Pima County Sheriff Clarence Dupnik, who I am assuming is something of a master of the "complex and demanding craft of policing" seeing as how he's been a policeman for over five decades, begs to differ.
Per Amanda Terkel, Dupnik called the law "racist" and "disgusting" and "stupid" and, in his "nuanced judgment" could not be enforced without mandatory racial profiling. Dupnik's reckoning of the legal issue is that he's just as likely to be sued for racial profiling as he is for not doing enough racial profiling, so he's standing pat, and will not enforce the new law.
Interesting turn of events. What exactly does happen if local law enforcement refuses to enforce this new law? Do THEY get thrown in jail instead?
Well now that we have identifed that there is something "racist, disgusting, and stupid" in Arizona, you know who simply has to show up to defend it don't you?

From Arizona Gov. Jan Brewer's Facebook page: "Had such a great time with Sarah Palin last night that we went to the Diamondbacks game today before she left town. It was great talking to her about my efforts here in Arizona of securing our borders, fighting Obama Care and preserving our 2nd Amendment rights."
We should start a countdown as to how many days she can go without fufilling that 'other' responsiblity as a mom.

This man brings up the disrespect Brewer & Co show to the hardworking border patrol agents who ARE working- all on the federal dime.
Although I understand that the Sheriff does not like this law, unfortunately for him, it's the law and it's his sworn responsibility and duty to uphold the law. That includes every law on the books, not just the ones his agrees with. Failure to do so should cost him his job.

If we ever doubted whether or not Sarah Palin was a closet racist, this seals it for me. She pals around with people like this ignorant governor (when is this governor up for re-election - I plan to contribute to her opponent's campaign). This law is unconstitutional, plain and simple. All that bs from Sarah Palin about our freedom - fighting for our freedom in far-flung places like Iraq and Afghanistan.... Well, THIS is what we Americans have long enjoyed as a basic right and freedom: the right to be free from harassment and persecution by our government without due cause, the right to live and move about freely without fear of being stopped by the authorities and forced to prove our legal status. This new law amounts to fascism, this is what we fought against in the Cold War, this is what people who live under military dictatorships have to live with on a daily basis. The fact that these two dumb broads don't realize it says it all, and it makes me literally sick to my stomach. And what about John McCain and his racist self? Disgusting. We are going to throw these people out of office, they better start making plans for the future.
ReplyDeleteI snowbird in Apache Junction (Pima County) from Alaska and there's plenty of anti-Mexican feeling to go around in that area. It is refreshing to hear the Sheriff speak up. As to whether he should enforce it because it is the law, one is reminded of "I was only following orders"..

Kudos to our Sheriff Dupnik. He's never been afraid to make a principled stand.
ReplyDeleteAs for Jan Brewer - she's our Sean Parnell. She was Sec'y of State under Janet Napolitano until Napolitano left to become Sec'y of Homeland Security - and God made Brewer Gov. I can find no mention of education beyond a local community college in a Phoenix suburb, but even some community college education puts her among the Republican intellectual elite in Arizona (40% of our State Legs have no education beyond HS). She was a supporter of Gov Evan Meacham, a racist, right-wing Mormon and another national embarrassment until he was impeached for campaign finance shenanigans. One of his MANY low-lights was referring to Af-Am children as pickaninnies - later defending himself by claiming he thought it was a term of endearment. (Yes, I can see he was Jan's kind of guy.) So her 2010 election bid is to become elected to the office of Gov for the first time. Frmr Phx mayor and our current AG, (Dem) Terry Goddard is running against her. (Our AG is not appointed.) Lately his support among Hispanics is surging for some reason(?), and he now has pulled from several points back to being a few points ahead of Brewer in polls. It's also an encouraging sign to see her hanging out with shit-for-brains Palin - McCain's numbers are tanking, too.
Remember - Bristol, Piper and Tripp were at the game with her (for all you who think she doesn't see her kids often. I'm not advocating it, but how do you feel about men who go out of town for business often? Her family now depends on her solely. I know Todd could go back to work, but you cannot control how families operate. I trust theyre doing fine.

ReplyDeleteAll anyone has to do to prove that they're here in the U.S. legally is to show a driver's license. We all carry them. And, since the 1940s, federal law has required non-citizens in this country to carry, on their person, the documentation proving they are here legally -- green card, work visa, etc. My relatives who went through the rigorous process to legally came here from another country always carried that sort of proof in their wallets.

Latino all the time, especially in the summer. When I go to Miami, nobody even speaks to me in English, assuming I am Cuban. The last thing I need on my vacation is some good old fashioned racism.

There will be an injunction against this law and it will be challenged, mostly on Federal jurisdiction grounds. States cannot usurp Federal authority on immigration issues.
ReplyDeleteThe AZ law has a specific provision allowing 'citizens' to sue law enforcement officials they don't believe are being aggressive enough in enforcing the law (read: 'aren't being quick enough to profile brown people in the neighborhood'), so every racist MinuteMan in the state will file suit against the police. This bill is so horribly written and useless it essentially creates a no-win situation for law enforcement. They can be sued for racial profiling and they can be sued for not racially profiling. Racist, but even worse--just plain dumb. Pima cty is actually on the border, unlike Gov Brewer's home in the Phoenix area. If the sheriff of Pima--the guy most directly affected by law enforcement issues related to illegal immigation--is against the law, then it needs to go away. It won't pass muster against even the tiniest Constitutional challenge anyway.

ReplyDeleteAnyone who maintains the position - whether they do so naively or whether they are intentionally dissembling - that this new law would not lead to racial profiling, is just plain wrong. They are not going to be stopping Anglo-appearance individuals and families. They are going to be stopping those who appear to be Latino. Can you imagine what that would feel like if you were a legal-status American Latino? It is simply un-American for any legal resident to have to endure feeling intimidated, or to have to live with the constant threat of questioning by law enforcement. Those who seek to minimize the negative potential of this kind of legislation do not personally fear being targeted as a result of it. If this law stands, we are on a very, very slippery slope my friends. It's going to get ugly, and we will have the Republicans to thank for it.
ReplyDeleteI have relatives who work in law enforcement, btw, and I can tell you that the majority of cops probably feel very inconvenienced and resentful of this kind of legislation. It creates extra work for understaffed police departments, and it burdens already over-stretched resources. Probably many won't seek to enforce it, which is the only silver lining in this story. People's points about the federal authority superseding the state's are probably correct, as well.
The disgusting attempts to rally a voting pool by tapping into generalized rage, hidden and overt racism, and financial frustration/stress is just part and parcel of the GOP way. Doesn't this ring a bell with anyone? Can you say pre-WWII Germany? Also, the very party who regularly runs on old-time patriotism is engaging in the repugnant tactics of a former enemy of war. Ironic, isn't it?
I really strongly disagree with the "countdown 'til Sarah is at home" concept. The kids need to have one responsible parental caregiver, and that is First Dud for the Palin clan. For a while I was the sole breadwinner in my family while my husband was SAH dad, and he did a stellar job. There was no reason that my kids had to have *me* serving them dinner.

I agree completely and sympathize with you when you see the "anti-Mexican" behavior in Apache Junction. Apache Junction is in Pinal County and some parts are in Maricopa which is the county of madness where Phoenix is.

This is all about harassing legal citizens. We already have tough immigration laws in place and enforced regularly.
The Tucson local media is also talking about economic blow back. We're only 45 minutes from the border and one can visit any local mall and lose count of the license plates displaying Sonoran plates. We count on Mexcican visitors to shop here.

ReplyDeleteAt Azstarnet.com, a Tucson policeman has filed a Federal lawsuit against SB1070. So, you can see that Pima County citizens, including the police, are reacting appropriately.
Plus, reported at Azstarnet.com about the "birther" bill, "PHOENIX - A bill to require presidential candidates to show their birth certificates to get on the state's ballot is being set aside at the Arizona Legislature."
Keep the pressure on. Make sure this doesn't happen in your state, too!
Linda Arizona, you will NOT have to carry your birth certificate. The bill states, "Before asking a person about immigration status, law enforcement officials are required by the law to have 'reasonable suspicion' that a person is an illegal immigrant. The concept of 'reasonable suspicion' is well established by court rulings. Since Arizona does not issue driver's licenses to illegal immigrants, having a valid license creates a presumption of legal status.

ReplyDeleteI can tell, too, that you are not an attorney. And, while I am not one either, one of my best friends is an attorney. In discussions many years ago, I was instructed that there is a huge difference between "probable cause" and "reasonable cause" and "reasonable SUSPICION" is neither of these.
Moreover, my friend made if very clear that an officer of the law (or any agent or agency of government) can decide that ANY suspicion is reasonable.
For example: You check out a book in Spanish. The librarian is an employee of the local government. Seeing this, the librarian has a "reasonable suspicion" that you may be illegal. That librarian is now required by law to ask for your papers.

Linda Arizona, the bill addresses "law enforcement officials" not general "government employees." Therefore, a librarian is NOT going to be required to do any enforcement of the immigration law.
ReplyDeleteSure, there are people in every state driving with forged licenses. That's a completely separate crime. What this bill states is that your legitimate Arizona license is all the proof you need to show that you're a citizen. Of course, if someone were using a forged license, that would be dealt with under the penal code that addresses forged licenses.
Throughout the United States (not just in AZ), officers have to meet the guidelines of "probable cause" because it is guaranteed by the Fourth Amendment. The term "reasonable cause" is one that is defined by each state. In some, it has exactly the same meaning as "probable cause." Other states define the term differently.
The third term, "reasonable suspicion" requires a lesser amount of evidence. Therefore, in order to make an arrest, the officer must have probable cause, but only reasonable suspicion is required to stop or detain a suspect. In every situation, police officers have to have evidence, facts, and observations that they can articulate to back up their motive to act.
If the defendant feels that the police did not have enough evidence, then this can be challenged in court. The judge will listen to the officer articulate the facts that led to his decision to act and to the defendant's side of the situation and make a decision as to whether or not the officer had solid reason for his/her action. If he/she did not, then he/she will face disciplinary action.
Listen, Latinos with limited English skills and little money rarely have adequate representation in traffic court, much less for something more significant like legal residency. The idea that every instance of unjust harassment would be subject to legal review is a complete joke. When people are intimidated they are less likely to fight back, and the people in Arizona who back this law are counting on that. They are also counting on a mass exodus, which has already begun. Parsing out the various terms and categories, state vs. federal law, etc, within this context does nothing to change what the tangible effects will be... I am related to law enforcement - disciplinary action when you are dealing with both the "thin blue line" and an almost disenfranchised minority will be non-existent. Thank God for the groups who are pro-actively challenging this legislation, and for any who will provide advocacy for mistreated Latinos. Saw a CNN story early this morning about a couple having to live in separate states, and the wife pointed out that the Arizona economy will suffer damage in the short term and the long term. You watch, if it hurts Arizona enough economically, they will repeal. Sad to say, but money trumps everything. I am encouraged by the info above about this idiot Governor. Let's help get her defeated.

While it is an established fact that something has to be done in Arizona and other border states about illegal immigration, alienating a large part of the population with heavy-handed tactics is no answer.
ReplyDeleteI traveled to Arizona in a cross-country trip in 1979 with my mother and my daughter, who is now an adult in her early 30's. Among other treats, we saw the Grand Canyon. Now, you couldn't pay me to go there for any reason. I am a black woman who at times has been mistaken for a Latina, so that's a good enough reason to stay away. Not to mention that I am a firm supporter of the protesting of Governor Brewer's wrongheaded attempts to deal with the problem. The only thing I agree with the supporters of this law about is that long-term federal inaction has been part of the problem. I understand that when GW Bush tried immigration reform, his own party blocked his efforts. It IS heartening to know that the opposition to this law is not only from liberals and progressives. Some conservatives have also spoken out against it. In any case, hope that Jan Brewer will be soundly defeated in her bid for election. She just handed her political enemies a huge gift.
