McConchie, of the AUL, told the Guardian the group had drafted a model “Dignified Final Disposition Act” and was tweaking it in response to the clandestine videos. “We’re working with legislators. There’s a lot of interest.”
The proposed law would mandate that fetal remains be cremated or buried. If cremated, they would have to be cremated separately from medical waste and a county medical examiner would have to authorise the cremation.
The act would also require fetal death certificates for “each fetal death after delivery, miscarriage or abortion”. A stillborn child would need a state-issued “certificate of birth resulting in stillbirth”.
The AUL has helped pro-life legislators restrict abortion availability in many states in what has been dubbed a “stealth war” on abortion.
If you guessed this is in response to those doctored Planned Parenthood videos give yourself a gold star. (By the way according to this article there are about a dozen more of those on the way.)
Can you imagine being a young woman who had a miscarriage early in their first trimester who then had to fill out paperwork to obtain a death certificate for something the size of your thumbnail?
And how many women have miscarriages and never even know it? Would they be breaking this new law if they were simply ignorant of the fact that they needed this paperwork?
I have heard of draconian laws before, but this one takes the cake.
Somebody please remind me again, why do women continue to vote Republican?

I am an Advanced Life Support - Cardiac EMT in a rural Virginia county. Occasionally we are called for a young woman with one or more of severe abdominal pain, vaginal hemorrhaging, extreme sensitivity to touch, and/or similar symptoms. Sadly, many of these turn out to be a miscarriage or an ectopic pregnancy -- not many, 2-3 a year, but every one of them tears out the hearts of everyone on the ambulance crew and in the ER.
ReplyDeleteBack in 2009 a Republican state senator, Mark Obenshain, introduced a bill that required any woman experiencing a miscarriage to report the fact to her local sheriff or police department. The report had to include mother's name, location of fetal remains, and other personal information. In addition to the mother, we medical personnel, including EMT's, were required to report miscarriages. The bill was defeated.
In 2013, Obenshain ran for Attorney General. During the campaign, he indicated he would, if elected, try again to pass this bullshit law.
During his campaign he spoke to a group of us EMT's after which he took questions. The first question was not a question. Instead, another EMT stood up and told Obenshain he'd be goddam if he or any EMT he knew would comply with the requirement to report a miscarriage. Everyone of us leaped to our feet cheering -- several approached him with hands in front of themselves telling him to "Cuff me here and now!!" We laughed his ass off the platform.
He didn't answer any more questions, left the venue, and never looked back. He lost the AG election, thank God.
I had a miscarriage years ago. It is a devastating experience for a woman. I felt "less than" as though I would never have another child. The experience alone is bad enough, not to mention if you also had to arrange a burial or cremation. When I did get pregnant again, my doctor was afraid I was experiencing an imagined pregnancy. I was 6 months along before he finally agreed that I really was expecting! Life altering experience, believe me.

I had a miscarriage many years ago in my mid 20s. I'd taken a pregnancy test and had my first Dr appt scheduled, but miscarried the day before my appointment. It was like a heavier than normal period and had I not been trying to get pregnant I would not have given it too much thought. I've often wondered how many women are pregnant and miscarry without ever knowing. And I don't understand at all why any woman would ever vote Republican. Maybe Colin Powell if he ever ran for office but he's the only one I would even consider.

DeleteI, too, was pregnant but had a miscarriage after about a month. There was nothing to "bury" or "cremate." I was very sad, and still remember this loss, but it's my private business. I would never tell an official about what was happening with my body.
Why don't they require men who have vasectomies to publicly record their procedures, and chastise them for limiting the number of potential babies? Why don't they harvest condoms -- whenever they're bought, the name of the purchaser is recorded?
I too was pregnant as a result of a rape when I was 18. I had no idea I was pregnant and when I miscarried I was stunned at having such a heavy period as mine had always been light. It took me so long to put 2 and 2 together. Would these idiots like to shame me now?

I had a missed miscarriage at 8 or 9 weeks, then a D&E. Then my husband and I kept trying and got pregnant again a couple months later. The missed abortion didn't actually bother me all that much (not surprisingly, women can feel differently about these things).
ReplyDeleteBut, do you know what I didn't need? To fill out paperwork for a death certificate and possibly set myself up for an investigation to make sure it wasn't something I did that caused the end of my pregnancy.
I agree. What really angers me when this ugly proposal gets raised (and it has been raised before) is that the medical community stays silent. What courage our doctors, obgyn's and hospitals have!!!
DeleteMy experience was similar but the miscarriage (or "spontaneous abortion" but don't tell the GOP legislators that) happened suddenly. The only early indication was that, while I had thought I was pregnant and in fact got positive results from the doctor's office the same day, something had not seemed right. Frankly I was relieved. Having lived through a very complicated pregnancy with a happy result I was terrified of going anything like those months again. The human body is not so easy to legislate about and it would be best if the medical community would speak out LOUDLY and decisively and put these lunatics in their place - which is far away from women's bodies.

One really big problem: No one is pronounced dead when their heart stops. As an Advanced Life Support - Cardiac EMT, I can count 5 times in the last 4 years I have found a person in cardiac arrest -- no blood pressure, no heartbeat in my stethoscope, no pulse. Apply the AED, give it a few seconds to analyze, shock, and heart starts. Of the 5 hearts I have restarted, 3 are still alive.
I guess I shouldn't try to confuse a Palin with facts.

Cremate what? Bury what? And by whose expense? Just another way to punish sinful women who have sex? How about an amendment that the FATHER pays for this and if there is no Father then the STATE pays for it?

Death certificates are for PEOPLE. Until you are born you are NOT A PERSON. DeleteAs someone who's experienced carrying a baby I learned late in my pregnancy would be born dead, I'm beyond offended that these asswipes feel the need to codify this stupid idea into law, and add to the burden/emotional and physical pain of loss. And what right do they have to enforce this fetal disposal law? The fetal tissue IS hazardous waste and is already treated as such. I recall, in my case, we were given the option to have the stillborn child buried/or cremated if we wished, and we chose what we felt was best for us.

So sorry for your loss. I had a miscarriage, after an Air Force doctor examined me and said "You are NOT pregnant. In future, do not come to this clinic wasting my time, unless you are sure. While I am wasting my time with YOU, I could be attending to a real patient" Two weeks later, I was losing a lot of blood. Called the base hospital to talk to him. Was told he was on the golf course, since "doctors get time off, you know" Next thing I knew, the baby dropped into the toilet, tiny as a little fist. Took it to the hospital. All the neigbors were upset about this doctor. My husband complained to the base commander and was told "You could ruin this man;s reputation" My husband said "He should not be practicing if he can not tell if a woman is pregnant or not" Took a long time to recover from that, was so afraid it would happen again. A few months later, had another D&C positive I was having another miscarriage. The civilian doctor told me I had not been pregnant, but said "We are going to let the Air Force pay for this, since they ARE responsible"
DeleteAnita---I am so sorry for your loss. I myself had a late-term fetal death (26 weeks). In my case, I had to have a late-term abortion procedure because labor did not commence on its own and I was in danger of sepsis.

DeleteDo these morons believe that if a woman, who, perhaps, has made a serious mistake, is forced to deliver a child she will necessarily love and care for it? More often than not, this innocent baby becomes a burden who struggles through childhood. And to what end? Said baby, now adolescent or young adult, will probably be denied opportunites because he/she left school early and had no guidance as to an alternative path through life. And, will these mothers step up and provide a better future? Well, of course, some will, often with the help of family and that is great. But, in truth, this does not happen often enough.
ReplyDeleteAlthough I do firmly believe that abortion is a woman's right (would it be otherwise if the man were the child bearer???) I certain do not condone arbitrary procedures. If you have three boys and the fourth is not the girl you desire, it is just stupid and cruel, in my opinion, to opt for an abortion. But, in the end, it is a woman's right, plain and simple.
Next thing you know, females starting at age 13 will have to present themselves at state-run clinics for pregnancy testing once a month.
