some. For me, the song's just irritatingly cute sounding.

Poor Trump just continues to have bad days, and now today he's mum--only thing he's tweeting about is how unfair CNN is to him, even though his surrogates get an insane amount of air time there and now Lewandowski's been hired.
I don't think Trump wants to talk to much about abortion because fundamentally he's for it and he probably has had a few mistresses that he's paid to get scraped.

I have to wonder if they'll move to quickly confirm Garland once it becomes clear Trump will never win.
I'd like Hillary to make a statement that once sworn in she will also nominate Garland. What are they going to do? Sit on every nomination for another four years?

DeleteThe ignorance of people who don't know the legal precedent of Roe v Wade is driving me crazy.
ReplyDeleteThe case was decided on a right to privacy. Meaning that the government can't interfere in the most personal of decisions, whether to continue a pregnancy or not.
If Roe v Wade had gone the other way, we would become China. The Chinese government had a one child policy. The government was in charge of it's citizens reproductive decisions. So if the government could tell a woman that she MUST terminate a pregnancy (for example, the woman is pregnant with her second child) then the government could also tell a woman she CAN'T terminate a pregnancy. In both cases, the government made the decision NOT THE WOMAN!
By legalizing abortion in the USA, the reproductive decision is in the hands of women, where it should be, not in the hands of the government. Why can't people understand this? If you don't want an abortion, don't get one. But we must protect that right to abortion and privacy no matter what.

Because they choose not to, because it does not fit into their belief system, because Woman, in their way of living, is nothing but an obedient vessel for their sperm, which will lead to the birth of a son, which will lead to the continuance of "the Line" of domination, and which, if she produces "only" daughters, becomes less and less valued. Research history and prove me wrong. It is disgusting...

DeleteBTW, if the supreme court would have stood up for this law there was a civil rights lawyer ready to make sure dental surgery could never be done outside of a hospital and only by dentsts that had rights to practice at that hospital. As even one man would have been inconvenienced the Texas law would have been repealed. BTW dental surgery is much more dangerous than having an abortion.
I'm so glad they voted the right way. Abortion should be safe, clean and rare. It's a private matter between a woman, her conscience, her doctor and partner.

ReplyDeleteThe SCOTUS decision reaches FAR beyond current anti-abortion laws in many states. Justice Ginsburg pointed out how the decision essentially strikes down all laws the GOP has carefully crafted to make abortions all but impossible to obtain.
