The lawyer for former Sarah Palin aide and author Frank Bailey said Tuesday that Bailey is fully cooperating with the state's investigation into how he put together his upcoming "expose" of Palin.
"Mr. Bailey has complied with all requests from the Attorney General's office and his actions are within the boundaries of his legal rights," attorney Kevin Clarkson said in an emailed statement.
The Alaska Executive Branch Ethics Act says former public officials can't use information acquired in the course of their work for personal gain if the information hasn't been publicly disseminated.
Bailey's lawyer said Tuesday that provision is meant for different situations, such as when an official learns the state will build a road to a piece of property and then leaves state employment and buys and develops that property. The emails don't have inherent value, he argued.
"The value that exists in Mr. Bailey's book comes not from the emails, but from his personal recollections of events that transpired within the Palin Administration ... the emails simply serve to refresh Mr. Bailey's recollections as he writes of events, and also as proof of his recollections," he said.
He said the First Amendment protects Bailey's right to pen a book about Palin.
McLeod has been asking the attorney general for months about what's being done with her ethics complaint against Bailey. Assistant Attorney General Margaret Paton Walsh responded to her on Friday. Among the issues, Paton Walsh said, are whether Bailey has possession of official state emails that are no longer in state archives.
Bailey attorney Clarkson said Tuesday that, in response to requests from the attorney general's office, Bailey took care to make sure everything was legal.
"Mr. Bailey provided his manuscript to the attorney general's office, along with copies of the emails referenced in the manuscript, for review and approval prior to submitting the final manuscript to his publisher," Clarkson said.
He said Bailey removed from his book references to a few emails that the state felt were privileged information or confidential.
You know I kind of stopped covering Andree McLoed quite a while back when it seemed that she was filing ethics complaints every five minutes. I do support many of her points of view, as well as her desire to see Palin held accountable for her numerous unethical behaviors, but after awhile it just got to be too much.
I mean after you file that many ethics complaints people just stop taking you seriously.
Having said that, I really think that Andree is getting in her own way here. If we REALLY want to know what is in many of those e-mails, our best bet is supporting Bailey's book.
After all, HIS e-mails will not be redacted.
Fortunately it looks as if the ethics complaint will NOT stop this book from being published.
Clarkson said Tuesday that the attorney general's office has minor concerns that Bailey shared with co-authors Morris and Devon a few emails considered privileged and pulled from the book. "But the vast bulk of Andree McLeod's ethics complaint is baseless and will be disposed of as such," he said.

ReplyDeleteI agree with you. At some point, her ethic complaint filings get in her own way if she is serious about exposing corruption, particularly with Sarah Palin.
ReplyDeleteIt's almost as if Andree has become obsessed with her role, rather than the truth. Rather than step back and gauge objectively whether a particular complaint will produce the desired results, she seems to have become subjectively submerged into to the role of being the One Who Discovers or Exposes the Truth.
Does she really need to insert herself into this particular situation? Has it not occurred to her that by doing so she is actually benefiting Sarah Palin? Does she care?

If Bailey had to provide the manuscript to the AG's office prior to it going to the publisher - how much you wanna bet that the Palins have already seen it too. She's still too close to the Parnell Administration.

ReplyDeleteBut no I will not apologize. I am not saying that Andree was not a very brave individual and an important part of what helped to drive Palin out of office, but I will say that after awhile there were so MANY complaints that NONE of the complaints were considered viable.
It allowed the personnel board to dismiss them as frivolous without much blow-back from the public.
That is just my opinion, and that is what I am stating here. As always people are welcome to disagree with me.

Those of us reading "The Lies of Sarah Palin" and Bailey's forthcoming book need to make sure we get the word out to people in the lower 48 to purchase the books.
ReplyDeleteI wouldn't think she'd win the primary for the Republicans, but she is supposedly being supported by big money. You really don't know what to believe when reading the current 'stuff' out there about her.
Alaskans already know the evilness of Palin, but many in the lower 48 don't. I'm even purchasing extra books to mail to some family members and friends - that really liked Palin in the beginning and are now having second thoughts. Figure the books will just reinforce what I've been telling them for a good two years.

I was hoping we'd learn something new from Bailey's book, something substantial, possibly even perjury on Sarah's part during one or both of the Troopergate investigations. Cancel that thought. I'm losing hope.
Andree McLeod, I commend for trying to show the unethical ways and lies of Sarah (and Todd) Palin - the elected 'quitter' governor and the proven 'stand in' governor. I never understood why she didn't have more success with her endeavors other than the fact that some seats on the Personnel Board had been appointed by Sarah Palin and the complaints were filed AGAINST her.
ReplyDeleteWhen the initial complaints were filed it seemed that people favored what McLeod was doing. Now people are saying she was in overkill mode with the complaints.
Is that hindsight thinking? Not sure, but perhaps 'others' know more about the situation(s) than do I.
Anyway, I do appreciate Andree trying to 'legally' show us the lies and unethical ways of Sarah and Todd Palin. She was successful with some of her filings. If it had not been for her, the Palins would never have had had to reimburse moneys they'd taken from the taxpayers/State of Alaska.
Andree should be thanked by all of us for her successes in the Palins actually being found 'guilty' of misdeeds.

This is about allegations that Boeing broke federal law by moving production activities from one factory to another to punish their workforce for unionization efforts. Palin is advocating we let Boeing off the hook for potentially breaking the law so they do not move to a more "business-friendly" country.
In short, she is endorsing one of the key precepts of neo-liberal globalism: competition between geopolitical entities for capital. Very often, this "competition" is little more than a race to the bottom in terms of labor and environmental standards. If a company feels pestered enough by government regulators who do not appreciate their water supply being contaminated or their workers being underpaid and abused, they have the right to move their operations to another country that is willing to accept the pollution and blatant exploitation.

Nope, I don't blame Andree for all the ethic complaints and I don't agree that because there were so many they dismissed them as frivolous. They did so because SARAH told them too, heads would roll and family jobs lost.
ReplyDeleteBut, something I am happy about is yes, all Frank's emails will be non redacted and the admin won't dare leave out ANY or make ANY disappear since they don't really know how many and which emails Frank has, ho ho ho.
He may not have been able to put them all in his book, but I bet the other emails are very interesting. He's got her and Parnell's number now. I bet Parnell is sweatin giving them up. Which he BESS DO before the statute of limitations runs out or he'll be toast for sure!
Also too, it's kinda hard to pick and choose ethic complaints when Sarah created them weekly, that is not Andree's fault.

But no harm in spreading the word! I’m reading Mr. Dunn’s book right now, and am amazed at the Republican's lack of a thorough vetting process for Palin. They were clearly a bunch of white men (no women were involved in the process) dazzled by her naughty librarian looks and folksy charm, so sure that they would capture all the Hillary voters, that they never scratched the surface to reveal the racist, vacuous, perpetual mean-girl lurking just beneath the surface. No one in Alaska was contacted during the process except Van Flein!

Look, I have been on this blog for a long, long time. I have read of, waited for, prayed for a fair outcome of so many of McLeod's ethics charges, and others. We know Palin and Company are lying, thieving, cheating good-for-nothings. We are all in this together. I say Yay for Bailey. I don't think J. Devon would lend her name, time, and extraordinary writing ability to anything less than honest. If Bailey used emails that he was the recipient of, whether as the "To" or as a "cc" then they were his. And if they were on yahoo, or another "personal" server, then Palin is in the wrong for communicating state business that way. And besides, I would not doubt that there is evidence in those emails, of fraud, deception, extortion, heck, maybe even murder, or some knowledge thereof. When a crime is being uncovered, I think the state "ethic" of non-disclosure flies out the window, don't you???!

2:23 pm, I think there's more hope in the lower 48 than you realize. I posted yesterday about my difficulty in locating a copy of Dunn's book here in conservative Colorado Springs. BUT I also, through my job, have come in contact with numerous 20-somethings here, including current and ex-military personnel and members of New Life Church, and I've been amazed at their almost universal disdain and laughter when Sarah Palin's name is mentioned. A few of them still think she's a wonderful mother and Christian, but the vast majority see her for the lying, hypocritical grifter she is.

People outside of Alaska know very well about Sarah Palin because as the VP candidate, she was potentially going to be VP of the entire UNITED STATES. Yes, those of us on the OUTSIDE like Alaskans like to refer to us.

ReplyDeleteSorry about offending you - I've lived in Alaska since 1950 and people that live south of our state have always been referred to as folks/people in the 'lower 48'. The term certainly isn't a negative in my mind as I have many friends and family member in the 'lower 48'!!!!
Never has/had crossed my mind that it could be offensive to anyone. First time I've heard of it being so and I moved here in the 4th grade and now am an elderly retired senior! Doubt the use of the term will ever be dropped - -

ReplyDeleteI disagree with McLeod on this one. he was a party to the emails. he was involved in the email chain of action. if he took them from other people when he was not involved and wrote a book based on them, then her complaint would have more validity. but he was involved. he's part of it all.
Is Andree interested in justice or in leading the charge?

ReplyDeleteThat said, I want to see Bailey's emails too because that's the only way I'll ever see them. Gov. Parnell is still covering for the Quitter and will not release any emails or parts of emails that are damaging to her. Gov. Parnell's neck should be the next one on the ethics chopping block.
@2:23 and 7:04: it's not the term "lower 48" itself that is the problem, it's what it quite often implies: an us/them mentality, better-than, and sometimes an inherent arrogance.

Thank your for your response, like I said, maybe I was taking it the wrong way; I've just heard so much of it and the "you people on the Outside" comments that it rankles me.
And I don't expect that people will ever stop using it; nor was I expecting it, just expressing my opinion. Sarah Palin is an extreme example of this attitude where she brags on and on and on about Alaska ad naseum. I'm not from Texas, but I'e always thought her comment about Texas being the "little sister state of Alaska" is offensive. The arrogance gets under my skin at times.
7:41 Parnell should be recalled...he is playing games w/the Legislature as to wanting to provide more tax credits in Alaska to the oil companies (an issue that is being discussed in our Congress as well and appears to be going down!)- he is unethical as to action and non-action - with regard to protecting our former idiot governor - anti abortion - and on and on and on.
