The Alaska attorney general's office says it's investigating a charge that former Sarah Palin aide Frank Bailey wrongfully used state emails as the basis for his coming book slamming the ex-governor.
Assistant Attorney General Margaret Paton Walsh on Friday wrote to Anchorage activist Andree McLeod, who filed an ethics complaint against Bailey in September and has been repeatedly asking since what's being done about it.
"In addition to the ongoing investigation ... this office has been working with Enterprise Technology Services, the state's IT division, to ascertain whether the state is missing emails that are state records and which Mr. Bailey may have in his possession," she wrote to McLeod.
"Please be assured that we take this matter very seriously and are working to ensure that the state has possession of all state records and emails," Paton Walsh wrote.
Bailey did not respond to the Daily News on Monday. He did express confidence to The Associated Press in September, after McLeod filed her ethics complaint, that his "efforts and procedures" had been lawful in preparing his memoir.
This possibility has been widely discussed by a lot of people behind the scenes, and some of us even suggested releasing the e-mails on Wikileaks before the book was published.
A few have even put forward the opinion that the leaked manuscript simply could NEVER have been published as it was written due to the heavy reliance on the e-mails in Bailey's possession which fleshed out the narrative, and gave it iron clad credibility.
However I have also been told that the authors were prepared for this contingency, and are prepared to address it legally. I certainly hope they are correct, because I really do want to read the final version of this book.

I'm thinking that there are a slew of emails on off-govt accounts that the courts have said are not government emails and therefore not subject to FOIA requests. Could there be a book that doesn't use state emails, but does use the private account emails?

ReplyDeleteOne of Geoffrey Dunn's remarks in a Q&A hosted by Phil Munger the other night over at FDL was that he hadn't realized Alaskan politics were so corrupt. And he did a hell of a lot of research for his book, unless you don't think an 18 page bibliography is much.
The state is the people, and I doubt very much if Sarah chatted about security issues in any meaningful way in those emails.

I just don't understand why the state has been able to delay for this long. I'd be furious if I lived in that state. There is no due process. Tax payers seem to not have much recourse. Thank God for Andree McLeod; she sticks her neck out time and again.
The State of Alaska may kick and scream and take the issue to court, but I think any court would find the email sent on yahoo accounts isn't state property. The only way email would be "missing" is if the sender and every recipient deleted the email and even then, a good forensic computer examiner could find them, unless the servers on which the email resided was destroyed. I think that was going to be their excuse for not releasing all the email is some of it's missing. Why is Andrea McLeod protesting Bailey using the email? She could get more from Bailey than she's going to get from the state. Is she unable to work with other people?

She didn't count on the people she ran over with the bus, being the ones to shed light on her cancerous personality.

I thought at the time of the "leaked" manuscript that the clock started running then if SP wanted to take action on her own to stop the release of the e-mails. And since nothing was done, I wondered what was up. I could not imagine her just accepting the release. So, obviously, she turned to her successor to put the squeeze on the publication.
As an IT guy myself, I believe, if it has a non-government email address in any of the From, To, CC, or BCC fields, then its an open record. Period. Doesn't matter if its From, To, CC, or BCC to a government email address, if there is a non-government email address involved, its an open record.

I too am certain the publisher anticipated this legal challenge. I doubt they would have agreed to publish if they thought they could not win.
Of course, the Alaska government likes to contradict itself with regards to Palin. Remember Troopergate? Todd was a private citizen who could do whatever he wanted then, but an executive adviser subject to protection when the Yahoo account went to court. It wouldn't surprise me for Palin's Yahoo records to NOT be state property, but Bailey's somehow ARE. *eyeroll*

I guarantee that at least a third of yahoo mail holders have easily had their emails hijacked and taken over by spammers. I had notifications that someone tried to change my password at least three times before I closed that account. At least my password was better than where I went to high school.

Gee, the Palin-Parnell administration have refused to release the emails despite being asked as far back as 2008, and now they are picking on Frank Bailey for releasing copies of emails that either he sent, were sent to him, or were sent on Palin's private email system.
ReplyDeleteMakes a lot of sense to me. Obviously if an email was sent, regardless of whether Bailey has it, it is on a server somewhere- unless Palin had the server scrubbed. That's what the AG should be investigating.
Bailey's lawyer also needs to look at where the emails came from. Did the emails come from Palin's private yahoo email account?

To answer some of your questions about the state e-mails, yes they are supposed to finally be released later this month.
ReplyDeleteHowever I have long been of the opinion that they will be so heavily redacted as to be rendered virtually useless. (That was what Linda Kellen-Biegel discovered when she received the e-mails from HER records request.)
However Bailey's e-mails are completely intact and have not been subjected to the state's black "Sharpie of secrecy." That is what makes his book so potentially valuable.
That is why I have suggested they just send the e-mails to Wikileaks and get them out into the public domain.
Phil is right, they belong to the people of the state of Alaska, and we deserve to see them.
And in my opinion we also deserve to be able to read this book, which heavily references what is in them, while also giving us some perspective as to what was happening when they were written.
Bailey saved the State of Alaska tons of money by helping distribute the emails. Something the state had manpower problems doing itself.

And much effort has gone into omitting and/or abbreviating (threads, let's say, or even text) in order to do this magic.
But now it becomes clear that this magic will be revealed with the publication - and obvious existence - of emails you have altered or omitted from what you represent as the legal, lawful and responsive total to the legal, lawful request.
Oh oops! You would be f***ed, and in a very public manner. And would, further, be shown to be out of compliance, in fact illegal, in your responsive emails. Not a lot of time to fix this one. Better stop it some other way.

ReplyDeletePhil is right: if they are State emails, they belong to the people of AK who have a right to know what business is being conducted and that it is being conducted above board - that is behind the whole issue of Sarah Palin asking if certain phones she had (her private blackberry) and what emails could be subject to disclosure ...then she went on to conduct State business on her private accounts. That makes her "private" emails and "private" phones subject to subpoena, disclosure. Am I not correct on this? Yes, they are stonewalling ... they won't release the state emails and they are going to try and stop Bailey from showing his. I don't think Jeanne Devon or Frank Bailey would have proceeded with this manuscript without anticipating an attempt to make them cease and desist and they are prepared for this - it is behind the whole issue of what was supposed to be transparency in her governorship and was everything but!
ReplyDeletePhil Munger is right, the emails belong to the people of the State of Alaska, whose taxes paid for them. That was the reason that Nixon had to eventually turn over the incriminating Watergate Tapes. He fought that battle with much better resources and was eventually forced by the US Supreme Court to turn them over. Nixon tried everything, including allowing one senator (the oldest, most hard of hearing Republican he could find) to review them, and he still lost. In the end, before they were turned over, 18 1/2 minutes seemed to have been erased.
ReplyDeleteSarah has delayed long enough regarding the emails that are supposed to be released this May that it is hard to believe that there is nothing there.
As for emails going missing, the only thing that comes to mind is the example of McCain's group scrubbing the Johnston family's computers. Now those are some missing records.
If Frank was copied on the emails, that presents an interesting legal situation. What could be a problem is if government employees are asked to sign a non-disclosure agreement. However, a good lawyer could make the case that the agreement cannot force a person to withhold information about a crime.
That statement from the state official doesn't make sense.

If the emails are evidence of wrong doing, withholding them is aiding and abetting the crime. I am going to suggest that Bailey, Devon et al search their souls and do the right thing, namely, make a copy of any and all incriminating emails and send it to the FBI/Justice Department.
ReplyDeleteThere will be no justice going through the State of Alaska's government. It requires the Federal government, and it would be the first step in cleaning up Alaska corruption.
The moral battle for the authors is to decide what the reason for writing the book is. If it was to make money and make them famous, that's selfish. If it was to expose the corruption of the Sarah Palin administration, then the correct thing to do would be to turn copies of the emails over to federal authorities. They can still write a best seller about exposing the corruption in Alaska as a happy ending to their story.
I am still interested in the fact that Frank Bailey participated in Sarah's administration then, and seems to have had a "come to Jesus moment" later, when he found some co-authors and the prospect of making money. The authors really need to do the right thing, make those emails available to authorities instead of cashing in right now. Cashing in is Sarah's style.

Oh my goodness. Looks like the powers that be in Alaska government still have allegiances to Sarah. Someone's got to coax Bailey and his co-writers that they need to get legal advice quickly. They need to swiftly release those e-mails to the public first, then hand them over to SOA, who then probably would shred them. If they wait til the book is ready, some type of State jurisdiction may have the power to stop all publishing of that material.

The court already ruled that the yahoo acount didn't fall under state jurisdiction. That means all of the yahoo emails that Bailey has are NOT under the jurisdiction of the state and can't be "investigated."

Alaska (and the nation) are suppose to finally see emails released (written during the Palin half-term Administration) by the end of May. Wanna bet the majority of them will be doctored up so much their content will not be understandable? The national press has been after these emails for years now.
Don't forget that Parnell is the exising governor and he has protected Palin and her ilk since he went into the office because Palin had 'appointed' him as her second in command. He is referred to as 'Captain Zero'!
Alaska is still as corrupt as it was before Palin, during Palin and after Palin. She who said she was going to 'clean things up'! My ass!
The book is due out in two weeks, right? Even with a rushed schedule, the publisher has probably already completed the first print run and is in the process of shipping the title to stores everywhere. It's very late in the game for the opposing side to stop the release. And even if they do, there are plenty of people--from printers to warehouse workers to booksellers--who could easily snag a copy or two and still distribute them.
ReplyDeleteHoward Books, which is releasing this title, is a "Christian" imprint of Simon & Schuster. S&S is a MAJOR publisher. I can't imagine they don't have a kick-ass legal team that could run circles around Van Flea. I'm sure they vetted the book thoroughly for legal issues before the publisher agreed to invest money in the production and marketing.
I think all that the last-minute freakout will do is contribute some free pre-release publicity.

I believe the legal begals of the publisher and authors looked deeply into the matter of Bailey releasing the emails in his book (as backup to things written) and assured themselves all was legal in doing so.
ReplyDeleteSounds to me like Palin et al are trying to stop from being embarrassed.
Someone mentioned McLeod and Palin being in cahoots about all of these previous filed complaints that never went anywhere. Wouldn't that be something? The recent claim filed by McLeod doesn't make one bit of sense to me. Maybe she has another motive to doing so that will back up some of her previous claims?
Pretty sad when we don't believe a damned thing about Toad or sister Sarah (Bristol and Track now too) in our world today, isn't it. They have already proven to be such frauds.
I'm reading my book (just received yesterday) "The Lies of Sarah Palin" - boy of boy - she was and is something else. I know she has a place in hell awaiting her.

Don't forget that this book has already been prepared for publication at the end of May. Books have been sent to folks to review...others already have it. It can be leaked very easily should the State of Alaska try to put a halt to the publication.
ReplyDeleteGod, I'd love to see the Palins in Court, but they have absolutely no grounds to stand on here.
Remember, Sarah and Todd used Yahoo (when she was quitter governor) and it was deemed to be OK by the Personnel Board back a couple of years ago.
Why are they acting like there are only one copy and can be only one copy of an email?

Parnell and cohorts are just as corrupt as $palin and her BFF's were. They just do it without the drama. Expect to learn nothing from the released emails, they've had years to alter them.
ReplyDeleteI am confused as to why Andree would file a complaint to withold the emails, other than that bailey will make money from them. They belong to US and may be the ONLY way to get to the bottom of the barrel of rot that was the palin administration.
The idea of Wikileaks is a great one. They should be sent to Wikileaks, and released on the date the book is released.
$carah doesn't have a leg to stand on in this. If they were "State" emails, they're public. Any ONE person who was part of an email communication - no matter how many times down the line it's been cc'd or forwarded by an original owner - can release any and all parts of the email that they were privy to.

This smells fishy as hell to me. Why would McLeod file the complaint...is the Parnell Administration setting her up to be the bad guy....could they have talked her into filing the complaint?

Shannyn cannot talk about it on her radio show today, I'm sure...due to her closeness to Jeanne Devon.
Jeanne cannot talk about it on her blog site....as a co-author. Part of this thing from the State is BECAUSE Jeanne got to view all of the emails Bailey had and disclosed in the book.
If the State of Alaska stops the publication of the book (which is probably in mass print already since it's publication date was the end of the month), I sincerely hope the book is leaked!

In the case of Bailey's emails, I believe they "belong" to all the people copied on them. Any one of those people could have released them or used them in a book or article. This is especially true if they were not sent on the official Alaska State email system. (Note: I'm not a lawyer, but have some familiarity with this subject through my old job). None of them should be "lost" as each person in the communication chain has a right to keep his or her personal copy. Again, if not on the State system, the archive rules can't apply, because the state has no control over the server onto which they might be saved.
ReplyDeleteWith regard to State emails, there are retention rules to which employees are bound to follow. Those rules do not, however, enjoin them from keeping personal files apart from the state system. In neither case is there no presumption of confidentiality for any of the writers or copyees unless 1) marked as such on the document or 2) sent on a specific system designated for confidential correspondence.
The technological age has complicated the confidentiality laws tremendously and legislatures have been lazy about addressing this issue other than claiming, vaguely, that all laws pertaining to paper documents apply equally to electronic ones. Um, no. That doesn't work. It'll be interesting how the courts in AK handle this, given the culture of corruption there, I cannot predict whether the outcome will even come near the law, much less follow it.

Oh, and by the way, I don't expect the state to release the emails at the end of May. I don't think they ever intended to and will now use this investigation as an excuse to delay once again. And the public's right to know will be trampled on once again. So much for the Freedom of Information Act.

Well, I just bought The Lies of Sarah Palin for my Kindle. We don't have a book store nearby unless I drove half an hour to a Mall or took Metro into DC, also a half hour ride.
